which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide coverage for certain vision items and services under part B of the Medicare program.</official-title></form><legis-body id="H26BB8F3C67134D85BF346AB6580C447C" style="OLC"><section id="H0F49345630D1490EBBDD032C6A7E15C5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Vision Act of 2021</short-title></quote>.</text></section><section id="HB04E1629C7314367940912767B24A1C1"><enum>2.</enum><header>Providing coverage for vision care under the Medicare program</header><subsection id="H636D9B9E4BB546D8A213E3168B8579F5"><enum>(a)</enum><header>Coverage</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><paragraph id="H278EA792C53A487D8700E8F890877920"><enum>(1)</enum><text>in subparagraph (GG), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph><paragraph id="HB29847B6F45E4402B1D2C9B8393F7E43"><enum>(2)</enum><text>in subparagraph (HH), by striking the period at the end and adding <quote>; and</quote>; and</text></paragraph><paragraph id="HE539BCED606E487297C19A47B5DA7BE1"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HAC1AEC70AC3C42A59F62A8900B3365E8" style="OLC"><subparagraph id="idEB0E3FC8800444BDBFA856CC2023741F"><enum>(II)</enum><text display-inline="yes-display-inline">vision services (as defined in subsection (lll));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8E6BCB02B0C84E10A00FB20C130EB0DA"><enum>(b)</enum><header>Vision services defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HD8DE0D8C97084DC9A04AD68400144A14" style="OLC"><subsection id="H485A83D4D0F54711A284366FA790357D"><enum>(lll)</enum><header>Vision services</header><text display-inline="yes-display-inline">The term <term>vision services</term> means—</text><paragraph id="H122848D2DB124B449072DB75A9FB8BDD"><enum>(1)</enum><text display-inline="yes-display-inline">routine eye examinations to determine the refractive state of the eyes, including procedures performed during the course of such examination; and</text></paragraph><paragraph commented="no" id="H2441FE49378A41DD9DD07D573EB15BE6"><enum>(2)</enum><text>contact lens fitting services;</text></paragraph><continuation-text continuation-text-level="subsection">furnished on or after January 1, 2024, by or under the direct supervision of an optometrist or ophthalmologist who is legally authorized to furnish such examinations, procedures, or fitting services (as applicable) under State law (or the State regulatory mechanism provided by State law) of the State in which the examinations, procedures, or fitting services are furnished.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF4CEF0F6324D47848D34B14741D4BE9B"><enum>(c)</enum><header>Payment; coinsurance; and limitations</header><paragraph id="H4F62D55A4C0D433FBB5DA184DF71C559"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><subparagraph id="H2543F18636B643B6B04D108037F2078B"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(DD)</quote>; and</text></subparagraph><subparagraph id="HD1E923C0C9EB4C61B1050B742FB0D8BD"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before the semicolon at the end the following: <quote>, and (EE) with respect to vision services (as defined in section 1861(lll)), the amount paid shall be equal to 80 percent of the lesser of the actual charge or the amount determined under the payment basis determined under section 1848</quote>.</text></subparagraph></paragraph><paragraph commented="no" id="H90A9F862C85F4EFB83894EDC2866D3D5"><enum>(2)</enum><header>Limits specified</header><text>Section 1834 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H0CD9A1AEA3B84085B6C565956E43676F" style="OLC"><subsection commented="no" id="H699B6D224F4A4CE1805CE3DEB4D9FBAF"><enum>(z)</enum><header>Limitation for vision services</header><text display-inline="yes-display-inline">With respect to vision services (as defined in section 1861(lll)) and an individual, payment may be made under this part for only 1 routine eye examination described in paragraph (1) of such section and 1 contact lens fitting service described in paragraph (2) of such section during a 1-year period.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="H1FBB13492B944C37884C1CAA075929A5"><enum>(d)</enum><header>Payment under physician fee schedule</header><paragraph id="HDD098B089C094987BCEEC8B1A21CE391"><enum>(1)</enum><header>In general</header><text>Section 1848(j)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(j)(3)</external-xref>) is amended by inserting <quote>(2)(II),</quote> before <quote>(3)</quote>.</text></paragraph><paragraph commented="no" id="HA98A13BEFF0F41A59D33460F0C46DFD7"><enum>(2)</enum><header>Budget neutrality</header><text>Section 1848(c)(2)(B)(iv) of the Social Security Act (42 U.S.C. 1395–w(c)(2)(B)(iv)) is amended—</text><subparagraph commented="no" id="H2EE114BDFC694A3C93BF3A6611035880"><enum>(A)</enum><text>in subclause (III), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" id="H2748E4C183E946F8925F5CE06969C986"><enum>(B)</enum><text>in subclause (IV), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="H7B410DE4BDD7488D9E863454A297F288"><enum>(C)</enum><text>by adding at the end the following new subclause:</text><quoted-block display-inline="no-display-inline" id="HB2138059733F43AD8E6718F3773E8C23" style="OLC"><subclause commented="no" id="H792E3908067E41BCA2EFF877F0E03842"><enum>(V)</enum><text display-inline="yes-display-inline">the amendment made by section 2(d)(1) of the <short-title>Medicare Vision Act of 2021</short-title> shall not be taken into account in applying clause (ii)(II) for 2024 and 2025.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HC516E6CBF8334D8D9CC6C0DDB28A1F16"><enum>(e)</enum><header>Coverage of conventional eyeglasses and contact lenses</header><text>Section 1861(s)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(8)</external-xref>) is amended by striking <quote>, and including one pair of conventional eyeglasses or contact lenses furnished subsequent to each cataract surgery with insertion of an intraocular lens</quote> and inserting <quote>, including one pair of conventional eyeglasses or contact lenses furnished subsequent to each cataract surgery with insertion of an intraocular lens, if furnished before January 1, 2024, and including conventional eyeglasses or contact lenses, whether or not furnished subsequent to such a surgery, if furnished on or after January 1, 2024</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H9BE7927C1AF34E6DB6870A703243201F"><enum>(f)</enum><header>Special payment rules for eyeglasses and contact lenses</header><paragraph id="H8DAD47D4F86F41268770052D05128B29"><enum>(1)</enum><header>Limitations</header><text>Section 1834(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H4B8896FD0D534219B6B8B433DA849A1D" style="OLC"><paragraph id="HACA00B9B64D447A99254EE459BF8E1ED"><enum>(6)</enum><header>Payment limitations for eyeglasses and contact lenses</header><subparagraph id="HBD5AAB8371134874B9085D1409B3946A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to eyeglasses and contact lenses furnished to an individual on or after January 1, 2024, subject to subparagraph (B), payment may be made under this part only—</text><clause id="HE55BA733FD7C435CA2F0F81ECAEB0687"><enum>(i)</enum><text display-inline="yes-display-inline">during a 1-year period, for either 1 pair of eyeglasses (including lenses and frames) or a 1-year supply that is provided in not more than 180-day increments of contact lenses;</text></clause><clause id="H1A996EF0CE1541D2BA735D00A372230A"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to amounts attributable to the frames of such a pair of eyeglasses and amounts attributable to contact lenses furnished during a year, in an amount not greater than—</text><subclause id="H1425EB42347449CDB40B6364081EA767"><enum>(I)</enum><text display-inline="yes-display-inline">for 2024, $100; and</text></subclause><subclause id="HA5CC3C5B5C0F4965B3988E274540ABF5"><enum>(II)</enum><text display-inline="yes-display-inline">for a subsequent year, the amount specified under this subparagraph for the previous year, increased by the percentage change in the consumer price index for all urban consumers during such previous year;</text></subclause></clause><clause id="H31D3B58920BD406CABE2574D291D9220"><enum>(iii)</enum><text display-inline="yes-display-inline">for types of eyeglass lenses, and for types of contact lenses, as determined appropriate by the Secretary;</text></clause><clause id="H172FF1E65E334D80B10A1178BB0FB63A"><enum>(iv)</enum><text display-inline="yes-display-inline">if furnished pursuant to a written order of a physician described in section 1861(kkk); and</text></clause><clause id="HFF4018D8DBBD4C52B0E78C3936D5188E"><enum>(v)</enum><text display-inline="yes-display-inline">if during the 1-year period described in clause (i), the individual did not already receive (as described in subparagraph (B)) one pair of conventional eyeglasses or contact lenses subsequent to a cataract surgery with insertion of an intraocular lens furnished during such period.</text></clause></subparagraph><subparagraph id="H8DC4439CE92A43DCAFD988F9C27A8512"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">With respect to a 1-year period described in subparagraph (A)(i), in the case of an individual who receives cataract surgery with insertion of an intraocular lens, notwithstanding subparagraph (A), payment may be made under this part for one pair of conventional eyeglasses or contact lenses furnished subsequent to such cataract surgery during such period.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H5D27757C75F443EDA4FCAEB23EDF583A"><enum>(2)</enum><header>Application of competitive acquisition</header><subparagraph id="H8EC4CE433064413B9BEFF90B78DBCD93"><enum>(A)</enum><header>In general</header><text>Section 1834(h)(1)(H) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(h)(1)(H)</external-xref>) is amended—</text><clause id="H8D5E3FBECAB04181B29A021D6E35ABCF"><enum>(i)</enum><text display-inline="yes-display-inline">in the header by inserting <quote><header-in-text level="subparagraph" style="OLC">, eyeglasses, and contact lenses</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">orthotics</header-in-text></quote>;</text></clause><clause id="H3E00473E31EF4CB285ACE7AD87DE65EB"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>and of eyeglasses and contact lenses described in paragraph (2)(D) of such section,</quote> after <quote>2009,</quote>; and</text></clause><clause id="H2F4274681EDD44BF9579F330619F4864"><enum>(iii)</enum><text display-inline="yes-display-inline">in clause (i), by inserting <quote>or such eyeglasses and contact lenses</quote> after <quote>orthotics</quote>.</text></clause></subparagraph><subparagraph id="H993E6AC8FBB5445983CE051267823D0F"><enum>(B)</enum><header>Conforming amendment</header><clause id="HF3577A79B13F46A497C23A4CF5788FA8"><enum>(i)</enum><header>In general</header><text>Section 1847(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HDC05F65A36404229B9C82952ECA67304" style="OLC"><subparagraph id="H5FE1C87E374B4ECA8A41614BB4745358"><enum>(D)</enum><header>Eyeglasses and contact lenses</header><text display-inline="yes-display-inline">Eyeglasses and contact lenses for which payment would otherwise be made under section 1834(h).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause><clause id="H5D7EE1DB796941FC996977AB31EFB302"><enum>(ii)</enum><header>Exemption of certain items from competitive acquisition</header><text>Section 1847(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3">42 U.S.C. 1395w–3(a)(7)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H704548EEB6A74566ADC88AA13A43464A" style="OLC"><subparagraph id="H8AF66A8C3F44474391850F944EA99E1B"><enum>(C)</enum><header>Certain eyeglasses and contact lenses</header><text display-inline="yes-display-inline">Those items and services described in paragraph (2)(D) if furnished by a physician or other practitioner (as defined by the Secretary) to the physician’s or practitioner’s own patients as part of the physician’s or practitioner’s professional service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="H35FA4177ED3F4890B2FD81DCCEC3D4E1"><enum>(g)</enum><header>Exclusion modifications</header><text>Section 1862(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)</external-xref>) is amended—</text><paragraph id="H491D8930ECB644DFBE5EE02FD7E1090D" display-inline="no-display-inline"><enum>(1)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HBA81E762E73D4129ABF5C5180B75EB73"><enum>(2)</enum><text>in subparagraph (P), by striking the semicolon at the end and inserting <quote>, and</quote>; and</text></paragraph><paragraph id="H9B44833FFD904F209AA0258463E721BF"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9D3FCE4A7282470DB4F1AAE1BEDB0F37"><subparagraph id="HB3C180A63EB447FEB4D9C8AD27588840" indent="up1"><enum>(Q)</enum><text display-inline="yes-display-inline">in the case of vision services (as defined in section 1861(lll)) that are routine eye examinations and contact lens fitting services (as described in paragraph (1) or (2), respectively, of such section), which are furnished more frequently than once during a 1-year period;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H75B129656ABD4116A7D44ED4273B427A"><enum>(h)</enum><header>Repeal of ground for exclusion</header><text display-inline="yes-display-inline">Section 1862(a)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(7)</external-xref>) is amended by striking <quote>, eyeglasses (other than eyewear described in section 1861(s)(8)) or eye examinations for the purpose of prescribing, fitting, or changing eyeglasses, procedures performed (during the course of any eye examination) to determine the refractive state of the eyes</quote>.</text></subsection><subsection id="H7ADC9B2911A6454598C6F96CAE27E593"><enum>(i)</enum><header>Low vision aids</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Health and Human Services shall, in consultation with relevant stakeholders—</text><paragraph id="HB816DF390A2F4A58BC268DBF46C9F23B"><enum>(1)</enum><text>undergo a review and analysis of clinically indicated magnifiers, spectacles, and other similar vision enhancement devices used to assist individuals with low vision and visual impairments;</text></paragraph><paragraph id="HF46ADB35C92E4B2AA8C615B96EC7C1AB"><enum>(2)</enum><text>based on such review identify such specific devices that are not, but which pursuant to administrative action could be, covered under the Medicare program under title XVIII of the Social Security Act coverage; and</text></paragraph><paragraph id="H084052B3352F4F97930916F7E2C6A6EF"><enum>(3)</enum><text>take such administrative actions as are necessary to provide for such coverage of such devices so identified as the Secretary determines appropriate.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="HB34FE6600FAE4F719428B3B7FD7FC79A" section-type="subsequent-section"><enum>3.</enum><header>Implementation funding</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall provide for the transfer from the Federal Supplementary Medical Insurance Trust Fund under section 1841 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395t">42 U.S.C. 1395t</external-xref>) to the Centers for Medicare &amp; Medicaid Services Program Management Account for the period of 2022 through 2026 of such sums as may be necessary for purposes of implementing the amendments made by section 2.</text></section></legis-body></bill>
