<section id="H9AD8BED17A0E4AD19B468BF270EC87EA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Black Farmers and Socially Disadvantaged Farmers Increased Market Share Act</short-title></quote>.</text></section> <section id="H6A51AC80CB7643EB99D03A5E5B08BCA0" section-type="subsequent-section"><enum>2.</enum><header>Food hub grants to increase market access for socially disadvantaged farmers and ranchers</header> <subsection id="H24E9685D5EE74129B5A84EA771A72488"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H21A455AEF4B04C2BB4FE801EA71A410F"><enum>(1)</enum><header>Agricultural food product</header><text display-inline="yes-display-inline">The term <quote>agricultural food product</quote> means a raw, cooked, or a processed edible substance, beverage, or ingredient produced and otherwise prepared for sale in the United States (including any insular area (as defined in section 1404 of the National Agricultural, Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>))), derived from one or more agricultural commodities of United States origin, and used or intended for use or for sale in whole or in part for human consumption. <italic></italic></text></paragraph> <paragraph id="H8444F4D2A38B403A8D839875B425CCE7"><enum>(2)</enum><header>Donated food</header><text>The term <quote>donated food</quote> has the meaning given the term in section 250.2 of title 7 of the Code of Federal Regulations (or any successor regulation).</text></paragraph>
<paragraph id="H041FA5C72E9A4AAFBBC49140673D6B0E"><enum>(3)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text> <subparagraph id="H9EE368D05D334BCF9D886D78D0F04D1C"><enum>(A)</enum><text display-inline="yes-display-inline">an entity formed by two or more agricultural producers, not less than half of whom are members of a socially disadvantaged group; or</text></subparagraph>
<subparagraph id="H988ECE2E70F848D68EEF97E5A69ADDE6"><enum>(B)</enum><text>a non-profit organization or Tribal organization with demonstrated experience working with socially disadvantaged farmers or ranchers.</text></subparagraph></paragraph> <paragraph id="H4AE91310D595494EBB656CBAE421F173"><enum>(4)</enum><header>Eligible partner</header><text display-inline="yes-display-inline">The term <quote>eligible partner</quote> means a non-profit organization, a State cooperative extension service or a college or university (as such terms are defined in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>)), Tribal organization, or other State or local government entities with demonstrated experience in providing assistance such as grants management, technical assistance, and business plan development, to agricultural producers.</text></paragraph>
<paragraph id="HB0571264C25E48C9A52F751315DD3908"><enum>(5)</enum><header>Food hub</header><text display-inline="yes-display-inline">The term <quote>food hub</quote> means a business or organization that actively manages the aggregation, distribution, and marketing of source-identified agricultural food products from producers for wholesale, retail, or institutional markets.</text></paragraph> <paragraph id="H714C25B737E84530832F41706EB4E17D"><enum>(6)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph>
<paragraph id="H23C2A3C71C534E90B1C9811111DCAE04" commented="no"><enum>(7)</enum><header>Socially disadvantaged farmer or rancher</header><text>The term <quote>socially disadvantaged farmer or rancher</quote> has the meaning given the term in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>).</text></paragraph> <paragraph id="H798D8D8C839E44F893E47405F03A17EE" commented="no"><enum>(8)</enum><header>Socially disadvantaged group</header><text>The term <quote>socially disadvantaged group</quote> has the meaning given the term in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>).</text></paragraph>
<paragraph id="H620B0A6CDB80474684A22EDDE92493AC"><enum>(9)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <quote>Tribal organization</quote> has the meaning given the term in section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>).</text></paragraph></subsection> <subsection id="H64E0B70840EE4BBEB3E8134718657BC1"><enum>(b)</enum><header>Grants to increase market access</header> <paragraph id="H1B57FD1A81CD4E8CAE1EB32BAD54108C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program to make grants on a competitive basis to eligible entities to support new or expanding food hubs designed to increase market access for socially disadvantaged farmers and ranchers, but may also increase market access for other farmers and ranchers.</text></paragraph>
<paragraph id="H664BE5AF1FE349AEB17FBB19AF144EE9"><enum>(2)</enum><header>Use of funds</header><text>An eligible entity selected to receive a grants under this subsection may use grants funds—</text> <subparagraph id="H0D3AA541D03B472FB9695207A381FE5C"><enum>(A)</enum><text>to purchase and develop land, buildings, and associated infrastructure for commercial or industrial properties, including expansion or modernization, for use in processing, distributing, aggregating, storing, transporting, or marketing agricultural food products;</text></subparagraph>
<subparagraph id="H46ACFFFE6CB14C639395F733BA07CB3C"><enum>(B)</enum><text>to construct or equip facilities for use in processing, distributing, aggregating, storing, transporting, or marketing agricultural food products;</text></subparagraph> <subparagraph id="H0F60B21688B1421C918329D8A185AACF"><enum>(C)</enum><text>to purchase machinery and equipment for use in processing, distributing, aggregating, storing, transporting, or marketing agricultural food products;</text></subparagraph>
<subparagraph id="HBC7DE56CD9634318B86987FC3313FE33"><enum>(D)</enum><text>for general operating expenses directly related to a food hub, including planning and development related to the establishment or expansion of any food hub;</text></subparagraph> <subparagraph id="H196D7BD00C3C4E19B944788970ACBE94"><enum>(E)</enum><text>to provide marketing services for agricultural food products, including providing platforms (such as electronic or web-based platforms) for sales, inventory, and aggregation; and</text></subparagraph>
<subparagraph id="H035604876FCB4C2999E4A9F2DDEEBB47"><enum>(F)</enum><text>to conduct other activities supporting the development or expansion of a food hub, as determined by the Secretary.</text></subparagraph></paragraph> <paragraph id="H31B2AC710C6549DF820B6E05F4D41484"><enum>(3)</enum><header>Application</header> <subparagraph id="H10E5F680B3C1415F9953CE44D6D982BD"><enum>(A)</enum><header>In general</header><text>An eligible entity seeking a grant under this subsection shall submit to the Secretary an application that contains—</text>
<clause id="H9D1CA9CA04C84FFA8DAACCCE613AEECB"><enum>(i)</enum><text display-inline="yes-display-inline">a description of the activities the eligible entity will carry out to support one or more new or existing food hubs, including a plan for each such food hub to process, distribute, store, or market agricultural food products for wholesale, retail, or institutional markets;</text></clause> <clause id="H1F1B454A2F1440B6B9FB5B38BEE98B4D"><enum>(ii)</enum><text>a description of the ways in which each such food hub that the eligible entity is proposing to establish or expand is designed to increase market access for socially disadvantaged farmers or ranchers;</text></clause>
<clause id="HFB9C2D603D1D4EF89E5834F4A730D402"><enum>(iii)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), a description of the eligible entity’s demonstrated competency to develop and manage each such food hub, provide fiscal accountability, collect data, and prepare reports and other necessary documentation; and</text></clause> <clause id="H8D11BF33F9324FDABDD41862548A287A"><enum>(iv)</enum><text>any other information, as determined by the Secretary.</text></clause></subparagraph>
<subparagraph id="H8FA711852451466CA9C27374B3B36160"><enum>(B)</enum><header>Requirement to include eligible partners</header><text>An eligible entity that does not have one or more of the demonstrated competencies described in clause (iii) of subparagraph (A) shall submit to the Secretary in its application—</text> <clause id="H19D08EE674CA42A9BE91F5CAB02026C6"><enum>(i)</enum><text>a list of one or more eligible partners such eligible entity is partnering with;</text></clause>
<clause id="H2BB4C6EDCA8643F7BF97313FE65AD6BF"><enum>(ii)</enum><text>the responsibilities of each eligible partner in supporting such eligible entity; and</text></clause> <clause id="HD4FC6CD7DBD74F1A90E41D6C799DB495"><enum>(iii)</enum><text>a description of the demonstrated competencies of the eligible partner or partners in performing such responsibilities.</text></clause></subparagraph>
<subparagraph id="H313C516D2D6C43089C670B543DF81C9B"><enum>(C)</enum><header>Eligible entities serving as eligible partners</header><text display-inline="yes-display-inline">An eligible entity specified in subparagraph (B) of subsection (a)(3) seeking a grant under this section may serve as an eligible partner for other eligible entities in one or more grant applications under this subsection.</text></subparagraph></paragraph> <paragraph id="H5FE82A30CBBB4455A6C96B523928E97D"><enum>(4)</enum><header>Priority</header><text>In making grants under this subsection, the Secretary may give priority to grant applications for food hubs that—</text>
<subparagraph id="HD3FAF748A50041C08A01BC0BE7FEDBDF"><enum>(A)</enum><text>benefit underserved communities, as defined in section 310B(g)(9)(A)(ii) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(g)(9)(A)(ii)</external-xref>); </text></subparagraph> <subparagraph id="HBF8B8ACD9D904EA8A20FB71420D6BD9D"><enum>(B)</enum><text>aggregate, distribute, and market agricultural food products that meet the standards for donated foods, as determined by the Secretary; or</text></subparagraph>
<subparagraph id="H8C320704CE0D4475BB11703552777846"><enum>(C)</enum><text display-inline="yes-display-inline">have not been awarded a Department of Agriculture grant, including a grant under section 210A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c</external-xref>), in the preceding or current fiscal year.</text></subparagraph></paragraph> <paragraph id="H929BE52AD5754AC8873D7FB14E99A672"><enum>(5)</enum><header>Maximum grant term</header><text>The term of a grant under this subsection may not exceed 5 years.</text></paragraph>
<paragraph id="HCFB139B88F504ED282B39712DA00CC5B"><enum>(6)</enum><header>No matching funds</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under this section shall not be required to provide non-Federal matching funds with respect to such grant.</text></paragraph></subsection> <subsection id="H4457586F22FA4312B36A302A97858B91"><enum>(c)</enum><header>Prioritizing Purchases for USDA Domestic Food Assistance Programs</header> <paragraph id="HF2CE41DBB31744639E9FFE64004A3B94"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a process—</text>
<subparagraph id="H7103B9951D42413386B0A8CE73165657"><enum>(A)</enum><text display-inline="yes-display-inline">to prioritize the purchase of agricultural food products from socially disadvantaged farmers and ranchers, including from food hubs developed or expanded under this section, for use in Department of Agriculture programs that distribute agricultural food products within the United States (including any insular area (as defined in section 1404 of the National Agricultural, Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>))); and</text></subparagraph> <subparagraph id="H5049B82456434320AAB8535E300E2C2C"><enum>(B)</enum><text display-inline="yes-display-inline">that is designed to account for barriers to market entry faced by socially disadvantaged farmers and ranchers while maintaining the integrity of the purchasing process established under this subsection, including ensuring that any entity that is suspended or debarred from participation in any Federal program is not eligible to participate in the purchasing process established under this subsection. <italic></italic></text></subparagraph></paragraph>
<paragraph id="H668DADBAF7AA478E8BD923B1FEBF83B9"><enum>(2)</enum><header>Waivers</header>
<subparagraph id="H069924933ACF4F44A880F9B1237A7924"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In establishing the process described in paragraph (1), the Secretary may provide for the waiver of the full and open competition procedures for the award of Federal contracts, section 3324 of title 31, United States Code, and section 725 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/7/2209f">7 U.S.C. 2209f</external-xref>), if the Secretary identifies requirements under such sections and procedures as presenting barriers to market entry for socially disadvantaged farmers and ranchers.</text></subparagraph> <subparagraph id="HE46E173AF2D84FF5B15EA3537418F88A"><enum>(B)</enum><header>Notification</header><text display-inline="yes-display-inline">Not later than 10 days after providing for any waiver under subparagraph (A), the Secretary shall notify the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate of such waivers and provide a description of how such waivers would address barriers to market entry for socially disadvantaged farmers and ranchers for a particular agricultural food product.</text></subparagraph></paragraph></subsection>
<subsection id="H76451F2F4A8B4FDABD7B6FA557ADC50D"><enum>(d)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than December 31, 2022, and each December thereafter until the completion of the grants awarded under subsection (b), the Secretary shall make publicly available on the Department of Agriculture’s website and submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, a report that includes—</text> <paragraph id="H39FF3DD6D34C43D48C63FDF4F576C0BE"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the status of each grant awarded under subsection (b);</text></paragraph>
<paragraph id="H1FC974EEC121404591F7A4ACEF9CD299"><enum>(2)</enum><text>the number of socially disadvantaged farmers and ranchers participating in the food hub supported by such grant in the previous fiscal year; </text></paragraph> <paragraph id="H62CF6238234B48C89F7D6AB3FAE5DD0F"><enum>(3)</enum><text>to the maximum extent practicable, the amount of agricultural food products produced by socially disadvantaged farmers and ranchers processed, distributed, aggregated, stored, or marketed by the food hub supported by such grant in the previous fiscal year; and</text></paragraph>
<paragraph id="H1FF835FF36D04EC2AE3F10D28D438175"><enum>(4)</enum><text display-inline="yes-display-inline">the total amount of donated food purchased by the Secretary from food hubs supported with grants awarded under this section in the previous fiscal year.</text></paragraph></subsection> <subsection id="H9CCE495B59F14CB48E1CA935FE8045B7" commented="no"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out subsection (b) $100,000,000 for fiscal year 2022, to remain available until expended.</text></subsection></section>
<section id="HDF47CD1870214874A74B4687F97E8EB4" section-type="subsequent-section"><enum>3.</enum><header>Agriculture hub credit</header>
<subsection id="H991954A81EFC4C3EA891E64F53BC4B7A"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text> <quoted-block display-inline="no-display-inline" id="H5B6D909E8AD9408BB1AFFE1A1BB26649" style="OLC"> <section id="H2DE57184FD6449EC86A5AA6457E90028"><enum>45U.</enum><header>Agriculture hub credit</header> <subsection id="HEE578F207B04447CA533CCC662D5898E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of section 38, the agriculture hub credit determined under this section for any taxable year is an amount equal to 25 percent of the qualified food hub expenses for the taxable year.</text></subsection>
<subsection id="H0841093BF35E42E4B5352629B1427D7F"><enum>(b)</enum><header>Qualified food hub expenses</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>qualified food hub expenses</quote> means amounts paid or incurred by the taxpayer during the taxable year—</text> <paragraph id="HB5AEF9E30E7645BFAE452AAD434EC65D"><enum>(1)</enum><text display-inline="yes-display-inline">for agricultural food products from a food hub developed or expanded under section 2 of the <short-title>Black Farmers and Socially Disadvantaged Farmers Increased Market Share Act</short-title>, and</text></paragraph>
<paragraph id="HBCAAD1630BDE461DA128039037D8391B"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with a contract certified by the Secretary of Agriculture under section 3(c) of the <short-title>Black Farmers and Socially Disadvantaged Farmers Increased Market Share Act</short-title>.</text></paragraph></subsection> <subsection id="H57F069BC101D46F393B7D59D041F1FB0"><enum>(c)</enum><header>Food hub</header><text display-inline="yes-display-inline">The term <quote>food hub</quote> has the meaning given such term in section 2 of the <short-title>Black Farmers and Socially Disadvantaged Farmers Increased Market Share Act</short-title>. </text></subsection>
<subsection id="HD2F9CC1DBCAD4B6C9EA28F69ACB08AF6"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply to taxable years beginning after the Secretary determines the grant program under section 2 of the <short-title>Black Farmers and Socially Disadvantaged Farmers Increased Market Share Act</short-title> has ended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H9A1EF8B6198F4642B133B5618227AC77"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H3AFF03BC27F84C93BA2033E295D10FEB"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/38">Section 38(b)</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
<subparagraph id="HD0BC09F86E0441BFA4495973BD766DC3"><enum>(A)</enum><text>in paragraph (32), by striking <quote>plus</quote> at the end,</text></subparagraph> <subparagraph id="H537757CE7DCE4B488DC0EE5D531F04FB"><enum>(B)</enum><text>in paragraph (33), by striking the period at the end and inserting <quote>, plus</quote>, and</text></subparagraph>
<subparagraph id="HFB5E2434B4634491BB8A650EFB5DF0FC"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H5EEDA9688A3644DAAB955AAD7958937B" style="OLC"> <paragraph id="H98D3313AF35D4129BCDC5A47AFF1164E"><enum>(34)</enum><text>the agriculture hub credit determined under section 45U(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H6E70672A6BFC4C8CB19FAD4F108647F8"><enum>(2)</enum><text>The table of sections for subpart D of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following new item:</text> <quoted-block display-inline="no-display-inline" id="HA6840D89ACF240A39A7B05E8B8F98E0A" style="OLC"> <toc> <toc-entry bold="off" level="section">Sec. 45U. Agriculture hub credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H956269ABD1E84A14ACA75EA38CA3C554"><enum>(3)</enum><text>Section 280C of such Code is amended by adding at the end the following new subsection: </text>
<quoted-block style="OLC" id="HF4DB8E1D49BF492B80A3E897F9E0344D" display-inline="no-display-inline">
<subsection id="H4AE0FF1E62194390933C6DAFBC8C379F"><enum>(i)</enum><header>Agriculture hub credit</header><text display-inline="yes-display-inline">Any deduction or other credit otherwise allowable with respect to an expense for which a credit is allowed under section 45U(a) shall be reduced by the amount of the credit under section 45U(a) with respect to such expense. If a credit is allowed under section 45U(a) with respect to property of a kind which would properly be included in the inventory of the taxpayer if on hand at the close of the taxable year or property held by the taxpayer primarily for sale to customers in the ordinary course of the trade or business of such taxpayer, opening inventory or purchases shall be reduced by the amount of the credit so allowed.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF0E3B26805F2421D905C5D1EC456EDCA"><enum>(c)</enum><header>Certification process</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary of Agriculture shall issue regulations to establish a process to certify, at the request of entities seeking an agriculture hub credit <external-xref legal-doc="usc" parsable-cite="usc/26/45U">section 45U</external-xref> of the Internal Revenue Code of 1986, as added by subsection (b), that a contract under which expenditures referred to in such section 45U are made—</text>
<paragraph id="HEF1D7E7731BA4A36940152F3E46E2E9F"><enum>(1)</enum><text display-inline="yes-display-inline">is not between related parties;</text></paragraph> <paragraph id="HE05BA8C000874981B29E1720684B987E"><enum>(2)</enum><text display-inline="yes-display-inline">is the result of arm’s length negotiations; and</text></paragraph>
<paragraph id="H35A2A122E1FA45129063BD6C855CFC69"><enum>(3)</enum><text display-inline="yes-display-inline">meets any other requirements, as determined by the Secretary of Agriculture, in consultation with the Secretary of Treasury.</text></paragraph></subsection> <subsection id="H9E1ACE3EF07B490685A3245BB128CB6D"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to expenses paid or incurred in taxable years beginning after December 31, 2021.</text></subsection></section>
<section id="HC10B4661CCE8429FA67786E1A47BA31A"><enum>4.</enum><header>Civil rights accountability for USDA employees</header>
<subsection id="HB4F45E259D09432E8DC35B5C4478ED84"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall ensure that officials and employees of the Department of Agriculture are held accountable in accordance with subsection (b) if, while in the course of their employment or in administering a Department of Agriculture program, such officials and employees are found to have engaged in any discriminatory actions, retaliatory actions, harassment, civil rights violations, or related misconduct, including any such actions or misconduct involving any of the following: </text> <paragraph id="H1AFE62F2EDCE45ACAB1602F21BE46238"><enum>(1)</enum><text display-inline="yes-display-inline">Failure to provide a receipt for service in accordance with section 2501A(e) of the Food, Agriculture, Conservation or Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279-1">7 U.S.C. 2279–1(e)</external-xref>) to any current or prospective applicants of or participants in Department of Agriculture programs. </text></paragraph>
<paragraph id="H98199F623E2E4537A4B7BDA1387AEE56"><enum>(2)</enum><text display-inline="yes-display-inline">Providing an inaccurate receipt for service under such section 2501A(e) to any current or prospective applicants of or participants in Department of Agriculture programs.</text></paragraph> <paragraph id="H0EA724D2B25F423CB81A48F275F61C24"><enum>(3)</enum><text display-inline="yes-display-inline">Failure to provide appropriate information regarding relevant programs and services at the Department of Agriculture, when requested by any current or prospective applicants of or participants in Department of Agriculture programs.</text></paragraph>
<paragraph id="H113CADC1B41F493FBF4D4185AD4535A4"><enum>(4)</enum><text display-inline="yes-display-inline">Failure to timely process applications or otherwise delaying program services to any current or prospective applicants of or participants in, Department of Agriculture programs.</text></paragraph></subsection> <subsection id="H9FE6582AAE3B4AD3A87E596BC0FACC80"><enum>(b)</enum><header>Taking corrective action</header><text display-inline="yes-display-inline">The Secretary shall ensure that appropriate corrective action is taken with respect to any official or employee of the Department of Agriculture who has been found to have engaged in any of the actions, violations, or misconduct referred to in subsection (a) while in the course of such official’s or employee’s employment or in administering a Department of Agriculture program—</text>
<paragraph id="HAB323B1C43A34C4CA5F25CBBA32CE9EE"><enum>(1)</enum><text display-inline="yes-display-inline">in any administrative finding by the Department of Agriculture, including any final agency decision issued by the Assistant Secretary of Agriculture for Civil Rights and any civil rights compliance review or misconduct investigation conducted by the Department of Agriculture;</text></paragraph> <paragraph id="H0B9B5664C381453AADC7DE928B1F84B2"><enum>(2)</enum><text>in any administrative or judicial proceeding;</text></paragraph>
<paragraph id="HE780041CE2334322872C8861E987210A"><enum>(3)</enum><text>in any civil rights settlement;</text></paragraph> <paragraph id="H37AADE1AA2374225B2BFBD738C8C3AFF"><enum>(4)</enum><text>in any audit or investigation conducted by the Office of the Inspector General of the Department of Agriculture; or</text></paragraph>
<paragraph id="H369667239072484D913EA6FDFA1B4DD9"><enum>(5)</enum><text>in any investigation conducted by the Office of the Special Counsel.</text></paragraph></subsection> <subsection id="HD0FD46A3FB5647698B883BFF31982CE4"><enum>(c)</enum><header>Corrective action defined</header><text display-inline="yes-display-inline">In this section, the term <quote>corrective action</quote> means any action taken to respond to any of the actions, violations, or misconduct referred to in subsection (a) that—</text>
<paragraph id="H4D29EA2D8838434C9C31730BAEFB2CDE"><enum>(1)</enum><text display-inline="yes-display-inline">would enhance civil rights at the Department of Agriculture, including any policy or programmatic changes to prevent similar misconduct from occurring in the future; and</text></paragraph> <paragraph id="H64F8EB27498E417684A19E7CE9E0853B"><enum>(2)</enum><text>may include disciplinary actions, including—</text>
<subparagraph id="H27DFF9864DF54971947284B16FFCC30F"><enum>(A)</enum><text display-inline="yes-display-inline">removal from Federal service;</text></subparagraph> <subparagraph id="HA37BB626683D47F38D42BEAB7CBC69C7"><enum>(B)</enum><text>suspension without pay;</text></subparagraph>
<subparagraph id="HED3FF32342C3416E978BD8B753D84B0D"><enum>(C)</enum><text>any reduction in grade or pay; and</text></subparagraph> <subparagraph id="HCF818677547D41238D1F8B71E76CA023"><enum>(D)</enum><text display-inline="yes-display-inline">letter of reprimand.</text></subparagraph></paragraph></subsection></section>
<section id="HB3B6E24AEEB44D558AE59D86EEC83EDB"><enum>5.</enum><header>Equitable relief</header>
<subsection id="H4CC3628ED809491CA2A3516FF8EB4A3B"><enum>(a)</enum><header>Equitable relief from ineligibility for loans, payments, or other benefits</header><text>Section 1613 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7996">7 U.S.C. 7996</external-xref>) is amended—</text> <paragraph id="H5754E488178144E4ADAA3C5B77A9A950"><enum>(1)</enum><text>by redesignating subsections (f) through (j) as subsections (g) through (k), respectively;</text></paragraph>
<paragraph id="HA4F500182D1C4DA794384042DD1E6D4C"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text> <quoted-block id="H773EEF7ABB1D47138CB0DF9AB042353A" style="OLC"> <subsection id="H3F1CA018E3084681B17E2522139BD1BA"><enum>(f)</enum><header>Equitable relief by the Assistant Secretary of Agriculture for Civil Rights</header> <paragraph id="H81BFDA58A44946E28C79C1A459A23BFD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary of Agriculture for Civil Rights (or a designee of the Secretary in the Office of the Assistant Secretary for Civil Rights, if no Assistant Secretary of Agriculture for Civil Rights is confirmed in accordance with section 218(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6918">7 U.S.C. 6918(b)</external-xref>)) may grant relief in accordance with subsections (b) through (d) to a participant who files a civil rights program complaint.</text></paragraph>
<paragraph id="H7D4E86067B9A49DF8828DF4EE413ABEB"><enum>(2)</enum><header>Decisions</header><text>The decision by the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary) to grant relief under this subsection—</text> <subparagraph id="H6A2D895CECB94BBE9CCC35CB07623C33"><enum>(A)</enum><text>shall not require prior approval by any officer or employee of the Department of Agriculture; and</text></subparagraph>
<subparagraph id="H5EE0D9E5526546388878F9D48180657B"><enum>(B)</enum><text>is subject to reversal only by the Secretary (who may not delegate the reversal authority).</text></subparagraph></paragraph> <paragraph id="HD5EF0F577654439E93FBC2D144696A0C"><enum>(3)</enum><header>Other authority</header><text>The authority provided to the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary) under this subsection is in addition to any other applicable authority and does not limit other authority provided by law or the Secretary.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H72C845061F1D49E2BD2EC511F012B357"><enum>(3)</enum><text>in subsection (g), as so redesignated, by striking <quote>or the State Conservationist</quote> and inserting <quote>the State Conservationist, or the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary)</quote>; and</text></paragraph> <paragraph id="HBF45839FEBCE49ED9CE21C2FC52B81AB"><enum>(4)</enum><text>in paragraph (1) of subsection (h), as so redesignated, by striking <quote>and (e)</quote> and inserting <quote>(e), and (f)</quote>.</text></paragraph></subsection>
<subsection id="H3C83246E017544FCAEC565366BD59FFE"><enum>(b)</enum><header>Equitable relief for actions taken in good faith</header><text>Section 366 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008a">7 U.S.C. 2008a</external-xref>) is amended—</text> <paragraph id="HEA545B1FB5814B3CB09727E23B63A2FE"><enum>(1)</enum><text>by amending subsection (b) to read as follows:</text>
<quoted-block id="HB20408B321CA4641A7B203BAE84A8E9A" style="OLC">
<subsection id="H26A0B3C68CEA4D5DBB95EF28BBC355BD"><enum>(b)</enum><header>Limitation</header><text>The Secretary may only provide relief to a farmer or rancher under subsection (a) if the Secretary determines that the farmer or rancher—</text> <paragraph id="HB9DAFB936B8B4747B7D056338D702EED"><enum>(1)</enum><text>acting in good faith, relied on an action of, or the advice of, the Secretary (including any authorized representative of the Secretary) to the detriment of the farming or ranching operation of the farmer or rancher; or</text></paragraph>
<paragraph id="H01E2730D2CC244FC88A8342F72B99453"><enum>(2)</enum><text>failed to comply fully with the requirements of a program described in subsection (a)(1), but made a good faith effort to comply with the requirements.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> <paragraph id="H1935E26851A04E4A8725025EC91EF850"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text>

<paragraph id="HF72DC1EEA01C4B5CA67B16C097D14829"><enum>(4)</enum><text>in subsection (f), as so redesignated, by striking <quote>Secretary</quote> and inserting <quote>Secretary, or the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary)</quote>.</text></paragraph></subsection></section> <section id="HE554ECFD36BA4C5884F8ED96C12DAC39"><enum>6.</enum><header>Burden of Proof for National Appeals Division Hearings</header><text display-inline="no-display-inline">Section 277(c)(4) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6997">7 U.S.C. 6997(c)(4)</external-xref>) is amended to read as follows: </text>
