which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to allow additional funds to be provided under the airport improvement program for certain noise mitigation projects, and for other purposes.</official-title></form><legis-body id="H4CD1953E60E34D4DBD57C7EBCBC0BC5B" style="OLC"><section id="H0211374E43844A4C9D42718B65702885" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Noise Mitigation Repair and Replacement Program Act</short-title></quote>.</text></section><section id="HD24A7F8F2F8749A4ACF69AE1DEF37939" section-type="subsequent-section"><enum>2.</enum><header>Noise mitigation projects</header><subsection id="H7A78840EDB1D4495AC2BDF079A332A1A"><enum>(a)</enum><header>Government share</header><text display-inline="yes-display-inline">Section 47109 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H111648DC2B9A4625B28180FB56AB7C2A" display-inline="no-display-inline"><subsection id="H23148B8EDD304594B403512CA7E5805C"><enum>(g)</enum><header>Special rule for noise mitigation projects</header><text display-inline="yes-display-inline">With respect to a project to carry out noise mitigation that is granted a waiver under section 47110(j), the allowable project cost for such project shall be calculated without consideration of any costs that were previously paid by the Government.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H776D7DFAEFE14C20A55CAC9B0C3471EB"><enum>(b)</enum><header>Noise mitigation projects</header><text display-inline="yes-display-inline">Section 47110 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H0BB7FFFA96EA407EA05F1BD4C62AA155" display-inline="no-display-inline"><subsection id="H9812A114AE844BDD9E9F9B84D801594B"><enum>(j)</enum><header>Special rule for noise mitigation projects</header><paragraph id="HA6F73A065FFE46E7BEF5745C5FB263D7"><enum>(1)</enum><header>In general</header><text>The Secretary shall waive the requirement of subsection (b)(4) for a project to carry out noise mitigation for a building or other structure that has previously received Federal assistance under this subchapter for noise mitigation if—</text><subparagraph id="H672E8FD1AEBB4F09BA278B83541BADF6"><enum>(A)</enum><text>the Secretary determines that the additional assistance is justified due to—</text><clause id="H9B65670E8DEB4395A1FACD762F7B513C" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">increased aircraft noise that would have afforded different levels of mitigation, even if the property owner had waived all damages and conveyed a full and unrestricted easement; or</text></clause><clause id="H3EA4275472BF4A05AEF923B8EAB8E621" commented="no"><enum>(ii)</enum><text>the building or other structure containing soundproofing installation, structure, or other type of sound mitigation equipment product or benefit previously installed under a noise mitigation program under this subchapter that is determined to be eligible pursuant to paragraph (2); and</text></clause></subparagraph><subparagraph id="H141557BC14B04769B1731F1CC40DCA84"><enum>(B)</enum><text display-inline="yes-display-inline">the building or other structure—</text><clause id="HFEA79E5F9DCD4F469CC08BCFD697B880"><enum>(i)</enum><text>falls within the Day Night Level (DNL) 65 standard according to the most recent noise exposure map, as such term is defined in section 150.7 of title 14, Code of Federal Regulations; or</text></clause><clause id="H6FA8767CCEE946A794335B3247BC2765"><enum>(ii)</enum><text>fell within such standard at the time the initial noise mitigation was carried out and a building inspector has determined that—</text><subclause id="H88C72BA76CAE44F395CE7C0D0E4474C8"><enum>(I)</enum><text>such mitigation caused physical damage the building or other structure; or</text></subclause><subclause id="H78153098CA1045C6A22DC0A0B2F766CA"><enum>(II)</enum><text display-inline="yes-display-inline">the materials used for such mitigation were of low quality and have deteriorated, broken, or otherwise no longer function as intended.</text></subclause></clause></subparagraph></paragraph><paragraph id="H5DD11AB79EAE4D89B9D804DE1CBD7020"><enum>(2)</enum><header>Eligibility determination</header><text>To be eligible for waiver under this subsection for a project, an applicant shall—</text><subparagraph id="H39C7D130FB4A445E83C0371D8B23F1AA"><enum>(A)</enum><text>exhaust any amounts available through warranties on the applicable building or structure for the proposed noise mitigation activities; and</text></subparagraph><subparagraph id="H66E09B4DDFB04C2AA324C5561FBADC2A"><enum>(B)</enum><text>demonstrate that a State-certified building inspector conducted an inspection of the building or other structure and determined that—</text><clause id="H7E1C78E2F1AF4BBD9494D97AE17407A0"><enum>(i)</enum><text>the noise mitigation for which Federal assistance was previously provided is degraded or ineffective, or the manner of installation of such mitigation has caused damage to the building or other structure; and</text></clause><clause id="H7725B4F0E00E41648060CD59876907AB"><enum>(ii)</enum><text>the condition of noise mitigation improvement described in subparagraph (A) is not attributed to actions taken by an owner or occupant of the building or other structure. </text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
