R. 415</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="P000599">Mr. Posey</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, to provide that in the case of an agency that appeals the ruling of a court under that chapter, and does not prevail on appeal, the court shall award the prevailing party reasonable attorney’s fees and costs, and for other purposes.</official-title></form><legis-body id="H855B28785E05403BA6DF003EC62920FA" style="OLC"><section id="H5277CFB67B4548B4B78A7EBB7DF21CE9" section-type="section-one"><enum>1.</enum><header>Agency required to pay attorney’s fees and costs in unsuccessful appeals</header><subsection id="HCB8EBA844BB843B39C7E2F77E18CEBA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">Chapter 7</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HDE6503D9A5B442B280ED0BEB39267336" style="USC"><section id="H3EE9CF48CB3A4AAEA89E57EC94A243EB"><enum>707.</enum><header>Attorney’s fees and costs in appeals</header><text display-inline="no-display-inline">In the case that an agency appeals a ruling of a court under this chapter, and does not prevail in the appeal, the court shall award reasonable attorney’s fees and costs to the prevailing party. Such award shall be paid out of the administrative budget of the office in the agency that filed the appeal.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H280B7FDF54694938878D24D134F6B4DF"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5 is amended by inserting after the item related to section 706 the following:</text><quoted-block display-inline="no-display-inline" id="H9DD498939E79497BBD08E732D64BD7F6" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">707.
