which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 40, United States Code, to establish an Appalachian regional energy hub initiative, and for other purposes.</official-title></form><legis-body id="H75B8FB00827A4879A20DEDEEA89F3389" style="OLC"><section id="H9F22DDF8705849FC820B07E5629708C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Appalachian Regional Energy Hub Initiative Act</short-title></quote>.</text></section><section id="H597D8032EAA64B4AAC42D8020645476A"><enum>2.</enum><header>Appalachian regional energy hub</header><subsection id="H2978295E5EBD4F66A4550AAC9E4FDFFD"><enum>(a)</enum><header>Appalachian regional energy hub initiative</header><paragraph id="HF1B65C29E9784D8786EEDFA26E9DECAC"><enum>(1)</enum><header>In general</header><text>Subchapter I of chapter 145 of subtitle IV of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H727D9DD0E40B44768ACEE7CF76E3065A" style="USC"><section id="H84FB6F2F2B5C40AA9329A9C1649B0822"><enum>14511.</enum><header>Appalachian regional energy hub initiative</header><subsection id="HD3AB0786CACE4A1091B205C5F960B98A"><enum>(a)</enum><header>In general</header><text>The Appalachian Regional Commission may provide technical assistance to, make grants to, enter into contracts with, or otherwise provide amounts to individuals or entities in the Appalachian region for projects and activities—</text><paragraph id="H16207371B97549C0A99BE1D241DAA24F"><enum>(1)</enum><text display-inline="yes-display-inline">to conduct research and analysis regarding the economic impact of an ethane storage hub in the Appalachian region that supports a more-effective energy market performance due to the scale of the project, such as a project with the capacity to store and distribute more than 100,000 barrels per day of hydrocarbon feedstock with a minimum gross heating value of 1,700 Btu per standard cubic foot;</text></paragraph><paragraph id="H7EB0E8549D714FFD9A4CEB645B386D5C"><enum>(2)</enum><text>with the potential to significantly contribute to the economic resilience of the area in which the project is located; and</text></paragraph><paragraph id="H62731B3C4CD44EB5ACC411D31926706D"><enum>(3)</enum><text display-inline="yes-display-inline">that will help establish a regional energy hub in the Appalachian region for natural gas and natural gas liquids, including hydrogen produced from the steam methane reforming of natural gas feedstocks.</text></paragraph></subsection><subsection id="H558C69FCFCE844F68A4B0FD1D5BC605F"><enum>(b)</enum><header>Limitation on available amounts</header><text>Of the cost of any activity eligible for a grant under this section—</text><paragraph id="HE6D82E76551D4B1A8740B1CDC13407E2"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraphs (2) and (3), not more than 50 percent may be provided from amounts made available to carry out this section;</text></paragraph><paragraph id="HA6F7D80ED3124EAF89EF5A31CAA08CC1"><enum>(2)</enum><text>in the case of a project to be carried out in a county for which a distressed county designation is in effect under section 14526, not more than 80 percent may be provided from amounts made available to carry out this section; and</text></paragraph><paragraph id="H1530B34A214549429F73EF8FCC47060F"><enum>(3)</enum><text>in the case of a project to be carried out in a county for which an at-risk county designation is in effect under section 14526, not more than 70 percent may be provided from amounts made available to carry out this section.</text></paragraph></subsection><subsection id="HDDCB1E0B3AFB442CA791148973B14473"><enum>(c)</enum><header>Sources of assistance</header><text>Subject to subsection (b), a grant provided under this section may be provided from amounts made available to carry out this section, in combination with amounts made available—</text><paragraph id="H63F366C0CBD14551951172F503D50E6F"><enum>(1)</enum><text>under any other Federal program; or</text></paragraph><paragraph id="HDCAFBC78047F4C97881469B3E614640A"><enum>(2)</enum><text>from any other source.</text></paragraph></subsection><subsection id="H520761460C1145EB8400D296F5CFF26E"><enum>(d)</enum><header>Federal share</header><text>Notwithstanding any provision of law limiting the Federal share under any other Federal program, amounts made available to carry out this section may be used to increase that Federal share, as the Appalachian Regional Commission determines to be appropriate.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HC737A4B82CA44A6FB10A77935A8B6F4A"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/145">chapter 145</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block id="H0B7C15EB44294882AAEB6BC92725D0C0" style="OLC"><toc><toc-entry level="section">14511. Appalachian regional energy hub initiative.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H32C23BF0BA274AAF9B14E6B0B3CB27E6" display-inline="no-display-inline"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 14703 of title 40, United States Code, is amended—</text><paragraph id="HEFE0AA00D79043E7A57C44E4B00C4676"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HEAC6C5972FDE4BC2A3ECF957EFC53728"><enum>(A)</enum><text>in paragraph (4) by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HE233C7D05B674E35912AE0C62C700D08"><enum>(B)</enum><text>in paragraph (5) by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H61F71D78753B44328B3C56E4373A7AD5"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H5B7F5ABB23564CDE9CFD6DFE270E3A8A" display-inline="no-display-inline"><paragraph id="H576D831E115C4648ABCF5D8007F38C90"><enum>(6)</enum><text display-inline="yes-display-inline">$200,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H56D677C2E8464DABB5C2F5FE1EA164FA"><enum>(2)</enum><text>in subsection (c), by striking <quote>$10,000,000 may be used to carry out section 14509 for each of fiscal years 2016 through 2021</quote> and inserting <quote>$20,000,000 may be used to carry out section 14509 for each of fiscal years 2022 through 2026</quote>;</text></paragraph><paragraph id="H86C53EBE581043D5979A45C56DCDBAED"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph><paragraph id="H174543BF7C2A4FCB87F5E6C964C7371F"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text><quoted-block display-inline="no-display-inline" id="H73881774206D4D2BB8DD90653E893EC3" style="OLC"><subsection id="HF5436927C7B248BFB31FD45730AF40AE"><enum>(d)</enum><header>Appalachian regional energy hub initiative</header><text>Of the amounts made available under subsection (a), $5,000,000 shall be used to carry out section 14511 for each of fiscal years 2022 through 2026.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAF41BF28EB8C4F7D8C3DE1326E8B2B21"><enum>(c)</enum><header>Termination</header><text>Section 14704 of title 40, United States Code, is amended by striking <quote>2021</quote> and inserting <quote>2026</quote>. </text></subsection></section></legis-body></bill>
