<official-title display="yes">To amend the Richard B. Russell National School Lunch Act to establish a pilot grant program to make grants to school food authorities to provide 100 percent plant-based food and milk options, and for other purposes.</official-title>

<section id="HC3BCD2FB413447DCA4522C1CA3708F25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Future Students and Earth Pilot Program Act of 2021</short-title></quote>. </text></section> <section id="HA17DDB145D9D460DA707810133A666D9"><enum>2.</enum><header>Pilot grant program for 100 percent plant-based food and milk options</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) is amended by inserting before subsection (b) the following: </text>

<subsection id="H9AF233057E374A3E944202743C59D4D4"><enum>(a)</enum><header>Pilot grant program for 100 percent plant-Based food and milk options</header>
<paragraph id="HF953E6E42E414A03B66780982DB3F250"><enum>(1)</enum><header>Program authorized</header><text>Not later than 90 days after the date of the enactment of this subsection, the Secretary shall establish and carry out a pilot grant program to make grants to eligible school food authorities to carry out the activities described in paragraph (4).</text></paragraph> <paragraph id="HAFB369B801BA4449BADC6C87CD693F44"><enum>(2)</enum><header>Grant terms</header> <subparagraph id="H353616627740498B9989C5A8CC50E228"><enum>(A)</enum><header>Number of grants awarded</header><text>The Secretary shall award at least 50 grants under the pilot grant program established under paragraph (1).</text></subparagraph>
<subparagraph id="HC58FEFDA101D4FB9B31E387032A08F12" commented="no"><enum>(B)</enum><header>Term</header><text>The term of a grant awarded under this subsection shall be 3 years.</text></subparagraph> <subparagraph id="H3A3D8AF59CA94E4FA866903068B0A49B"><enum>(C)</enum><header>Purpose and scope</header><text display-inline="yes-display-inline">The Secretary shall, to the maximum extent practicable, award grants under this subsection in diverse amounts in order to best match—</text>
<clause id="H6887C7AE1F464DE0939FD5F766AF3EC7"><enum>(i)</enum><text>the need of the school food authority awarded the grant; and</text></clause> <clause id="H87FE21D2C20C4B08BBFABCFB9365A503"><enum>(ii)</enum><text>the award to the purpose and scope of the project to be funded.</text></clause></subparagraph></paragraph>
<paragraph id="HB33051B841AD47A4800DE3C9BA8FCC9F"><enum>(3)</enum><header>Application</header>
<subparagraph id="H646F1BE2971143F0AD3D666ADDCAD014"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant under this subsection, an eligible school food authority shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph> <subparagraph id="HDB7496803E75468199C53A60165AF4C6"><enum>(B)</enum><header>Priority</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary shall give priority to awarding grants to an eligible school food authority that—</text>
<clause id="H8ED585DF4D284D34B0FB28479E467FE2"><enum>(i)</enum><text>will use the grant funds to—</text> <subclause id="H6B355A36415D47F2AF0FD50761B0A473"><enum>(I)</enum><text>serve a high proportion of children who are eligible for free or reduced price lunches;</text></subclause>
<subclause id="H5251486A814A4AA49E37ED6D829EC3FB"><enum>(II)</enum><text>demonstrate collaboration with nongovernmental and community-based organizations, agricultural producer groups, and other community partners;</text></subclause> <subclause id="H4E1A8DFF97C74558A638758A12343AB2"><enum>(III)</enum><text>serve a high proportion of children from socially disadvantaged backgrounds; and</text></subclause>
<subclause id="H844965D704F146ACB71272A938672B7E"><enum>(IV)</enum><text>incorporate experiential and traditional and culturally appropriate food, nutrition, or agricultural education activities in curriculum planning; </text></subclause></clause> <clause id="HA4BEA3365D764BB59D069B8F48DD1745"><enum>(ii)</enum><text>in the application of such eligible school food authority under subparagraph (A)—</text>
<subclause id="HE6E882756E334266A63FEE204F7990CD"><enum>(I)</enum><text>includes an adequate and participatory evaluation plan; and</text></subclause> <subclause id="HCB9F764A3A3344719CA7D99075DE0F50"><enum>(II)</enum><text display-inline="yes-display-inline">includes a plan for providing culturally appropriate meals; and</text></subclause></clause>
<clause id="H9523C6C0FC804C41AB4D79AD5A8E20B6"><enum>(iii)</enum><text>meets any other criteria that the Secretary determines appropriate.</text></clause></subparagraph></paragraph> <paragraph id="H89FFE8494E134197B429C94324788EA5"><enum>(4)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A grant under this subsection may be used for any of the following:</text>
<subparagraph id="H4D76877C413F432D9E27D8BE8C508C93"><enum>(A)</enum><text>To contract with third parties for professional development training for food service personnel on serving (including preparing, procuring, marketing, and creating menus) 100 percent plant-based food options or 100 percent plant-based milk options, except that any employee who participates in such a training shall be compensated for such training at the regular rate of pay of such employee. </text></subparagraph> <subparagraph id="H6C76EEEABC404644ABCCE72C1F6D15C0"><enum>(B)</enum><text>To provide technical assistance and pupil engagement and education on 100 percent plant-based food and 100 percent plant-based milk options, including providing taste tests, recipe development, and culinary education.</text></subparagraph>
<subparagraph id="HD067D3A282CA48F4A312764055E25D75"><enum>(C)</enum><text>To provide additional compensation for additional work relating to serving meals that include a 100 percent plant-based food option or a 100 percent plant-based milk option.</text></subparagraph> <subparagraph id="HBFBB3C5FD17547A9B37EDBA258FC98AB"><enum>(D)</enum><text display-inline="yes-display-inline">To conduct outreach to and cover costs of procurement of foods from agricultural producers of meat alternates including—</text>
<clause id="HAE13754D146D4C2485608ED1E4F3C1BA"><enum>(i)</enum><text>beginning farmers (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>));</text></clause> <clause id="H599FACE81D2B4D34886A4F255F581FF4"><enum>(ii)</enum><text>veteran farmers (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>));</text></clause>
<clause id="H18313694BC074E43864B8D1B16D36CAE"><enum>(iii)</enum><text>socially disadvantaged farmers (as defined in section 355(e) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2003">7 U.S.C. 2003(e)</external-xref>)); and</text></clause> <clause id="H6F1B7A66B0024C42A3D93056805807B6"><enum>(iv)</enum><text>local farmers.</text></clause></subparagraph></paragraph>
<paragraph id="H2E77538799E64CDC9D1D0A6AFEE39877"><enum>(5)</enum><header>Reports</header>
<subparagraph id="H7C810820110A477F99D302C5AC43E3DF"><enum>(A)</enum><header>Recordkeeping required</header><text>Each eligible school food authority awarded a grant under this subsection shall keep such records of meat alternative and fluid milk alternative items served pursuant to this subsection as the Secretary determines appropriate.</text></subparagraph> <subparagraph id="HC9B12EEEAC8E4F079FDE53DCD22D7B11"><enum>(B)</enum><header>Report required by school food authorities</header><text>Not later than 1 year after receiving a grant under this subsection, and annually for the duration of the pilot grant program thereafter, a school food authority shall submit to the Secretary a report on the success of the pilot grant program, including information on—</text>
<clause id="H9BB699F3BF9148DB92802BFA3C108E1C"><enum>(i)</enum><text display-inline="yes-display-inline">the number of 100 percent plant-based food options and 100 percent plant-based milk options that the school food authority served during the grant period compared with the preceding school year;</text></clause> <clause id="H612DAEABAC224C02983288E897C56C97"><enum>(ii)</enum><text>the number of schools served by the school food authority pursuant to the grant;</text></clause>
<clause id="H582516E0A29D486DBD8C3BB04432275D"><enum>(iii)</enum><text>the number of students served by the school food authority pursuant to the grant; and</text></clause> <clause id="HB85202D9DA7A44F8B019675AC42F2CDD"><enum>(iv)</enum><text>how the school food authority used the grant funds.</text></clause></subparagraph>
<subparagraph id="HDE66033AA04D4505AB1C2A0A0897EA73"><enum>(C)</enum><header>Report by Secretary</header><text>Not later than 60 days after the date described in paragraph (7), the Secretary shall submit to Congress a report that includes a summary of the reports received under subparagraph (B) and such information with respect to the pilot program the Secretary determines relevant.</text></subparagraph></paragraph> <paragraph id="H0198B115C43547FC8FB154F0D7CA2D33"><enum>(6)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance and information to assist school food authorities—</text>
<subparagraph id="HE634D0E9716E42559697193B383208A0"><enum>(A)</enum><text display-inline="yes-display-inline">to facilitate the coordination and sharing of information and resources in the Department that may be applicable to the activities described in paragraph (4);</text></subparagraph> <subparagraph id="H700883A656B74835A121ABAAEAC13C9F"><enum>(B)</enum><text>to collect and share information on best practices; and</text></subparagraph>
<subparagraph id="HB7A773BA58234CBBA486C1E8B644577F"><enum>(C)</enum><text>to disseminate research and data on existing farm to school programs and the potential for programs in underserved areas.</text></subparagraph></paragraph> <paragraph id="H83136DF6ECC0415FACC2129978292FA1" commented="no"><enum>(7)</enum><header>Sunset</header><text>The authority to carry out this subsection shall terminate on the date that is 5 years after the date of the enactment of this subsection.</text></paragraph>
<paragraph id="HC0AF305CF68F4BAA87D80F700749E391"><enum>(8)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $10,000,000 for fiscal year 2022, to remain available until the date described in paragraph (7). </text></paragraph> <paragraph id="H7A7C8EF6EE8C499E98DC8BE47D2F0B43"><enum>(9)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="HA2900C88232B4090BC764CD23D38F4F6"><enum>(A)</enum><header>100 percent plant-based food option</header><text display-inline="yes-display-inline">The term <term>100 percent plant-based food option</term> means a breakfast or lunch meal option or component that—</text> <clause id="H0824B1E302EB476F93E07811C980115E"><enum>(i)</enum><text>includes a meat alternate as described in—</text>
<subclause id="H8B2347C0108B496A8C852B4902E64979"><enum>(I)</enum><text>section 210.10 of title 7, Code of Federal Regulations (or successor regulations); or</text></subclause> <subclause id="HE13BF048AF874852BA38AA0C1D6E81BF"><enum>(II)</enum><text display-inline="yes-display-inline">appendix A to part 210 of 7, Code of Federal Regulations (or successor regulations); and</text></subclause></clause>
<clause id="H4FD95869B2574A70A0C84C080A15E464"><enum>(ii)</enum><text>does not contain any animal products or byproducts, such as meat, poultry, fish, dairy, or eggs.</text></clause></subparagraph> <subparagraph id="HEDF4E988F2AC4D05B4C3FCCF38314761"><enum>(B)</enum><header>100 percent plant-based milk option</header><text display-inline="yes-display-inline">The term <term>100 percent plant-based milk option</term> means a beverage, including a 100 percent plant-based dairy alternative, that—</text>
<clause id="HA88911A9364146139B37A8CE44F917A4"><enum>(i)</enum><text>does not contain any animal products or byproducts; and</text></clause> <clause id="H500B6C9F81C5487380621770F13C312D"><enum>(ii)</enum><text>meets the standards for a substitution for fluid milk in accordance with section 9(a)(2)(B)(i).</text></clause></subparagraph>
<subparagraph id="HEF8AA5BF62A24F9883C45E56139D236D"><enum>(C)</enum><header>Eligible school food authority</header><text display-inline="yes-display-inline">The term <term>eligible school food authority</term> means a school food authority for which 50 percent or more of the students served by such school food authority are eligible for free or reduced price lunch under this Act or free or reduced price breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>).</text></subparagraph> <subparagraph id="H7C9E83E3B5FB4E639A8BA05440DD3253"><enum>(D)</enum><header>Socially disadvantaged</header><text>The term <term>socially disadvantaged</term> has the meaning given the term in section 124.103 of title 13, Code of Federal Regulations (or successor regulations). </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
