which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Stop Student Debt Relief Scams Act of 2019 to make technical corrections.</official-title></form><legis-body id="HEDCF228F96CA427C8BCB422076FF0BED" style="OLC"><section id="HCCE9DA06687047BD9C39ABD6FE1F4422" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Student Debt Relief Scams Technical Corrections Act</short-title></quote>.</text></section><section id="H289755C4CB464A55A79394C52BB63E52"><enum>2.</enum><header>Guidance on criminal penalties</header><text display-inline="no-display-inline">The Stop Student Debt Relief Scams Act of 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/116/251">Public Law 116–251</external-xref>) is amended in section 2(b) by striking <quote>The Secretary</quote> and inserting <quote>Not later than July 1, 2021, the Secretary</quote>.</text></section><section id="HBABB54B6AA1B444AB0C66DD493E80A0B"><enum>3.</enum><header>Requirements for third-party data system access</header><subsection id="H7D2285B4DE0F4BDF90E88019BA11C6A0"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Subsection (e) of section 485B of the Higher Education Act of 1965, as added by section 4(3) of the Stop Student Debt Relief Scams Act of 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/116/251">Public Law 116–251</external-xref>), is amended— </text><paragraph id="H5E6DCC2E72744C849F98E4B456DD47AD"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>, at the discretion of the Secretary,</quote> after <quote>may</quote>;</text></paragraph><paragraph id="HC1719A7948884C8F99FFD7A6E7359952"><enum>(2)</enum><text> in paragraph (2)—</text><subparagraph id="HC9EFC4FF8B6B46D99CD0446AC72F20F3"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>means—</quote> and inserting <quote>means either of the following:</quote>;</text></subparagraph><subparagraph id="H9C9672F6A438437D85FD1FA686D4ED02"><enum>(B)</enum><text>in subparagraph (A)—</text><clause id="H74946955739B442C843042841E594C94"><enum>(i)</enum><text>by striking <quote>a guaranty agency</quote> the first place such term appears and inserting <quote>A guaranty agency</quote>; and</text></clause><clause id="H925F343173034323BE125703522B81DF"><enum>(ii)</enum><text>by striking <quote>; or</quote> and inserting a period; and</text></clause></subparagraph><subparagraph id="H022C114E19BB41CE8E6337736DAC9DC6"><enum>(C)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5D06203871874458A7A18C32213B2E9F"><subparagraph id="HB255BF8B799D4A53BE556A86A19BE510"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H29B9C573B67E4C07A43F76537DC102C3"><enum>(i)</enum><text>An attorney, government, agency, or organization described in any of subclauses (I) through (IV) of clause (ii), who or that—</text><subclause id="H56DE79E69D134A6F8C184F3FC761300D" indent="up1"><enum>(I)</enum><text>is providing financial or student loan repayment services or counseling to a student, borrower, or parent; </text></subclause><subclause indent="up1" id="H63DF21DE8BEB462E9A8141250DCDDB08"><enum>(II)</enum><text>has not engaged in unfair, deceptive, or abusive practices (including an entity that is owned or operated by a person or entity that engaged in such practices), as determined by the Secretary; </text></subclause><subclause indent="up1" id="H328489A5B1DF4CC9B14A1EADBD113E8E"><enum>(III)</enum><text>accesses the system only through a separate point of entry; and</text></subclause><subclause indent="up1" id="HE2A4E9643AB4433CBFD808923EDD9C0C"><enum>(IV)</enum><text>has consent from the relevant student, borrower, or parent to access the system. </text></subclause></clause><clause id="HF6257ADCCB2948BDADEB136E4ACBE36B" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HA440629CA14048F48DCA1F65A6960912"><enum>(I)</enum><text>A licensed attorney representing a student, borrower, or parent. </text></subclause><subclause indent="up1" id="HBC0D409883D84607966A0D7171C8EC6D"><enum>(II)</enum><text>A Federal, State, local, or Tribal government or agency.</text></subclause><subclause indent="up1" id="H967EEBD9053440089971DC3FFCD7A3D9"><enum>(III)</enum><text>A nonprofit organization. </text></subclause><subclause id="HD5DFBB3BD68E4AC4841CA45D8B3125B3" indent="up1"><enum>(IV)</enum><text>A for-profit organization—</text><item id="H76829546AA6D4A4D9051CD39ACD3AF98"><enum>(aa)</enum><text>authorized as a public benefit corporation to provide a public benefit of objective and accurate financial or student loan repayment services or counseling;</text></item><item id="HF158AEDFC71E4932B27AAC55E033797E"><enum>(bb)</enum><text>that is approved by the Secretary in accordance with paragraphs (3) and (4); and </text></item><item id="H784C127087AF4C1D863B19AFA2CCF490"><enum>(cc)</enum><text>that does not charge the student, borrower, or parent a fee or any other monetary charge for financial or student loan repayment services or counseling or any other services at any point.</text></item></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7E966DB3AEEB4197B926E4F51CBD1F3D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H87C8D041642143BBB4EC14BFB39E61C0"><paragraph id="HE5D1345B32014C73935D6F44D508F173"><enum>(3)</enum><header>Discretion to approve applications</header><text>Approval of applications from authorized persons or entities for third-party data access shall be at the discretion of the Secretary after consideration of such applications as the Secretary may prescribe. Authorized access shall be for periods as the Secretary may determine and may be terminated at the discretion of the Secretary.</text></paragraph><paragraph id="HE1017E01B883404A8B852793C37B6D21"><enum>(4)</enum><header>Consideration for for-profit organization approval to access the system</header><text>In considering applications for approval for third-party data system access in accordance with this subsection by a for-profit organization described in paragraph (2)(B)(ii)(IV), the Secretary shall—</text><subparagraph id="HE0B0B7BC4E6E4B21821EB0CA2B89FE25"><enum>(A)</enum><text>consider how the no fee service or counseling to the student, borrower, or parent is funded and determine whether the organization provides financial or student loan repayment services or counseling in the best interest of students, borrowers, or parents, in consultation with the Private Education Loan Ombudsman of the Consumer Financial Protection Bureau (designated pursuant to section 1035 of the Consumer Financial Protection Act of 2010 Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5535">12 U.S.C. 5535</external-xref>)); and</text></subparagraph><subparagraph id="H990CE1DCDDC745DCAEB52133CF8A4A22"><enum>(B)</enum><text>respond in writing, which may include electronic communication, to such organization regarding such application not later than 180 days after the date of submission of the application.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC5378F86383C4492B083EAF2C2D484CD"><enum>(b)</enum><header>Effective date</header><text>The amendments made in this section shall take effect as if included in the Stop Student Debt Relief Scams Act of 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/116/251">Public Law 116–251</external-xref>) and in accordance with section 6 of such Act. </text></subsection></section></legis-body></bill>
