R. 4102</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210623">June 23, 2021</action-date><action-desc><sponsor name-id="S001204">Mr. San Nicolas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HSM00">Small Business</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for contracting with Native CHamoru Organizations, and for other purposes.</official-title></form><legis-body id="H9CCF4CEC928D4DF7B32625519BBB16FE" style="OLC"><section id="HC9290EAE65BA46798D88E3A46E0335F6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native CHamoru Equity Act</short-title></quote>.</text></section><section id="HA849AD0313264DAF86F8849FE729B0B1"><enum>2.</enum><header>CHamoru Registry Program</header><text display-inline="no-display-inline">The Organic Act of Guam (<external-xref legal-doc="usc" parsable-cite="usc/48/1421">48 U.S.C. 1421 et seq.</external-xref>) is amended by inserting after section 3 the following:</text><quoted-block style="traditional" id="HD18BFA2A22414DB1814309168337E134" display-inline="no-display-inline"><section id="HB28F200CD1FA47E7ADD98B4C09B3C8DE"><enum>4.</enum><subsection commented="no" display-inline="yes-display-inline" id="HEA3BE315E9D44DCB8F32150DF44A9139"><enum>(a)</enum><text display-inline="yes-display-inline">There is established under the Office of the Governor the <quote>CHamoru Registry Program</quote>, which shall keep a database to serve as a genealogy bank to verify Native CHamoru ancestry requirements. The Governor of Guam shall include in the database the name of any individual who submits to the Governor of Guam a request to be included and a copy of the birth certificate of that individual and birth certificates of direct ancestors that demonstrate that one or more of the individual’s direct ancestors resided on Guam before August 1, 1950. </text></subsection><subsection id="H952B8F018743437C8531985CD4CCA9C9"><enum>(b)</enum><text display-inline="yes-display-inline">Not less than once every 3 years, the Office of Public Auditor shall audit the database established by subsection (a) to ensure the accuracy of the database and that the database is in compliance with the requirements of subsection (a).</text></subsection><subsection id="H2E924069497545A7AD2571513A49659A"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H7034AEA6CCDB479892D805F296622352"><enum>(1)</enum><text display-inline="yes-display-inline">In this section, the term <term>Native CHamoru</term> means an individual who can document that one or more of the individual’s direct ancestors resided on Guam before August 1, 1950.</text></paragraph><paragraph id="HE5D790D4F7EC43BEBC3406DCA94B7062" indent="up1"><enum>(2)</enum><text>No residency or blood quantum amount shall be required for an individual to qualify as a <quote>Native CHamoru</quote> under paragraph (1).</text></paragraph></subsection><subsection id="H12F0FC94ED114041A2E01EDBF4A14B98"><enum>(d)</enum><text display-inline="yes-display-inline">The Superior Court of Guam shall have original jurisdiction over all judicial proceedings with respect to the CHamoru Registry Program and the database established by subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H59BEEC46C6B949F188610652F5910CF5"><enum>3.</enum><header>Small business contracting for Native CHamoru Organizations</header><subsection id="H9DBFCAF4256D477895D271263F831678"><enum>(a)</enum><header>Native CHamoru Organization defined</header><text>Section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HFED2AD826C444092AD2D93423873EAA6" display-inline="no-display-inline"><subsection id="H6E6FB125074A4874A84FCD90DB14CBF1"><enum>(gg)</enum><header>Native CHamoru Organization</header><paragraph id="HFE1215BCED2742169DD75F4C723ED2C4"><enum>(1)</enum><header>In general</header><text>In this Act, the term <term>Native CHamoru Organization</term> means any organization—</text><subparagraph id="H98F7A9BC09314BCBA3EC9314DC33369B"><enum>(A)</enum><text display-inline="yes-display-inline">that is a nonprofit corporation that has filed articles of incorporation with the director (or the designee thereof) of the Guam Department of Revenue and Taxation, or any successor agency;</text></subparagraph><subparagraph id="HC41A0870D26941B8A0266A541047ED55"><enum>(B)</enum><text display-inline="yes-display-inline">that is controlled by Native CHamorus; and</text></subparagraph><subparagraph id="H9116B9BE4A474779B11D264C457CCC90"><enum>(C)</enum><text display-inline="yes-display-inline">whose business activities will principally benefit Native CHamorus.</text></subparagraph></paragraph><paragraph id="HB67AE1A770864B60AD83028FF3219744"><enum>(2)</enum><header>Rule of construction</header><text>The Administrator shall, to the extent practicable, determine whether an organization is a Native CHamoru Organization in the same manner as such determination is made under section 8(a)(15) with respect to Native Hawaiian Organizations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H32B4E94BDA6E4F109916A040F95BB711"><enum>(b)</enum><header>Socially and economically disadvantaged small business concern</header><text>Section 8(a)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)(4)</external-xref>) is amended—</text><paragraph id="HA5D3125034F74145A33D09ED889478AB"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H425D5F04B87F4260AE6319004AF5302B"><enum>(A)</enum><text>in clause (i)—</text><clause id="HC27DE14436B14B4DAE189E784339178F"><enum>(i)</enum><text>in subclause (II), by striking <quote>or</quote> at the end; and</text></clause><clause id="H57CAA5F883704994B24C2AE4235C105C"><enum>(ii)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H797D1EC744ED4E57B30796EABED30AD9"><subclause id="H95E885B55962465E9F03D6C8FD776702" indent="up2"><enum>(IV)</enum><text>an economically disadvantaged Native CHamoru Organization, or</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H1F30FFE0CA1D460C94DFF6A9C6F3830B"><enum>(B)</enum><text>in clause (ii)—</text><clause id="H98F69061BB004B098BF5EFC2E42E6811"><enum>(i)</enum><text>in subclause (II), by striking <quote>or</quote> at the end;</text></clause><clause id="H9ED3618F027B452EAF58C95215BFA950"><enum>(ii)</enum><text>in subclause (III), by striking the period at the end and inserting <quote>, or</quote>; and</text></clause><clause id="H2D5438CF45F742589BF5E052378F46C9"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following new subclause:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H6E583575FECF420EBDBAB88B57E5FEC9"><subclause id="H829F0D4F814F4106A6CC9047447FF223" indent="up2"><enum>(IV)</enum><text>an economically disadvantaged Native CHamoru Organization.</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H13DE4759B528447E9043BDBEBEAE6B95"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="H334E29F5E8184AF897F6081CE118589A"><enum>(A)</enum><text>in clause (ii), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H3FF96D8092F44B3988BB9A7FEAF28F2C"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>, or</quote>; and</text></subparagraph><subparagraph id="H8923836FA826430BB02C260B744F1597"><enum>(C)</enum><text>by adding at the end the following new clause:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H851E861B90844F26BDB60B34E8EFA8D5"><clause id="HB8E53D1BB8724F2FA77979BF4ED57F20" indent="up2"><enum>(iv)</enum><text>Native CHamoru Organizations described in subparagraph (A)(i)(IV) or subparagraph (A)(ii)(IV).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HE70288D72D8D4434B766E340678A07B5"><enum>(c)</enum><header>HUBZone small business concern</header><text>Section 31(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/15/657a">15 U.S.C. 657a</external-xref> note) is amended—</text><paragraph id="H4C6BE08090354BBD8B52FC5B1C7141A7"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (E)(ii), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HAEC5672221224AEFBD92E41573801566"><enum>(2)</enum><text>in subparagraph (F)(iii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HF8898F29B0F146F5A5BDA4581091D402"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HA3100A39ADEC43EC89C8DFA4A1EC03A8" display-inline="no-display-inline"><subparagraph id="HA9B44804CBDE4B7F992059C1075C3672"><enum>(G)</enum><text display-inline="yes-display-inline">a small business concern—</text><clause id="H67A70AEDEB1F401C9E677E85F8B9B526"><enum>(i)</enum><text display-inline="yes-display-inline">that is wholly owned by one or more Native CHamoru Organizations, or by a corporation that is wholly owned by one or more Native CHamoru Organizations; or</text></clause><clause id="H9A0F0AA21EB44A59929222D815F54733"><enum>(ii)</enum><text display-inline="yes-display-inline">that is owned in part by one or more Native CHamoru Organizations, or by a corporation that is wholly owned by one or more Native CHamoru Organizations, if all other owners are either United States citizens or small business concerns.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF58CCACF81CC471CBDD847363192EE19"><enum>(d)</enum><header>Findings</header><text display-inline="yes-display-inline">Section 2(f)(1)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631(f)(1)(C)</external-xref>) is amended by inserting <quote>Native CHamoru Organizations,</quote> after <quote>Native Hawaiian Organizations,</quote>.</text></subsection></section></legis-body></bill>
