R. 4082</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210623">June 23, 2021</action-date><action-desc><sponsor name-id="C001114">Mr. Curtis</sponsor> (for himself and <cosponsor name-id="O000171">Mr. O'Halleran</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, <committee-name committee-id="HAS00">Armed Services</committee-name>, and <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent catastrophic wildland fires by establishing a commission to study and recommend wildland fire prevention, mitigation, suppression, management, and rehabilitation policies for the Federal Government, and for other purposes.</official-title></form><legis-body id="HA81847B8C8FF463A9DBEF42715C67850" style="OLC"><section section-type="section-one" id="H0B2AB35A02A246CCBFC9C6CDD32A6958"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildland Fire Mitigation and Management Commission Act of 2021</short-title></quote>.</text></section><section id="H6BA5343891CB4A1DB0A6BD782F4A0B16"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H6BFA82ADFE224A2C95211092A66CE6BD"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="HCF1449C466A04AE297F06ECF9B307DB8"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph><subparagraph id="H6EA8B626C6604081B597326CDB37F672"><enum>(B)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></subparagraph><subparagraph id="H66D07C66CA8144F3ACBDF8D313BD2973"><enum>(C)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph id="HE9075B1F895B4C2FB1D07D1570EB5353"><enum>(D)</enum><text>the Committee on Appropriations of the Senate; </text></subparagraph><subparagraph id="H6848C9DC0D13468C99E2668FB69794E4"><enum>(E)</enum><text>the Committee on Natural Resources of the House of Representatives;</text></subparagraph><subparagraph id="H5423F74F081640A68DAE6EAF48F73E59"><enum>(F)</enum><text>the Committee on Agriculture of the House of Representatives;</text></subparagraph><subparagraph id="H9ECCC6F5B87E4D4F80F3695BC1443BD8"><enum>(G)</enum><text>the Committee on Homeland Security of the House of Representatives;</text></subparagraph><subparagraph id="HB53F5ABD17A34FBD9135ABA3AB6734CE"><enum>(H)</enum><text>the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="H872F60C5E11D46468E7C5472AC7F4CE2"><enum>(I)</enum><text>the Committee on Ways and Means of the House of Representatives. </text></subparagraph></paragraph><paragraph id="HB6A3A319073D4E66A6CB41B30C790CFB"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the commission established under section 3(a).</text></paragraph><paragraph id="H6F532601579C441FA6E463A19EF8ADC9"><enum>(3)</enum><header>High-risk Indian tribal government</header><text>The term <term>high-risk Indian tribal government</term> means an Indian tribal government, during not fewer than 4 of the 5 years preceding the date of enactment of this Act— </text><subparagraph id="HE5B9D1850FF440A9995250983515A709"><enum>(A)</enum><text>that received fire management assistance under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>); or </text></subparagraph><subparagraph id="H149E63D12E4A4C3097FCCD55D4E90DDF"><enum>(B)</enum><text>land of which included an area for which the President declared a major disaster for fire in accordance with section 401 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>). </text></subparagraph></paragraph><paragraph id="H85DC01434A2E4BED8F4340F00538BBFC"><enum>(4)</enum><header>High-risk State</header><text>The term <term>high-risk State</term> means a State that, during not fewer than 4 of the 5 years preceding the date of enactment of this Act—</text><subparagraph id="H7D372CC7B424472F85B47B22F01532C5"><enum>(A)</enum><text>received fire management assistance under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>); or</text></subparagraph><subparagraph id="H5FBB1FF1B67D48B683BD3F4356E5E169"><enum>(B)</enum><text>included an area for which the President declared a major disaster for fire in accordance with section 401 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text></subparagraph></paragraph><paragraph id="H80F123D69EFF45DE87BDA47B0D4D8368"><enum>(5)</enum><header>Indian tribal government</header><text>The term <term>Indian tribal government</term> has the meaning given the term in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></paragraph><paragraph id="HEEE470B5AB0F467C9F6E2EF126812FD2"><enum>(6)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means—</text><subparagraph id="H442A554945BF4308BEF235C318ECA126"><enum>(A)</enum><text>the Secretary of the Interior; </text></subparagraph><subparagraph id="H31CF6870505546168CFCEE3A34AB7D25"><enum>(B)</enum><text>the Secretary of Agriculture; and </text></subparagraph><subparagraph id="HC676B0DC7C4C4148B4542FC4BA21BC53"><enum>(C)</enum><text>the Secretary of Homeland Security, acting through the Administrator of the Federal Emergency Management Agency.</text></subparagraph></paragraph><paragraph id="H02B233082282453AA4095C74E06679B3"><enum>(7)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></paragraph><paragraph commented="no" id="H6ED3D709EB98499DA245B4FA143EDE9F"><enum>(8)</enum><header>Wildland-urban interface</header><text>The term <term>wildland-urban interface</term> has the meaning given the term in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>). </text></paragraph></section><section id="HA872995A4759430B8CC36ADCA6A9F40A"><enum>3.</enum><header>Establishment of Commission</header><subsection id="H44C633B903594C15B91196C0935723F5"><enum>(a)</enum><header>Establishment</header><text>Not later than 30 days after the date of enactment of this Act, the Secretaries shall jointly establish a commission to study and make recommendations to improve Federal policies relating to—</text><paragraph id="H8E36B3B2220B4527B4960CC6B1F8A54E"><enum>(1)</enum><text>the prevention, mitigation, suppression, and management of wildland fires in the United States; and </text></paragraph><paragraph id="H27CEC249F2B54578B488979AF64ECAE4"><enum>(2)</enum><text>the rehabilitation of land in the United States devastated by wildland fires.</text></paragraph></subsection><subsection id="H80EF8401F0194D60A9B70318E00EBA85"><enum>(b)</enum><header>Membership</header><paragraph id="H4AC4D3C6F584480299F4233C323FA92F"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of—</text><subparagraph id="H8EBCE38C298B4B98BADB11DE0FD9BDDF"><enum>(A)</enum><text>each of the Secretaries (or designees), who shall jointly serve as the co-chairpersons of the Commission;</text></subparagraph><subparagraph id="HE35D5638EE9B48428C6E1B6F12C1F7EA"><enum>(B)</enum><text>not greater than 8 representatives of Federal departments or agencies, to be appointed by the Secretaries, including—</text><clause id="HB1E7732FB3644EC38A47512998E824EB"><enum>(i)</enum><text>not fewer than 1 representative from each of—</text><subclause id="H66AF0D5430BF4428B7696C9A01190C53"><enum>(I)</enum><text>the Bureau of Land Management;</text></subclause><subclause id="HD6CEC0D2A6AF4A73841E5EB2B9D9F730"><enum>(II)</enum><text>the National Park Service;</text></subclause><subclause id="H9379E3446EB049C1AA154EAB66613CCA"><enum>(III)</enum><text>the Bureau of Indian Affairs; and</text></subclause><subclause id="HF4FDAAB357984BDD9E838E0D8611DC7D"><enum>(IV)</enum><text>the Forest Service; </text></subclause></clause><clause id="H07FEA7CA367B4F008D48059428030328"><enum>(ii)</enum><text>a representative of or liaison to the Mitigation Framework Leadership Group of the Federal Emergency Management Agency; </text></clause><clause id="H58D64DFFF3914E3883ADA7B2AE67269B"><enum>(iii)</enum><text>a representative to the National Interagency Coordination Center, which is part of the National Wildfire Coordination Group;</text></clause><clause id="HC471C037F1824E5FA1EAA404893B4E55"><enum>(iv)</enum><text>a representative from 1 of the coordinating agencies of the Recovery Support Function Leadership Group; and</text></clause><clause id="H7DEB1838639A48DB97099C4613678CF5"><enum>(v)</enum><text>if the Secretaries determine it to be appropriate, a representative of any other Federal department or agency, such as the Department of Energy, the Environmental Protection Agency, or the Department of Defense; and</text></clause></subparagraph><subparagraph id="H19C750EB71184056833E7257D2137654"><enum>(C)</enum><text>not greater than 17 non-Federal stakeholders with expertise in wildland fire preparedness, mitigation, suppression, or management, who collectively have a combination of backgrounds, experiences, and viewpoints and are representative of rural, urban, and suburban areas, to be appointed by the Secretaries, including— </text><clause id="HC2AFE378EFBC4320A42D44F89699C95A"><enum>(i)</enum><text>not fewer than 1 State hazard mitigation officer of a high-risk State (or a designee);</text></clause><clause id="H2C765476A5AA450DA0C8EAAF0D3E5F5E"><enum>(ii)</enum><text>with preference given to representatives from high-risk States and high-risk Indian tribal governments, not fewer than 1 representative from each of—</text><subclause id="H725CD8859CA94DD388C4076C1028BF2F"><enum>(I)</enum><text>a State department of natural resources, forestry, or agriculture or a similar State agency;</text></subclause><subclause id="H13905D5434A14AB8B4CB4810C225133C"><enum>(II)</enum><text>a State department of energy or a similar State agency;</text></subclause><subclause id="H762B50B53AAA40E395BE710550900DF3"><enum>(III)</enum><text>a county government, with preference given to counties at least a portion of which is in the wildland-urban interface; and</text></subclause><subclause id="H5FA23A79871242569BC792BEC3440D54"><enum>(IV)</enum><text>a municipal government, with preference given to municipalities at least a portion of which is in the wildland-urban interface;</text></subclause></clause><clause id="HB9FD5CAFBA07404C891DF81B9EECB4B5"><enum>(iii)</enum><text>with preference given to representatives from high-risk States and high-risk Indian tribal governments, not fewer than 1 representative from each of— </text><subclause id="H371F5E8AA649489886B6E68221B3D094"><enum>(I)</enum><text>the public utility industry;</text></subclause><subclause id="H8E1F500CC83640A3A11BB69780CCF5E2" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text>the property development industry; and</text></subclause><subclause id="H1E407B9063684011A10768D7CF564AE6"><enum>(III)</enum><text>Indian tribal governments; and </text></subclause></clause><clause id="HB75AFC1220174B3F9736237B4233927F"><enum>(iv)</enum><text>any other appropriate non-Federal stakeholders, which may include the private sector, with preference given to non-Federal stakeholders from high-risk States and high-risk Indian tribal governments. </text></clause></subparagraph></paragraph><paragraph id="HFE23AD36EE5A4BD49320A88EE717B36E"><enum>(2)</enum><header>State limitation</header><text>Each member of the Commission appointed under clauses (i) and (ii) of paragraph (1)(C) shall represent a different State.</text></paragraph><paragraph commented="no" id="HEC86DA6FE7BC43A9813D234FF49825E3"><enum>(3)</enum><header>Date</header><text>The appointments of the members of the Commission shall be made not later than 60 days after the date of enactment of this Act.</text></paragraph></subsection><subsection commented="no" id="HD5675C313F714A65BDF13A9920616DD3"><enum>(c)</enum><header>Period of appointment; vacancies</header><paragraph commented="no" id="HBF0EF0BDEA0147068A3E269D30D4F6C9"><enum>(1)</enum><header>In general</header><text>A member of the Commission shall be appointed for the life of the Commission.</text></paragraph><paragraph commented="no" id="HE84181FD4B064907B533D0F83C0E4C39"><enum>(2)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text><subparagraph commented="no" id="H3C1C954D09F047AC96C605739131132E"><enum>(A)</enum><text>shall not affect the powers of the Commission; and</text></subparagraph><subparagraph commented="no" id="HE90AD27881944C2A8F52EF2F36C14377"><enum>(B)</enum><text>shall be filled in the same manner as the original appointment.</text></subparagraph></paragraph></subsection><subsection id="HA5CBA54629EC444A8904613B0AF73B60"><enum>(d)</enum><header>Meetings</header><paragraph commented="no" id="H3357B36595964555A19604ABADC1F142"><enum>(1)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed, the Commission shall hold the first meeting of the Commission.</text></paragraph><paragraph id="HB598E98A139B4F94A92BA24548A0B7E0"><enum>(2)</enum><header>Frequency</header><text>The Commission shall meet not less frequently than once every 30 days.</text></paragraph><paragraph id="H0E0F25A49A014985AD4DBD801282EE50"><enum>(3)</enum><header>Type</header><text>The Commission may hold meetings, and a member of the Commission may participate in a meeting, remotely through teleconference, video conference, or similar means.</text></paragraph><paragraph commented="no" id="H7B90940A79794BE8B035FFD0EDC5463C"><enum>(4)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text></paragraph></subsection></section><section id="HDC853271060246F19ED6D14A7F906183"><enum>4.</enum><header>Duties of Commission</header><subsection id="H872A8D348F934BC5A5B93EBD98231E7B"><enum>(a)</enum><header>Report on recommendations To mitigate and manage wildland fires</header><paragraph id="H23D9339246124AE3810386578AF738B6"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the first meeting of the Commission, the Commission shall submit to the appropriate committees of Congress a report describing recommendations to prevent, mitigate, suppress, and manage wildland fires, including—</text><subparagraph id="HC48C7ECE6FD04F73802E07036F7208DB"><enum>(A)</enum><text>policy recommendations, including recommendations—</text><clause id="H94F7D510DAA54053AFA140847B15FE40"><enum>(i)</enum><text>to maximize the protection of human life, community water supplies, homes, and other essential structures, which may include recommendations to expand the use of initial attack strategies; </text></clause><clause id="H2A7A7C34AEB543CEB9125868C5E8E4BA"><enum>(ii)</enum><text>to facilitate efficient short- and long-term forest management in residential and nonresidential at-risk areas;</text></clause><clause id="H1D86C11EA8AE47B79843F5E81ABA8D3F"><enum>(iii)</enum><text>to manage the wildland-urban interface; </text></clause><clause id="H5687EC3E73194B6A8B2E64E2B5F4BF44"><enum>(iv)</enum><text>to manage utility corridors; and</text></clause><clause id="H9E535B00083B4D468FF75778A078B88D"><enum>(v)</enum><text>to rehabilitate land devastated by wildland fire;</text></clause></subparagraph><subparagraph id="H3FCDDAD9130344BA808E507B4CDD81E4"><enum>(B)</enum><text>policy recommendations described in subparagraph (A) with respect to any recommendations for categorical exclusions from the requirement to prepare an environmental impact statement or analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="HE0CBACF0BD6541258FBB40B767CB3455"><enum>(C)</enum><text>policy recommendations for modernizing and expanding the use of technology, including satellite technology, to prevent, mitigate, suppress, and manage wildland fires, including any recommendations with respect to—</text><clause id="HA5F978B16DE74B53922377120C6099DB"><enum>(i)</enum><text>the implementation of section 1114 of the John D. Dingell, Jr. Conservation, Management, and Recreation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1748b-1">43 U.S.C. 1748b–1</external-xref>); or </text></clause><clause id="HC97D0746EC7E4F37944B8B9DBE3BD0F9"><enum>(ii)</enum><text>improving early wildland fire detection;</text></clause></subparagraph><subparagraph id="HC00A2E291C9B4308B608CE9E4D629DBF"><enum>(D)</enum><text>an assessment of Federal spending on wildland fire-related disaster management, including—</text><clause id="H717A427BDF5F4D8492E24C4E01533405"><enum>(i)</enum><text>a description and assessment of Federal grant programs for States and units of local government for pre- and post-wildland fire disaster mitigation and recovery, including—</text><subclause id="H05E39AFACB5F44C58921979D5161F537"><enum>(I)</enum><text>the amount of funding provided under each program;</text></subclause><subclause id="HFFDA478A443D4EE9845649AE056D901F"><enum>(II)</enum><text>the effectiveness of each program with respect to long-term forest management and maintenance; and</text></subclause><subclause id="H03F21732D4B64478872248E336961225"><enum>(III)</enum><text>recommendations to improve the effectiveness of each program, including with respect to—</text><item id="H3AABB6A82295452B9B2B596E3F0CD371"><enum>(aa)</enum><text>the conditions on the use of funds received under the program; and </text></item><item id="HDE5F6A17387041ABA5AEA2E777797B3F"><enum>(bb)</enum><text>the extent to which additional funds are necessary for the program; </text></item></subclause></clause><clause id="HE6C0FE322EE34DFCA055151F5835587B"><enum>(ii)</enum><text>an evaluation, including recommendations to improve the effectiveness in mitigating wildland fires, of—</text><subclause id="H5C7555B4ADAD447DA40FB8EB60228A09"><enum>(I)</enum><text>the Building Resilient Infrastructure and Communities program under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>);</text></subclause><subclause id="H0549946DFA2443FCBE54444D97331279" commented="no"><enum>(II)</enum><text>the Pre-Disaster Mitigation program under that section (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>);</text></subclause><subclause id="HB089452A6631419C819FACE271C02A8F" commented="no"><enum>(III)</enum><text>the Hazard Mitigation Grant Program under section 404 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>); and</text></subclause><subclause id="H64C9C094EE81474AA736116C7E7D068E" commented="no"><enum>(IV)</enum><text>Hazard Mitigation Grant Program post-fire assistance under sections 404 and 420 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>, 5187);</text></subclause></clause><clause id="H813163F73A2C422A97A077E7AC6D8817"><enum>(iii)</enum><text>an assessment of the definition of <quote>small impoverished community</quote> under section 203(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133(a)</external-xref>), specifically—</text><subclause id="H187B30C9012A4E5BB8998ADFAE2341D1"><enum>(I)</enum><text>the exclusion of the percentage of land owned by an entity other than a State or unit of local government; and </text></subclause><subclause id="HDC9487A206F54AAEA016E54C67BD231A"><enum>(II)</enum><text>any related economic impact of that exclusion; and</text></subclause></clause><clause id="HD4F7EA89E12141668C9C3ECBFBB1AE49"><enum>(iv)</enum><text>recommendations for Federal budgeting for wildland fires;</text></clause></subparagraph><subparagraph id="H7FF5BC58086F4D288716995212854A98"><enum>(E)</enum><text>any recommendations for matters under subparagraph (A), (B), (C), or (D) specific to—</text><clause id="H3675BF753BE6409F82AD604D99973154"><enum>(i)</enum><text>forest type, vegetation type, or forest and vegetation type; or</text></clause><clause id="HFCB295B5141742229DF194CA8EF842DC"><enum>(ii)</enum><text>State land, Tribal land, or private land; and</text></clause></subparagraph><subparagraph id="H72D4AD97D46C4E0987E5D10F0EAADA25"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="HE2117EBB45A14646A32FFB2B1E079CDF"><enum>(i)</enum><text>a review of the national strategy described in the report entitled <quote>The National Strategy: The Final Phase in the Development of the National Cohesive Wildland Fire Management Strategy</quote> and dated April 2014; and</text></clause><clause id="H224FDF68F88C4CCE9BDAE08E77EDBFBD" indent="up1"><enum>(ii)</enum><text>any recommendations for changes to that national strategy to improve its effectiveness. </text></clause></subparagraph></paragraph><paragraph id="H59C7E2C0E94642EB8365187189D670ED"><enum>(2)</enum><header>Specific policy recommendations</header><text>To the maximum extent practicable, the report described in paragraph (1) shall include detailed short- and long-term policy recommendations, including any recommendations for Federal legislation.</text></paragraph><paragraph id="H426AA88FDFB548BAAB4EFD70C66700B9"><enum>(3)</enum><header>Interim reports</header><text>Before the submission of the report under paragraph (1), on approval of all members of the Commission, the Commission may submit to the appropriate committees of Congress 1 or more interim reports, as the Commission determines to be appropriate, relating to any matters described in paragraph (1).</text></paragraph></subsection><subsection id="H4D4BDD81F8D04632856037780391AC1E"><enum>(b)</enum><header>Report on aerial wildland firefighting equipment strategy and inventory assessment</header><paragraph id="HBD38D2F4C5FC47588B4D765BA0F1DBB1"><enum>(1)</enum><header>Submission of inventory to the Commission</header><text>Not later than 45 days after the date on which the Commission holds the first meeting of the Commission, the Secretary of Defense and the heads of other relevant Federal departments and agencies shall submit to the Commission an inventory of surplus cargo and passenger aircraft and excess common-use aircraft parts that may be used for wildland firefighting purposes, excluding any aircraft or aircraft parts that are—</text><subparagraph id="H6483B4AB584C4D4986DBD46C0083033C"><enum>(A)</enum><text>reasonably anticipated to be necessary for military operations, readiness, or fleet management in the future; or </text></subparagraph><subparagraph id="HA6A119E8C373402CB93F8A942B6D15AB"><enum>(B)</enum><text>already obligated for purposes other than fighting wildland fires. </text></subparagraph></paragraph><paragraph id="H9EB60A8A601A4F2AB02BFD1CA9CB531F"><enum>(2)</enum><header>Submission of report to Congress</header><text>Not later than 90 days after the date on which the Commission receives the inventory described in paragraph (1), the Commission shall submit to the appropriate committees of Congress a report outlining a strategy to meet aerial firefighting equipment needs through 2030 in the most cost-effective manner, including—</text><subparagraph id="H4876955D758747F19E502A6A077B3F4D"><enum>(A)</enum><text>an assessment of the expected number of aircraft and aircraft parts needed to fight wildland fires through 2030;</text></subparagraph><subparagraph id="HCEFDFC4F14DA40A389C46E726CF60958"><enum>(B)</enum><text>an assessment of existing authorities of the Secretary of Defense and the heads of other relevant Federal departments and agencies to provide or sell surplus aircraft or aircraft parts to Federal, State, or local authorities for wildland firefighting use, including—</text><clause id="H3937DA9E8B7C41CCA75F9201202AD679"><enum>(i)</enum><text>a description of the current use of each existing authority; and </text></clause><clause id="H1869FEAB45DD4AFB9268D3C5497E4B12"><enum>(ii)</enum><text>a description of any additional authorities that are needed for the Secretary of Defense and the heads of other relevant Federal departments and agencies to provide or sell surplus aircraft or aircraft parts to Federal, State, or local authorities for wildland firefighting use; and</text></clause></subparagraph><subparagraph id="HE994644824AC406A93239B8C16CFABEC"><enum>(C)</enum><text>recommendations to ensure the availability of aircraft and aircraft parts that the Commission expects will be necessary to fight wildland fires through 2030 in the most cost-effective manner. </text></subparagraph></paragraph><paragraph id="H4A4AAAB7F2FD4E1DBDED0CF7E05792BF"><enum>(3)</enum><header>Considerations for accessing aircraft and aircraft parts</header><text>In developing the strategy in the report required under paragraph (2) and the recommendations under paragraph (2)(C), the Commission shall consider all private and public sector options for accessing necessary aircraft and aircraft parts, including procurement, contracting, retrofitting, and public-private partnerships. </text></paragraph><paragraph id="HACA3B746A45A4EB0A3C77D0508B1D744"><enum>(4)</enum><header>Unclassified report</header><text>The inventory and report submitted under paragraphs (1) and (2), respectively—</text><subparagraph id="H33EDE4CC19AF4067BDAE5E0282899C58"><enum>(A)</enum><text>shall be unclassified; but</text></subparagraph><subparagraph id="H20A52CEC103645CC9DA8CB5607F5C52F"><enum>(B)</enum><text>may include a classified annex.</text></subparagraph></paragraph></subsection><subsection id="H4837ACAFA24548CABBC7CB57414B51BD"><enum>(c)</enum><header>Majority requirement</header><text>Not less than <fraction>2/3</fraction> of the members of the Commission shall approve the recommendations contained in each report submitted under subsection (a) or (b)(2).</text></subsection></section><section commented="no" id="H40EF4045C1C54F4FA558F8A7B10DC89A"><enum>5.</enum><header>Powers of Commission</header><subsection commented="no" id="H294B237E2BC34CC2977DD39496149DA0"><enum>(a)</enum><header>Hearings</header><text>The Commission may hold such hearings, sit and act at such times and places, take such testimony, and receive such evidence as the Commission considers advisable to carry out this Act.</text></subsection><subsection commented="no" id="H85B96260E0584AD99045850F7BA27173"><enum>(b)</enum><header>Information from Federal agencies</header><paragraph commented="no" id="H85D3DBE94B3746A6AC41D047998351C7"><enum>(1)</enum><header>In general</header><text>The Commission may secure directly from a Federal department or agency such information as the Commission considers necessary to carry out this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA3146246F2B7419AB7D5825C0707516C"><enum>(2)</enum><header>Furnishing information</header><text>On request of the Chairpersons of the Commission, the head of the department or agency shall furnish the information to the Commission.</text></paragraph></subsection><subsection commented="no" id="H2329816965954AAD932AFCE4410BDE5C"><enum>(c)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the Federal Government.</text></subsection><subsection commented="no" id="H78C20CCB726D44299EB094B63190A6EC"><enum>(d)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of such gifts or donations of services or property as the Commission considers necessary to carry out this Act.</text></subsection></section><section commented="no" id="HA746524BBB754D1E9CE96DC3C243A458"><enum>6.</enum><header>Commission personnel matters</header><subsection commented="no" id="H8FF074C8845A47608C232F945E3D58DB"><enum>(a)</enum><header>No compensation</header><text>A member of the Commission shall serve without compensation.</text></subsection><subsection commented="no" id="H306A1B8FF16F4C2C8F3C761DC5CC39FB"><enum>(b)</enum><header>Travel expenses</header><text>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Commission.</text></subsection><subsection commented="no" id="HB28D3A54FA2F464FA8D5C50611174A9B"><enum>(c)</enum><header>Staff</header><paragraph commented="no" id="HF706376CE1DE40B3B8A73F33818DF8C1"><enum>(1)</enum><header>In general</header><text>The Chairpersons of the Commission may, without regard to the civil service laws (including regulations), appoint and terminate an executive director and such other additional personnel as may be necessary to enable the Commission to perform its duties, except that the employment of an executive director shall be subject to confirmation by the Commission.</text></paragraph><paragraph commented="no" id="H50589ACC9E3A4E629B0846C0AF157E65"><enum>(2)</enum><header>Compensation</header><text>The Chairpersons of the Commission may fix the compensation of the executive director and other personnel without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the executive director and other personnel may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title.</text></paragraph></subsection><subsection commented="no" id="H7204E024B26F4826A427A3DFBC78B155"><enum>(d)</enum><header>Detail of government employees</header><text>A Federal Government employee may be detailed to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></subsection><subsection commented="no" id="HA7062BBCDF254370B8E9CE1CB8974D49"><enum>(e)</enum><header>Procurement of temporary and intermittent services</header><text>The Chairpersons of the Commission may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, at rates for individuals that do not exceed the daily equivalent of the annual rate of basic pay prescribed for level V of the Executive Schedule under section 5316 of that title.</text></subsection></section><section id="H1080977C0F6648F9A780B64B68486027"><enum>7.</enum><header>Termination of Commission</header><text display-inline="no-display-inline">The Commission shall terminate on the date that is 180 days after the date on which the Commission has submitted the reports under subsections (a) and (b) of section 4.</text></section><section id="H240FD65A22F640AEB6EB3FCD925CBBBD" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $1,000,000.</text></section></legis-body></bill>
