R. 406</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="L000582">Mr. Lieu</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the sale of shark parts, and for other purposes.</official-title></form><legis-body id="H9EE4DDB05F27439B9C589F57319363FA" style="OLC"><section id="HD93C2793F542408DAA88E75A2CAAA7BE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Shark Sales Elimination Act of 2021</short-title></quote>. </text></section><section id="H4C5B029B9C734AE49571261DA93FB53B"><enum>2.</enum><header>Prohibition on sale of shark parts</header><subsection id="H0F823D6A3E3B431D8C8A7ADDCE76EAF8"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Except as provided in subsection (c), no person shall possess, offer for sale, sell, or purchase any shark part or product containing any shark part.</text></subsection><subsection id="H0882E489C2E94ACBA1CF42022594A8F6"><enum>(b)</enum><header>Penalty</header><text>For purposes of section 308(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1858">16 U.S.C. 1858(a)</external-xref>), a violation of this section shall be treated as an act prohibited by section 307 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1857">16 U.S.C. 1857</external-xref>).</text></subsection><subsection id="H7A43675C8B194D27B2356A83D8531DBB"><enum>(c)</enum><header>Exemption for traditional fisheries, education, and science</header><text>Subsection (a) shall not apply with respect to possession of a shark part that was taken lawfully under a State, territorial, or Federal license or permit to take or land sharks, if the shark part is separated from the shark in a manner consistent with the license or permit and is—</text><paragraph id="HCFAEDD1BF2114CF3BDF9D31A7EF28A88"><enum>(1)</enum><text>destroyed or discarded;</text></paragraph><paragraph id="H19FB01A90E30457DB8CD92FC0A3B2485"><enum>(2)</enum><text>used for noncommercial subsistence purposes in accordance with State or territorial law; or</text></paragraph><paragraph id="H0FEBA8BBF69C4ABABC329610E27FBF30"><enum>(3)</enum><text>used solely for display or research purposes by a museum, college, or university, or other person under a State or Federal permit to conduct noncommercial scientific research.</text></paragraph></subsection><subsection id="H753BD01547744099842A04487D160CBC"><enum>(d)</enum><header>State authority</header><text>Nothing in this Act affects any right of a State or territory of the United States to adopt or enforce any regulation or standard that is more stringent than a regulation or standard in effect under this Act.</text></subsection><subsection id="H7A0628220854465C9BC148A458290C7A"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H8953885309F943A6A6A0CC133BF5E67B"><enum>(1)</enum><header>Shark</header><text>The term <term>shark</term> means any species of the orders Pristiophoriformes, Squatiniformes, Squaliformes, Hexanchiformes, Lamniformes, Carchariniformes, Orectolobiformes, and Heterodontiformes.</text></paragraph><paragraph id="H5E34EF89B2124AE1947BF61BAA06D67B"><enum>(2)</enum><header>shark part</header><text>The term <term>shark part</term> means any shark or raw, dried, or otherwise processed detached part of a shark.</text></paragraph></subsection></section></legis-body></bill>
