which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to provide for additional subsidization assistance to a municipality to carry out on-site wastewater treatment system projects, and for other purposes.</official-title></form><legis-body id="HAA63A0F3616D4BBDB6C12B59D3063D29" style="OLC"><section id="HF87B8736A1CE401EAB69F461B11F0788" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Septic Upgrade Grant Act</short-title></quote>.</text></section><section id="H9F2CC29FDCD74A48BC85BB8CE737D772" section-type="subsequent-section"><enum>2.</enum><header>Water pollution control revolving loan funds</header><text display-inline="no-display-inline">Section 603(i) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(i)</external-xref>) is amended—</text><paragraph id="H1CE8B3689EFA47F7AC07B760BEC5FB7E"><enum>(1)</enum><text>by striking paragraph (1)(B) and inserting the following:</text><quoted-block style="OLC" id="H83486798B1FF4C12982F0CCF484CE41C" display-inline="no-display-inline"><subparagraph id="HFA90C8BCB75F463191FE054DB2B81B06"><enum>(B)</enum><text display-inline="yes-display-inline">to implement a program, process, material, technique, or technology to—</text><clause id="H39E3AC4D309A421C9EF9A9D52C61AF60"><enum>(i)</enum><text display-inline="yes-display-inline">address water-efficiency goals;</text></clause><clause id="H6CA44FA161E34828BBF2C30E061AA6D1"><enum>(ii)</enum><text>address energy-efficiency goals;</text></clause><clause id="H164A5A88EAE04B08958F493CA055474A"><enum>(iii)</enum><text>mitigate stormwater runoff;</text></clause><clause id="H03892B7237C24C5B9DCDE6F8B98BC3CB"><enum>(iv)</enum><text display-inline="yes-display-inline">mitigate pollution from from on-site wastewater treatment systems; or</text></clause><clause id="H8841BD0C0396403598D2E3F94811153F"><enum>(v)</enum><text>encourage sustainable project planning, design, and construction.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H8F73D99960B6456BADF3C42233486C4F"><enum>(2)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" id="HBF8704B296C1433CB2C240CE8662684E" display-inline="no-display-inline"><paragraph id="H9D60C53F40B2488D957559A5A1BBA45F"><enum>(3)</enum><header>Subsidization amounts</header><text display-inline="yes-display-inline">A State may use for providing additional subsidization in a fiscal year under this subsection an amount that does not exceed the greater of—</text><subparagraph id="H37D8C7371A2C4E1FBAEF164C62C18AEC"><enum>(A)</enum><text>30 percent of the total amount received by the State in capitalization grants under this title for the fiscal year; or</text></subparagraph><subparagraph id="H90AD1305BC904FA78C0CB9B19E189CD5"><enum>(B)</enum><text>the annual average over the previous 10 fiscal years of the amounts deposited by the State in the State water pollution control revolving fund from State moneys that exceed the amounts required to be so deposited under section 602(b)(2).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HCFE8B0E3B2B540119DC2F45FB2D7F366"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H33AE22B64A114E63A60F6F216B192B23" display-inline="no-display-inline"><paragraph id="HE3F3C95BAE774BB69C4AE60673816DA9"><enum>(4)</enum><header>Additional subsidization for on-site wastewater treatment system programs</header><subparagraph id="HB853A6BD241D47DCB953582A96B4AD05"><enum>(A)</enum><header>Eligibility</header><clause id="H3F30EF2FA4FC475C8657FB176C77C447"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">To be eligible for additional subsidization for an on-site wastewater treatment system program under paragraph (1)(B)(iv), a municipality shall ensure that such program is included in a conservation management plan approved pursuant to any State or local law or in a conservation and management plan approved pursuant to section 320.</text></clause><clause id="H8E6E0C1163E0471CBAD2996ADF5F8484"><enum>(ii)</enum><header>Plan contents</header><text>A plan described in clause (i) shall—</text><subclause id="H6DDF4E219FA5470CA623B071C15EE965"><enum>(I)</enum><text display-inline="yes-display-inline">identify any pollutants of concern or water pollution problems that threaten public health, drinking water, natural resources, or freshwater or marine ecosystem recovery; and</text></subclause><subclause id="HB9242B6FE0C24253B6081D88694852EA"><enum>(II)</enum><text>address how the on-site wastewater treatment system program described in clause (i) will abate the pollutants or water pollution problems identified in subclause (I).</text></subclause></clause><clause id="HE0CE786B6CCD4210963D9DDAF44A9006"><enum>(iii)</enum><header>Program management</header><text display-inline="yes-display-inline">An on-site wastewater treatment system program carried out using funds provided under this subsection shall be managed by a municipality and have enforceable program requirements to ensure the long-term sustainability of an on-site wastewater treatment system, including proper operation and maintenance of such system.</text></clause></subparagraph><subparagraph id="HA20C32E7D0CE4A368C93CB8BB4CB5792"><enum>(B)</enum><header>New construction not eligible</header><text>Any on-site wastewater treatment system project proposed to be carried out on a new construction site shall not be eligible for additional subsidization pursuant to this subsection.</text></subparagraph><subparagraph id="H8FBFA6A9F1E144249B1D625A4E7D040E"><enum>(C)</enum><header>Non-Federal share</header><text display-inline="yes-display-inline">The non-Federal share of the cost of an on-site wastewater treatment system project carried out under this subsection shall be not more than 20 percent.</text></subparagraph><subparagraph id="HE57143288A2D4E08927CF76E1B9BD9D5"><enum>(D)</enum><header>Priority</header><text>A State shall prioritize awarding additional subsidization under paragraph (1)(B)(iv) for on-site wastewater treatment system programs that—</text><clause id="HE3107DFC227145059C831F691623AC08"><enum>(i)</enum><text>benefit a financially distressed community (as such term is defined in section 221(c)); or</text></clause><clause id="HAC5F02EBE9CB498AB078D9BF21ECF030"><enum>(ii)</enum><text display-inline="yes-display-inline">are carried out in an area that—</text><subclause id="HC01060893CE948CDA71AC8632A7EF0AA"><enum>(I)</enum><text>is in close proximity to threatened or impaired water bodies or groundwater; or</text></subclause><subclause id="HCE8E27D54EC64C58A6E97715B48731E4"><enum>(II)</enum><text display-inline="yes-display-inline">has groundwater, or surface waters used as drinking water where a septic system or cesspool is known or suspected to be a major source of pollutants. </text></subclause></clause></subparagraph></paragraph><paragraph id="H90E106F72F714CEEBC75962D7A819370"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H969B1DE4B7994C7D9CE66B4A819D2289"><enum>(A)</enum><header>New construction</header><text display-inline="yes-display-inline">The term <quote>new construction</quote> means the preparation for and construction of—</text><clause id="H0C074509AAD24C3086CC3185D1FE48CD"><enum>(i)</enum><text>a new housing structure on a site; or</text></clause><clause id="HBE8C70CC22FD4EE89506916B815DEB06"><enum>(ii)</enum><text>a significant extension to an existing housing structure on a site.</text></clause></subparagraph><subparagraph id="H4CC5CFE63EBB43ADBF79581F3AE5163D"><enum>(B)</enum><header>On-site wastewater treatment system program</header><text display-inline="yes-display-inline">The term <quote>on-site wastewater treatment system program</quote> means a program to carry out more than 1 on-site wastewater treatment system project in a municipality that meets the eligibility criteria under paragraph (4)(A).</text></subparagraph><subparagraph id="H60FEBEA6875245BAA574C836029B6AEB"><enum>(C)</enum><header>On-site wastewater treatment system project</header><text display-inline="yes-display-inline">The term <quote>on-site wastewater treatment system project</quote> means a project that replaces a septic system or cesspool serving a single dwelling or small business with a wastewater treatment system that reduces nitrogen pollution by at least 50 percent, in accordance with standard 245 developed by the National Sanitation Foundation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
