R. 4058</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210622">June 22, 2021</action-date><action-desc><sponsor name-id="M001163">Ms. Matsui</sponsor> (for herself and <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to ensure coverage of mental and behavioral health services furnished through telehealth.</official-title></form><legis-body id="HE351FA0F6E064BEEA8AE3A66FA651FC1" style="OLC"><section id="H2F8C60BBCC8C4062A35451DED6E4BEF1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telemental Health Care Access Act of 2021</short-title></quote>.</text></section><section id="H45811507ACF34DA581E0FFA9DDF224DE"><enum>2.</enum><header>Ensuring coverage for mental and behavioral health services furnished through telehealth</header><subsection id="H3C830BD3BAC14F47B9C91080B109CCF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1834(m)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(7)</external-xref>) is amended—</text><paragraph id="H06947D5DE15C4320B516862319375A0E"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="paragraph" style="OLC">mental health services</header-in-text></quote> and all that follows through <quote>The geographic</quote> and inserting <quote><header-in-text level="paragraph" style="OLC">mental and behavioral health services furnished through telehealth.</header-in-text>—The geographic</quote>;</text></paragraph><paragraph id="HBB8C51BF88A84B17AF13B29D8B05139D"><enum>(2)</enum><text>by striking <quote>subject to subparagraph (B),</quote>;</text></paragraph><paragraph id="HE32D3D047ADC46FAB80FF95031D6ECEB"><enum>(3)</enum><text>by inserting <quote>, or for the provision of behavioral health services</quote> after <quote>or treatment of a mental health disorder</quote>; and </text></paragraph><paragraph id="H38BC7F385C554EF09DD55B41037FA44C"><enum>(4)</enum><text>by striking subparagraph (B).</text></paragraph></subsection><subsection id="H43C58DC54BA44EE4B2A2A1EF588E811C"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect as if included in the enactment of section 123 of division CC of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>).</text></subsection></section><section id="H6C435DB0AC4D4FBEA0B251F07FF9E062"><enum>3.</enum><header>Study and report on utilization of mental and behavioral health services furnished through telehealth</header><text display-inline="no-display-inline">Not later than 1 year after the first day after the end of the emergency period described in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>), the Secretary of Health and Human Services shall submit to Congress a report on the utilization of mental and behavioral health services furnished through telehealth under section 1834(m)(7) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(7)</external-xref>), that includes any recommendations of the Secretary regarding—</text><paragraph id="H0C6DF2C7CC674F528AA0C7A847B6A6BC"><enum>(1)</enum><text display-inline="yes-display-inline">fraud or abuse prevention with respect to such services; and</text></paragraph><paragraph id="HCD1C92EA2AC640349E1ABE2CB1A6B58E"><enum>(2)</enum><text display-inline="yes-display-inline">additional funding that the Office of Inspector General of the Department of Health and Human Services may require for purposes of conducting audits, investigations, and other oversight and enforcement activities with respect to the furnishing of such services.</text></paragraph></section></legis-body></bill>
