R. 4049</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210622">June 22, 2021</action-date><action-desc><sponsor name-id="G000576">Mr. Grothman</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to give a preference, with respect to project grants for preventive health services, for States that allow trained individuals to carry and administer epinephrine, and for other purposes.</official-title></form><legis-body id="H28158B0BD2B746009E61301C8B4E14DC" style="OLC"><section id="HEF33D0FC63A04157B4578F5B1D4D6651" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Dillon’s Law</short-title></quote>.</text></section><section id="HDC3826ADEA6E4D82B0840AB67A62A859"><enum>2.</enum><header>Preference for States that allow trained individuals to carry and administer epinephrine</header><text display-inline="no-display-inline">Section 317 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H0805BD3A162D4012A76D727441E645B2" display-inline="no-display-inline"><subsection id="HA78196039BD34E75BE8A78433F379391"><enum>(o)</enum><header>Preference for States that allow trained individuals To carry and administer epinephrine</header><paragraph id="HE13BE9B7643C40EFA2330AD5860A7219"><enum>(1)</enum><header>Preference</header><text display-inline="yes-display-inline">The Secretary, in making grants under this section, shall give preference to any State that—</text><subparagraph id="H8396F459C3F642FDBB083140DAAAE041"><enum>(A)</enum><text>permits a trained individual to administer epinephrine to any individual reasonably believed to be having an anaphylactic reaction; and</text></subparagraph><subparagraph id="HA608AE1EA0A24737844E6B48C40EC4BD"><enum>(B)</enum><text>provides to the Secretary the certification described in paragraph (2).</text></subparagraph></paragraph><paragraph id="H4E07C54F58694A51B56298E5324ACBE1"><enum>(2)</enum><header>Civil liability protection law</header><text>The certification described in this paragraph is a certification made by the attorney general of the State that the State—</text><subparagraph id="HB623F11DFABC4C24A5011EF64883BB4F"><enum>(A)</enum><text>has a civil liability protection law;</text></subparagraph><subparagraph id="HDDDDBACDE1124EF79A467B9F4A0E902D"><enum>(B)</enum><text>has reviewed such law to determine the application of such law with regard to a trained individual who may administer epinephrine to another individual reasonably believed to be having an anaphylactic reaction; and</text></subparagraph><subparagraph id="HA31FB352D3E145ECA87E58535AABDAC6"><enum>(C)</enum><text>has concluded that such law provides adequate civil liability protection applicable to such a trained individual.</text></subparagraph></paragraph><paragraph id="H48037FC9A9BF4DBC8F2D6A03A544F3C7"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection creates a cause of action or in any other way increases or diminishes the liability of any person under any other law.</text></paragraph><paragraph id="HB437458EE89A414D94B44EA31191709B"><enum>(4)</enum><header>Definitions</header><text>For purposes of this subsection:</text><subparagraph id="H38891F5B43A94F32895C3AC798EBF1DA"><enum>(A)</enum><text>The term <term>civil liability protection law</term> means a State law offering liability protection to individuals who give aid on a voluntary basis in an emergency to an individual who is ill, in peril, or otherwise incapacitated.</text></subparagraph><subparagraph id="HC86B0345294E4221988CE54881045303"><enum>(B)</enum><text>The term <term>trained individual</term> means an individual—</text><clause id="H29CBCA850B6542C68D98EA276D3BFD7C"><enum>(i)</enum><text>who has received training in the administration of epinephrine; and</text></clause><clause id="HD64AA48E15A94FA3BDBCE89FA968B7DA"><enum>(ii)</enum><text>whose training in the administration of epinephrine meets appropriate medical standards and has been approved by the State.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
