Scott Franklin of Florida</sponsor> (for himself, <cosponsor name-id="C001104">Mr. Cawthorn</cosponsor>, <cosponsor name-id="J000292">Mr. Johnson of Ohio</cosponsor>, <cosponsor name-id="S000168">Ms. Salazar</cosponsor>, <cosponsor name-id="J000304">Mr. Jackson</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, <cosponsor name-id="G000596">Mrs. Greene of Georgia</cosponsor>, <cosponsor name-id="B001302">Mr. Biggs</cosponsor>, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, and <cosponsor name-id="H001084">Ms. Herrell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the head of each agency to repeal at least two rules before adopting a proposed rule, and for other purposes.</official-title></form><legis-body id="H88124BA37A5B440C8475E66B4A6F05B3" style="OLC"><section id="HE9634925CFDE4DF2B3FCEDE35EA00CF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cutting Unnecessary Regulatory Burdens Act</short-title></quote>.</text></section><section id="HD8E92269562E42039B023EAC47B55647"><enum>2.</enum><header>Repeal of regulations required before the adoption of a proposed rule</header><subsection id="HEA666AD3F9FD47ECA0BB76A3EE811E24"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Prior to, or at the time of, the promulgation of any major rule, the head of an agency shall repeal not less than 2 rules under the jurisdiction of that agency to offset the costs of the major rule.</text></subsection><subsection id="H73FFD8C54E9B48658A2A0AEA3A3AB223"><enum>(b)</enum><header>Incremental cost allowance</header><text display-inline="yes-display-inline">The head of an agency may not issue a rule that exceeds the total cost of the rules identified for repeal unless required by law or approved in writing by the Director of the Office of Management and Budget. </text></subsection><subsection id="H51011135ED6A4673B3E671D2FFBB81A7"><enum>(c)</enum><header>Exceptions</header><text>This section shall not apply to any rule related to the following:</text><paragraph id="HEC721710A973422797E8E52C8F67327C"><enum>(1)</enum><text>The Armed Forces.</text></paragraph><paragraph id="H950BCD47171840AA92D5FD1D0F537816"><enum>(2)</enum><text>National security.</text></paragraph><paragraph id="HB0343F9D19AC4833B1DA172DFDD9FAB8"><enum>(3)</enum><text display-inline="yes-display-inline">The foreign affairs function of the United States.</text></paragraph><paragraph id="HBDBBFA415F5944A6A53A06B25172DED1"><enum>(4)</enum><text>Any major rule related to agency organization, procedure, practice, management, or personnel.</text></paragraph></subsection><subsection id="H36953127EC32448082CA43DC7BFBC78A"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HECB478EABA734E9A9AADFF246F0A88D1"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given such term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H045F021CEC2C48AF8B0A4F23739EE260"><enum>(2)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Management and Budget. </text></paragraph><paragraph id="HBCDDDD5749244E88985873D3A50CBB1F"><enum>(3)</enum><header>Major rule</header><text>The term <term>major rule</term> has the meaning given such term in section 804 of title 5, United States Code.</text></paragraph><paragraph id="HFD16489372CE4B82A4EB592E578A7F5A"><enum>(4)</enum><header>Rule</header><text>The term <term>rule</term> has the meaning given such term in section 804 of title 5, United States Code. </text></paragraph></subsection></section></legis-body></bill>
