R. 4040</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220728">July 28, 2022</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to extend telehealth flexibilities under the Medicare program, and for other purposes.</official-title></form><legis-body id="H084C01FFB8744264B173A2ACFE2657AE" style="OLC"><pagebreak></pagebreak><section id="H55A964AA72F748DBB2C00C6CE2360D5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Telehealth Beyond COVID–19 Act of 2022</short-title></quote>.</text></section><section id="H7387282FD53C4BDA90BE5F7349933D9E" commented="no"><enum>2.</enum><header>Removing geographic requirements and expanding originating sites for telehealth services</header><text display-inline="no-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H4059CF40102143C5B56A6FD3E59173E6" commented="no"><enum>(1)</enum><text>in paragraph (2)(B)(iii)—</text><subparagraph id="H80051B28CE754773BA35EE17F0AFF07D"><enum>(A)</enum><text>by striking <quote>With</quote> and inserting <quote>In the case that the emergency period described in section 1135(g)(1)(B) ends before December 31, 2024, with</quote>; and </text></subparagraph><subparagraph id="H577487433AFA40019E58A8C567C2A08F"><enum>(B)</enum><text>by striking <quote>that are furnished during the 151-day period beginning on the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> and inserting <quote>that are furnished during the period beginning on the first day after the end of such emergency period and ending December 31, 2024</quote>; and</text></subparagraph></paragraph><paragraph id="H81B0355D807446D68B606BC903D59C88" commented="no"><enum>(2)</enum><text>in paragraph (4)(C)(iii)—</text><subparagraph id="H9568DE3F11FA41719388961222B1AC36"><enum>(A)</enum><text>by striking <quote>With</quote> and inserting <quote>In the case that the emergency period described in section 1135(g)(1)(B) ends before December 31, 2024, with</quote>; and</text></subparagraph><subparagraph id="H08DEA755BAEE4BAA8EC7D146115039FB"><enum>(B)</enum><text>by striking <quote>that are furnished during the 151-day period beginning on the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> and inserting <quote>that are furnished during the period beginning on the first day after the end of such emergency period and ending on December 31, 2024</quote>.</text></subparagraph></paragraph></section><section id="H13A0F3140E3F47A7B954F9C03024B23B"><enum>3.</enum><header>Expanding practitioners eligible to furnish telehealth services</header><text display-inline="no-display-inline">Section 1834(m)(4)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(E)</external-xref>) is amended by striking <quote>and, for the 151-day period beginning on the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> and inserting <quote>and, in the case that the emergency period described in section 1135(g)(1)(B) ends before December 31, 2024, for the period beginning on the first day after the end of such emergency period and ending on December 31, 2024</quote>.</text></section><section id="H2718B9B49F314806834059CD621668D8"><enum>4.</enum><header>Extending telehealth services for federally qualified health centers and rural health clinics</header><text display-inline="no-display-inline">Section 1834(m)(8)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(8)(A)</external-xref>) is amended by striking <quote>during the 151-day period beginning on the first day after the end of such emergency period</quote> and inserting <quote>in the case that such emergency period ends before December 31, 2024, during the period beginning on the first day after the end of such emergency period and ending on December 31, 2024</quote>.</text></section><section id="H90F77D10E7E04126A98A95AE661EC32D" commented="no"><enum>5.</enum><header>Delaying the in-person requirements under medicare for mental health services furnished through telehealth and telecommunications technology</header><subsection id="H32D020B6A3574A0DAA54AF404A07E4BD"><enum>(a)</enum><header>Delay in requirements for mental health services furnished through telehealth</header><text display-inline="yes-display-inline">Section 1834(m)(7)(B)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(7)(B)(i)</external-xref>) is amended, in the matter preceding subclause (I), by striking <quote>on or after the day that is the 152nd day after the end of the period at the end of the emergency sentence described in section 1135(g)(1)(B))</quote> and inserting <quote>on or after January 1, 2025 (or, if later, the first day after the end of the emergency period described in section 1135(g)(1)(B))</quote>.</text></subsection><subsection id="H7CFA86B3196C44ACAE35E07AD245490D"><enum>(b)</enum><header>Mental health visits furnished by rural health clinics</header><text>Section 1834(y) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(y)</external-xref>) is amended—</text><paragraph id="HD3E10931131D42DD80C0165E44D1968C"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">to hospice patients</header-in-text></quote>; and</text></paragraph><paragraph id="H80CFC5B2871F4F3BAA772A9C128030B2"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>prior to the day that is the 152nd day after the end of the emergency period described in section 1135(g)(1)(B))</quote> and inserting <quote>prior to January 1, 2025 (or, if later, the first day after the end of the emergency period described in section 1135(g)(1)(B))</quote>.</text></paragraph></subsection><subsection id="H51A7C023228B40098477B219BAB66927"><enum>(c)</enum><header>Mental health visits furnished by federally qualified health centers</header><text>Section 1834(o)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(o)(4)</external-xref> is amended—</text><paragraph id="H48B207167AFA4776BFD3881FF791D31B"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">to hospice patients</header-in-text></quote>; and</text></paragraph><paragraph id="H7F62C2EFF6A74BF98E499F5BB8214E89"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>prior to the day that is the 152nd day after the end of the emergency period described in section 1135(g)(1)(B))</quote> and inserting <quote>prior to January 1, 2025 (or, if later, the first day after the end of the emergency period described in section 1135(g)(1)(B))</quote>.</text></paragraph></subsection></section><section id="HE908117EE03A4ECB8624ABDE808F9662" commented="no"><enum>6.</enum><header>Allowing for the furnishing of audio-only telehealth services</header><text display-inline="no-display-inline">Section 1834(m)(9) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(9)</external-xref>) is amended by striking <quote>The Secretary shall continue to provide coverage and payment under this part for telehealth services identified in paragraph (4)(F)(i) as of the date of the enactment of this paragraph that are furnished via an audio-only telecommunications system during the 151-day period beginning on the first day after the end of the emergency period described in section 1135(g)(1)(B)</quote> and inserting <quote>In the case that the emergency period described in section 1135(g)(1)(B) ends before December 31, 2024, the Secretary shall continue to provide coverage and payment under this part for telehealth services identified in paragraph (4)(F)(i) that are furnished via an audio-only communications system during the period beginning on the first day after the end of such emergency period and ending on December 31, 2024</quote>.</text></section><section id="H7A3FE31CD4CB4082A1A37ADDF5ED8757" commented="no"><enum>7.</enum><header>Use of telehealth to conduct face-to-face encounter prior to recertification of eligibility for hospice care during emergency period</header><text display-inline="no-display-inline">Section 1814(a)(7)(D)(i)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(7)(D)(i)(II)</external-xref>) is amended by striking <quote>and during the 151-day period beginning on the first day after the end of such emergency period</quote> and inserting <quote>and, in the case that such emergency period ends before December 31, 2024, during the period beginning on the first day after the end of such emergency period described in such section 1135(g)(1)(B) and ending on December 31, 2024</quote>.</text></section><section id="HC380882587564ADCB28A60CE7ED70E63" commented="no"><enum>8.</enum><header>Funding from medicare improvement fund</header><text display-inline="no-display-inline">Section 1898(b)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395jjj">42 U.S.C. 1395jjj(b)(1)</external-xref>) is amended by striking <quote>$7,500,000,000</quote> and inserting <quote>$5,153,000,000</quote>.</text></section><section id="HF95CAEE6F6854DA895A23C47177721B9"><enum>9.</enum><header>Program instruction authority</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary of Health and Human Services may implement the provisions of, including amendments made by, sections 2 through 7 through program instruction or otherwise.</text></section><section id="H0C9F9B306E7440359138045F5A200497"><enum>10.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body><attestation><attestation-group><attestation-date date="20220727" chamber="House">Passed the House of Representatives July 27, 2022.</attestation-date><attestor display="yes">Cheryl L.
