R. 4036</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210622">June 22, 2021</action-date><action-desc><sponsor name-id="B001257">Mr. Bilirakis</sponsor> (for himself and <cosponsor name-id="S001200">Mr. Soto</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act and the SUPPORT for Patients and Communities Act to provide for Medicare and Medicaid mental and behavioral health treatment through telehealth.</official-title></form><legis-body id="HCC923BDF0826466BAD9664D7F0A64B44" style="OLC"><section section-type="section-one" id="HA66781F263C446EA9B99967CEC72195F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhance Access to Support Essential Behavioral Health Services Act</short-title></quote> or the <quote><short-title>EASE Behavioral Health Services Act</short-title></quote>.</text></section><section id="H9E1963DF81204553B886495547FA1AED"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="HE4E3C4BE780C41AEAF9F32222A895BFB"><enum>(1)</enum><text display-inline="yes-display-inline">Nearly 18 percent of adults in the United States reported a mental, behavioral, or emotional disorder in 2015.</text></paragraph><paragraph id="H732FD3AB09B94D20BD5D7ECE97DAA73B"><enum>(2)</enum><text>Children are also significantly impacted. According to the Centers for Disease Control and Prevention, 1 in 6 children ages 2 years through 8 years have a diagnosed mental, behavioral, or developmental disorder, indicating that disorders begin in early childhood and affect lifelong health.</text></paragraph><paragraph id="H73FF628CD0E548498142649CEB261363"><enum>(3)</enum><text>Moreover, 1 in 7 children and adolescents have at least one treatable mental health disorder.</text></paragraph><paragraph id="HE6461A783A004B3B96CCE0C6C8A76912"><enum>(4)</enum><text>There is a critical link between mental health and substance use disorders. According to the Substance Abuse and Mental Health Services Administration, 1 in 4 adults with severe mental illness had a substance use disorder in 2017.</text></paragraph><paragraph id="H8BAECAD85B584A4E8D8F3ED121BC7F0F"><enum>(5)</enum><text>Moreover, children who have had a major depressive episode are more than twice as likely to use illicit drugs.</text></paragraph><paragraph id="HF4F7B0BAA72744758B17BB3FD25A62B5"><enum>(6)</enum><text>In 2017, approximately 19.7 million people aged 12 years or older had a substance use disorder related to their use of alcohol or illicit drugs in the past year.</text></paragraph><paragraph id="H6B8509DFB51440C3A28A43C3C3EF9435"><enum>(7)</enum><text>Despite this overwhelming need, access to behavioral health services remains among the most pressing health care challenges in our country.</text></paragraph><paragraph id="H0623BDB53FEE408F8E19F8603CD7C967"><enum>(8)</enum><text>An estimated 56 percent of Americans with a mental health disorder did not receive treatment in 2017.</text></paragraph><paragraph id="H41191CA02BB54834AC319FBE9F19904F"><enum>(9)</enum><text>Similarly, half of children and adolescents did not receive treatment for their mental health disorder in 2016.</text></paragraph><paragraph id="H091E33BA46424A99B606CCA71D3DB0DE"><enum>(10)</enum><text>Further complicating access to care, as demand for behavioral health services increases in communities across the United States, the number of psychiatrists available to treat them continues to decline.</text></paragraph><paragraph id="H7F1B4FC5D06E48FCBA01DC1C2525DFDF"><enum>(11)</enum><text>The population of practicing psychiatrists declined by more than 10 percent between the period of 2003 through 2013, while the population of primary care physicians and neurologists grew during the same period.</text></paragraph><paragraph id="H6C8DF81D07AB4EA7870501E209149E9E"><enum>(12)</enum><text>Technology has evolved to connect individuals to health care services in new ways, including via telehealth.</text></paragraph><paragraph id="HAC38F171B60644818133ED682EE94B9C"><enum>(13)</enum><text>Moreover, studies show that video visits are an effective strategy to provide mental health treatment to children and, in fact, may be preferable in some cases.</text></paragraph><paragraph id="H564CA8631A7644F69F36043F52D1EF71"><enum>(14)</enum><text>During the 115th Congress, Congress recognized the potential of telehealth to ensure that those in urgent need of substance use disorder treatment receive the care they require.</text></paragraph><paragraph id="HA52CF2BFFEED4F36B2B9B261EBFAA993"><enum>(15)</enum><text>As passed and signed into law, sections 2001 and 1009 of the SUPPORT for Patients and Communities Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>) expands the use of telehealth services for the treatment of opioid use disorder and other substance use disorders.</text></paragraph><paragraph id="HDE8D0E952E3042FB8D5ECE5409823A8C"><enum>(16)</enum><text>It is widely recognized that there is a close relationship between mental health and substance use disorders.</text></paragraph></section><section id="HD2A11E8C7C6B44618F22696D09BB975E"><enum>3.</enum><header>Medicare treatment of behavioral health services furnished through telehealth</header><text display-inline="no-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H607FC5A7F90C4789BC0BB05D8EF63384"><enum>(1)</enum><text>in paragraph (4)(C)—</text><subparagraph id="H94109045AAF14E2EBF38E3AA2BC0A922"><enum>(A)</enum><text>in clause (i), by striking <quote>and (7)</quote> and inserting <quote>(7), and (9)</quote>; and</text></subparagraph><subparagraph commented="no" id="HF353F25D77974C85BC1D2356EBECEDF8"><enum>(B)</enum><text>in clause (ii)(X)—</text><clause commented="no" id="HFA8B4237A10C419380BEDFCC513FD26B"><enum>(i)</enum><text>by striking <quote>or telehealth services</quote> and inserting <quote>, telehealth services</quote>; and</text></clause><clause commented="no" id="H96885947B0344E6AAAB99C60CC3A00CE"><enum>(ii)</enum><text>by inserting <quote>or telehealth services described in paragraph (9)</quote> before the period at the end; and</text></clause></subparagraph></paragraph><paragraph id="HF2823FE79D274DF0960E4E580A2910BE"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF805D50BA67C4BDA86AEC7FC07422312"><paragraph id="HBB184C2BF2794CC48CFB9E258E1CF215"><enum>(9)</enum><header>Treatment of behavioral health services furnished through telehealth</header><text>The geographic requirements described in paragraph (4)(C)(i) shall not apply with respect to telehealth services that are behavioral health services furnished on or after January 1, 2022, to eligible telehealth individuals, including initial patient evaluations, follow-up medical management, and other behavioral health services, as determined by the Secretary, at an originating site described in paragraph (4)(C)(ii) (other than an originating site described in subclause (IX) of such paragraph).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H44E543C6E8634A7AA62552EB413F1B77"><enum>4.</enum><header>Medicaid mental and behavioral health treatment through telehealth</header><text display-inline="no-display-inline">Section 1009 of the SUPPORT for Patients and Communities Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>) is amended—</text><paragraph id="HE82089DBBACA4ADDA5F748A872EE3FFD"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph display-inline="no-display-inline" id="H4B3A60AC195E40B99CCE691FB17ABB9F"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text style="OLC" level="subsection">treatment for substance use disorders</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">treatment for substance use disorders and mental health disorders and behavioral health disorders</header-in-text></quote>;</text></subparagraph><subparagraph id="HE77744F03F104CE7BCBE734CFBAD3A17"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>Not later than 1 year after the date of enactment of this Act, the Secretary</quote> and inserting <quote>The Secretary</quote>;</text></subparagraph><subparagraph id="H7398CE373A074F4D8E33150FE35F6410"><enum>(C)</enum><text>in paragraph (1)—</text><clause id="H0B34CC096EDD40A4ACD3F36D2AC068F0"><enum>(i)</enum><text>by striking <quote>treatment for substance use disorders</quote> and inserting <quote>treatment for substance use disorders and mental health disorders and behavioral health disorders</quote>; and</text></clause><clause id="HB1038AD3531347B6BEB62AC69898AC92"><enum>(ii)</enum><text>by inserting <quote>psychotherapy,</quote> after <quote>counseling,</quote>;</text></clause></subparagraph><subparagraph id="H5878A86C589743E997A16620D61407EB"><enum>(D)</enum><text>in paragraph (2), by inserting <quote>or mental health disorders and behavioral health disorders</quote> after <quote>substance use disorders</quote>;</text></subparagraph><subparagraph id="HBEEC8890F85149D3962AC488AAA60342"><enum>(E)</enum><text>in paragraph (3), by inserting <quote>and mental health disorders and behavioral health disorders</quote> after <quote>substance use disorders</quote>; and</text></subparagraph><subparagraph id="H4E7C06E78C904F0EB4FFEFECAFE96559"><enum>(F)</enum><text>by adding at the end, below and after paragraph (3), the following flush left text:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H189987F2EB824A98A131C38C01395701"><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The Secretary shall issue the guidance under this subsection not later than 1 year after the date of the enactment of this Act, with respect to the matters described in the previous provisions of this subsection relating to substance use disorders, and not later than 2 years after the date of the enactment of this Act, with respect to the matters described in such previous provisions relating to mental health disorders and behavioral health disorders.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H938CABB21784459FBBBBEC175F4F030D"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph display-inline="no-display-inline" id="H11532153B74240A7AD21DE045B754CB3"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text style="OLC" level="subsection">treatment for substance use disorders</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">treatment for substance use disorders and mental health disorders and behavioral health disorders</header-in-text></quote>;</text></subparagraph><subparagraph id="HF729C7B2CC0743BFAFBB1CEE397B991D"><enum>(B)</enum><text>in paragraph (1), by striking <quote>treatment for substance use disorders</quote> and inserting <quote>treatment for substance use disorders and mental health disorders and behavioral health disorders</quote> each place it appears; and</text></subparagraph><subparagraph id="H7AA77E69A0B145B084366954F8703F92"><enum>(C)</enum><text>in paragraph (2)—</text><clause id="H66041F91861E46FDA022FCACA9367FDC"><enum>(i)</enum><text>by inserting <quote>with respect to substance use disorders,</quote> after <quote>paragraph (1),</quote>; and</text></clause><clause id="H09F27D35DA264BC1871021DDB1950BA1"><enum>(ii)</enum><text>by adding at the end the following new sentence: <quote>Not later than 2 years after the date of enactment of this Act, the Comptroller General shall submit to Congress a report containing the results of the evaluation conducted under paragraph (1), with respect to mental health disorders and behavioral health disorders, together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate.</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H92AA98EE28954C1AB64433EA71EFC0A7"><enum>(3)</enum><text>in subsection (d)(1)—</text><subparagraph display-inline="no-display-inline" id="HACC39071ABC74A579D5F74DBA4F9E70C"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>and mental health disorders and behavioral health disorders</quote> after <quote>substance use disorders</quote>;</text></subparagraph><subparagraph id="H4AC6EFF3E0C742E8B950560730C09C3B"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>, and mental health disorders and behavioral health disorders</quote> after <quote>opioid use disorder</quote>; and</text></subparagraph><subparagraph id="HB96F6E14656443599A89A023F736FCA3" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>and mental health disorders and behavioral health disorders</quote> after <quote>substance use disorders</quote>.</text></subparagraph></paragraph></section><section commented="no" id="HC62A3EBA95AD461BAC89A5B670CC6DE8"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect as is included in the enactment of the SUPPORT for Patients and Communities Act.</text></section></legis-body></bill>
