which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to provide for the establishment of a virtual health pilot program to facilitate utilization of remote patient monitoring technology to maintain or expand access to health care services for individuals in rural areas, and for other purposes.</official-title></form><legis-body id="H355A1A5CC4D9403A80B24C1E699AD1CE" style="OLC"><section id="H4BE1C5D29DB64F7482BD52DC09FA11D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Rural Telehealth Access Act of 2021</short-title></quote>. </text></section><section id="HFD5239CB199C45F29DF0CFE068AC5F9D" section-type="subsequent-section"><enum>2.</enum><header>Increasing rural telehealth access</header><subsection id="H0B8123ED28374228B3845629580DF1E7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Subsection (a) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended—</text><paragraph id="H02EED7E45BA6496096BDDDF3383CBE6B"><enum>(1)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (7) and (8), respectively; and</text></paragraph><paragraph id="HEF5CA20B65A542A9848149DADC15D9A5"><enum>(2)</enum><text>by inserting after paragraph (5), the following:</text><quoted-block style="OLC" id="HAFF0FF5AB47449259AF13346BDD7A783" display-inline="no-display-inline"><paragraph id="HEA0EF8DCB9DB4452B25A631E90B5D7DE"><enum>(6)</enum><header>Remote patient monitoring technology</header><text display-inline="yes-display-inline">The term <term>remote patient monitoring technology</term> means digital technologies used to collect medical and other forms of health data from individuals in one location and electronically transmit such data securely to health care providers in a different location for assessment, recommendations, and interventions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H23276DA77C2640049D9E216836D6A76C"><enum>(b)</enum><header>Programs</header><text>Subsection (b) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended—</text><paragraph id="H26BC512500AF4C1490A1D2B2D3F74FAA"><enum>(1)</enum><text>by striking <quote>The Secretary shall establish, under section 301</quote> and inserting the following:</text><quoted-block style="OLC" id="H2C386FD9AEBA48EA94C1882C13B28B21" display-inline="no-display-inline"><paragraph id="H7A3A24CFE94A43D1AB1DE12159220820"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish, under section 301</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA6EC61B53B6E46D6829656255A3134B0"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HB95E9E3587A34A8F95BED47ABB322169" display-inline="no-display-inline"><paragraph id="HD0933C5FFD7E4C019D4C8F11BFC4F576"><enum>(2)</enum><header>Virtual health pilot program</header><text display-inline="yes-display-inline">The Secretary shall establish a virtual health pilot program to facilitate utilization of remote patient monitoring technology to maintain or expand access to health care services for individuals in rural areas.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8A28B227974747F285A1988738A5BD39"><enum>(c)</enum><header>Grants</header><text display-inline="yes-display-inline">Subsection (d) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H53B1DB4B6D4B40C48C19E7B75C0473D4" display-inline="no-display-inline"><paragraph id="H39FAEA81260D4E30AFCAA69A7DD149E3"><enum>(3)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">The Director shall, in carrying out the virtual health pilot program referred to in subsection (b)(2), award grants to eligible entities to facilitate utilization of remote patient monitoring technology in rural areas to—</text><subparagraph id="HDA1AD6E370F24CE28C7480DCBB0AFD27"><enum>(A)</enum><text>maintain or expand access to, and coordinate health care services for, individuals with chronic conditions;</text></subparagraph><subparagraph id="HB9B77D0C0BA842E4A13FFAD1FC8FFE38"><enum>(B)</enum><text>improve and expand the training of health care providers using remote patient monitoring technology; and</text></subparagraph><subparagraph id="H222C9C8E0EC34E7BBF1E4B150D4AC1FF"><enum>(C)</enum><text display-inline="yes-display-inline">minimize challenges facing health care providers and health care facilities, including rural health clinics, community health centers, community behavioral health centers, long-term care facilities, and rural hospitals, as such providers and facilities serve their communities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H854BE94679C340EC98D52D6652A9E75D"><enum>(d)</enum><header>Grant periods</header><text display-inline="yes-display-inline">Subsection (e) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended—</text><paragraph id="H82814B3B22124A79B217D6C42885742A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Director may award grants under this section</quote> and inserting the following:</text><quoted-block style="OLC" id="H7A4DD7F78D7C454CAD0B39E9915A5352" display-inline="no-display-inline"><paragraph id="H5A3C597A0E9A4319B7BBCD11564F7897"><enum>(1)</enum><header>Telehealth network and telehealth research center grants</header><text display-inline="yes-display-inline">The Director may award grants under paragraphs (1) and (2) of subsection (d)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HAC5364A831B241559333110523D32778"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HCD6755F500024BDE92B6CE424136DBEE" display-inline="no-display-inline"><paragraph id="H1926C80EC8F749549FB7519FDC84B329"><enum>(2)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">The Director shall—</text><subparagraph id="HA04EB97241C542BD90E169F32B0FF2BB"><enum>(A)</enum><text>not later than 30 days after the date of enactment of <short-title>Increasing Rural Telehealth Access Act of 2021</short-title>, issue a notice of the availability of funding through grants under subsection (d)(3); and</text></subparagraph><subparagraph id="H270ABD090EBA460AB0DED103903B96D7"><enum>(B)</enum><text>not later than 90 days after the date of issuance of the notice required by subparagraph (A), award all grants under subsection (d)(3).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6B05CB4908AA4D2395109C6029804A88"><enum>(e)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">Subsection (f) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC2D2992B055D4AEAB8B2815D6AFC74FB" display-inline="no-display-inline"><paragraph id="H22F29121D7704EECB23FB1EE0202F922"><enum>(4)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (d)(3), an entity shall—</text><subparagraph id="HDE059DA89BA24B83800959C8665037A0"><enum>(A)</enum><text display-inline="yes-display-inline">meet the requirements of paragraphs (1), (2), and (3) of this subsection that apply to an entity seeking a grant under subsection (d)(1);</text></subparagraph><subparagraph id="H01A738326C38493B9C755F895AE2393D"><enum>(B)</enum><text>be located in a rural area; and</text></subparagraph><subparagraph id="H0ADD8E005972454BA88063B5DAC6F677"><enum>(C)</enum><text>demonstrate that the entity will provide services using remote patient monitoring technology that is—</text><clause id="H780F26CA380F4AD28421794CD38C444A"><enum>(i)</enum><text>cellular enabled;</text></clause><clause id="H3CD1E574DEAD41E8B6148E1F16B9E600"><enum>(ii)</enum><text display-inline="yes-display-inline">approved, cleared, or authorized by the Food and Drug Administration; and</text></clause><clause id="H3AE24B21B1354D2A8EA5B89AB67FB05A"><enum>(iii)</enum><text display-inline="yes-display-inline">operable using cellular standards, including 2G and 3G, that offer broad network coverage in rural areas without broadband access, as determined by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H93C57413B518460FAB53DE6C9C334756"><enum>(f)</enum><header>Applications</header><text display-inline="yes-display-inline">Subsection (g) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended—</text><paragraph id="HC8CA4579E44042D9ADE46ED06B4224AA"><enum>(1)</enum><text>by redesignating paragraphs (1) through (8) as subparagraphs (A) through (H), respectively, and moving the margin of each such redesignated subparagraph 2 ems to the right;</text></paragraph><paragraph id="H8A290C4102F846A4AEB81F3288EAA226"><enum>(2)</enum><text>by striking <quote>To be eligible to receive a grant under subsection (d)</quote> and inserting the following:</text><quoted-block style="OLC" id="HB5824282198944E0B65F265E774A0E06" display-inline="no-display-inline"><paragraph id="H4A035BD7E8BD46958003386CC9FA34F8"><enum>(1)</enum><header>Telehealth network and telehealth research center grants</header><text display-inline="yes-display-inline">To be eligible to receive a grant under paragraph (1) or (2) of subsection (d)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H071CF3A0FF974839A9D06D3D9CE5ED39"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HBB853201CA6A4557962056010A18FE91" display-inline="no-display-inline"><paragraph id="H6F8F3B898F764A1D8F2C4592F47516D3"><enum>(2)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (d)(3), an eligible entity shall prepare and submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require and include in such application—</text><subparagraph id="H4C4A350B50C946918ECFADF96133FE1B"><enum>(A)</enum><text>a description of the project that the eligible entity will carry out using the funds provided under the grant;</text></subparagraph><subparagraph id="H210A5EEB230646EEB26202A216B3FD0D"><enum>(B)</enum><text>a description of the manner in which the project funded under the grant will meet the health care needs of rural or other populations to be served through the project, or maintain or improve access to services of, and the quality of the services received by, those populations;</text></subparagraph><subparagraph id="H083474FE74A44079ABB7B2AA6EBAE6E0"><enum>(C)</enum><text>information on the source and amount of non-Federal funds that the entity will provide for the project; and</text></subparagraph><subparagraph id="H2DA4EB5285864F8E9C5BF9DDD03731BD"><enum>(D)</enum><text display-inline="yes-display-inline">evidence of intent to provide services using remote patient monitoring technology as described in subsection (f)(4)(C).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB0BECB999C124197868A3668B53028DD"><enum>(g)</enum><header>Preferences</header><text display-inline="yes-display-inline">Subsection (h) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H388C80B2C260454392FAD77DA7022575" display-inline="no-display-inline"><paragraph id="H448D997ECDC44DCC8586DABDE2CE263C"><enum>(3)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">In awarding grants under subsection (d)(3), the Secretary shall give preference to any eligible entity that—</text><subparagraph id="H4871B633D5BB4983ACA393393C986BFE"><enum>(A)</enum><text>is able to establish a virtual health program using remote patient monitoring technology within 60 days of receipt of the award; and</text></subparagraph><subparagraph id="H50632329235D487D8C2A7FDFCF632B84"><enum>(B)</enum><text display-inline="yes-display-inline">proposes to use Federal funds made available through such a grant to establish and furnish services using remote patient monitoring technology that provides real time, continuous coaching services.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA6F370DD8B114B5A90809FA5E0E15C7F"><enum>(h)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Subsection (j) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HB81CEDAAF15D4658BF700D49FD939E03" display-inline="no-display-inline"><paragraph id="HCE25C3AD5B9B4E35BECD12B55ADEBAA5"><enum>(3)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">The recipient of a grant under subsection (d)(3) may use funds received through such grant for salaries, equipment, and operating or other costs for—</text><subparagraph id="H0C2122C7BA514BFCBC537561A9F3CB6B"><enum>(A)</enum><text>developing and delivering services using remote patient monitoring technology that enhance access to community-based health care services in rural areas;</text></subparagraph><subparagraph id="HBC56AFF861894A038444113D0AD09416"><enum>(B)</enum><text>developing and acquiring, through lease or purchase, computer hardware and software, audio and video equipment, computer network equipment, interactive equipment, data terminal equipment, and other equipment that furthers the objectives of the virtual health pilot program;</text></subparagraph><subparagraph id="HE704F82466284A0384653379B155AD5A"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H848F2CAB4B754485A7B2CAE13D3DA5A7"><enum>(i)</enum><text>providing for transmission of medical data, and maintenance of equipment; and</text></clause><clause id="H080BE5805DE846BAB2E66DC0828D1E1E" indent="up1"><enum>(ii)</enum><text>providing for compensation (including travel expenses) of specialists, and referring health care providers, who are providing virtual health services through remote patient monitoring technology if no third-party payment is available; </text></clause></subparagraph><subparagraph id="H67541A52B3174DD0B1FD87995D2AD329"><enum>(D)</enum><text>collecting and analyzing usage statistics and data to document the cost-effectiveness of services using remote patient monitoring technology; and</text></subparagraph><subparagraph id="H76C2F721C82648AE985DC7D3AFE2B1D4"><enum>(E)</enum><text>carrying out such other activities as are consistent with achieving the objectives of the virtual health pilot program, as determined by the Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF7E749724F7F4150A0C4B2A10518660E"><enum>(i)</enum><header>Funding</header><text display-inline="yes-display-inline">Subsection (q) of section 330I of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-14">42 U.S.C. 254c–14</external-xref>) is amended—</text><paragraph id="HC7003E07221C4601BC29E738960C87F4"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Authorization of appropriations</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Funding</header-in-text></quote>; </text></paragraph><paragraph id="H8D8AA1418EE846D58E94E8AEBD4C3B64"><enum>(2)</enum><text>by striking <quote>There are authorized to be appropriated to carry out this section</quote> and inserting the following:</text><quoted-block style="OLC" id="HB66360294B4848E3835280A3D302A5D9" display-inline="no-display-inline"><paragraph id="H349D7D40C1EE4566B72757FEAF7D25FF"><enum>(1)</enum><header>Telehealth network and telehealth research center grants</header><text display-inline="yes-display-inline">To carry out this section with respect to grants under paragraphs (1) and (2) of subsection (d), there is authorized to be appropriated</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4966995F6F3C4E7BBA7919A7C665FA62"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HBCE726BDF9D6408593D132436DBF8E24" display-inline="no-display-inline"><paragraph id="H984D3242D204438B9C4238AAF374EA2C"><enum>(2)</enum><header>Virtual health network pilot program grants</header><text display-inline="yes-display-inline">To carry out this section with respect to the virtual health pilot program under subsection (b)(2), including grants under subsection (d)(3), there is authorized to be appropriated $50,000,000, to remain available until expended.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H23F8471EC8B3457ABE7034E78AF96604"><enum>(j)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than two years after awarding all grants under subsection (d)(3) of section 330I of the Public Health Service Act, as added by this section, the Secretary of Health and Human Services shall prepare and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on the activities and outcomes of the pilot program under subsection (b)(2) of section 330I of such Act, as added by this section.</text></subsection></section></legis-body></bill>
