R. 4004</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210617">June 17, 2021</action-date><action-desc><sponsor name-id="L000589">Mrs. Lesko</sponsor> (for herself, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="D000616">Mr. DesJarlais</cosponsor>, <cosponsor name-id="L000578">Mr. LaMalfa</cosponsor>, and <cosponsor name-id="R000612">Mr. Rose</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Federal funding for institutions of higher education that have partnerships with schools or other organizations funded by North Korea, and for other purposes.</official-title></form><legis-body id="HBCD2C2E176A3472980ABC0A2DDE93F52" style="OLC"><section id="H434A248AE43A41108F23D1F07244A3E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Student Exchanges with North Korean Schools Act</short-title></quote>. </text></section><section id="H2ACEFFB828DA4EE79DCE3724257C0FC8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H96E8A38219B54ED1AD0D26335B91A7DD"><enum>(1)</enum><text display-inline="yes-display-inline">The General Association of Korean Residents in Japan, also known as Chongryon, is an affiliated organization with the Government of the Democratic People’s Republic of North Korea, also known as North Korea.</text></paragraph><paragraph id="HF35F792B0271443DB38BFFFD723E5AFE"><enum>(2)</enum><text>Chongryon has a long history of assisting the North Korean Government, including operating a ferry that was suspected to have smuggled materials for the country’s illegal weapons programs.</text></paragraph><paragraph id="HD02469EB2ABC46D0AE676F5705444BCC"><enum>(3)</enum><text>Due to these actions, Chongryon is under surveillance from Japanese law enforcement agencies.</text></paragraph><paragraph id="H704A095BE7B841C6B8AB5CE21A007691"><enum>(4)</enum><text>Chongryon and its members run numerous organizations and companies, including banks and educational institutions in various cities across Japan.</text></paragraph><paragraph id="HA5D381AD61A44D76A3D0C408740A4D31"><enum>(5)</enum><text>Chongryon operates over 100 educational institutions, including Korea University, located in Kodaira, Tokyo.</text></paragraph><paragraph id="H9572C8CDD0D14748BB04AC979A8514A6"><enum>(6)</enum><text>Korea University received funding directly from the North Korean government every year since 1957, including over 132.4 million yen in 2002.</text></paragraph></section><section id="H702C2A203E4E4AEB939A6A566829E116"><enum>3.</enum><header>Prohibition on availability of funds for certain institutions</header><text display-inline="no-display-inline">Section 105 of the Mutual Educational and Cultural Exchange Act of 1961 (<external-xref legal-doc="public-law" parsable-cite="pl/87/256">Public Law 87–256</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2455">22 U.S.C. 2455</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HF541DFC1CAEA4122B695CD70E383CD23" display-inline="no-display-inline"><subsection id="H05F3326473DC4217BB135BDE6D45C9E6"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H658D67327A8C472DB1599A9A78E874C3"><enum>(1)</enum><text display-inline="yes-display-inline">No covered funds may be awarded to an institution of higher education that has an agreement in effect with an institution of higher education or other organization funded directly by the Government of the Democratic People’s Republic of North Korea.</text></paragraph><paragraph id="HB9EDC187682C4D9A97913360B0EEF135" indent="up1"><enum>(2)</enum><text>In this subsection:</text><subparagraph id="H0BA676A72FFA439A8DE7E65401FA789C"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>covered funds</term> means Federal funds made available—</text><clause id="H94C2600EC48842F3B462FD7687A03343"><enum>(i)</enum><text>under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>); and</text></clause><clause id="HC0642985F450408D8F7C10FBC71E6914"><enum>(ii)</enum><text display-inline="yes-display-inline">for the J. William Fulbright Educational Exchange Program referred to in section 112.</text></clause></subparagraph><subparagraph id="H89B6DF109467494B8FD9B222F283148C"><enum>(B)</enum><text>The term <term>institution of higher education</term> has the meaning given that term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
