which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure the humane treatment of pregnant women by reinstating the presumption of release and prohibiting shackling, restraining, and other inhumane treatment of pregnant detainees, and for other purposes.</official-title></form><legis-body id="H923A276432AD4D4E9CD9BCE6D4FA422C" style="OLC"><section section-type="section-one" id="HFC4D90B4136C40ED83253EDC9BD5EA70"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Shackling and Detaining Pregnant Women Act</short-title></quote>.</text></section><section id="H000BA162089046099704B697A6908B44"><enum>2.</enum><header>Limitation on detention of pregnant women and mothers of newborns</header><subsection id="H686EC9901ED04AD1910202C8331F46E5"><enum>(a)</enum><header>Presumption of release</header><paragraph commented="no" display-inline="no-display-inline" id="H04DD0F9F758049CEAFA10DAD2F0535A3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="H73C62517B754470CB4FF0EB5FB3657E7"><enum>(A)</enum><text display-inline="yes-display-inline">shall not detain an individual under any provision of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) during pregnancy or postpartum recovery, pending a decision with respect to whether the individual is to be removed from the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA260131136C945CDA2CE2A88C7764879"><enum>(B)</enum><text>shall immediately release any detainee found to be pregnant.</text></subparagraph></paragraph><paragraph id="H940D2756D9944DB4972276DBC779FB9F"><enum>(2)</enum><header>Exceptions</header><text>The Secretary may detain pursuant to the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) an individual during pregnancy or postpartum recovery under extraordinary circumstances in which the Secretary makes an individualized determination that credible, reasonable grounds exist to believe that the individual presents an immediate and serious threat of hurting themselves or others.</text></paragraph><paragraph id="H056D0205EACC442CB8FE695993E56002"><enum>(3)</enum><header>Removal</header><text>In a case in which detention is the least restrictive means of effectuating the removal from the United States of a pregnant individual subject to a final order of deportation or removal, the Secretary may, solely for the purpose of such deportation or removal, detain the pregnant individual for a period that is—</text><subparagraph id="H3012F2F40D31409CB19D92E574357492"><enum>(A)</enum><text>the shortest possible period immediately preceding the deportation or removal of the individual from the United States; and</text></subparagraph><subparagraph id="H7939FA4FA2BB4C5282B089F63792ACCF"><enum>(B)</enum><text>not more than 5 days.</text></subparagraph></paragraph></subsection><subsection id="H4B31F797633144E7BDA23B213831D6CE"><enum>(b)</enum><header>Weekly review required</header><paragraph id="H9CA89270058A4B0A9329605228A0E255"><enum>(1)</enum><header>In general</header><text>With respect to a detainee detained under paragraph (2) of subsection (a), not less frequently than weekly, the Secretary shall conduct an individualized review to determine whether the detainee continues to be subject to detention under that paragraph.</text></paragraph><paragraph id="H204117C2ACB74BDE9308D554699A3714"><enum>(2)</enum><header>Release</header><text>In the case of a determination under paragraph (1) that a pregnant detainee is not subject to detention under subsection (a)(2), not later than 1 day after the date on which the Secretary makes the determination, the Secretary shall release the detainee.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H1F0F1DABB5E54B07A232FF5923062369"><enum>3.</enum><header>Humane treatment of pregnant women while in detention</header><subsection id="H1281228C08D14C82959AB0647F2DF56E"><enum>(a)</enum><header>Prohibition on restraint of pregnant detainees</header><paragraph id="H6F8DD9E5FE3547D9875CF723BC38DC46"><enum>(1)</enum><header>Prohibition</header><text>Except as provided in paragraph (2), a detention facility shall not use a restraint on a detainee—</text><subparagraph id="H37B26ABDF7774A7FA07452ABFFC81079"><enum>(A)</enum><text>known to be pregnant, including during—</text><clause id="HFFDB512F327F404FA3EF9722B5270F56"><enum>(i)</enum><text>labor;</text></clause><clause id="H1FF1324295F54AA9B4387B3B909E0880"><enum>(ii)</enum><text>transport to a medical facility or birthing center; and</text></clause><clause id="H732BF62020694F2BA2CDEFFA038D8AEE"><enum>(iii)</enum><text>delivery; or</text></clause></subparagraph><subparagraph id="H3B053DE9A1764CAD805024D1C3F5D4DF"><enum>(B)</enum><text>during postpartum recovery.</text></subparagraph></paragraph><paragraph id="H0798B3C9A63443498E420A91E82B2EE9"><enum>(2)</enum><header>Use of restraints for medical purposes and in extraordinary circumstances</header><subparagraph id="H310532F92CAE449EBFAD7790AF525DF0"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1), subject to subparagraph (B), use of a restraint on a detainee described in paragraph (1) may be permitted only—</text><clause id="HC22B6DDF9FF54C5082E4B6A7E8DD8858"><enum>(i)</enum><text>for a medical purpose if the lead medical staff of the detention facility who is a licensed health care provider has ordered the use of the restraint for the medical purpose; or</text></clause><clause id="HC6078752AD814F7FAF555F1777F7B821"><enum>(ii)</enum><text>in an extraordinary circumstance, except for a medical purpose, in which the facility administrator has ordered the use of the restraint after making an individualized determination that—</text><subclause id="HDA387D0BFC24441E967D699B1C5A6A65"><enum>(I)</enum><text>credible, reasonable grounds exist to believe the detainee presents an immediate and serious threat of hurting staff or others; or</text></subclause><subclause id="HD043B09123CB40B09F91FC5076061C96"><enum>(II)</enum><text>reasonable grounds exist to believe the detainee presents an immediate and credible risk of escape that cannot be reasonably minimized through any other method.</text></subclause></clause></subparagraph><subparagraph id="HBC2C7C9ACCFF4EAB8EF30CBCBF74910E"><enum>(B)</enum><header>Requirement for least restrictive restraints</header><text>In the rare event of an extraordinary circumstance described in subparagraph (A)(ii), only the least restrictive restraint necessary shall be used, except that—</text><clause id="H23C02F13D3684C64BB42DFF5E795C49D"><enum>(i)</enum><text>if a doctor, nurse, or other health professional treating a detainee described in paragraph (1) requests that a restraint not be used, the detention officer accompanying the detainee shall immediately remove any restraint;</text></clause><clause id="H4743A7FD20544D98BC76532CF251978A"><enum>(ii)</enum><text>under no circumstance shall a leg, waist, or 4-point restraint be used;</text></clause><clause id="H3B553FCA027E4E96939973AE9A0277EE"><enum>(iii)</enum><text>under no circumstance shall a wrist restraint be used to bind the hands of such a detainee behind the back of the detainee or to another individual; and</text></clause><clause id="HD1EC92C66489436BBFB2F5A14BF31F4E"><enum>(iv)</enum><text>under no circumstance shall any restraint be used on any detainee who is in labor or delivering.</text></clause></subparagraph></paragraph><paragraph id="H2B84A15C62AC4EF58842461867263E97"><enum>(3)</enum><header>Record of extraordinary circumstances</header><subparagraph id="H587E010258AC4E2691A72C3EAF5A9017"><enum>(A)</enum><header>Requirements</header><text>If a restraint is used on a detainee pursuant to paragraph (2)(A), not later than 5 days after the date on which the restraint was used, the facility administrator shall—</text><clause id="H5BF9EEE3F00146BB8B0CEE288A321978"><enum>(i)</enum><text>make a written finding that describes the medical purpose or extraordinary circumstance that dictated the use of the restraint; and</text></clause><clause id="HA8CF49180C9849F7B3FA40B396A140C0"><enum>(ii)</enum><text>submit the finding to the Director.</text></clause></subparagraph><subparagraph id="H7A202E2773A345E9B76B282A9908EBB3"><enum>(B)</enum><header>Retention</header><clause id="H965B1EA1D4A34E8DA94B4E1F02A1A505"><enum>(i)</enum><header>Detention facility</header><text>With respect to a written finding under subparagraph (A)(i), the facility administrator shall—</text><subclause id="H51FC6C13F0A74F7D81827B21B9C7F238"><enum>(I)</enum><text>keep the finding on file at the applicable detention facility for not less than 5 years after the date on which the restraint was used; and</text></subclause><subclause id="H3919335E93044094B8640FCF8B556B1D"><enum>(II)</enum><text>make the finding available for public inspection.</text></subclause></clause><clause id="HBEA72CBC088B496E8809A365F2C9D100"><enum>(ii)</enum><header>Immigration and Customs Enforcement</header><text>With respect to a written finding submitted to the Director under subparagraph (A)(ii), the Director shall maintain the written finding and make the finding available for public inspection.</text></clause><clause id="H651194D560EA40E88CADF315BDE3E434"><enum>(iii)</enum><header>Privacy</header><text>With respect to a written finding made available for public inspection under clause (i) or (ii), the individually identifying information of a detainee shall not be made available for public inspection without the prior written consent of the detainee.</text></clause></subparagraph></paragraph></subsection><subsection id="HA5419D0636E540D49E296D1C8B300916"><enum>(b)</enum><header>Prohibition on presence of detention officers</header><paragraph id="H6C74EFB7C44C4CDCBE49F1085D5FB53A"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), no detention officer shall be present in the room during a pelvic exam, labor, delivery, or treatment of any other symptom relating to a pregnancy of a detainee, unless specifically requested by medical personnel.</text></paragraph><paragraph id="H535ECFFAAC7540C5841840977EFA83C7"><enum>(2)</enum><header>Exception</header><text>If the presence of a detention officer is requested by medical personnel, the detention officer shall—</text><subparagraph id="H8403399E38A44D6694FE6A4D60A0FD06"><enum>(A)</enum><text>be female, if practicable; and</text></subparagraph><subparagraph id="H1C41E0C6D63345F3A4DE8D9682D414C0"><enum>(B)</enum><text>remain at a reasonable distance from the detainee and toward the detainee's head to protect detainee's privacy.</text></subparagraph></paragraph><paragraph id="H05D5256F33294C04A52C31729E1DDA60"><enum>(3)</enum><header>Use of restraints</header><text>If a restraint is used on a detainee pursuant to subsection (a)(2)(A), a detention officer shall remain immediately outside the room at all times so that the officer may promptly remove the restraint if requested by medical personnel, as required by subsection (a)(2)(B)(i).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB8D3B665212A4D6F984AD208670627F2"><enum>(c)</enum><header>Access to services</header><text>A pregnant detainee shall have access to health care services, including comprehensive services relating to reproductive health care and pregnancy, including—</text><paragraph commented="no" display-inline="no-display-inline" id="H0EAD736E984943F1980E116D11962103"><enum>(1)</enum><text>routine or specialized prenatal care;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71500174A9AA4203983665ABB4341F14"><enum>(2)</enum><text>comprehensive counseling and assistance;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1C13ECDB46CB498AA8D4E2EA0731E17B"><enum>(3)</enum><text>postpartum follow-up;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H775BA0D8DA144D1E86DE3743FBCF475A"><enum>(4)</enum><text>lactation services; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H88B6B32BB66944248A1E94059BDBE951"><enum>(5)</enum><text>abortion services.</text></paragraph></subsection></section><section id="H5E483F436CAC4761961567E758A7FA6A"><enum>4.</enum><header>Notice of rights and training</header><subsection id="H9DEDF06368A64A91873CF66E71A4B295"><enum>(a)</enum><header>Notice of detainee rights</header><text>The Secretary shall provide to each detainee, in the detainee's native language, notice of the detainee's rights under this Act.</text></subsection><subsection id="H33311B4EA8EA401389BF9984BDA984C3" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Training for DHS employees</header><text display-inline="yes-display-inline">At the time of hiring, and annually thereafter, the Secretary shall provide training on the requirements of this Act to each employee of the Department of Homeland Security who has a role in the detention or care of a pregnant detainee or a postpartum parent of a newborn detained under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>). </text></subsection></section><section id="HAAD12463755C4AB8BC5EBBF4F5AE3628"><enum>5.</enum><header>Reporting; rulemaking</header><subsection id="H1BB51F2727734F648B39210E992C4F00"><enum>(a)</enum><header>Reports</header><paragraph id="H41C59D2A32914A4BAC5408D48B0D16BE"><enum>(1)</enum><header>Reports by facility administrators</header><text>Not later than 30 days after the end of each quarter fiscal year, the facility administrator of each detention facility that detained a pregnant detainee during the quarter shall submit to the Secretary a written report that includes, with respect to the detention facility during the quarter, the following:</text><subparagraph id="H40C11295338A445CB44855A93B7B7A50"><enum>(A)</enum><text>An account of every instance of the use of a restraint on a pregnant detainee, including the justification for such restraint and the name of the facility administrator who made the individualized determination under section 3(a)(2)(A)(ii).</text></subparagraph><subparagraph id="H21163E4E86914D128361FEF96F048267"><enum>(B)</enum><text>The number of pregnant detainees held at the detention facility.</text></subparagraph><subparagraph id="H3796D97AC7A6424FAF2C265B1537D6C8"><enum>(C)</enum><text>The average length of detention of pregnant detainees.</text></subparagraph><subparagraph id="HFF1197237053458EBDA234CC17AC1B8D"><enum>(D)</enum><text>The number of pregnant detainees detained longer than 15 days.</text></subparagraph><subparagraph id="H7A94577EFBD7480191D4E1DB4672EA71"><enum>(E)</enum><text>The number of pregnant detainees detained longer than 30 days.</text></subparagraph></paragraph><paragraph id="HE001A1145FF5496899693369FB0A6B51"><enum>(2)</enum><header>Audit and reports by Secretary</header><text>Not later than 90 days after the end of each fiscal year, the Secretary shall—</text><subparagraph id="H5C3CDCA1286E4AB59AEDBAE3CFF9A8F3"><enum>(A)</enum><text>complete an audit of the information submitted under subparagraphs (B) through (E) of paragraph (1); </text></subparagraph><subparagraph id="H64F4B36429724D30AC03C26CB2499A38"><enum>(B)</enum><text>submit to the appropriate committees of Congress a report that includes all information submitted under paragraph (1), dis­ag­gre­gated by detention facility; and </text></subparagraph><subparagraph id="H7BBB162F897F42DAB9DE6262FA2CEEE5"><enum>(C)</enum><text>issue regulations in accordance with national standards regarding minimum standards facilities should provide. </text></subparagraph></paragraph><paragraph id="H0E010277C2C44055AF9BD22C3BD71FFB"><enum>(3)</enum><header>Privacy</header><text>A report submitted under this subsection shall not contain the individually identifying information of any detainee.</text></paragraph><paragraph id="H2497C83436BB4BB480C28FE6AC781B0E"><enum>(4)</enum><header>Public inspection</header><subparagraph id="HF96195F0C69E40A4A6EE0932CB8B1D4F"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), a report submitted under this subsection shall be made available for public inspection.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFFA9D72EB551405B8A53C269EE6EF5EE"><enum>(B)</enum><header display-inline="yes-display-inline">Facility administrator</header><text display-inline="yes-display-inline">A report submitted under this subsection that is made available for public inspection shall not contain the name of the facility administrator otherwise included under paragraph (1)(A).</text></subparagraph></paragraph></subsection><subsection id="HCF9F1A807B2347DE819983094F81D162"><enum>(b)</enum><header>Rulemaking</header><text>The Secretary and the Attorney General shall adopt regulations or policies to carry out this Act at each detention facility.</text></subsection></section><section id="HA056A326E2624BFF873F6E46DB809F8D"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HED169C50D4D349B499D42B91F7C38748"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="H1D18970063F14B55A07645D757CBEECB"><enum>(A)</enum><text>the Committee on the Judiciary and the Committee on Appropriations of the Senate; and</text></subparagraph><subparagraph id="HE985467369874DA1A6E011B7A10403E0"><enum>(B)</enum><text>the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H01FA995522D94FFFBFCF6E42A45D42AB"><enum>(2)</enum><header>Detainee</header><text>The term <term>detainee</term> includes any adult or juvenile individual detained by any Federal, State, or local law enforcement agency (including under contract or agreement with such agency) under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></paragraph><paragraph id="H2AEE73860C0D4DBFAA7D05F5E73E67BD"><enum>(3)</enum><header>Detention facility</header><text>The term <term>detention facility</term> means a Federal, State, or local government facility, or a privately owned and operated facility, that is used, in whole or in part, to hold individuals under the authority of the Director of U.S. Immigration and Customs Enforcement or the Commissioner of U.S. Customs and Border Protection, including a facility that—</text><subparagraph id="HF172F4153CB445B7A0EF000A8624E5C0"><enum>(A)</enum><text>holds such individuals under a contract or agreement with the Director or Commissioner; or</text></subparagraph><subparagraph id="H0FC811EBA61E4568ADC8EA6BDADFFB70"><enum>(B)</enum><text>is used, in whole or in part, to hold individuals pursuant to an immigration detainer or similar request.</text></subparagraph></paragraph><paragraph id="H221763DEB0DD43FFBD65DC5CAB72B510"><enum>(4)</enum><header>Detention officer</header><text>The term <term>detention officer</term> means an individual who works at a detention facility, including an individual who works at a detention facility pursuant to contract or subcontract.</text></paragraph><paragraph id="HE840D9133EFA4E8BAF84BA27330DABE2"><enum>(5)</enum><header>Director</header><text>The term <term>Director</term> means the Director of U.S. Immigration and Customs Enforcement.</text></paragraph><paragraph id="HD7D064B66CF44FE389BDEF13C01371C7"><enum>(6)</enum><header>Facility administrator</header><text>The term <term>facility administrator</term> means the official responsible for oversight of a detention facility or the designee of such official.</text></paragraph><paragraph id="H51353AA5A1FF464DBDC72C50D476630C"><enum>(7)</enum><header>Postpartum recovery</header><text>The term <term>post­par­tum recovery</term> means the 1-year period, or longer, as determined by the licensed health care provider of the individual concerned, following delivery, including the entire period during which the individual is in a medical facility, birthing center, or infirmary after birth.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D8593CD6A7C477E837357E28E319BBC"><enum>(8)</enum><header>Restraint</header><text>The term <term>restraint</term> means any physical restraint or mechanical device used to control the movement of the body or limbs of a detainee body, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="HABBEA2674E0B47A4B4226D75525D6F8E"><enum>(A)</enum><text>flex cuffs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H837C077EAC4B4EA6BDFEE4229A71E98C"><enum>(B)</enum><text>soft restraints;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H309741A39BAA43B3924E30432D986712"><enum>(C)</enum><text>hard metal handcuffs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAE91F256BB294739B41A1D98AD2660C3"><enum>(D)</enum><text>a black box;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEB3F04AB30704A71A79BC3AE0A834A37"><enum>(E)</enum><text>Chubb cuffs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H26D70009C7074839B182761E27F373C7"><enum>(F)</enum><text>leg irons;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3086AFDB9B584D7EB5375CE8358589D5"><enum>(G)</enum><text>belly chains;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BCF520A26454B0F9E61C89BA2F99EF0"><enum>(H)</enum><text>a security (tether) chain;
