R. 398</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="G000595">Mr. Good of Virginia</sponsor> (for himself, <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="B001274">Mr. Brooks</cosponsor>, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="G000589">Mr. Gooden of Texas</cosponsor>, <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>, <cosponsor name-id="B001302">Mr. Biggs</cosponsor>, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, <cosponsor name-id="A000375">Mr. Arrington</cosponsor>, <cosponsor name-id="G000576">Mr. Grothman</cosponsor>, and <cosponsor name-id="R000597">Mr. Rice of South Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to provide that an alien who has been convicted of a crime is ineligible for asylum, and for other purposes.</official-title></form><legis-body id="HBA18D46081F84C7884B0853D31E13257" style="OLC"><section id="HFCFD98FDC61B44A8A9E38B044FB12A35" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Asylum for Criminals Act of 2021</short-title></quote>.</text></section><section id="H401F3F7FAEF64764A1D83822BDFCB2CE"><enum>2.</enum><header>Aliens convicted of crimes ineligible for asylum</header><text display-inline="no-display-inline">Clause (ii) of section 208(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>) is amended—</text><paragraph id="H7D5A2C4D041C483C95A7C2806BF5EA47"><enum>(1)</enum><text>by amending clause (ii) of subparagraph (A) to read as follows: </text><quoted-block style="OLC" id="H0041ED14C4794F47885C87FE88CF1B07" display-inline="no-display-inline"><clause id="HF65C4CF4C62F48F2B60821870D43A890"><enum>(ii)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B), the alien has been finally convicted of a crime; </text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HC479E637AA8247D791DA10A20EDADBC1"><enum>(2)</enum><text>by amending subparagraph (B) to read as follows: </text><quoted-block style="OLC" id="H43CAE2E9565E4B17B531459AC3E22AB8" display-inline="no-display-inline"><subparagraph id="HB86F54AA8490413DBC68DBCF9438E423"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may designate by regulation political offenses committed outside the United States that will be not considered to be a crime described in clause (ii). The authority under this subparagraph is limited to political offenses committed outside the United States. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
