R. 3976</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210617">June 17, 2021</action-date><action-desc><sponsor name-id="B001305">Mr. Budd</sponsor> (for himself and <cosponsor name-id="M001210">Mr. Murphy of North Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide defense and security assistance to ensure the survival of Israel and its people from an existing or imminent military threat, and for other purposes.</official-title></form><legis-body id="H41C9EFA8F8F04AD2AB4FC5DAF368AEC0" style="OLC"><section id="HB823AC3C9E2143589374ADECAA2110DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America Stands with Israel Act</short-title></quote>.</text></section><section id="H3946989AD3EC485B88A0E86F44768307"><enum>2.</enum><header>Authority to address existing or imminent military threat to Israel</header><subsection id="H506AE82A7A5D44E79AADA7014C50829D"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">The President, upon request of the Prime Minister of Israel, is authorized to carry out such actions that may be necessary to ensure the survival of Israel and its people from an existing or imminent military threat, including threats from other countries, terrorist organizations, and violent extremist, cyber, and chemical, biological, and nuclear threats. Any activities carried out pursuant to such authority shall be conducted in a manner that appropriately protects the national security interests of the United States and the national security interests of Israel.</text></subsection><subsection id="H579B49758CEF4E74BA562105916F54D2"><enum>(b)</enum><header>Use of force</header><paragraph id="H7B74B6EF96554ECA9FFE8C60B1F000CF"><enum>(1)</enum><header>In general</header><text>In carrying out subsection (a), the President is authorized to use force and introduce United States Armed Forces—</text><subparagraph id="HDDD415F8CA94473195C216AC6ACD47F8"><enum>(A)</enum><text>into hostilities or into situations where imminent involvement in hostilities is clearly indicated by the circumstances;</text></subparagraph><subparagraph id="HC123DC3844D6416A9BA006DD6A9EAA59"><enum>(B)</enum><text>into the territory, airspace or waters of a foreign country, while equipped for combat; or</text></subparagraph><subparagraph id="H4D50BB65F18441CCADC59352F14B955D"><enum>(C)</enum><text>in numbers which substantially enlarge United States Armed Forces equipped for combat already located in a foreign country.</text></subparagraph></paragraph><paragraph id="H42D4BA92BACB437491299F9890E57B32"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 48 hours after exercising the authority under this subsection, the President shall submit to the Speaker of the House of Representatives and to the President pro tempore of the Senate a report, in writing, setting forth—</text><subparagraph id="H1E08EDF1B1184EE889B21A8FEA6AFD2E"><enum>(A)</enum><text>the circumstances necessitating the introduction of United States Armed Forces;</text></subparagraph><subparagraph id="HACA5209E0B974571984A0A1746C39262"><enum>(B)</enum><text>the constitutional and legislative authority under which such introduction took place; and</text></subparagraph><subparagraph id="H239E2D7FC8A8402986162DF1AD09D882"><enum>(C)</enum><text display-inline="yes-display-inline">the estimated scope and duration of the hostilities or any other situation described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="H9D21B6606F5E44AA97A9334817DE37F0"><enum>(c)</enum><header>Other information To be reported</header><text display-inline="yes-display-inline">The President shall provide such other information as Congress may request in the fulfillment of its constitutional responsibilities with respect to exercising the authority under subsection (b).</text></subsection><subsection id="H7C58A86707944AA882B8EBD3FDB391A3"><enum>(d)</enum><header>Periodic reports; semiannual requirement</header><text display-inline="yes-display-inline">Whenever United States Armed Forces are introduced into hostilities or into any other situation described in subsection (b), the President shall, so long as such Armed Forces continue to be engaged in such hostilities or situation, report to Congress periodically on the status of such hostilities or situation as well as on the scope and duration of such hostilities or situation, but in no event shall the President report to Congress less often than once every six months.</text></subsection></section><section id="H14FE35BC428A450F84F7AFE27710A805"><enum>3.</enum><header>Waiver for existing or imminent military threat to Israel</header><text display-inline="no-display-inline">Section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HCEA0837ED2FD4A8280C5E517E8320248" style="OLC"><subsection id="HBCFB128539D34BC88C5B656BE1D381AD"><enum>(l)</enum><header>Waiver for existing or imminent military threat to Israel</header><paragraph id="HB38EDB4FE4504B6589BB0F15735F0164"><enum>(1)</enum><header>In general</header><text>Upon receiving information that Israel is under an existing or imminent threat of military attack, the President may waive the requirements of this Act and direct the immediate transfer to Israel of such defense articles or services the President determines to be necessary to assist Israel in its defense against such threat. Amounts obligated or expended to carry out this paragraph shall not be subject to any limitation in law, or provision of any bilateral agreement, relating to the amount of United States assistance authorized to be made available to Israel.</text></paragraph><paragraph id="H72C02086C9DB4933BEE9945BA798A572"><enum>(2)</enum><header>Notification required</header><text display-inline="yes-display-inline">As soon as practicable after a transfer of defense articles or services pursuant to the authority provided by paragraph (1), the President shall provide a notification in writing to Congress of the details of such transfer, consistent with the requirements of section 36 of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
