applicability</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act, the provisions of chapters 2 through 6 of title II of the Trade Act of 1974, as in effect on June 30, 2021, and as amended by this Act, shall—</text><paragraph id="H23E6D53782AB42EFAC275109ED7A862C" display-inline="no-display-inline"><enum>(1)</enum><text>take effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="H843A53A115984838BC772C087C99536B"><enum>(2)</enum><text display-inline="yes-display-inline">apply with respect to petitions for certification filed under chapter 2, 3, 4, or 6 of title II of the Trade Act of 1974 on or after such date of enactment.</text></paragraph></subsection><subsection id="HB9C6962C766848E9BDE4DFC22B7569B4"><enum>(b)</enum><header>Reference</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a provision of chapters 2 through 6 of title II of the Trade Act of 1974, the reference shall be considered to be made to a provision of any such chapter, as in effect on June 30, 2021. </text></subsection><subsection id="H5FBDB4EA93E444F58BB1215D6D129FF9"><enum>(c)</enum><header>Repeal of snapback</header><text>Section 406 of the Trade Adjustment Assistance Reauthorization Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/114/27">Public Law 114–27</external-xref>; 129 Stat. 379) is repealed. </text></subsection></section><title id="H41A30C1189EC49B799B1DC367CBE17B6" style="OLC"><enum>I</enum><header>Trade Adjustment Assistance for Workers</header><section section-type="subsequent-section" id="H6F2775F480CD4675B4353F4798DE3A6F" commented="no"><enum>101.</enum><header>Filing petitions</header><text display-inline="no-display-inline">Section 221(a)(1) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271(a)(1)</external-xref>) is amended—</text><paragraph id="H52EE54157AE044F3B7E31C67C86F50D7"><enum>(1)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDF7D67AD9DDC40BFA23F23577B29DBBB"><subparagraph id="H3435F853513844848DF61F724B7CF694" indent="up1" commented="no"><enum>(A)</enum><text>One or more workers in the group of workers.</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HE1A644F3B4CB46C9B2D420E854F8EEEB" commented="no"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph id="H714379E1FE0C4417B3025246B7F501D2"><enum>(A)</enum><text>by striking <quote>or a State dislocated worker unit</quote> and inserting <quote>a State dislocated worker unit</quote>; and</text></subparagraph><subparagraph id="HAB9D7F7C9AE842548DD32169925F6F10"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end before the period the following: <quote>, or workforce intermediaries, including labor-management organizations that carry out re-employment and training services</quote>. </text></subparagraph></paragraph></section><section id="H1336D5AFEC1242D8A2414B4724566792"><enum>102.</enum><header>Group eligibility requirements</header><subsection id="H8DC0F12572A048B7B3F78617E4891871"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 222(a)(2) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272(a)(2)</external-xref>) is amended—</text><paragraph id="H2A485A5D802C40FBBCDCEA37B865387A"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><subparagraph id="H25A25AC176FB4439868C0AC5D251CBA1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by inserting <quote>or failed to increase</quote> after <quote>absolutely</quote>; and</text></subparagraph><subparagraph id="H8ECBA3214ECE414A96E7B00AB03CDFE4"><enum>(B)</enum><text>in clause (iii)—</text><clause id="HE2508D97D0F34E98AACCB05428029132"><enum>(i)</enum><text>by striking <quote>to the decline</quote> and inserting <quote>to any decline or absence of increase</quote>; and</text></clause><clause id="HDF023AD080B04CC2AB1D784B1E22C786"><enum>(ii)</enum><text>by striking <quote>or</quote> at the end;</text></clause></subparagraph></paragraph><paragraph id="H9B06FEFAB8DD40B19F3658327FB42E4A"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HBC91D18B604C4B099D6B3DC494AABE4B" commented="no"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HDD55EE2F8E7C48D893B0484B9A7DE6E4"><subparagraph id="H3242329D346D403CADBD9F663B8F2196" indent="up1" commented="no"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H69E6634DCFD84B26B7440E1072B4EAD8"><enum>(i)</enum><text display-inline="yes-display-inline">the sales or production, or both, of such firm have decreased;</text></clause><clause id="HB41E5C38FD6244A6A11EF1DFFB9F6A17" indent="up1" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HAC4921E09A7B4BB3844643CA7DAD500E"><enum>(I)</enum><text>exports of articles produced or services supplied by such workers’ firm have decreased; or</text></subclause><subclause id="H2E45361A11364753BB863B61863ACEDD" indent="up1"><enum>(II)</enum><text>imports of articles or services necessary for the production of articles or services supplied by such firm have decreased; and </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1DF9B18FFC004915AC2C448FC4E36A8C" indent="up1"><enum>(iii)</enum><text>the decrease in exports or imports described in clause (ii) contributed to such workers’ separation or threat of separation and to the decline in the sales or production of such firm.</text></clause></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBB0B1917C32A43F0B1A55FDC35DE0C64"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended—</text><paragraph id="HC499BE45249C45899A8F1F31471602C6"><enum>(1)</enum><text>in subsections (a) and (b), by striking <quote>importantly</quote> each place it appears; and</text></paragraph><paragraph id="HFA2F2A319FF14EAEA6BBCE48821FCA89"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="HF00F4115BF3D4BB786D94A4943141BAF"><enum>(A)</enum><text>by striking paragraph (1); and</text></subparagraph><subparagraph id="H4F1AC8ADD0834B5182CCA6760A658368"><enum>(B)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (1) through (3), respectively.</text></subparagraph></paragraph></subsection><subsection id="HE2CED75642004EA396A633913EC84B05" commented="no"><enum>(c)</enum><header>Eligibility of staffed workers and teleworkers</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>), as amended by subsection (b), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4E0E4B0532E74342B9B9B7A32DB3FC24"><subsection id="H4B470D6AB37C485BB0BAE19D6A71D80D" commented="no"><enum>(f)</enum><header>Treatment of staffed workers and teleworkers</header><paragraph id="HDBA448B5F31649F880D93DAE5E30645B" commented="no"><enum>(1)</enum><header>In general</header><text>For purposes of subsection (a), workers in a firm include staffed workers and teleworkers.</text></paragraph><paragraph id="HAD1F664617B942DFB912F05C33BA2D30" commented="no"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H1CB53E1BF79C4B07B8965934D8B243D6" commented="no"><enum>(A)</enum><header>Staffed worker</header><text>The term <term>staffed worker</term> means a worker who performs work under the operational control of a firm that is the subject of a petition filed under section 221, even if the worker is directly employed by another firm.</text></subparagraph><subparagraph id="HF957759C62D04EF583E950415C8A52C2" commented="no"><enum>(B)</enum><header>Teleworker</header><text>The term <term>teleworker</term> means a worker who works remotely but who reports to the location listed for a firm in a petition filed under section 221.</text></subparagraph></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section><section id="H743FC8E210064FB2BD41341D5F0F354D" commented="no"><enum>103.</enum><header>Application of determinations of eligibility to workers employed by successors-in-interest</header><text display-inline="no-display-inline">Section 223 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF1D24423A28B419F9A78FF2A8F9A8863"><subsection id="HE07BC3726F7542F8BA5D166FD019F919" commented="no"><enum>(f)</enum><header>Treatment of workers of successors-in-Interest</header><text>If the Secretary certifies a group of workers of a firm as eligible to apply for adjustment assistance under this chapter, a worker of a successor-in-interest to that firm shall be covered by the certification to the same extent as a worker of that firm.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="H6527F6C9B82E41B9BEC2E6248C628C9A"><enum>104.</enum><header>Provision of benefit information to workers</header><text display-inline="no-display-inline">Section 225 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2275">19 U.S.C. 2275</external-xref>) is amended—</text><paragraph id="HFBAD5C6071FB428392608931D3FB789B" commented="no"><enum>(1)</enum><text>in subsection (a), by inserting after the second sentence the following new sentence: <quote>The Secretary shall make every effort to provide such information and assistance to workers in their native language.</quote>; and</text></paragraph><paragraph id="HB8C9EDAB25DB48EC921BE4401612F431"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HC03B50C9486E42639DAF7C46B2CEB9E9" commented="no"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph><subparagraph id="H4B9C522CE7F84088BE7910314317CF1A" commented="no"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block id="H051C413EA2FE43BF8CA7EDF903EAE012" style="OLC"><paragraph id="H9058D971D42F42948D9E3F97F0F87CC7" commented="no" indent="up1"><enum>(2)</enum><text>The Secretary shall provide a second notice to a worker described in paragraph (1) before the worker has exhausted all rights to any unemployment insurance to which the worker is entitled (other than additional compensation described in section 231(a)(3)(B) funded by a State and not reimbursed from Federal funds).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAFA423A1A1CB449480061DBA07755349" commented="no"><enum>(C)</enum><text>in paragraph (3), as redesignated by paragraph (1), by inserting <quote>print or digital</quote> before <quote>newspapers</quote>; and</text></subparagraph><subparagraph id="H0BA5FA8F8B2045848D600AA020862D27"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block id="H0EB02711DD51402CACABFB1E60996BE5" style="OLC"><paragraph id="HE085B0C390E6464E98DA944790781CF7" indent="up1"><enum>(4)</enum><text>For purposes of providing outreach regarding the benefits available under this chapter to workers covered by a certification made under this subchapter, the Secretary may take any necessary actions, including the following:</text><subparagraph id="H8317FEE91CBC4E96987912B53840E7DB"><enum>(A)</enum><text>Collecting the email addresses and telephone numbers of such workers from the employers of such workers to provide outreach to such workers.</text></subparagraph><subparagraph id="H2F636F8D1EF04D4AB0AA035441B4DE8B"><enum>(B)</enum><text>Partnering with the certified or recognized union, a community-based worker organization, or other duly authorized representatives of such workers.</text></subparagraph><subparagraph id="H13846D9990EA463585F799881B09875F"><enum>(C)</enum><text>Hiring peer support workers to perform outreach to other workers covered by that certification.</text></subparagraph><subparagraph id="H04028B00C47A4DF286EB19763716A13A"><enum>(D)</enum><text>Using advertising methods and public information campaigns, including social media, in addition to notice published in print or digital newspapers under paragraph (3).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H8DD2B8D4D6354CA49A19CD2DB1B52C7A"><enum>105.</enum><header>Qualifying requirements for workers</header><subsection id="H2EF06D76AA234DE7B76438B74E28B12B"><enum>(a)</enum><header>Modification of conditions</header><paragraph id="H029B95BD75E84FABA949A9E36891A507"><enum>(1)</enum><header>In general</header><text>Section 231(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291(a)</external-xref>) is amended—</text><subparagraph id="HBC648E52953E4DF197C85C756DC1E454"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="HB263DACD83294F15B9CDAD7BA8D553AC"><enum>(B)</enum><text>by redesignating paragraphs (3), (4), and (5) as paragraphs (2), (3), and (4), respectively; and</text></paragraph><paragraph id="H94B7EB0EF5C241B5A5D2D1C5AEA7FAEB"><enum>(2)</enum><text>by inserting before subparagraph (D) (as redesignated) the following:</text><quoted-block style="OLC" id="H62E3A0942EEA4C37855C75548CC637EF" display-inline="no-display-inline"><subparagraph id="HEEE507B19B1945CA889F04EE6968CF9F"><enum>(A)</enum><header>Recall</header><text display-inline="yes-display-inline">The worker has been notified that the worker will be recalled by the firm from which the separation occurred.</text></subparagraph><subparagraph id="H234FDF7ED7104EB2BE2CB95C368C62E6"><enum>(B)</enum><header>Marketable skills</header><text>The worker possesses marketable skills for suitable employment (as determined pursuant to an assessment of the worker, which may include the profiling system under section 303(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(j)</external-xref>), carried out in accordance with guidelines issued by the Secretary) and there is a reasonable expectation of employment at equivalent wages in the foreseeable future.</text></subparagraph><subparagraph id="HA3F1ED77E45F4AE1AA38379A420CC72F"><enum>(C)</enum><header>Retirement</header><text>The worker is within 2 years of meeting all requirements for entitlement to either—</text><clause id="H7FD5943A5E6F401893F6B0E2D777E8CD"><enum>(i)</enum><text>old-age insurance benefits under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>) (except for application therefor); or</text></clause><clause id="HDF966B820DD54979BE5B9221633D093A"><enum>(ii)</enum><text>a private pension sponsored by an employer or labor organization.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H585671DC937B4174BF49C44A01FC993F"><enum>106.</enum><header>Modification to trade readjustment allowances</header><subsection id="H95CE3572FE5B4A1DBA035145F78997D2"><enum>(a)</enum><header>Payment To complete training</header><text>Section 233 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2293">19 U.S.C. 2293</external-xref>) is amended—</text><paragraph id="HE4D3BBA0435D4D46BF45CA417D386109"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HBBE95D9E9BEA4404A396E41755EA9EBE"><enum>(A)</enum><text>in paragraph (2), by inserting after <quote>104-week period</quote> the following: <quote>(or, in the case of an adversely affected worker who requires a program of prerequisite education or remedial education (as described in section 236(a)(5)(D)) in order to complete training approved for the worker under section 236, the 130-week period)</quote>;</text></subparagraph><subparagraph id="H5A5DCCC205CF4C9FAE3F21C67942F545"><enum>(B)</enum><text>in paragraph (3), by striking <quote>65 additional weeks in the 78-week period</quote> and inserting <quote>78 additional weeks in the 91-week period</quote>; and</text></subparagraph><subparagraph id="HC08D002336084888B44FF3000569FD0E"><enum>(C)</enum><text>in the flush text, by striking <quote>78-week period</quote> and inserting <quote>91-week period</quote>; and</text></subparagraph></paragraph><paragraph id="H7E3CA7C2BE2A45A3904917926203C668"><enum>(2)</enum><text>by amending subsection (f) to read as follows:</text><quoted-block id="H117ED206966B48D09F7E191A1AB02005" style="OLC"><subsection id="H95A055436DC2443F88127A90FADFBC82"><enum>(f)</enum><header>Payment of trade readjustment allowances To complete training</header><text>Notwithstanding any other provision of this section, in order to assist an adversely affected worker to complete training approved for the worker under section 236 that includes a program of prerequisite education or remedial education (as described in section 236(a)(5)(D)), and in accordance with regulations prescribed by the Secretary, payments may be made as trade readjustment allowances for up to 26 additional weeks in the 26-week period that follows the last week of entitlement to trade readjustment allowances otherwise payable under this chapter.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0FB8E5F8A70941D5B18F021F3648FDE0"><enum>(b)</enum><header>Payment to workers in on-the-Job training, customized training, or apprenticeship programs</header><text>Section 233(d) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2293">19 U.S.C. 2293(d)</external-xref>) is amended to read as follows:</text><quoted-block id="HE0884BF85AAD4A08ADD077D9169528C6" style="OLC"><subsection id="HEFEC5296CF7A440ABA257276780F44F7"><enum>(d)</enum><header>Payment to workers in on-the-Job training, customized training, or apprenticeship programs</header><paragraph id="H8CE053FC22874F0CB00C29C572A074C6"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) and notwithstanding any other provision of this chapter, a trade readjustment allowance may be paid under this part to an adversely affected worker for any week during which the worker is receiving on-the-job training or customized training, or is participating in a registered apprenticeship program, under section 236.</text></paragraph><paragraph id="HCB617030720D42D993D6D46E4190D035"><enum>(2)</enum><header>Income limitation</header><text>The Secretary shall reduce the amount of the trade readjustment allowance otherwise payable to a worker under paragraph (1) to ensure that the sum of the income of the worker from the on-the-job training, customized training, or apprenticeship program described in that paragraph and the trade readjustment allowance paid to the worker under that paragraph does not exceed $70,000 during a year.</text></paragraph><paragraph id="HA6EF2BADF8BB4E2193E0B5D0EE906389"><enum>(3)</enum><header>Adjustment of income limitation for inflation</header><subparagraph id="H5B9E4F0C52CE4E13A69A701900A81BE8"><enum>(A)</enum><header>In general</header><text>The Secretary of Labor shall adjust the income limitation under paragraph (2) on October 1, 2021, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2020.</text></subparagraph><subparagraph id="HCECCCA08F52F4365B4629CAF464729B5"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="HC5AF34E9C75E48D4B7B1419707FD4488"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="H61DD415C76EF4F468D2B772A822E95D3"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="H41EC7AAC49AF4B3090132A6ED4D727A6"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HB6FDB26CB230418CA9F3E6DE876759F4" section-type="subsequent-section"><enum>107.</enum><header>Automatic extension of trade readjustment allowances</header><subsection id="HC6ABB3F7E65D4A71A0C4833399542DCF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part I of subchapter B of chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291 et seq.</external-xref>) is amended by inserting after section 233 the following new section:</text><quoted-block style="OLC" id="H7CBE4F4A13D04529B1B086CFED5110FD" display-inline="no-display-inline"><section id="HCF575AD89E02448E9B1F93C0F428089E"><enum>233A.</enum><header>Automatic extension of trade readjustment allowances</header><subsection id="H953A7060F9A342F29298C254EFDF914B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the limitations under section 233(a), the Secretary shall extend the period during which trade readjustment allowances are payable to an adversely affected worker who completes training approved under section 236 by the Secretary during a period of heightened unemployment with respect to the State in which such worker seeks benefits, for the shorter of—</text><paragraph id="H725338A0BAA54720AEC473B2FAD5F43F"><enum>(1)</enum><text>the 26-week period beginning on the date of completion of such training; or</text></paragraph><paragraph id="H3E8229DF3B1940C09226A7619608A4BC"><enum>(2)</enum><text display-inline="yes-display-inline">the period ending on the date on which the adversely affected worker secures employment.</text></paragraph></subsection><subsection id="H5A2F97C2BB4D47E481EE7D6271FF3F6B"><enum>(b)</enum><header>Job search required</header><text display-inline="yes-display-inline">A worker shall only be eligible for an extension under subsection (a) if the worker is complying with the job search requirements associated with unemployment insurance in the applicable State.</text></subsection><subsection id="H019B878D75D04B56A34B09FDEE81AAF3"><enum>(c)</enum><header>Period of heightened unemployment defined</header><text>In this section, the term <term>period of heightened unemployment</term> with respect to a State means a 90-day period during which, in the determination of the Secretary, either of the following average rates equals or exceeds 5.5 percent:</text><paragraph id="H6C3C2EB6A3694D678015B63E22021A64" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The average rate of total unemployment in such State (seasonally adjusted) for the period consisting of the most recent 90 days for which data for all States are published before the close of such period.</text></paragraph><paragraph id="H5B26C8BD72ED48AAB565A680B8C33AB2" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The average rate of total unemployment in all States (seasonally adjusted) for the period consisting of the most recent 90 days for which data for all States are published before the close of such period.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6097D118A1CA4693A707B0EBE72FD4D3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by inserting after the item relating to section 233 the following:</text><quoted-block style="OLC" id="HC597CC3F822242BDBCD58F0047631569" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 233A. Automatic extension of trade readjustment allowances.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HD473F0B95EF640B1AF5C2068B1E757AD" commented="no"><enum>108.</enum><header>Employment and case management services</header><text display-inline="no-display-inline"> Section 235 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2295">19 U.S.C. 2295</external-xref>) is amended—</text><paragraph id="H699590C1645E4F88B9D45E90149B2B84"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><subparagraph id="H283A2455C507476DB6BB303F2C7A8849"><enum>(A)</enum><text>by inserting after <quote>regional areas</quote> the following: <quote>(including information about registered apprenticeship programs, on-the-job training opportunities, and other work-based learning opportunities)</quote>; and</text></subparagraph><subparagraph id="H202DB4B0BC804E39857CEFAE46DDF3F7"><enum>(B)</enum><text>by inserting after <quote>suitable training</quote> the following: <quote>, information regarding the track record of a training provider’s ability to successfully place participants into suitable employment</quote>; </text></subparagraph></paragraph><paragraph id="H77A1E1A07F7E4E138384791A1B1F1548" commented="no"><enum>(2)</enum><text>by redesignating paragraph (8) as paragraph (9); and</text></paragraph><paragraph id="HCCA2374730474B5AA4EC4EEF56947188" commented="no"><enum>(3)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" id="HF60C8E803CC44C0CBF90E3EF7A586159" display-inline="no-display-inline"><paragraph id="H72734A445CD84805A00AF4CF98DFE85A" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">Information related to direct job placement, including facilitating the extent to which employers within the community commit to employing workers who would benefit from the employment and case management services under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H21B647C893884CBC8FA5A1A9DF0E5DF2"><enum>109.</enum><header>Training</header><text display-inline="no-display-inline">Section 236(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2296">19 U.S.C. 2296(a)</external-xref>) is amended—</text><paragraph id="H060AD178FB1848758FA796492069E512"><enum>(1)</enum><text>in paragraph (1)(D), by inserting <quote>, with a demonstrated ability to place participants into employment</quote> before the comma at the end;</text></paragraph><paragraph id="H0A3D05DF41434B74AF3484F3213B4C15"><enum>(2)</enum><text>by striking paragraph (3); commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">work to assist workers from underserved communities to establish a work history, demonstrate success in the workplace, and develop the skills that lead to entry into and retention in unsubsidized employment;</text></subparagraph><subparagraph id="H902AD62512864C759EEED56D9DE973E0"><enum>(C)</enum><text display-inline="yes-display-inline">facilitate joint cooperation between representatives of workers, employers, and communities, especially in underserved rural and urban regions, to ensure a fair and engaging workplace that balances the priorities and well-being of workers with the needs of businesses; and</text></subparagraph><subparagraph id="H472F577BCB674301AE60326A6CD6AAC4"><enum>(D)</enum><text display-inline="yes-display-inline">have a proven track record in adequately serving individuals who face the greatest barriers to employment, including people with low incomes, people of color, immigrants, and formerly incarcerated individuals.</text></subparagraph></paragraph><paragraph id="HEDA8AAEB9A524257B25A0FD5965DE3BB" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Each cooperating State agency shall seek, including through agreements and training programs described in this subsection, to ensure the reemployment of adversely affected workers upon completion of training as described in section 236.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA2ADE44D96C04012A4A1D88C9AE95C57"><enum>(b)</enum><header>Administration</header><paragraph id="HC54F8639760C4FD2AB06976644AAEE8D"><enum>(1)</enum><header>In general</header><text legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311(j)(2)</external-xref>) is amended—</text><paragraph id="HA49E86BD8C6643A4952A46A8D94A1FBD"><enum>(1)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" id="H9DC6A00310034797B8DA63EBBFDF747C" display-inline="no-display-inline"><subparagraph id="H6B1752D5BDA8497388D8A04937AD9E57"><enum>(B)</enum><header>Additional indicators and analytics</header><text display-inline="yes-display-inline">The Secretary and a cooperating State or cooperating State agency—</text><clause id="H918AAB4C60454554B8CA97B4013926ED"><enum>(i)</enum><text display-inline="yes-display-inline">shall conduct a comparative analysis between the median earnings of workers described in subparagraph (A)(i)(I) and the distributions of earnings across the workforce in the affected economic region; and</text></clause><clause id="H4C89DA6B05E84A3CAE547B34F27B46DF"><enum>(ii)</enum><text display-inline="yes-display-inline">may agree upon additional indicators of performance for the trade adjustment assistance program under this chapter, as appropriate.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC8707AC2424144E5806F1CCA8389CC25"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1E3F0511F7414CA3B7B437A92A512CA7" display-inline="no-display-inline"><subparagraph id="HC8DF8AD06ABB47078A87209FFF003FCA" commented="no"><enum>(C)</enum><header>Dashboard</header><text display-inline="yes-display-inline">The Secretary shall require each cooperating State and cooperating State agency to perform workforce analytics for the purpose of creating a dashboard that includes different measures of job quality for reemployment and training activities provided under this chapter.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4B334A15A29442A8AFFADBCC826E4906" commented="no"><enum>(d)</enum><header>Staffing</header><text display-inline="yes-display-inline">Section 239 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2311">19 U.S.C. 2311</external-xref>) is amended by striking subsection (k) and inserting the following: </text><quoted-block style="OLC" id="HE36FE0BB5CA841C39FE0358EC4D64D61" display-inline="no-display-inline"><subsection id="H063F562553ED4FD09AFD17420F72B78F"><enum>(k)</enum><header>Staffing</header><text display-inline="yes-display-inline">An agreement entered into under this section shall provide that the cooperating State or cooperating State agency shall require that any individual engaged in functions to carry out the trade adjustment assistance program under this chapter shall be a State employee covered by a merit system of personnel administration.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H3EB72B0F341743CEBDA85F99E191BE00"><enum>112.</enum><header>Reemployment trade adjustment assistance program</header><text display-inline="no-display-inline">Section 246(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2318">19 U.S.C. 2318(a)</external-xref>) is amended—</text><paragraph id="H3192197A1A8046BBA9F0AF5F385BFFC5"><enum>(1)</enum><text>in paragraph (3)(B)(ii), by striking <quote>$50,000</quote> and inserting <quote>$70,000 (subject to adjustment under paragraph (8))</quote>;</text></paragraph><paragraph id="HEC7BB9B9B3474A62B75BBBDDC987A08D"><enum>(2)</enum><text display-inline="yes-display-inline">in salary limitation and total amount of payments for inflation</header><subparagraph id="HD528BEBCB48B4235966CFCC9C695B3BD"><enum>(A)</enum><header>In general</header><text>The Secretary of Labor shall adjust the salary limitation under paragraph (3)(B)(ii) and the amount under paragraph (5)(B)(i) on October 1, 2021, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2020.</text></subparagraph><subparagraph id="HAF8D5A9F8E694515B750DB6D6DA3C153"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="H8475CF60FEDA43338C203830B4F8BC3B"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="HD7E7D60F3E9E4D6FBBC20ABF14B2213F"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="HE9B91F37DF8240D389E6A47644E53E53"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H5777F2028E7E48589164087E0EAD7370"><enum>113.</enum><header>Extension of trade adjustment assistance to public agency workers</header><subsection id="HDFAE3BFBFD8443D19223009F8763C01C"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 247 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>) is amended—</text><paragraph id="H932F3B085D484A92AA7E9DF082739DA3"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph id="H955BF6D381B445DFB1773ECFEE44FC87"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>The</quote> and inserting <quote>Subject to section 222(d)(5), the</quote>; and</text></subparagraph><subparagraph id="H2005E3AFA0054F0BA214DDFE8B2B483F"><enum>(B)</enum><text>in subparagraph (A), by striking <quote>or service sector firm</quote> and inserting <quote>, service sector firm, or public agency</quote>; and</text></subparagraph></paragraph><paragraph id="H86C2C4E4C6424B8B9F78FD713A804095"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HB98AAE7A27E14A2EA5D851D0BE67A47D" display-inline="no-display-inline"><paragraph id="H6011106B97FE465FA2E37BCBC7E74EDB"><enum>(20)</enum><text display-inline="yes-display-inline">The term <term>public agency</term> means a department or agency of a State or local government or of the Federal Government.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4D3E919BACC24CD999D8D9D5FCAA7B35"><enum>(b)</enum><header>Group eligibility requirements</header><text display-inline="yes-display-inline">Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>), as amended by subsections (b) and (c) of section 102, is further amended—</text><paragraph id="HCEEED1D25B13406DA7258C3E12B9A35F"><enum>(1)</enum><text>by redesignating subsections (c), (d), (e), and (f) as subsections (d), (e), (f), and (g), respectively;</text></paragraph><paragraph id="H465F48BB174343BFA5BD0EC0DC2CCE65"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" id="H3BB735607CA5405E99EA8FCB6EFE02B0" display-inline="no-display-inline"><subsection id="H88D65B57C0BA4DDEA33A05DC66F9F18A"><enum>(c)</enum><header>Adversely affected workers in public agencies</header><text display-inline="yes-display-inline">A group of workers in a public agency shall be certified by the Secretary as eligible to apply for adjustment assistance under this chapter pursuant to a petition filed under section 221 if the Secretary determines that—</text><paragraph id="HBD468DD1A6D549578B59F14A6E40885F"><enum>(1)</enum><text>a significant number or proportion of the workers in the public agency have become totally or partially separated, or are threatened to become totally or partially separated;</text></paragraph><paragraph id="H736818D3817B4377806984DECCC258E9"><enum>(2)</enum><text>the public agency has acquired from a foreign country services like or directly competitive with services which are supplied by such agency; and</text></paragraph><paragraph id="H7393639D44FB4B8F8335D76C652B204F"><enum>(3)</enum><text>the acquisition of services described in paragraph (2) contributed to such workers’ separation or threat of separation.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H262C696FD3E0483AB28BEB87BE2FE57B"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d) (as redesignated), by adding at the end the following:</text><quoted-block style="OLC" id="HD16770E569BB41579D43CE9C918DED94" display-inline="no-display-inline"><paragraph id="HAAE0B3BCA3B1462ABC920A71C6E92429"><enum>(5)</enum><header>Reference to firm</header><text display-inline="yes-display-inline">For purposes of subsections (a) and (b), the term <term>firm</term> does not include a public agency.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H930EB43C2C884FB88CA7A3F79F4D630C"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (2) of subsection (e) (as redesignated), by striking <quote>subsection (a) or (b)</quote> and inserting <quote>subsection (a), (b), or (c)</quote>.</text></paragraph></subsection></section><section id="H9FE129287876414EA1B408D8713AABE6" section-type="subsequent-section"><enum>114.</enum><header>Definitions</header><subsection id="HA6E7486DDF764C768A5080D14D757145"><enum>(a)</enum><header>Extension of adjustment assistance for workers to territories</header><text display-inline="yes-display-inline">Section 247(7) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319(7)</external-xref>) is amended—</text><paragraph id="H52FADBD0DED84ED3BBA622E1DB47F7C2" commented="no"><enum>(1)</enum><text>by inserting <quote>, Guam, the Virgin Islands of the United States, American Samoa, the Commonwealth of the Northern Mariana Islands,</quote> after <quote>District of Columbia</quote>; and</text></paragraph><paragraph id="H4E776560D6B94352895C28853F0DDF7E"><enum>(2)</enum><text>by striking <quote>such Commonwealth.</quote> and inserting <quote>such territories.</quote>.</text></paragraph></subsection><subsection id="HF37654CC45B048E894521FE95F534B0D"><enum>(b)</enum><header>Underserved community</header><text>Section 247 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>), as amended by section 113(a), is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H37F117F0AB00422A8DEDC8F891460B16" display-inline="no-display-inline"><paragraph id="H1F0D3CEFD4BF440EA273BFB64A48E5BD"><enum>(21)</enum><text display-inline="yes-display-inline">The term <term>underserved community</term> means a community with populations sharing a particular characteristic that have been systematically denied a full opportunity to participate in aspects of economic, social, or civic life, such as Black, Latino, and Indigenous and Native American persons, Asian Americans and Pacific Islanders, other persons of color, and other populations otherwise adversely affected by persistent poverty or inequality.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H3669C8B0906E457982276E023B04D04E"><enum>115.</enum><header>Subpoena power</header><text display-inline="no-display-inline">Section 249 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2321">19 U.S.C. 2321</external-xref>) is amended—</text><paragraph id="H7A170855A3C342EE8A67AB02736B7344"><enum>(1)</enum><text>in subsection (a), by adding at the end the following: <quote>The authority under the preceding sentence includes the authority of States to require, by subpoena, a firm to provide information on workers employed by, or totally or partially separated from, the firm that is necessary to make a determination under this chapter or to provide outreach to workers, including the names and address of workers.</quote>; and</text></paragraph><paragraph id="HB37AFF3A23B140EBB68F4BEECDFE0167"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HBED1FB9D77CF40A68E358F306BB9CD58" style="OLC"><subsection id="H825F9487757E44D68ACF79DF689789AF"><enum>(c)</enum><header>Enforcement of subpoenas by States</header><text>A State may enforce compliance with a subpoena issued under subsection (a)—</text><paragraph id="H3081700A282B4141AA9B3BA6A52559B6"><enum>(1)</enum><text>as provided for under State law; and</text></paragraph><paragraph id="HB58805BB562B48638C13855C61CF3F81"><enum>(2)</enum><text>by petitioning an appropriate United States district court for an order requiring compliance with the subpoena.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1121B11E2D9D49E0A575B3AACEE6C0EC" commented="no"><enum>116.</enum><header>Data collection with respect to training</header><text display-inline="no-display-inline">Section 249B of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2323">19 U.S.C. 2323</external-xref>) is amended—</text><paragraph id="H21BE28EE910748A9A2557ABED202E5C0"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HE5A3D759765C43EF8A9A062CF27C49F0" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H1BA4893AF6B44C48B0964941400D8D47"><enum>(i)</enum><text>in subparagraph (B), by adding at the end before the period the following: <quote>, and the relevant demographic information (including id="HB4362272AC244ADBAADDC2CD84E414D4" commented="no"><enum>(i)</enum><text>The petition number.</text></clause><clause id="H57664D4DFA574C1D8494BAA344721B5F"><enum>(ii)</enum><text>The names of the petitioner, firm, and certified or recognized union or other duly authorized representatives of the group of workers.</text></clause><clause id="H7D0E2E48E62F4E8D84FC30F8F30B97F7" commented="no"><enum>(iii)</enum><text>The names of the city and State in which the firm is located.</text></clause><clause id="H5C099266FC57495794B0A706CC0F3B91" commented="no"><enum>(iv)</enum><text>A description of the articles produced or services supplied by the firm.</text></clause><clause id="H6F99C91D5E93410EB8DD89A312F9A301" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">The classification of the firm under the North American Industry Classification System or the Standard Industrial Classification.</text></clause><clause id="H1C6D7DCDF1D345C1BD32BAD7824C1A1C"><enum>(vi)</enum><text display-inline="yes-display-inline">The relevant demographic information (including race, ethnicity, gender, income level, and age) regarding the workers.</text></clause><clause id="H8528CCD8448945C4A021607F06C1707E" commented="no"><enum>(vii)</enum><text>The determination of the Secretary to certify or deny the petition, including the basis for the determination.</text></clause><clause id="HD4FFF1B7FBC34892BD815D89E6D6B82C" commented="no"><enum>(viii)</enum><text display-inline="yes-display-inline">If the petition was certified—</text><subclause id="H6BA4CA95E30045158F3A78CBE4385683"><enum>(I)</enum><text>the country or countries in which increased imports, collected and reported under this paragraph shall be made available to the public, in a searchable format by each type of information required by clauses (i) through (vii), with an option to receive search results in an electronic spreadsheet format.</text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H095CF57EE6BE4ACFA5EB92A16A43DC0F"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="HD0900E89FB0142FAB74185122FB82C6D"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H41E23AB7D1AA4AB7A09CC7F56D3CB6C3"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4); display-inline="no-display-inline"><enum>117.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that, in administering the trade adjustment assistance program under chapter 2 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271 et seq.</external-xref>), a State should—</text><paragraph id="H8943C591E6D644969AC183D8194BFC92"><enum>(1)</enum><text display-inline="yes-display-inline">prioritize providing training that leads to employment outcomes that replace 100 percent of an adversely affected worker’s wages; </text></paragraph><paragraph id="HDE7ECCC2579A4ABBB8F04F70347C52A1"><enum>(2)</enum><text display-inline="yes-display-inline">steer workers toward training that leads to a livable wage and sustainable employment; and</text></paragraph><paragraph id="H1057A74F7F30426F8D7FFF77BCDE1C8F"><enum>(3)</enum><text display-inline="yes-display-inline">prioritize assistance for underserved communities to promote equitable and inclusive economic benefits for all workers.</text></paragraph></section></title><title id="H8665F8C8AABB4967A4E6FCDAAF71654C"><enum>II</enum><header>Trade Adjustment Assistance for Firms</header><section id="HEF51E610E8CA43A0BEEC738600CA46EB" commented="no"><enum>201.</enum><header>Petitions and determinations</header><text display-inline="no-display-inline">Section 251 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341</external-xref>) is amended—</text><paragraph id="HCFECBE884F784A5C90E08779F3117222"><enum>(1)</enum><text>in the second sentence of subsection (a), by striking <quote>Upon</quote> and inserting <quote>Not later than 5 days after</quote>; </text></paragraph><paragraph id="HF0DEFA30437642D892DFDD3FCDDBC86F" commented="no"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block style="OLC" id="HE3D70D9C90DB43A29EFFEBBD53C52306" display-inline="no-display-inline"><subsection id="H8E7C87E4F9934D6D9892D1A93E53B590" commented="no"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H96D85A0160294482B0CD04220BA26F6C"><enum>(1)</enum><text>The Secretary shall certify a firm (including any agricultural firm or service sector firm) as eligible to apply for adjustment assistance under this chapter if the Secretary determines—</text><subparagraph id="H38C6BE75E40B4F76808C1EF968E42665" indent="up1" commented="no"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HC9EC5E643B5544B3B4A20CEA71B03E66"><enum>(i)</enum><text>that a significant number or proportion of the workers in such firm have become totally or partially separated, or are threatened to become totally or partially separated, or</text></clause><clause id="HA4C36EA79E7C4D3ABE0066B47F8A2D65" indent="up1" commented="no"><enum>(ii)</enum><text>that—</text><subclause id="H8A4E3AE6BB0242928FE21F51577543B7" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">sales or production, or both, of the firm have decreased absolutely or failed to increase, </text></subclause><subclause id="HDBDB2F6BA67A404D8FEB761AB07B5B9B" commented="no"><enum>(II)</enum><text>sales or production, or both, of an article or service that accounted for not less than 25 percent of the total sales or production of the firm during the 12-month period preceding the most recent 12-month period for which date are available have decreased absolutely or failed to increase, </text></subclause><subclause id="H7CD7E2B04CAD4BA5840AA0265784C937" commented="no"><enum>(III)</enum><text>sales or production, or both, of the firm during the most recent 12-month period for which data are available have decreased or failed to increase compared to—</text><item id="H6FDB9DBF90AF425C9DCE98FEE714E00D" commented="no"><enum>(aa)</enum><text>the average annual sales or production for the firm during the 24-month period preceding that 12-month period, or </text></item><item id="HA58B6651D5554132956D3825E1ADA760" commented="no"><enum>(bb)</enum><text>the average annual sales or production for the firm during the 36-month period preceding that 12-month period, and </text></item></subclause><subclause id="HBA3CA9FFE8E44FC38FFA0894E0061CE7" commented="no"><enum>(IV)</enum><text>sales or production, or both, of an article or service that accounted for not less than 25 percent of the total sales or production of the firm during the most recent 12-month period for which data are available have decreased or failed to increase compared to—</text><item id="H3092D6DB335D4ADA904BBF3717D18AF8" commented="no"><enum>(aa)</enum><text>the average annual sales or production for the article or service during the 24-month period preceding that 12-month period, or </text></item><item id="HCDF4C51D5D4F452D8D743C8AEF543BBA" commented="no"><enum>(bb)</enum><text>the average annual sales or production for the article or service during the 36-month period preceding that 12-month period, and </text></item></subclause></clause></subparagraph><subparagraph id="H37E9292A8055419A8B89799704D39CCD" indent="up1" commented="no"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H6661C7E3D7CE48C08C2A3F5E4C6973BD"><enum>(i)</enum><text display-inline="yes-display-inline">increases of imports of articles or services like or directly competitive with articles which are produced or services which are supplied by such firm contributed to such total or partial separation, or threat thereof, and to such decline or failure to increase in sales or production, or</text></clause><clause id="H6E116836B015412580E13E4F9896B701" indent="up1" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">decreases in exports of articles produced or services supplied by such firm, or imports of articles or services necessary for the production of articles or services supplied by such firm, contributed to such total or partial separation, or threat thereof, and to such decline in sales or production.</text></clause></subparagraph></paragraph><paragraph id="H448120008AC04805A8C2A4F536344FDC" indent="up1" commented="no"><enum>(2)</enum><text>For purposes of paragraph (1)(B):</text><subparagraph id="H2B50691F8CF5492CB41C5AF2C911C1B5" commented="no"><enum>(A)</enum><text>Any firm which engages in exploration or drilling for oil or natural gas shall be considered to be a firm producing oil or natural gas.</text></subparagraph><subparagraph id="HD04814B7BFCF42628FC4AC436621DFF6" commented="no"><enum>(B)</enum><text>Any firm that engages in exploration or drilling for oil or natural gas, or otherwise produces oil or natural gas, shall be considered to be producing articles directly competitive with imports of oil and with imports of natural gas.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE0DA0D3974D34C2EA3F8B1B71D21EAB4"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="H31B7DC8DC97C4ECA879A59188A8570E2"><enum>(A)</enum><text>by striking <quote>this section,</quote> and inserting <quote>this section.</quote>; and</text></subparagraph><subparagraph id="HFECC76A212E345FCAE75D2D66EE99B40"><enum>(B)</enum><text>by striking <quote>but in any event</quote> and all that follows and inserting the following: <quote>If the Secretary does not make a determination with respect to a petition within 55 days after the date on which an investigation is initiated under subsection (a) with respect to the petition, the Secretary shall be deemed to have certified the firm as eligible to apply for adjustment assistance under this chapter.</quote>. </text></subparagraph></paragraph></section><section id="HDF297E22600B404B96679374207B056D"><enum>202.</enum><header>Approval of adjustment proposals</header><text display-inline="no-display-inline">Section 252 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2342">19 U.S.C. 2342</external-xref>) is amended—</text><paragraph id="HB24D17332ED7453387885E208173D605"><enum>(1)</enum><text>in subsection (a), by adding at the end before the period the following: <quote>and an assessment of the potential employment outcomes of such proposal</quote>; and</text></paragraph><paragraph id="H644578DDA62A41869CA143DA6DAC0B61"><enum>(2)</enum><text>in subsection (b), by striking <quote>gives adequate consideration to</quote> and inserting <quote>is in</quote>.</text></paragraph></section><section id="H89A1E21A5E0145C18B4925C8E3B150AB"><enum>203.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Section 253 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2343">19 U.S.C. 2343</external-xref>) is amended—</text><paragraph commented="no"><enum>(c)</enum><header>Amount of assistance</header><paragraph id="HD6CC20A401CE44A1BFE695749ABF72BF" commented="no"><enum>(1)</enum><header>In general</header><text>A firm may receive technical assistance under this chapter with respect to the firm’s economic adjustment proposal in an amount not to exceed $300,000, subject to adjustment under paragraph (2).</text></paragraph><paragraph id="H94F2348BE5E344CE94B42954028EAB91" commented="no"><enum>(2)</enum><header>Adjustment of salary limitation for inflation</header><subparagraph id="HB8130050675F46D593C8CA707D345226" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary of Commerce shall adjust the technical assistance limitation under paragraph (1) on October 1, 2021, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2020.</text></subparagraph><subparagraph id="H2CABF5BFFA374DAEA2F6D7BB1EFE5332" commented="no"><enum>(B)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under subparagraph (A), the Secretary—</text><clause id="H5225B64DDBC044FFA83094ADBB5FF3C2" commented="no"><enum>(i)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></clause><clause id="H29E358C2AE074F15850E39A5C8E878C9" commented="no"><enum>(ii)</enum><text>may ignore any such increase of less than 1 percent.</text></clause></subparagraph><subparagraph id="H690E5EE6DAF9475D8E04A59E70B14D5D" display-inline="no-display-inline" commented="no"><enum>(C)</enum><header>Consumer Price Index defined</header><text>For purposes of this paragraph, the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H5A99BF06CD8245658E77F88311EA7685"><enum>204.</enum><header>Annual report on trade adjustment assistance for firms</header><text display-inline="no-display-inline">Section 255A(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2345a">19 U.S.C. 2345a(a)</external-xref>) is amended—</text><paragraph id="H85C89F1D0A7C4C51A28527B335C85422"><enum>(1)</enum><text>in paragraphs (11) and (12) by inserting <quote>wages,</quote> before <quote>and productivity</quote> each place it appears; and</text></paragraph><paragraph program, including whether those employees are from underserved communities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HD369DBBD6C5240429F92F7D1E6BBCAC5"><enum>205.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 259 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2351">19 U.S.C. 2351</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H29CAD53F75AC4898902B093D614362FC" display-inline="no-display-inline"><paragraph id="H2F52F3E095574963964A7E5134D6B4D4"><enum>(3)</enum><header>Underserved community</header><text display-inline="yes-display-inline">The term <term>underserved community</term> has the meaning given that term in section 247.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC92603864C184FD1AB45E004E98994B4"><enum>206.</enum><header>Plan for outreach to potentially eligible firms</header><text display-inline="no-display-inline">Chapter 3 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD8805634D6A34A47B6D1119E7020C731" display-inline="no-display-inline"><section id="H330D362AEDCA4DBEB23C30270E7380F6"><enum>263.</enum><header>Plan for outreach to potentially eligible firms</header><subsection id="H5C2BB365D5E04BDFB91C81850BBECCA0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop a plan to provide outreach to firms that may be eligible for adjustment assistance under this chapter.</text></subsection><subsection id="H008BBD97261E4B7388064B0BE4F12ACC"><enum>(b)</enum><header>Matters To be included</header><text>The plan required by paragraph (1) shall include the following:</text><paragraph id="HDEB563D25D2744EAA1AB1DCE4C61E4BA"><enum>(1)</enum><text>Outreach to the United States International Trade Commission and to such firms in industries with increased imports identified in the Commission’s annual report regarding the operation of the trade agreements program under section 163(c).</text></paragraph><paragraph id="H73D36DA4907F4B6CA1E2620EBF5D729A"><enum>(2)</enum><text>Outreach to such firms in the service sector. </text></paragraph><paragraph id="H7E68B3B62EF94A7C9737C2694EEF3938"><enum>(3)</enum><text>Coordination with the Small Business Administration to identify such firms that are small businesses.</text></paragraph><paragraph id="H75D7A1F97DC84624BCF7E0309ABF788D"><enum>(4)</enum><text>Outreach to such firms that are minority- or women-owned firms.</text></paragraph><paragraph id="HC4E5B40F0A0D40F3834D30EACC82AD63"><enum>(5)</enum><text display-inline="yes-display-inline">Outreach to such firms that employ a majority or a substantial percentage of workers from underserved communities.</text></paragraph></subsection><subsection id="H41053DE475DF4B7E9F06E2019D1AFDAD"><enum>(c)</enum><header>Updates</header><text>The Secretary shall update the plan required under this section on an annual basis.</text></subsection><subsection id="HB97C3F6DBA804FA0931E53FA1832E888"><enum>(d)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">The Secretary shall submit the plan and each update to the plan required under this section to Congress.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></section></title><title id="HBB98C742DEF44C6E899A5005608D8FB3"><enum>III</enum><header>Trade Adjustment Assistance for Communities</header><section id="H4997235D59ED446AA1BB08585AA33751"><enum>301.</enum><header>Trade adjustment assistance for communities</header><subsection id="H36CB725980604FDCA9A879983DA2867D"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section and the amendments made by this section is to provide assistance to communities impacted by trade through—</text><paragraph id="H5955533E303A46B0AAAD5B513BE0FFF0"><enum>(1)</enum><text>the coordination of Federal, State, regional, and local resources;</text></paragraph><paragraph id="H58DF5D56E77D45ECAD913C3211EFDC2B"><enum>(2)</enum><text>the creation of community-based development strategies; and</text></paragraph><paragraph id="H66434C11FCD64289B5E061F7A3D3DC0A"><enum>(3)</enum><text display-inline="yes-display-inline">the development and provision of programs that meet the training needs of workers covered by certifications under section 223 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2273">19 U.S.C. 2273</external-xref>) (as amended by section 103).</text></paragraph></subsection><subsection id="H462CF0B923E3499A95D46BBE832EFA16"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 4 of title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2371">19 U.S.C. 2371 et seq.</external-xref>) is amended—</text><paragraph id="H5F066C4DC9244CE8A26B20FBF0DDA613"><enum>(1)</enum><text>by inserting after the chapter heading the following:</text><quoted-block style="OLC" id="HF7EC87B0C0314591990AD36A8A355414" display-inline="no-display-inline"><subchapter id="HDF18444B1C674027BF4B1864ECAB72BE"><enum>B</enum><header>Community College and Career Training Grant Program</header></subchapter><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H7993E6DC9A134D068BB940EEC282634E"><enum>(2)</enum><text>by redesignating sections 271 and 272 as sections 279 and 279A, respectively; and</text></paragraph><paragraph id="H3AC3BBDA48514BAFA35E470A4E3E0903"><enum>(3)</enum><text>by inserting before subchapter B (as designated by paragraph (1)) the following:</text><quoted-block style="OLC" id="H75B4A40122694D8C8971D86E90023D38" display-inline="no-display-inline"><subchapter id="H1C4864B7BBB64CFA8DF1D25D992716EF"><enum>A</enum><header>Trade Adjustment Assistance for Communities</header><section id="H738C23E79B8A4142B361F8AB0D44FDBE"><enum>271.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H0E8391C0E29C4937A80A4C5A6B60DD36"><enum>(1)</enum><header>Agricultural commodity producer</header><text display-inline="yes-display-inline">The term <term>agricultural commodity producer</term> has the meaning given that term in section 291. </text></paragraph><paragraph id="HC5795BE56C994C5F9B862E62B649732E"><enum>(2)</enum><header>Community</header><text>The term <term>community</term> means a city, county, or other political subdivision of a State or a consortium of political subdivisions of a State. </text></paragraph><paragraph id="H1FFABC888DE7426DBC2D1BC0E63EC750"><enum>(3)</enum><header>Eligible community</header><text>The term <term>eligible community</term> means a community that the Secretary has determined under section 273(b)(1) is eligible to apply for assistance under this subchapter. </text></paragraph><paragraph id="HD8830C505B164B84871CA6FCBD9784CF" commented="no"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="H78AFE9A3A3864743B32233ABE88EB84B"><enum>(5)</enum><header>Underserved community</header><text>The term <term>underserved community</term> has the meaning given that term in section 247. </text></paragraph></section><section id="H6EED769A05734911A6E48B5B43B92495" commented="no"><enum>272.</enum><header>Establishment of trade adjustment assistance for communities program</header><text display-inline="no-display-inline">The Secretary, acting through the Assistant Secretary for Economic Development, shall, not later than 90 days after the date of the enactment of this subchapter, establish a program to provide communities impacted by trade with assistance in accordance with the requirements of this subchapter. </text></section><section id="H3955424D0A8649719C09C33C21D2F4BF"><enum>273.</enum><header>Eligibility; notification</header><subsection id="H9C36621BD46C48D982D77C230B3DF408"><enum>(a)</enum><header>Petition</header><paragraph id="H772231728A2F4561A6F5E632F6770309"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a community may submit to the Secretary a petition for a determination under subsection (b)(1) that the community is eligible to apply for assistance under this subchapter if—</text><subparagraph id="H2A03621F95234BCF8B35BB745C7695B4"><enum>(A)</enum><text>on or after the date of the enactment of this subchapter, one or more certifications described in paragraph (3) of subsection (b) are made with respect to the community; and </text></subparagraph><subparagraph id="H20E64990183F452BBE187B974B241497"><enum>(B)</enum><text>the community submits the petition not later than 180 days after the date on which the most recent such certification is made.</text></subparagraph></paragraph><paragraph id="H4AEF281F11E3433C8E99B3E7C894B3F7"><enum>(2)</enum><header>Special rule</header><text display-inline="yes-display-inline">In the case of a community with respect to which one or more certifications described in paragraph (3) of subsection (b) were made on or after January 1, 1994, and before the date of the enactment of this subchapter, the community may, not later than December 31, 2022, submit to the Secretary a petition for a determination under subsection (b)(1) that the community is eligible to apply for assistance under this subchapter.</text></paragraph><paragraph id="H3440BD699C314E4482DC4AEEF9340342"><enum>(3)</enum><header>Notification of eligibility</header><text display-inline="yes-display-inline">If one or more certifications described in paragraph (3) of subsection (b) are made with respect to a community, the Secretary shall, concurrently with each such certification, notify the community and the Governor of the State in which the community is located of the ability of the community—</text><subparagraph id="HD07939263F9042948CB7A0E31C20BDF2"><enum>(A)</enum><text>to submit to the Secretary a petition under this subsection; and</text></subparagraph><subparagraph id="HC879F2EF2A5B4806BF515C2BCEDCE17A"><enum>(B)</enum><text display-inline="yes-display-inline">to receive technical assistance under paragraph (4) in developing the petition. </text></subparagraph></paragraph><paragraph id="H4623F213E79C4C2A8C828BDA4175BEE6"><enum>(4)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall, subject to the availability of appropriations, offer assistance in preparing a petition under this subsection to any community that requests such assistance.</text></paragraph></subsection><subsection id="H57C2F416BE6F47228EBBCE244908C0AF"><enum>(b)</enum><header>Affirmative determination</header><paragraph id="H4C134BB9C17949D685A1DEE3F5A1C8E9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall make a determination that a community is eligible to apply for assistance under this subchapter if the Secretary determines that the community is a community impacted by trade in accordance with paragraph (2). </text></paragraph><paragraph id="H6E5D1CC630174A56BF7DA4D5D7EF4044" commented="no"><enum>(2)</enum><header>Community impacted by trade</header><text>A community is a community impacted by trade if—</text><subparagraph id="HA83B466208704FD0A9827D468DD8BF90" commented="no"><enum>(A)</enum><text>one or more certifications described in paragraph (3) are made with respect to the community; and </text></subparagraph><subparagraph id="H5F7A632980E7426E9833222043F5F055" commented="no"><enum>(B)</enum><text>the community—</text><clause id="H4E22DA085C9C4A8BA1927A1F9ACB1B19" commented="no"><enum>(i)</enum><text>has a per capita income of 80 percent or less of the national average;</text></clause><clause id="H32CB689B34E54F4D80D079AE37315E73" commented="no"><enum>(ii)</enum><text>has a history of economic distress and long-term unemployment, as determined by the Secretary; or</text></clause><clause id="H1B6F9F24C9A442EF8D216A997B0F46CD" commented="no"><enum>(iii)</enum><text>is significantly affected by the threat to, or the loss of, jobs associated with any such certification, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="H6503208CBFFD408996E5243FA9274327"><enum>(3)</enum><header>Certification described</header><text display-inline="yes-display-inline">A certification described in this paragraph is a certification—</text><subparagraph id="H20E425DB6EE74C63AFDA39C1AC6A54AC"><enum>(A)</enum><text>by the Secretary of Labor that a group of workers located in the community is eligible to apply for assistance under section 223; </text></subparagraph><subparagraph id="H394B5FF3196B482FA05C577D5B636FDE"><enum>(B)</enum><text>by the Secretary of Commerce that a firm located in the community is eligible to apply for adjustment assistance under section 251; or</text></subparagraph><subparagraph id="H86E50161856F4505A28C8828DEE711EE"><enum>(C)</enum><text>by the Secretary of Agriculture that a group of agricultural commodity producers located in the community is eligible to apply for adjustment assistance under section 293.</text></subparagraph></paragraph></subsection><subsection id="HBAEDC6E63EA34A8B92B834810857BEAC"><enum>(c)</enum><header>Notification to community</header><text display-inline="yes-display-inline">Upon making a determination under subsection (b)(1) that a community is eligible to apply for assistance under this subchapter, the Secretary shall promptly notify the community and the Governor of the State in which the community is located—</text><paragraph id="H07C864192CEA466DB29F6C4A5A34943A"><enum>(1)</enum><text>of the determination;</text></paragraph><paragraph id="HECA2D2577E4D4C158CE9A29C026D7BAB"><enum>(2)</enum><text display-inline="yes-display-inline">of the applicable provisions of this subchapter, including of the means for obtaining assistance under this subchapter;</text></paragraph><paragraph id="H40DBAF5F6AD748BE8185354E471C8719"><enum>(3)</enum><text>of the means for obtaining assistance that may be available to the community under other provisions of law; and</text></paragraph><paragraph id="H7D40BA4ACFA34F8087C68069CFE48897"><enum>(4)</enum><text display-inline="yes-display-inline">of the availability to the community of technical assistance under subsection (a) (4) in developing its petition for assistance under this subchapter.</text></paragraph></subsection></section><section id="H6E60307573B14CD69585E4A8BE22C898"><enum>274.</enum><header>Grants to eligible communities</header><subsection id="HA2489870AFA24CD5B8E0E3754CCCBFDE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, subject to the availability of appropriations, award a grant under this section to an eligible community to assist the community in carrying out projects included in a strategic plan developed by the community under section 275. </text></subsection><subsection id="H77D277C7FB68479EAA30D4040B671AF7"><enum>(b)</enum><header>Application</header><paragraph id="HFFCF13FA4AB24CFE99A68427B9EC3D75"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible community seeking to receive a grant under this section shall submit to the Secretary an application that contains—</text><subparagraph id="HD7CE32AE8A234D3193639A19BD47E17D"><enum>(A)</enum><text>the strategic plan developed by the community under section 275 that is approved by the Secretary under such section; and</text></subparagraph><subparagraph id="HB5540BD19E584815A687E11975DD22A3"><enum>(B)</enum><text>a description of the projects included in the strategic plan.</text></subparagraph></paragraph><paragraph id="H12E3A48817A34CF8A6D0F1E8F41F2E7C"><enum>(2)</enum><header>Coordination</header><text>If an eligible institution (as such term is defined in section 279) located in an eligible community is seeking a grant under section 279 at the same time the community is seeking a grant under this section—</text><subparagraph id="H5FD7B9BC62B64ED38C0C7BAD36E48B68"><enum>(A)</enum><text>the Secretary, upon receipt of such information from the Secretary of Labor as required under section 279(e), shall notify the community that the institution is seeking a grant under section 279; and</text></subparagraph><subparagraph id="H7D449ED2645244BB852CBD8C834079F8"><enum>(B)</enum><text>the community shall include in the application to be submitted under this subsection, in coordination with the institution, a description of how the community will integrate projects included in the strategic plan with the specific project for which the institution submits the grant proposal under section 279.</text></subparagraph></paragraph></subsection><subsection id="H41FEC6875CC34B4F8781DF3C389CE3EC"><enum>(c)</enum><header>Limitation</header><text>The total amount of grants awarded to an eligible community under this section for each of the fiscal years 2022 through 2026 may not exceed $25,000,000. </text></subsection><subsection id="HE7D4FF23EF694E81894BAB71098AB5A2"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">The Secretary shall, in awarding grants under this section, give priority to eligible communities that have a history of economic distress and long-term unemployment, as determined by the Secretary.</text></subsection><subsection id="HE9C392613C7643A481E588A5A12FD84A"><enum>(e)</enum><header>Geographic diversity</header><paragraph id="HDA8F613A130F48FF894C8D88D87BA146"><enum>(1)</enum><header>In general</header><text>The Secretary shall, in awarding grants under this section, ensure that grants are provided to communities from geographically diverse areas.</text></paragraph><paragraph id="H9D16EABBE16141028EC6F923F45EE924"><enum>(2)</enum><header>Geographic region requirement</header><text display-inline="yes-display-inline">The Secretary shall, in meeting the requirement under paragraph (1), award a grant under this section for each of the fiscal years 2022 through 2026 to at least one community located in each geographic region for which regional offices of the Economic Development Administration of the Department of Commerce are responsible.</text></paragraph></subsection><subsection id="H458ACD1905044E55B4F83EC915C6AA5B"><enum>(f)</enum><header>Report by eligible community</header><paragraph id="HA7B582D113784E8EA9E55B2785118DC9"><enum>(1)</enum><header>In general</header><text>The Secretary shall require an eligible community that receives a grant under this section to submit to the Secretary a report that describes how funding under the grant is being allocated and implemented in furtherance of projects included in the strategic plan developed by the community under section 275.</text></paragraph><paragraph id="H47EC6DE634DC43E48D44E470EB44386C"><enum>(2)</enum><header>Timing</header><text>The report required by this subsection shall be submitted not later than 180 days after the eligible community initiates projects included in its strategic plan and every 180 days thereafter during the period in which the community is carrying out such projects.</text></paragraph></subsection><subsection id="H1D25293F0F0C4C5EAFB1B29452EFA4AF"><enum>(g)</enum><header>Report by Secretary</header><text display-inline="yes-display-inline">Not later than March 1, 2023, and annually thereafter for four years, the Secretary shall submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate for the preceding fiscal year a report describing—</text><paragraph id="H3A8B8BEF342E4C1C8651855FAEEAE630"><enum>(1)</enum><text>each grant awarded under this section to an eligible community; and</text></paragraph><paragraph id="H2C1D626E14274C878AB43E0EE0463F06"><enum>(2)</enum><text>the impact of such grant on the community, including the information contained in the reports submitted to the Secretary under subsection (e).</text></paragraph></subsection></section><section id="H9BB55351AE354E8797FD37BF87125083" commented="no"><enum>275.</enum><header>Strategic plans</header><subsection id="HED226F10DE334ED7B8EF214A2DE93CF6" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible community that seeks to receive a grant under section 274 shall develop a strategic plan to achieve economic adjustment to the impact of trade in accordance with the requirements of this section.</text></subsection><subsection id="H25AC4986E5F54A589550D26EF36A5F12" commented="no"><enum>(b)</enum><header>Consultation</header><paragraph id="H7162929155194157AA6F30D0967805CF" commented="no"><enum>(1)</enum><header>In general</header><text>To the extent practicable, an eligible community shall consult with the entities described in paragraph (2) in developing the strategic plan. </text></paragraph><paragraph id="HCE26A31C882C4544A5AFBF552166B2DA" commented="no"><enum>(2)</enum><header>Entities described</header><text>The entities described in this paragraph are public and private entities located in or serving the eligible community, including—</text><subparagraph id="HFDCFA385A18C4B1C831A18B7F1F0A33F" commented="no"><enum>(A)</enum><text>local, county, or State government agencies;</text></subparagraph><subparagraph id="H09EAE1F47FB74644857540D185378A0F" commented="no"><enum>(B)</enum><text>firms, including small- and medium-sized firms; </text></subparagraph><subparagraph id="H5CABDD5A000D4E00BF375CAAFD920EE1" commented="no"><enum>(C)</enum><text>local workforce investment boards; </text></subparagraph><subparagraph id="HDC6A9C0317D94E3ABEC1ED6B26477B7C" commented="no"><enum>(D)</enum><text>labor organizations, including State labor federations and labor-management initiatives, representing workers in the community; </text></subparagraph><subparagraph id="HCD99740E337A4DF09DE08DC3493B4997" commented="no"><enum>(E)</enum><text>educational institutions, local educational agencies, and other training providers; and</text></subparagraph><subparagraph id="HFFE74D9681E946ECB2D9C814ABD48657" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">local civil rights organizations and community-based organizations, including organizations representing underserved communities.</text></subparagraph></paragraph></subsection><subsection id="HDE4FCE9402734A84B7BD95A660B142B8" commented="no"><enum>(c)</enum><header>Contents</header><text>The strategic plan shall, at a minimum, contain the following: </text><paragraph id="HD0463FA7C8104BBDAE292FF5D1A77CD7" commented="no"><enum>(1)</enum><text>A description and analysis of the capacity of the eligible community to achieve economic adjustment to the impact of trade. </text></paragraph><paragraph id="H41E83475EE14483B983B11724927A35A" commented="no"><enum>(2)</enum><text>An analysis of the economic development challenges and opportunities facing the community, including the strengths and weaknesses of the economy of the community. </text></paragraph><paragraph id="H04BEFBD0EC344293B4C3C09AEF2EAE39" commented="no"><enum>(3)</enum><text>An assessment of—</text><subparagraph id="H83EDC770DF9148ADB93642871C8A9EE4"><enum>(A)</enum><text>the commitment of the community to carry out the strategic plan on a long-term basis; </text></subparagraph><subparagraph id="HB9359335B42F490986EDE0B4C0EDC380"><enum>(B)</enum><text>the participation and input of members of the community who are dislocated from employment due to the impact of trade; and</text></subparagraph><subparagraph id="HBE5B06E4C2424383B96F7E3B004757E3"><enum>(C)</enum><text display-inline="yes-display-inline">the extent to which underserved communities have been impacted by trade.</text></subparagraph></paragraph><paragraph id="H73F6A596737B4F218A79C064EB07CFBA" commented="no"><enum>(4)</enum><text>A description of how underserved communities will benefit from the strategic plan.</text></paragraph><paragraph id="HA04E77A46D574376A851CB640685C9B0" commented="no"><enum>(5)</enum><text>A description of the role of the entities described in subsection (b)(2) in developing the strategic plan. </text></paragraph><paragraph id="H99B955A65E36403B9B0C7BBD1ED27893" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">A description of projects under the strategic plan to facilitate the community’s economic adjustment to the impact of trade, including projects to—</text><subparagraph id="H126AB23F22BF445B9BD1BCC073986C3C"><enum>(A)</enum><text>develop public facilities, public services, jobs, and businesses;</text></subparagraph><subparagraph id="H26E3A402A20445C69953FB44D23F8CCF"><enum>(B)</enum><text>provide for the demolition of vacant or abandoned commercial, industrial, or residential property;</text></subparagraph><subparagraph id="HAB7F5D188C0C4AE9BE6F6F39C2D1BD3F"><enum>(C)</enum><text>remediate environmental contamination;</text></subparagraph><subparagraph id="H65A4A2DA365341FD9F60AD5B9FEFF940"><enum>(D)</enum><text>establish or support land banks;</text></subparagraph><subparagraph id="H041749C181AC42B996B5AA2B676E9286"><enum>(E)</enum><text>support energy conservation; and</text></subparagraph><subparagraph id="H264CE2200DF24451BF6A522EB20C0EA0"><enum>(F)</enum><text>support historic preservation.</text></subparagraph></paragraph><paragraph id="HD42B95F6E3D343B4A08EA9A49FFD5C64" commented="no"><enum>(7)</enum><text>A strategy for continuing the community’s economic adjustment to the impact of trade after the completion of such projects.</text></paragraph><paragraph id="HDB110EC8B468421FA3546B6244A1AC8C" commented="no"><enum>(8)</enum><text>A description of the educational and training programs and the potential employment opportunities available to workers in the community, including for workers under the age of 25, and the future employment needs of the community.</text></paragraph><paragraph id="HACA18D6807094F2883FAEA6062E96491" commented="no"><enum>(9)</enum><text>An assessment of—</text><subparagraph id="HFDB339A3D8774A3CA19740E6F898FC15"><enum>(A)</enum><text>the cost of implementing the strategic plan; and</text></subparagraph><subparagraph id="H3B09A4DD765D425CB31DDF5F34FD156F"><enum>(B)</enum><text>the timing of funding required by the community to implement the strategic plan.</text></subparagraph></paragraph><paragraph id="H26490F4D39424140A18248440D0ABFF2"><enum>(10)</enum><text display-inline="yes-display-inline">A description of the methods of financing to be used to implement the strategic plan, including—</text><subparagraph id="HB72129C34A7448238FE68F5AC28EF2BE" commented="no"><enum>(A)</enum><text>a grant received under section 274 or under other authorities;</text></subparagraph><subparagraph id="H8B941BC635E54233A785DC0BE0C12F39"><enum>(B)</enum><text>a loan, including the establishment of a revolving loan fund; or</text></subparagraph><subparagraph id="HBEC5D492A88A49DCBE07D00636FF97CF"><enum>(C)</enum><text>other types of financing.</text></subparagraph></paragraph><paragraph id="HB4E0AF90C7D1426FB71B0A1AA33B0E03"><enum>(11)</enum><text display-inline="yes-display-inline">An assessment of how the community will address unemployment among agricultural commodity producers, if applicable.</text></paragraph></subsection><subsection id="H8D6628890C0C4F72A1E14EF01EB5DE43" commented="no"><enum>(d)</enum><header>Technical assistance</header><paragraph id="H20078578043B49B9BB832225648FCE6B" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, subject to the availability of appropriations, offer assistance in developing a strategic plan under this section to any eligible community that requests such assistance.</text></paragraph><paragraph id="HB159A9A202114F28BE2A987015C3563E" commented="no"><enum>(2)</enum><header>Availability of amounts appropriated</header><text display-inline="yes-display-inline">The Secretary may make available not more than $50,000,000 of the amounts appropriated pursuant to the authorization of appropriations under section 277(c) for each of the fiscal years 2022 through 2026 to provide assistance to communities under this subsection.</text></paragraph></subsection><subsection id="H52E3919F3D9A48B4A84A83617A424119" commented="no"><enum>(e)</enum><header>Approval</header><text display-inline="yes-display-inline">The Secretary shall approve the strategic plan developed by an eligible community under this section if the Secretary determines that the strategic plan meets the requirements of this section.</text></subsection></section><section id="H039510B49C9A4882B3E39448C463AB7A" commented="no"><enum>276.</enum><header>Coordination of Federal response and other additional technical assistance</header><subsection id="H6AC681BD4B194143AE9928C5F9D330B7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall coordinate the Federal response with respect to an eligible community that is awarded a grant under section 274 to carry out the community’s strategic plan developed under section 275 by—</text><paragraph id="HE11F73F35372459B8E24E4CB17E73987" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">identifying and consulting, as appropriate, with—</text><subparagraph id="HA97209C8F9CD423987B55CB8FDADAF6A"><enum>(A)</enum><text>the Department of Agriculture, the Department of Defense, the Department of Education, the Department of Energy, the Department of Labor, the Department of Housing and Urban Development, the Department of Health and Human Services, the Small Business Administration, the Department of the Treasury; and</text></subparagraph><subparagraph id="H2E6662E9554547F4B001315F6264C705"><enum>(B)</enum><text>any other Federal, State, regional, or local government agency, if appropriate;</text></subparagraph></paragraph><paragraph id="H5F88C0DD17874B15A3DAEDA1719CBB90" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">assisting the community to access assistance from other available Federal sources as necessary to fulfil the community’s strategic plan developed under section 275; and</text></paragraph><paragraph id="H434D454FF9CD48749D0F9348900800D1"><enum>(3)</enum><text>ensuring that such assistance is provided in a targeted, integrated manner.</text></paragraph></subsection><subsection id="H5FF70DE84896411A9599C8AFE9EAB7F2"><enum>(b)</enum><header>Additional technical assistance</header><text>In addition to the coordination and assistance described in subsection (a), the Secretary shall, subject to the availability of appropriations, provide technical assistance for communities—</text><paragraph id="H0DC798E5D9334CAD8EEC38205850B2F8"><enum>(1)</enum><text display-inline="yes-display-inline">to identify significant impediments to economic development that result from the impact of trade on the community, including in the course of developing a strategic plan under section 275; and</text></paragraph><paragraph id="HCFF5E2A641F345789AFE02E995263566"><enum>(2)</enum><text display-inline="yes-display-inline">to access assistance under other available sources, including State, local, or private sources by carrying out projects that diversify and strengthen the economy in the community.</text></paragraph></subsection></section><section id="H4F27B9D80FC1473F97BCA745C0885210"><enum>277.</enum><header>General provisions</header><subsection id="HAFDAD46CE9BD46249521C3E01EB92CC5"><enum>(a)</enum><header>Regulations</header><paragraph id="HFA991AEEF6C14E0E8852B4C48E287877" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, subject to paragraph (3), promulgate such regulations as may be necessary to carry out this subchapter, including—</text><subparagraph id="HD1904915B8594898919804E6353FE226" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">administering the awarding of grants under section 274, including establishing guidelines for the submission and evaluation of grant applications under such section; and</text></subparagraph><subparagraph id="H3D59228C3B624704B0248550E9952877" commented="no"><enum>(B)</enum><text>establishing guidelines for the evaluation of strategic plans developed under section 275.</text></subparagraph></paragraph><paragraph id="HB9F3875EC20C489F91F034B1915989A2"><enum>(2)</enum><header>Consultations</header><text display-inline="yes-display-inline">The Secretary shall consult with the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate not later than 90 days prior to promulgating any final rule or regulation under this subsection.</text></paragraph><paragraph id="HF45616CF6F8D479FA5694C319FB63CB9" commented="no"><enum>(3)</enum><header>Relationship to existing regulations</header><text display-inline="yes-display-inline">The Secretary, to the maximum extent practicable, shall—</text><subparagraph id="H301319708EF34D038342DA5430584C3B" commented="no"><enum>(A)</enum><text>rely on and apply regulations promulgated to carry out other economic development programs of the Department of Commerce for purposes of carrying out this subchapter; and</text></subparagraph><subparagraph id="H6D9DCF3909824F8AA608314A2ABC55A2" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">provide guidance regarding the manner and extent to which such other economic development programs relate to this subchapter.</text></subparagraph></paragraph></subsection><subsection id="HD110449BE2934B1AA224C620DA3D55B3"><enum>(b)</enum><header>Personnel; resources</header><text display-inline="yes-display-inline">The Secretary shall—</text><paragraph id="H096823E5533A4B498872E558C75E981F"><enum>(1)</enum><text display-inline="yes-display-inline">designate such staff as may be necessary to provide sufficiently individualized assistance to each eligible community that seeks technical assistance under section 273(a)(4), 275(d), or 276(b) to develop and implement its strategic plan under section 275; and</text></paragraph><paragraph id="HACF3EB4DF4BC4ED897F3539707453EA2"><enum>(2)</enum><text>designate such staff and allocate such existing resources as may be necessary to carry out this subchapter.</text></paragraph></subsection><subsection id="H22E59386841A40079F6A3332AD93E5F7"><enum>(c)</enum><header>Authorization of appropriations</header><paragraph id="HD9A69439048A4D8DB8DCB98BBF613631"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary $1,000,000,000 for each of the fiscal years 2022 through 2026 to carry out this subchapter. </text></paragraph><paragraph id="H44F5828207C14E968B3D4EAC7A5AF19C"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated pursuant to the authorization of appropriations under this subsection—</text><subparagraph id="H9C74F1393F3A468894A6AF24EF9237F4"><enum>(A)</enum><text>shall remain available until expended; and</text></subparagraph><subparagraph id="H29FC99388E444E9D910864666DF5BC69"><enum>(B)</enum><text display-inline="yes-display-inline">shall be used to supplement, and not supplant, other Federal, State, regional, and local government funds made available to provide economic development assistance for communities.</text></subparagraph></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H50EF5557435D499B87C812791730CA93"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by striking the items relating to chapter 4 of title II and inserting the following: </text><quoted-block style="OLC" id="H35E0A118EA614055A62CD3562660A174" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry and</text></paragraph><paragraph id="H7B891A306F3746B1AB23484464CC2E11"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" id="H57AEF15682934194B9EC84E612EB42EB" display-inline="no-display-inline"><subsection id="HDD60C32D320E4946A8264DB732E5A63E"><enum>(e)</enum><header>Notification</header><text display-inline="yes-display-inline">Upon receipt of a grant proposal from an eligible institution seeking to receive a grant under this section, the Secretary shall notify the Secretary of Commerce that such grant proposal has been received for purposes of assisting an eligible community (as such term is defined in section 271) in which such institution is located in applying for a grant under section 274.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="H5614B74B6CA74EA4A2A623937A76FC37"><enum>IV</enum><header>Trade Adjustment Assistance for Farmers</header><section id="H6DB8D8551E454817B4E451EF4C3BFF28" commented="no"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 291 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401">19 U.S.C. 2401</external-xref>) is amended—</text><paragraph id="H25F12EBA5C484F6AA214029F19916C05" commented="no"><enum>(1)</enum><text>by striking paragraph (3); and </text></paragraph><paragraph id="H652B0914598A4F268BD5C69C93F6659F"><enum>(5)</enum><text>the decrease in such exports contributed to the decrease in the national average price, quantity of production, or value of production of, or cash receipts for, the agricultural commodity, as described in paragraph (1).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H78AD2504305A427991F5831C4A99ADE3"><enum>(2)</enum><text>in subsection (e)(3), by adding at the end before the period the following: <quote>or exports</quote>.</text></paragraph></section><section id="H6CF54EDCEC764631B389586EAC17F26D" commented="no"><enum>403.</enum><header>Annual report</header><text display-inline="no-display-inline">Section 293(d) (<external-xref legal-doc="usc" parsable-cite="usc/19/2401b">19 U.S.C. 2401b(d)</external-xref>) of the Trade Act of 1974 is amended by adding at the end the following:</text><quoted-block style="OLC" id="H087F2B76317443B0899F10826141E599" display-inline="no-display-inline"><paragraph id="HE4CF5C7A0A774242BEF44CBE977918F3" commented="no"><enum>(20)</enum><text display-inline="yes-display-inline">Data or information on the success of the program in assisting agricultural commodity producers to become more competitive.</text></paragraph><paragraph id="H0C5880330D0C4F28979F3380D65C6B06" commented="no"><enum>(21)</enum><text display-inline="yes-display-inline">The demographic information (including race, ethnicity, gender, income level, and age) of agricultural commodity producers, including whether those producers are from underserved communities.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H0AC214AAF1EA4020A2C1327870A72FE9" commented="no"><enum>404.</enum><header>Benefit information to agricultural commodity producers</header><text display-inline="no-display-inline">Section 295(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401d">19 U.S.C. 2401d(a)</external-xref>) is amended by adding at the end the following: <quote>The Secretary shall develop a plan to conduct targeted outreach and offer assistance to agricultural commodity producers from underserved communities</quote>. </text></section><section id="H027D01A16DE642349A854A6D1ABD1820"><enum>405.</enum><header>Qualifying requirements and benefits for agricultural commodity producers</header><text display-inline="no-display-inline">Section 296 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401e">19 U.S.C. 2401e</external-xref>) is amended—</text><paragraph id="HC448FC138556459C83826DBD62E12AE6"><enum>(1)</enum><text>in subsection (a)(1)(A), by striking <quote>90 days</quote> and inserting <quote>120 days</quote>;</text></paragraph><paragraph id="H3553BA676C5B4104B3B73A880721517C"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HA571CEFFDC824C97A0A49688919F4282"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3)(B), by striking <quote>$4,000</quote> and inserting <quote>$12,000</quote>; and</text></paragraph><paragraph id="HF0DF16D70BE34D7B884267C0C6FE6458" commented="no"><enum>(4)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H46BE06542D724960BCA34B2B65A857FF" display-inline="no-display-inline"><subsection id="H74C58FFE7C1B4EBB9F86948561A9B49F" commented="no"><enum>(e)</enum><header>Adjustments for inflation</header><paragraph id="H68A20BC6AEB64261AB700464AA78996E" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary of Agriculture shall adjust each dollar amount limitation described in this section on October 1, 2021, and at the beginning of each fiscal year thereafter, to reflect the percentage (if any) of the increase in the average of the Consumer Price Index for the preceding 12-month period compared to the Consumer Price Index for fiscal year 2020.</text></paragraph><paragraph id="H1A0116A8EE504EF9A6020EC60EAE5CF1" commented="no"><enum>(2)</enum><header>Special rules for calculation of adjustment</header><text>In making an adjustment under paragraph (1), the Secretary—</text><subparagraph id="H32005E273A6749B58C8764CE77ACA4FE" commented="no"><enum>(A)</enum><text>shall round the amount of any increase in the Consumer Price Index to the nearest dollar; and</text></subparagraph><subparagraph id="H6BC309297FE240538F1279D31EBAE305"><enum>(B)</enum><text>by striking <quote>section 271(a)(2)</quote> and inserting <quote>section 279(a)(2)</quote>. </text></subparagraph></paragraph><paragraph id="H07A55602C8434F7A9414CB5EEC1293D4"><enum>(4)</enum><header>Trade adjustment assistance for farmers</header><text display-inline="yes-display-inline">Section 298(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401g">19 U.S.C. 2401g(a)</external-xref>) is amended by striking <quote>2021</quote> and inserting <quote>2028</quote>.</text></paragraph></subsection></section><section id="H598CFCFB64C442B5936190DC0F13105D"><enum>502.</enum><header>Applicability of trade adjustment assistance provisions</header><subsection id="H751998B426ED42E0B205609A28D12CE3"><enum>(a)</enum><header>Workers certified before date of enactment</header><paragraph id="H34F862FEDEFA4D8EA7A17012BC7A0697"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (3), a worker certified as eligible for adjustment assistance under section 222 of the Trade Act of 1974 before the date of the enactment of this Act shall be eligible, on and after such date of enactment, to receive benefits only under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of enactment, or as such provisions may be amended after such date of enactment.</text></paragraph><paragraph id="HB051E8A209084D6BB33ADE222C16C791"><enum>(2)</enum><header>Computation of maximum benefits</header><text display-inline="yes-display-inline">Benefits received by a worker described in paragraph (1) under chapter 2 of title II of the Trade Act of 1974 before the date of the enactment of this Act shall be included in any determination of the maximum benefits for which the worker is eligible under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment.</text></paragraph><paragraph id="HDE8F6EAB2D234F7C8919E552C542D52F"><enum>(3)</enum><header>Authority to make adjustments to benefits</header><text display-inline="yes-display-inline">Notwithstanding any provision of chapter 2 of title II of the Trade Act of 1974, for the 90-day period beginning on the date of the enactment of this Act, the Secretary is authorized to make any adjustments to benefits to workers described in paragraph (1) that the Secretary determines to be necessary and appropriate in applying and administering the provisions of such chapter 2, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment, in a manner that ensures parity of treatment between the benefits of such workers and the benefits of workers certified after such date of enactment.</text></paragraph></subsection><subsection id="HD9A764E5A0A44B5AA99C8BC74E4D5973"><enum>(b)</enum><header>Workers not certified pursuant to certain petitions filed before date of enactment</header><paragraph id="H11A6A4A6DD114794BDA53A3C3E1B4493"><enum>(1)</enum><header>Certifications of workers not certified before date of enactment</header><subparagraph id="H8D85A642D48D4E9497BE8D9841F60F4C"><enum>(A)</enum><header>Criteria if a determination has not been made</header><text display-inline="yes-display-inline">If, as of the date of the enactment of this Act, the Secretary of Labor has not made a determination with respect to whether to certify a group of workers as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall make that determination based on the requirements of section 222 of the Trade Act of 1974, as in effect on such date of enactment. </text></subparagraph><subparagraph id="HC768F67228724AB38DD9EE6CAB9001DB"><enum>(B)</enum><header>Reconsideration of denials of certifications</header><text display-inline="yes-display-inline">If, before the date of the enactment of this Act, the Secretary made a determination not to certify a group of workers as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall—</text><clause id="H61819ABCDBED4F2AA16F95F2F45FB09E"><enum>(i)</enum><text>reconsider that determination; and</text></clause><clause id="HCC63D92771CC47CE91772046318221CD"><enum>(ii)</enum><text>if the group of workers meets the requirements of section 222 of the Trade Act of 1974, as in effect on such date of enactment, certify the group of workers as eligible to apply for adjustment assistance.</text></clause></subparagraph><subparagraph id="H5AF26DC7649047FDA71395F7ACDE4280"><enum>(C)</enum><header>Petition described</header><text display-inline="yes-display-inline">A petition described in this subparagraph is a petition for a certification of eligibility for a group of workers filed under section 221 of the Trade Act of 1974 on or after January 1, 2021, and before the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="H8FE7E6D40F02466FA1AD471F27C6E700"><enum>(2)</enum><header>Eligibility for benefits</header><subparagraph id="H00EAD448179840D6AA2FDD07CC527C77"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), a worker certified as eligible to apply for adjustment assistance under section 222 of the Trade Act of 1974 pursuant to a petition described in paragraph (1)(C) shall be eligible, on and after the date of the enactment of this Act, to receive benefits only under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on such date of enactment, or as such provisions may be amended after such date of enactment.</text></subparagraph><subparagraph id="H43AE97979159492D9EB4BFD46A33AA67"><enum>(B)</enum><header>Computation of maximum benefits</header><text display-inline="yes-display-inline">Benefits received by a worker described in paragraph (1) under chapter 2 of title II of the Trade Act of 1974 before the date of the enactment of this Act shall be included in any determination of the maximum benefits for which the worker is eligible under the provisions of chapter 2 of title II of the Trade Act of 1974, as in effect on the date of the enactment of this Act, or as such provisions may be amended after such date of enactment.</text></subparagraph></paragraph></subsection><subsection id="H7B46A45D151D45248E004E44C8687E44"><enum>(c)</enum><header> Conforming amendments</header><paragraph id="H4E8D6038328142A09B71FF9A7952B379"><enum>(1)</enum><header>Trade Act of 2002</header><text display-inline="yes-display-inline">Section 151 of the Trade Act of 2002 (19 U.S.C. note prec. 2271) is amended by striking subsections (a), (b), and (c).</text></paragraph><paragraph id="HB964F6E4C9454969AC150C8DCFA62D84"><enum>(2)</enum><header>Trade and Globalization Adjustment Assistance Act of 2009</header><text>Section 1891 of the Trade and Globalization Adjustment Assistance Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271</external-xref> note) is repealed.</text></paragraph><paragraph id="HB46DA58950524F569EF685C122A00D2B"><enum>(3)</enum><header>Trade Adjustment Assistance Extension Act of 2011</header><text>The Trade Adjustment Assistance Extension Act of 2011 is amended—</text><subparagraph id="H34572C34826A492CAC3FB8B9F589D554"><enum>(A)</enum><text display-inline="yes-display-inline">in section 201 (19 U.S.C. note prec. 2271), by striking subsections (b) and (c); and</text></subparagraph><subparagraph id="H2D708B7857C749F8A636FCE711DF28E8"><enum>(B)</enum><text display-inline="yes-display-inline">in section 405(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319(a)(1)</external-xref>), by striking subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="HF4CAE8DFC5E7455292D1305FD5A60BBF"><enum>(d)</enum><header>Trade adjustment assistance for firms</header><paragraph id="H7ACDC72874F148E58B4A5DFB088B1A74"><enum>(1)</enum><header>Certification of firms not certified before date of enactment</header><subparagraph id="H491E2A888CCD4A04801532A3F9B4C7D0"><enum>(A)</enum><header>Criteria if a determination has not been made</header><text>If, as of the date of the enactment of this Act, the Secretary of Commerce has not made a determination with respect to whether to certify a firm as eligible to apply for adjustment assistance under section 251 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall make that determination based on the requirements of section 251 of the Trade Act of 1974, as in effect on such date of enactment. </text></subparagraph><subparagraph id="HFF01487B1EA94817BA81F0B6797CDE6E"><enum>(B)</enum><header>Reconsideration of denial of certain petitions</header><text>If, before the date of the enactment of this Act, the Secretary made a determination not to certify a firm as eligible to apply for adjustment assistance under section 251 of the Trade Act of 1974 pursuant to a petition described in subparagraph (C), the Secretary shall—</text><clause id="H5FCA3E76633D440A9254E7FF7C1132DC"><enum>(i)</enum><text>reconsider that determination; and </text></clause><clause id="HB7522E6920A24446A39FEF69B583A33F"><enum>(ii)</enum><text>if the firm meets the requirements of section 251 of the Trade Act of 1974, as in effect on such date of enactment, certify the firm as eligible to apply for adjustment assistance. </text></clause></subparagraph><subparagraph id="H8D49A82E3B0245A3AD8705070947521F"><enum>(C)</enum><header>Petition described</header><text>A petition described in this subparagraph is a petition for a certification of eligibility filed by a firm or its representative under section 251 of the Trade Act of 1974 on or after January 1, 2021, and before the date of the enactment of this Act. </text></subparagraph></paragraph><paragraph id="HFD001F8012E049E8BCC367C82C3DC71E"><enum>(2)</enum><header>Certification of firms that did not submit petitions between January 1, 2021, and date of enactment</header><subparagraph id="HDE5B0C4BD4C64FD19B6D7667E889BFB0"><enum>(A)</enum><header>In general</header><text>The Secretary of Commerce shall certify a firm described in subparagraph (B) as eligible to apply for adjustment assistance under section 251 of the Trade Act of 1974, as in effect on the date of the enactment of this Act, if the firm or its representative files a petition for a certification of eligibility under section 251 of the Trade Act of 1974 not later than 90 days after such date of enactment. </text></subparagraph><subparagraph id="HE015316FC1054100BDDD1C6137F419A3"><enum>(B)</enum><header>Firm described</header><text>A firm described in this subparagraph is a firm that the Secretary determines would have been certified as eligible to apply for adjustment assistance if—</text><clause id="H28EBF5193FF543278CD28419F788FAA6"><enum>(i)</enum><text>the firm or its representative had filed a petition for a certification of eligibility under section 251 of the Trade Act of 1974 on a date during the period beginning on January 1, 2021, and ending on the day before the date of the enactment of this Act;
