which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to prevent concurrent receipt of unemployment benefits and Social Security disability insurance, and for other purposes.</official-title></form><legis-body id="H26A3C0FE4DED437CA3F2F75E090727FA" style="OLC"><section id="H1BA04079CF7042D785561260B39869B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Double Dip Elimination Act</short-title></quote>.</text></section><section id="H1020BBBF08694376B9D9A85830132974"><enum>2.</enum><header>Disqualification on receipt of disability insurance benefits in a month for which unemployment compensation is received</header><subsection id="HD50F57A525334895BA3014C5799394AD"><enum>(a)</enum><header>In general</header><text>Section 223(d)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/423">42 U.S.C. 423(d)(4)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HE96507D3A77C4499997A2935D5DE56B7" style="OLC"><subparagraph id="HF338FA4AB4564BE1BD183A6B677D72F4" indent="up2"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H2B43897AF2CC45D2B639765BFD08457B"><enum>(i)</enum><text display-inline="yes-display-inline">If for any week ending within a month an individual is paid unemployment compensation, such individual shall be deemed to have engaged in substantial gainful activity for such month.</text></clause><clause id="HB3B282D0C58E43338B15CB2048FDC8DB" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">For purposes of clause (i), the term <quote>unemployment compensation</quote> means—</text><subclause id="H2CE9E8AC2C544ACAA4532BCB03C4576B"><enum>(I)</enum><text><quote>regular compensation</quote>, <quote>extended compensation</quote>, and <quote>additional compensation</quote> (as such terms are defined by section 205 of the Federal-State Extended Unemployment Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note)); and</text></subclause><subclause id="H79F1BF6E8C05410B9C88D47C5AD2E99E"><enum>(II)</enum><text display-inline="yes-display-inline">trade readjustment allowance under title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251 et seq.</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCEBA28C904EE4AC6B6C39A56617CB78F"><enum>(b)</enum><header>Trial work period</header><text display-inline="yes-display-inline">Section 222(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/422">42 U.S.C. 422(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H7CD392AC34EE45F7984E0FCF3BD74322" style="OLC"><paragraph id="H8E68A13443F04AAC93E2295C672B2942" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE751C585C1A4486299FA022F61FEFF57"><enum>(A)</enum><text>For purposes of this subsection, an individual shall be deemed to have rendered services in a month if the individual is paid unemployment compensation for any week ending within such month.</text></subparagraph><subparagraph id="HBF0357FF0B3148AAB41BC43CDD2E5915" indent="up1"><enum>(B)</enum><text>For purposes of subparagraph (A), the term <quote>unemployment compensation</quote> means—</text><clause id="HCBCAB13F65EA4C1080E9CE5B260149E0"><enum>(i)</enum><text><quote>regular compensation</quote>, <quote>extended compensation</quote>, and <quote>additional compensation</quote> (as such terms are defined by section 205 of the Federal-State Extended Unemployment Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note)); and</text></clause><clause id="HDBB2399122EF454DB042DCA6D6321117"><enum>(ii)</enum><text display-inline="yes-display-inline">trade readjustment allowance under title II of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251 et seq.</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9C29FD4F449A47A2A7F4CF3EE84A7708"><enum>(c)</enum><header>Data matching</header><text>The Commissioner of Social Security shall implement the amendments made by this section using appropriate electronic data.</text></subsection><subsection id="HD9788C37D2164CDC8EE2C49574C31352"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to individuals who initially apply for disability insurance benefits on or after January 1, 2022, and are paid unemployment compensation for any week ending on or after January 1, 2022.</text></subsection></section></legis-body></bill>
