which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require Federal agencies to timely respond to right-of-way requests for the build out of broadband service, and for other purposes.</official-title></form><legis-body id="H08F4E3B513D144CE85632BAD602B5942" style="OLC"><section section-type="section-one" id="H7B94CF9D75D6489B986F1566A22AE3D1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accelerating Rural Broadband Deployment Act</short-title></quote>.</text></section><section id="H10F2209231414645A7686D021B61F03B"><enum>2.</enum><header>Access to Federal rights-of-way for build out of broadband service</header><subsection id="H4832748AD7544EB89EB2BAA82E05CB88"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H7DC00E9B8C9B41139D3E539A896E79DB"><enum>(1)</enum><header>Broadband service</header><text>The term <term>broad­band service</term> means— </text><subparagraph commented="no" id="HD185CDF6C491464C85FC08789D18027C"><enum>(A)</enum><text>any service that has the capacity to transmit data to enable users or devices to originate and receive high-quality voice, data, graphics, and video;</text></subparagraph><subparagraph commented="no" id="H04FFC2B5A8EC4E4DA0F0EC58AEFCF01B"><enum>(B)</enum><text>any service by wire or radio that provides the capability to transmit data to, and receive data from, all or substantially all internet endpoints— </text><clause commented="no" id="HC4BD19B3174E45B0B896878814AE023E"><enum>(i)</enum><text>including any capabilities that are incidental to, and enable the operation of, the service; and</text></clause><clause commented="no" id="HAE7E5192BF284B6C873212D48F64696E"><enum>(ii)</enum><text>excluding dial-up internet access service; or</text></clause></subparagraph><subparagraph commented="no" id="HCBD89EE21281443B8515D1DE9AA43EDE"><enum>(C)</enum><text>any service that is the functional equivalent of a service described in subparagraph (A) or (B).</text></subparagraph></paragraph><paragraph id="H1AE3B0DD39D6490EAE30E25559D06A9C"><enum>(2)</enum><header>Executive agency</header><text>The term <term>Executive agency</term>—</text><subparagraph id="H8D8A2F6DECD8476982A699E227292592"><enum>(A)</enum><text>has the meaning given the term in section 105 of title 5, United States Code; and</text></subparagraph><subparagraph id="H49C28F3C85DD4DA58AB333A866584F7C"><enum>(B)</enum><text>does not include the Department of Defense, except for the Army Corps of Engineers.</text></subparagraph></paragraph></subsection><subsection id="HBEB53F694DF74977B35303EC5BFA0DF0"><enum>(b)</enum><header>Access</header><paragraph id="HE9E760B902A24E05884E2269E2822650"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If an Executive agency, a State, a political subdivision or agency of a State, an Indian tribal government, or a person, firm, or organization requests access to a right-of-way owned by the Federal Government, or an instrumentality thereof, in order to place, construct, modify, or operate facilities for the provision of broadband service, the Executive agency having control of the right-of-way may grant to the applicant, on behalf of the Federal Government, a license of occupancy authorizing the deployment of all equipment required to deploy broadband service.</text></paragraph><paragraph id="HBDB84791A64A4A969705D92FCF5B6C11"><enum>(2)</enum><header>Duration</header><text> A license of occupancy issued under this subsection shall be issued with a duration of not more than 30 years and may be automatically renewed for additional periods of like duration. </text></paragraph><paragraph id="H709ACDEF173D442780A727E24654342F"><enum>(3)</enum><header>Fee</header><subparagraph id="H59734579B05C4C25956C9F447EC0FB5F"><enum>(A)</enum><header>In general</header><text>Each Executive agency shall establish an annual license fee for a license of occupancy issued under this subsection.</text></subparagraph><subparagraph id="H80D92C52A7C749CE924AAE50798D58A0"><enum>(B)</enum><header>Considerations</header><text>In establishing a fee under subparagraph (A), an Executive agency shall—</text><clause id="HB2B7B368C9E640598BB377950C4B4E7D"><enum>(i)</enum><text>consider property valuations based on the restricted and limited use nature of the underlying parcel (adjacent commercial, private or multiple use properties shall not be used for the purpose of determining comparable valuations); and</text></clause><clause id="H0D25ED4DF68F41E182E9E3EF06A6AFD1"><enum>(ii)</enum><text>the size of the portion of land requested to accommodate the equipment of the licensee that is required to deploy broadband service.</text></clause></subparagraph><subparagraph id="HBA107368CA84405B96CBDD20CA16965C"><enum>(C)</enum><header>Adjustments</header><text>An annual license fee established under this paragraph may be adjusted, not more frequently than once every 6 years, to reflect the current valuations upon renewal of such license. </text></subparagraph></paragraph><paragraph id="H8B7AD15B1DD74C4D9C17C3FA56B3E6E5"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to exempt an Executive agency from the requirements of division A of subtitle III of title 54, United States Code, or the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>). </text></paragraph></subsection><subsection id="H6EC5759DB88C4AA18D4A6C1A85E4E545"><enum>(c)</enum><header>Timely consideration of applications</header><paragraph id="H3CD5C2B879DB4E50B6B1CBEDFA4946E6"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date on which an Executive agency receives a request under subsection (b), the Executive agency shall—</text><subparagraph id="H018A918A9EFF47ECB0C9EEF15E93891B"><enum>(A)</enum><text>on behalf of the Federal Government, grant the application, grant the application subject to conditions, or deny the application; and</text></subparagraph><subparagraph id="H3510D0A607E34D26B78665E28B4B3130"><enum>(B)</enum><text>notify the applicant of the decision of the Executive agency under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HFE6634DD62E242FA8F796BED1CAC6667"><enum>(2)</enum><header>Explanation of denial</header><text>If an Executive agency denies an application under this subsection, the Executive agency shall notify the applicant in writing of such denial, which shall—</text><subparagraph id="HEFEA5CB14EDB45ED878EA19DDC614F78"><enum>(A)</enum><text>be supported by substantial evidence contained in a written record; and</text></subparagraph><subparagraph id="HE12E8EDF0B5848CA911D7E351880700A"><enum>(B)</enum><text>include a clear statement of the reasons for the denial. </text></subparagraph></paragraph><paragraph id="H2DE79978EABF49179EC47E77BAE9D107"><enum>(3)</enum><header>Public release of record</header><text>The written record described in paragraph (2)(A) shall be made available to the public on the date on which the written notification is provided to the applicant under paragraph (2). </text></paragraph><paragraph id="H15A9FE796D1F4A758B1E125BB1B5EF47"><enum>(4)</enum><header>Automatic grant of request</header><text>If an Executive agency fails to act on a request received under subsection (b) by the end of the 60-day period described in paragraph (1), the application shall be considered granted.</text></paragraph></subsection><subsection id="H750EDC776EE74D64BD6109BD35F7A2AB"><enum>(d)</enum><header>Requirement</header><text>Any regulation issued by an Executive agency governing management of access to a Federal right-of-way under this section shall—</text><paragraph id="H862AF316F8A847009E298DEEDDA13B4B"><enum>(1)</enum><text>be competitively and technologically neutral; and</text></paragraph><paragraph id="H3774DBE4234149BE85CC1D8BEBFE4D3B"><enum>(2)</enum><text>apply to all providers of broadband service on a competitively neutral and nondiscriminatory basis.</text></paragraph></subsection></section></legis-body></bill>
