which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title VI of the Public Utility Regulatory Policies Act of 1978 to establish a Federal renewable electricity standard for retail electricity suppliers, and for other purposes.</official-title></form><legis-body id="H84CF704E5C2A4DA4B857B749F7FB6C0C" style="OLC"><section id="H755F5D3F37E948ED8E1E9B5D8EA3440F" section-type="section-one"><enum>1.</enum><header>Short title; findings</header><subsection id="H1ADD881907624073AE558FF6DA4796C8"><enum>(a)</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Renewable Energy Act of 2021</short-title></quote>.</text></subsection><subsection id="H5BA6AD5754F7434F95EB56848AB50E1B" commented="no"><enum>(b)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="H1BE2BD935CC746ABB734ABA11F2A1973" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal renewable electricity standard established by section 610 of the Public Utility Regulatory Policies Act of 1978 (as added by this Act) establishes a market-based policy to create ongoing competition among renewable electricity generators across the United States and provide the greatest quantity of clean electricity for the lowest price; and</text></paragraph><paragraph id="H21925A7352B2406FAC22D03537E28FA1" commented="no"><enum>(2)</enum><text>the United States has vast wind, solar, hydropower, and geothermal resources that—</text><subparagraph id="H1C87A1913DBE44E7B07C0903577A133C" commented="no"><enum>(A)</enum><text>are renewable;</text></subparagraph><subparagraph id="HB408BA4FB7E248F581822945317D6483" commented="no"><enum>(B)</enum><text>are dispersed widely across different regions of the United States; </text></subparagraph><subparagraph id="HEBC34A501A2A429D8C06A34F46EB51F0" commented="no"><enum>(C)</enum><text>can be harnessed to generate a significant share of electricity in the United States; and</text></subparagraph><subparagraph id="HA7B6ED6FC47649BC9ADB452927F091F8" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">when deployed, will significantly reduce and eliminate the emission of harmful greenhouse gases and criteria pollutants, which have historically been concentrated in underserved communities and communities of color, contributing to disproportionate burdens and environmental injustices. </text></subparagraph></paragraph></subsection></section><section id="H73E7DEA1319E41FEBAE30F1E9C8E8AE1" commented="no"><enum>2.</enum><header>Federal renewable electricity standard</header><text display-inline="no-display-inline">Title VI of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2601">16 U.S.C. 2601 et seq.</external-xref>) is amended by adding after section 609 (<external-xref legal-doc="usc" parsable-cite="usc/7/918c">7 U.S.C. 918c</external-xref>) the following:</text><quoted-block id="HD3F12DE6CBB847EC8695841084A07E4B" style="OLC"><section id="H81E1A83748594D1CBDF424886556F4C6" commented="no"><enum>610.</enum><header>Federal renewable electricity standard</header><subsection id="H6B70D47C3506419AAF39A95CBFC8F365" commented="no"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9B7EA5A2516C4B3E99BB6430D0045171" commented="no"><enum>(1)</enum><header>Criteria air pollutant</header><text display-inline="yes-display-inline">The term <term>criteria air pollutant</term> means an air pollutant for which a national ambient air quality standard has been promulgated under section 109 of the Clean Air Act.</text></paragraph><paragraph id="HBB0D4075E2614E87BFC8758411CC61AA" commented="no"><enum>(2)</enum><header>Distributed generation</header><text display-inline="yes-display-inline">The term <term>distributed generation</term> means a non-centralized renewable energy resource installation, or interconnected series of installations, that generates electricity near the point of use with a total generating capacity of 1 megawatt or less.</text></paragraph><paragraph id="HF8383A2F3C5C4273B96617AF98971F7A" commented="no"><enum>(3)</enum><header>Environmental justice community</header><subparagraph id="H3180B6F3C62B4677B6747ACE7DECADCA" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>environmental justice community</term> means a low-income or low-wealth community that is impacted by environmental injustice.</text></subparagraph><subparagraph id="H507BDF8AA7794153BAAF60F11E009835" commented="no"><enum>(B)</enum><header>Inclusions</header><text>The term <term>environmental justice community</term> includes any community that—</text><clause id="HE552C593FDC444F6846B2C6525556464" commented="no"><enum>(i)</enum><text>is located nearest to an existing area of significant environmental pollution and degradation;</text></clause><clause id="H2607AE8AB99D4D71B73C36BDEDBB9E02" commented="no"><enum>(ii)</enum><text>bears a burden of negative public health effects from pollution;</text></clause><clause id="H29E771830D2247F2A3B78F447036DCFB" commented="no"><enum>(iii)</enum><text>includes 1 or more sites of—</text><subclause id="H6758633FA70246C5BAC769ECAC070933" commented="no"><enum>(I)</enum><text>a facility that is a part of a polluting industry;</text></subclause><subclause id="H4FFE3FD3179241868D1958E1512736B1" commented="no"><enum>(II)</enum><text>a waste dump; or</text></subclause><subclause id="HB72838F4E7BD4E48B6EC7A4AA78738DE" commented="no"><enum>(III)</enum><text>a facility for fossil resource extraction;</text></subclause></clause><clause id="HFCB291C0BAA84858A883734766CD644C" commented="no"><enum>(iv)</enum><text>experiences a high incidence of climate change impacts and disasters;</text></clause><clause id="H4FAE0EEDB5A54784BB85AFBD3DC2A91A" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">has been excluded or harmed by racist or discriminatory policies that have resulted in disproportionate burdens of environmental pollution and related health and socioeconomic disparities;</text></clause><clause id="H04C2376719C845788A855FA0471E31DA" commented="no"><enum>(vi)</enum><text>has a land-based or food subsistence culture that is experiencing ecosystem disruption and devastation;</text></clause><clause id="H2F5B33AC14144525B9819BCBBD3B29B7" commented="no"><enum>(vii)</enum><text>faces relocation and resettlement resulting from—</text><subclause id="H87989C7A761540E08BC8C37FD27FEC1D" commented="no"><enum>(I)</enum><text>climate change; or</text></subclause><subclause id="HD18AD9EDE3124B31919C55B9629FEC18" commented="no"><enum>(II)</enum><text>impacts to the environment and ecosystems; or</text></subclause></clause><clause id="H893829B604CF4552AD7C21A23098A337" commented="no"><enum>(viii)</enum><text display-inline="yes-display-inline">is an Indigenous community. </text></clause></subparagraph></paragraph><paragraph id="HAC3EFC0E731F459AB61F06CB7AAC95E1" commented="no"><enum>(4)</enum><header>Federal renewable electricity credit</header><text>The term <term>Federal renewable electricity credit</term> means a credit that—</text><subparagraph id="H028A91E04B0A4C13A3D583502BD53F58"><enum>(A)</enum><text>represents, for purposes of compliance with this section, 1 megawatt hour of renewable electricity; and</text></subparagraph><subparagraph id="H065D21B17E4C423EB28C4D1A9F5FFC24"><enum>(B)</enum><text>is issued pursuant to subsection (e).</text></subparagraph></paragraph><paragraph id="H5123FEF3950B4681B928026CC53E1A08" commented="no"><enum>(5)</enum><header>Impacted community</header><subparagraph id="H20A15A571DD2444E8D382E43FEB10AA4" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>impacted community</term> means a community that is harmed by environmental, economic, or socioeconomic injustice.</text></subparagraph><subparagraph id="H32C0B3858BEE4FFF8335F00D08A54C8F" commented="no"><enum>(B)</enum><header>Inclusions</header><text>The term <term>impacted community</term> includes—</text><clause id="H6FCCA55F8A1642768D96366ACB17B8DB" commented="no"><enum>(i)</enum><text>an environmental justice community; and</text></clause><clause id="H2CC77B4442F84FDD97883A5AB3F521BA" commented="no"><enum>(ii)</enum><text>a community that—</text><subclause id="HE0E710278D7A4332A6BD8DE17F1E9735" commented="no"><enum>(I)</enum><text>has a high concentration of low-income and low-wealth households, including households comprised primarily of members of groups that have historically experienced discrimination on the basis of race, gender, national origin, or ethnicity (including Black, Indigenous, Latinx, Arab, Asian, and Pacific Islander communities);</text></subclause><subclause id="HF5BA378F4C5342BEAAFC3523819089E9" commented="no"><enum>(II)</enum><text>has experienced or is experiencing economic transition, deindustrialization, historic underinvestment, and poverty; or</text></subclause><subclause id="H8E4F6F365DC245888C807039867E933F" commented="no"><enum>(III)</enum><text>has high unemployment due to—</text><item id="H59EABDCF71ED44CF80CEF0ACDBADBF49"><enum>(aa)</enum><text>a significant decline in coal mining activity; or</text></item><item id="HB8973A093CF1493693452B7C927B791F"><enum>(bb)</enum><text>the closure of a coal-fired power plant.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="H8463256BCA194511B30CD25114C80D9C" commented="no"><enum>(6)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means any Indian Tribe, band, nation, or other organized group or community (including any Native village, Regional Corporation, or Village Corporation (as those terms are defined in section 3 of the Alaska Native Claims Settlement Act)) that is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</text></paragraph><paragraph id="HCCE0894F38B445DFB9EFB4707A2282B7" commented="no"><enum>(7)</enum><header>Qualified hydropower</header><text>The term <term>qualified hydropower</term> means energy produced from generating capacity added to a dam on or after January 1, 2001, if the Commission certifies that—</text><subparagraph id="H25C0CC9038B047949D8C730F73DC7ABC" commented="no"><enum>(A)</enum><text>the dam—</text><clause id="HE8DA87886326484BA40B099DB6DF6D5E" commented="no"><enum>(i)</enum><text>was placed in service before the date of enactment of this section;</text></clause><clause id="H065826AE816C483ABD51EDEC1AB02410" commented="no"><enum>(ii)</enum><text>was operated for flood control, navigation, or water supply purposes; and</text></clause><clause id="H0CE9E1D2B34C4A5D821F40C4F1C069D1" commented="no"><enum>(iii)</enum><text>was not producing hydroelectric power prior to the addition of the capacity; and</text></clause></subparagraph><subparagraph id="H481F7B8AEFF34CE9B4239CBC9A810E2B" commented="no"><enum>(B)</enum><text>the hydroelectric project installed on the dam—</text><clause id="HC8D30F09760A492CB3376A1CC586D2E0" commented="no"><enum>(i)</enum><text>is licensed or is exempt from licensing by the Commission;</text></clause><clause id="HCD000AC1C93243C2B1B6DFCFB6B57C91" commented="no"><enum>(ii)</enum><text>is in compliance with—</text><subclause id="HAC14D5822A364FA4B110131C7085C754" commented="no"><enum>(I)</enum><text>the terms and conditions of the license or exemption; and</text></subclause><subclause id="H1947EE0155CC4493A74318E209455EF0" commented="no"><enum>(II)</enum><text>other applicable legal requirements for the protection of environmental quality, including applicable fish passage requirements; and</text></subclause></clause><clause id="H3B0C3BB6E062433DA3000309CBEE9067" commented="no"><enum>(iii)</enum><text>is operated so that the water surface elevation at any given location and time that would have occurred in the absence of the hydroelectric project is maintained, subject to any license or exemption requirements that require changes in water surface elevation for the purpose of improving the environmental quality of the affected waterway.</text></clause></subparagraph></paragraph><paragraph id="H91F99A9F1C32444CA715A7DE57464090" commented="no"><enum>(8)</enum><header>Renewable electricity</header><text>The term <term>renewable electricity</term> means electricity generated (including by means of a fuel cell) from a renewable energy resource.</text></paragraph><paragraph id="HDD0582B4EC1042EDA5C4DF51AFE472B4" commented="no"><enum>(9)</enum><header>Renewable energy resource</header><text>The term <term>renewable energy resource</term> means each of the following:</text><subparagraph id="H465C653DFAC142D381CFBA14E17CBCFF" commented="no"><enum>(A)</enum><text>Wind energy.</text></subparagraph><subparagraph id="H14917CC9608A456B9ACC69563A1EDCDD" commented="no"><enum>(B)</enum><text>Solar energy.</text></subparagraph><subparagraph id="H553F68D280794AC39724DCCF30F00054" commented="no"><enum>(C)</enum><text>Geothermal energy.</text></subparagraph><subparagraph id="H152C8A3014A848D3852D48E851650883" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Biogas derived from anaerobic digestion at wastewater treatment facilities, or from farm anaerobic digestion.</text></subparagraph><subparagraph id="HA29BDBE15C9146A5A009BA76406262AC" commented="no"><enum>(E)</enum><text>Qualified hydropower.</text></subparagraph><subparagraph id="HD1656A898841408B89D08E831DC578D0" commented="no"><enum>(F)</enum><text>Marine energy (as defined in section 632 of the Energy Independence and Security Act of 2007).</text></subparagraph></paragraph><paragraph id="HF0144E7B44694F32861E95F6DD1E4BB0" commented="no"><enum>(10)</enum><header>Retail electricity supplier</header><subparagraph id="H1BE94D45A85D44CAADCC28A43054C1CC" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>retail electricity supplier</term> means, for any calendar year, an electric utility that sells not fewer than 1,000,000 megawatt hours of electricity to electric consumers during the preceding calendar year.</text></subparagraph><subparagraph id="HDB9488F612454C2988552DA135DFB58F" commented="no"><enum>(B)</enum><header>Inclusions and limitations</header><text>For purposes of determining whether an electric utility qualifies as a retail electricity supplier under subparagraph (A)—</text><clause id="H01C7476BF5DB4D8EAA1202ABEE8DF3E5" commented="no"><enum>(i)</enum><text>the sales made by any affiliate of the electric utility to electric consumers, other than sales to lessees or tenants of the affiliate, shall be considered to be sales made by the electric utility; and</text></clause><clause id="H144DBE11AFEC477C9A7B9404B7BA94FA" commented="no"><enum>(ii)</enum><text>sales made by the electric utility to an affiliate, lessee, or tenant of the electric utility shall not be treated as sales to electric consumers.</text></clause></subparagraph><subparagraph id="H9C2FF196CEFB4BB68B0E7E0C824EE208" commented="no"><enum>(C)</enum><header>Affiliate</header><text>In this paragraph, the term <term>affiliate</term> when used in relation to a person, means another person that directly or indirectly owns or controls, is owned or controlled by, or is under common ownership or control with, that person, as determined under regulations promulgated by the Commission.</text></subparagraph></paragraph><paragraph id="H084B4964C77D457BB1B9B820D3B96B4D" commented="no"><enum>(11)</enum><header>Retail electricity supplier’s base quantity</header><text display-inline="yes-display-inline">The term <term>retail electricity supplier’s base quantity</term> means the total quantity of electricity sold by the retail electricity supplier, expressed in megawatt hours, to electric consumers during the relevant calendar year, excluding electricity generated by a hydroelectric facility, other than qualified hydropower.</text></paragraph><paragraph id="H1B6E7124C55A4C0DB9A738EDFF544E79" commented="no"><enum>(12)</enum><header>Retire and retirement</header><text>The terms <term>retire</term> and <term>retirement</term> mean, with respect to a Federal renewable electricity credit, to disqualify the credit for any subsequent use under this section, regardless of whether the use is a sale, transfer, exchange, or submission in satisfaction of a compliance obligation.</text></paragraph></subsection><subsection id="H91C78B461BC1476CB7C92C7C123FB7DD" commented="no"><enum>(b)</enum><header>Annual compliance obligation</header><paragraph id="HFD549A056AC14D6BA617A2BF8550CB23" commented="no"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in subsection (f), for each of calendar years 2021 through 2030, not later than March 31 of the following calendar year, each retail electricity supplier shall submit to the Commission a quantity of Federal renewable electricity credits that represents a quantity of megawatt hours of renewable electricity that is at least equal to the annual target of the retail electricity supplier under subsection (d).</text></paragraph><paragraph id="HC8DD83F5C4C94791B879DC4361949C11" commented="no"><enum>(2)</enum><header>Equity requirements</header><subparagraph id="HB2DFEF5D55AE4579924987EA33009C85" commented="no"><enum>(A)</enum><header>Distributed generation</header><text display-inline="yes-display-inline">The Commission shall require that, of the quantity of Federal renewable electricity credits required to be submitted by a retail electricity supplier to comply with paragraph (1)—</text><clause id="H59CED6B5F28B461AA1413733DC126EE1" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">for the period of calendar years 2021 through 2024, at least 15 percent of such Federal renewable electricity credits represent megawatt hours of renewable electricity generated by distributed generation; and</text></clause><clause id="H3583C9A954F54D71895B834F7C625100" commented="no"><enum>(ii)</enum><text>for the period of calendar years 2025 through 2030, at least 20 percent of such Federal renewable electricity credits represent megawatt hours of renewable electricity generated by distributed generation.</text></clause></subparagraph><subparagraph id="H84F31E550A834B45858BA042186853CF" commented="no"><enum>(B)</enum><header>Impacted communities</header><text>The Commission shall require that, of the quantity of Federal renewable electricity credits required to be submitted by a retail electricity supplier to comply with paragraph (1)—</text><clause id="H2AAE01735CAD41BFBBCC7224DB278344" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">for the period of calendar years 2021 through 2024, at least 15 percent of such Federal renewable electricity credits represent megawatt hours of renewable electricity generated in impacted communities; and</text></clause><clause id="HDC93A1544AD2408492610092F7E7BF03" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">for the period of calendar years 2025 through 2030, at least 20 percent of such Federal renewable electricity credits represent megawatt hours of renewable electricity generated in impacted communities.</text></clause></subparagraph><subparagraph id="H93751EB653574DFFA979D6B12425052F" commented="no"><enum>(C)</enum><header>Distributed generation occurring in a impacted community</header><text display-inline="yes-display-inline">For any calendar year, distributed generation that occurs in a impacted community may be used for purposes of complying with both subparagraph (A) and subparagraph (B). </text></subparagraph></paragraph></subsection><subsection id="HBE36F7CF927A4464A24BBEE50DDDFBEE" commented="no"><enum>(c)</enum><header>Establishment</header><paragraph id="HDB5CC03079E0497E9A7BCD1FCAC70858" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than January 1, 2022, the Commission shall promulgate regulations to implement and enforce the requirements of this section. </text></paragraph><paragraph id="HED534E0A05BE479CBE5914944208C71E" commented="no"><enum>(2)</enum><header>Considerations</header><text>In promulgating regulations under paragraph (1), the Commission shall, to the maximum extent practicable—</text><subparagraph id="H6A24FA5BF901426AB10E4745CDD5F5D8" commented="no"><enum>(A)</enum><text>preserve the integrity and incorporate best practices of existing State and Tribal renewable electricity programs;</text></subparagraph><subparagraph id="H1212116AB07C4DB39AA77060092A921A" commented="no"><enum>(B)</enum><text>preserve the integrity of voluntary renewable energy markets;</text></subparagraph><subparagraph id="HA1EDCA29020D444FA651A7BB34E74F55" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">design and implement such regulations in a manner that seeks to be equitable and just;</text></subparagraph><subparagraph id="HCEE748CD68A34124BF1E6A67539BD9BD" commented="no"><enum>(D)</enum><text>identify and prioritize measures to maximize reductions of emissions of greenhouse gases and criteria air pollutants in impacted communities;</text></subparagraph><subparagraph id="H55261322710C4928A061F474EB55ED74" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">ensure that activities undertaken to comply with such regulations result in a net decrease in emissions of criteria air pollutants in impacted communities;</text></subparagraph><subparagraph id="H78CC8A7AA7A54DDF9368C7D24C9E8185" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">ensure that the deployment of any new renewable electricity generation provides economic, health, and resiliency benefits to the communities and areas in which the generation is built, including the use of community benefit agreements or equivalent means as determined appropriate by the Commission;</text></subparagraph><subparagraph id="HE1C83049226D4FE5BA56D5C1531C4423" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">prioritize measures that will incentivize or allow for distributed, community, and public ownership over renewable energy projects; </text></subparagraph><subparagraph id="H950EEACF4DCA44F4880BC5AAE4F7A4DC"><enum>(H)</enum><text display-inline="yes-display-inline">establish and delegate to an appropriate entity the administration of a national Federal renewable electricity credit trading market for the issuance and trade of Federal renewable electricity credits, relying on existing and emerging State, Tribal, or regional tracking systems that issue and track non-Federal renewable electricity credits; </text></subparagraph><subparagraph id="HB4E011C48D2B48ADA013B1D408B07D17" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">establish and delegate to appropriate entities the administration of not fewer than 6 regional, geographically-based, Federal renewable electricity credit trading markets, and determine the optimal levels of credit trading allowed within and between regions to maximize deployment of new renewable electricity generation within each region; </text></subparagraph><subparagraph id="H84425C0D85CF433DA296673FD1721FC7" commented="no"><enum>(J)</enum><text>cooperate with States and Indian Tribes—</text><clause id="H826C28AD68DE42228FA97679E1C4D2E5" commented="no"><enum>(i)</enum><text>to facilitate coordination between State, Tribal, and Federal renewable electricity programs; and</text></clause><clause id="H2620F291649C4E38B9F99DAD2AB0E84D" commented="no"><enum>(ii)</enum><text>to minimize administrative burdens and costs to retail electricity suppliers; and</text></clause></subparagraph><subparagraph id="H853583C3B51948C3AF4EE25D8FB4D39A" commented="no"><enum>(K)</enum><text display-inline="yes-display-inline">encourage strategic deployment of distributed generation to maximize system benefits that can lower costs for all customers, including siting generation resources in grid-constrained areas and co-location of renewable energy resources with energy storage.</text></subparagraph></paragraph></subsection><subsection id="HF19E61F2B4AA4AD494D4C66F2961CB4B" commented="no"><enum>(d)</enum><header>Annual compliance requirement</header><paragraph id="H5AC982FBD69D4FBA94714ECF70460904" commented="no"><enum>(1)</enum><header>Annual targets</header><text>For each of calendar years 2021 through 2030, the annual target of a retail electricity supplier shall be equal to the number of megawatt hours that is equal to the product obtained by multiplying—</text><subparagraph id="H69FC99DE33094ACD890BC2D251ECE345" commented="no"><enum>(A)</enum><text>the required annual percentage for that calendar year under paragraph (2); tracking; verification</header><text>The regulations promulgated under this section shall include provisions governing the issuance, tracking, and verification of Federal renewable electricity credits.</text></subparagraph><subparagraph id="HD81BCC7544DE4EF588B5868CE0F7D4CB" commented="no"><enum>(B)</enum><header>Credit ratio</header><text>Except as provided in paragraphs (2) through (5), the Commission shall issue to each generator of renewable electricity 1 Federal renewable electricity credit for each megawatt hour of renewable electricity generated by the generator after December 31, 2020.</text></subparagraph><subparagraph id="HB1BEAC5625E347A2B182D22FA997480D" commented="no"><enum>(C)</enum><header>Serial number</header><text>The Commission shall assign a unique serial number to each Federal renewable electricity credit.</text></subparagraph></paragraph><paragraph id="H9B9A83CE966A4D8BBFD98FF23245217D" commented="no"><enum>(2)</enum><header>Generation from certain State renewable electricity programs</header><subparagraph id="H611640CD49A34965BAAF870E37B4DBFC" commented="no"><enum>(A)</enum><header>In general</header><text>If renewable electricity is generated with the support of payments from a retail electricity supplier pursuant to a State renewable electricity program (whether through State alternative compliance payments or through payments to a State renewable electricity procurement fund or entity), the Commission shall issue Federal renewable electricity credits to the retail electricity supplier for the portion of the relevant renewable electricity generation that is attributable to payments made by the retail electricity supplier, as determined pursuant to regulations promulgated by the Commission.</text></subparagraph><subparagraph id="HA483C66683214AC3A9F859E5D2044B1D" commented="no"><enum>(B)</enum><header>Remaining portion</header><text>For any remaining portion of the relevant renewable electricity generation, the Commission shall issue Federal renewable electricity credits to the generator, as provided in paragraph (1), except that not more than 1 Federal renewable electricity credit shall be issued for the same megawatt hour of electricity.</text></subparagraph><subparagraph id="HB6B77718788C4C12AC4060EDE5976760" commented="no"><enum>(C)</enum><header>State guidance</header><text>In determining how Federal renewable electricity credits will be apportioned among retail electricity suppliers and generators under this paragraph, the Commission shall consider information and guidance issued by the applicable one or more States.</text></subparagraph></paragraph><paragraph id="H8BFB54F1EB9A4407A284AB1261FD7C83" commented="no"><enum>(3)</enum><header>Certain power sales contracts</header><text>Except as otherwise provided in paragraph (2), if a generator has sold renewable electricity to a retail electricity supplier under a contract for power from a facility placed in service before the date of enactment of this section, and the contract does not provide for the determination of ownership of the Federal renewable electricity credits associated with the generation, the Commission shall issue the Federal renewable electricity credits to the retail electricity supplier for the duration of the contract.</text></paragraph><paragraph id="HCC08D6D001F3437B94917B80BE8BEA54" commented="no"><enum>(4)</enum><header>Credits based on qualified hydropower</header><text>For purposes of this subsection, the number of megawatt hours of renewable electricity generation from qualified hydropower shall be calculated—</text><subparagraph id="HEAF5EB55E2D44E42BF0969BBD172220D" commented="no"><enum>(A)</enum><text>based solely on the increase in average annual generation directly resulting from the efficiency improvements or capacity additions described in subsection (a)(6); and</text></subparagraph><subparagraph id="HAD0235CAAF0A4FE9A8B5F64605129A37" commented="no"><enum>(B)</enum><text>using the same water flow information used to determine a historic average annual generation baseline for the hydroelectric facility, as certified by the Commission.</text></subparagraph></paragraph><paragraph id="H50AE9C480EE941298AD493C9EAC22279" commented="no"><enum>(5)</enum><header>Credits based on farm anaerobic digestion</header><text display-inline="yes-display-inline">For any calendar year, a generator may only receive Federal renewable electricity credits for renewable electricity generated from biogas that is derived from farm anaerobic digestion if—</text><subparagraph id="H710A39705CC94072A618D6280198CE96" commented="no"><enum>(A)</enum><text>any manure used for such anaerobic digestion is from a farm that only provides its manure for anaerobic digestion to one anaerobic digester system; </text></subparagraph><subparagraph id="H56B1223C0A1B42A38DDBB3611446072E" commented="no"><enum>(B)</enum><text>the anaerobic digester system used by such generator has a capacity of less than, or equal to, 1 megawatt; and</text></subparagraph><subparagraph id="HA9D9CED4E2644FDABE9448D255B94EE8" commented="no"><enum>(C)</enum><text>during such calendar year the total renewable electricity produced from biogas derived from farm anaerobic digestion in the applicable State represents not more than 10 percent of the State’s overall electricity usage. </text></subparagraph></paragraph><paragraph id="H0254B4E75E024038B6B7DE0464CB4F70" commented="no"><enum>(6)</enum><header>Generation from mixed renewable and nonrenewable resources</header><text>If electricity is generated using both a renewable energy resource and an energy source that is not a renewable energy resource, the Commission shall issue Federal renewable electricity credits based on the proportion of the electricity generated that is attributable to the renewable energy resource.</text></paragraph><paragraph id="HB3263912A7DF4479BBFEF29DD79AC090" commented="no"><enum>(7)</enum><header>Prohibition against double-counting</header><text>The Commission shall ensure that—</text><subparagraph id="H343D9EBB559D45B296D3BBCDFF84EAF9" commented="no"><enum>(A)</enum><text>no Federal renewable electricity credit is used more than once for compliance with this section; and</text></subparagraph><subparagraph id="H55BE7D56C66D49179EBAB73900BD2130" commented="no"><enum>(B)</enum><text>not more than 1 Federal renewable electricity credit is issued for any megawatt hour of renewable electricity generated.</text></subparagraph></paragraph><paragraph id="H02815335734B4411B5BE25A792FAEFA8" commented="no"><enum>(8)</enum><header>Trading</header><text>The lawful holder of a Federal renewable electricity credit may—</text><subparagraph id="HE69D2778F5EA4FFAA8D2C649493A8774" commented="no"><enum>(A)</enum><text>sell, exchange, or transfer the credit;</text></subparagraph><subparagraph id="H5A23B54A370E444C81BEE8775EC84ACF" commented="no"><enum>(B)</enum><text>submit the credit for compliance under subsection (b); or</text></subparagraph><subparagraph id="H9CBA3BF726664C1F816CBB719A6C3F2E" commented="no"><enum>(C)</enum><text>submit the credit for retirement by the Commission.</text></subparagraph></paragraph><paragraph id="H267C3F4C71B64C23AF58A00A17F25F9B" commented="no"><enum>(9)</enum><header>Banking</header><subparagraph id="H137706AD003644CB8184A1956123C83A" commented="no"><enum>(A)</enum><header>In general</header><text>A Federal renewable electricity credit may be submitted in satisfaction of the compliance obligation under subsection (b) for the compliance year for which the credit was issued or for any of the 2 immediately subsequent compliance years.</text></subparagraph><subparagraph id="HEC2B0E0E124140218B6927060D7A8FFC" commented="no"><enum>(B)</enum><header>Retirement</header><text>The Commission shall retire any Federal renewable electricity credit that has not been retired by April 2 of the calendar year that is 2 years after the calendar year during which the credit was issued.</text></subparagraph></paragraph><paragraph id="H715320B6C40D419AA0F8234097567097" commented="no"><enum>(10)</enum><header>Retirement</header><text>The Commission shall retire a Federal renewable electricity credit immediately upon submission by the lawful holder of the credit, whether in satisfaction of a compliance obligation under subsection (b) or for another reason.</text></paragraph></subsection><subsection id="H5081A25EFFF34FE8BDBE6F45084D8E3C" commented="no"><enum>(f)</enum><header>Alternative compliance payments</header><paragraph id="H8E2BD0A9DDBC4A96BAEB8AE8A63BE91F" commented="no"><enum>(1)</enum><header>In general</header><text>A retail electricity supplier may satisfy the requirements of subsection (b) in whole or in part by submitting in accordance with this subsection, in lieu of each Federal renewable electricity credit that would otherwise be submitted, an alternative compliance payment equal to $50, adjusted for inflation on January 1 of each year following calendar year 2021, in accordance with regulations promulgated by the Commission.</text></paragraph><paragraph id="H29AB070282CE4681AE08EC0C8D795B37" commented="no"><enum>(2)</enum><header>Payment to State funds</header><subparagraph id="HDC650371538A4ED496733109D317804F" commented="no"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this paragraph, payments made under this subsection shall be made directly to one or more States in which the retail electricity supplier sells electricity, in proportion to the portion of the retail electricity supplier’s base quantity that is sold within each applicable State, if—</text><clause id="HE586B3AB5F084FFE9D0398279E6E25FA" commented="no"><enum>(i)</enum><text>the payments are deposited directly into a fund of the State treasury established for that purpose; and</text></clause><clause id="HB43DB5EABA45467BB60341CA8152B858" commented="no"><enum>(ii)</enum><text>the State uses the funds in accordance with paragraphs (3) and (4).</text></clause></subparagraph><subparagraph id="HBD7E6F372C83493DAF7062212A36E5C9" commented="no"><enum>(B)</enum><header>Noncompliance</header><text>If the Commission determines that a State is in substantial noncompliance with paragraph (3) or paragraph (4), the Commission shall direct that any future alternative compliance payments that would otherwise be paid to the State under this subsection shall instead be paid to the Commission and deposited in the Treasury.</text></subparagraph></paragraph><paragraph id="HD2DFF2BA6E6D44C59A304CEB61A41FC8" commented="no"><enum>(3)</enum><header>State use of funds</header><text>As a condition of receipt of alternative compliance payments pursuant to this subsection, a State shall—</text><subparagraph id="H20D0AF095BBC42B2999ECB488556512E"><enum>(A)</enum><text>use the payments exclusively for—</text><clause id="HC0FE3D9DB6B44E6CB7D9CBB2D8E80657" commented="no"><enum>(i)</enum><text>deploying technologies that generate electricity from renewable energy resources;</text></clause><clause id="H1C828C5A855F4D4D87E74BB2DAF41F96"><enum>(ii)</enum><text display-inline="yes-display-inline">deploying technologies that store electricity for use at a later time; or</text></clause><clause id="H426659C316ED456BA769071ECF2E555D" commented="no"><enum>(iii)</enum><text>implementing cost-effective energy efficiency programs to achieve energy savings; and</text></clause></subparagraph><subparagraph id="H8A4E1B5C378A420EB170572B2BB705F3" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">invest or use the payments in a manner designed to ensure that impacted communities receive, or directly benefit from, at least 50 percent of such funds.</text></subparagraph></paragraph><paragraph id="H3AF10ED636674B3C86012795FF9679B0" commented="no"><enum>(4)</enum><header>Reporting</header><subparagraph id="H78028F67C47144F596B169FF70B0A528" commented="no"><enum>(A)</enum><header>In general</header><text>As a condition of receipt of alternative compliance payments pursuant to this subsection, a State shall submit to the Commission an annual report, in accordance with regulations promulgated by the Commission, containing a full accounting of the use of the payments, including a detailed description of the activities funded by the payments and demonstrating compliance with the requirements of this subsection.</text></subparagraph><subparagraph id="H798EF559B5A44E548303A6F99B451EB9" commented="no"><enum>(B)</enum><header>Deadline</header><text>A State shall submit a report under this paragraph—</text><clause id="H619E2BA41FC049AD9A2EAD78CFC66DCE" commented="no"><enum>(i)</enum><text>not later than 1 year after the date on which the first alternative compliance payment is received; and</text></clause><clause id="H1927DA4F73A845E68AD97C0F20C3DA54" commented="no"><enum>(ii)</enum><text>every 1 year thereafter until all alternative compliance payments are expended.</text></clause></subparagraph></paragraph></subsection><subsection id="H249E64E02B5C42B497E8BF2B0B19B244" commented="no"><enum>(g)</enum><header>Information collection</header><text display-inline="yes-display-inline">The Commission may require any retail electricity supplier, renewable electricity generator, or any other entity that the Commission determines appropriate, to provide any information the Commission determines appropriate to carry out this section.</text></subsection><subsection id="H725C8F56BD6C42C8B1182D12A90FE89A" commented="no"><enum>(h)</enum><header>Enforcement and judicial review</header><paragraph id="HDE0392012C164F5D8CECFE82839C3807" commented="no"><enum>(1)</enum><header>Failure to submit credits</header><text>If any person fails to comply with the requirements of subsection (b) or (f) for a calendar year, the person shall be liable to pay to the Commission a civil penalty equal to the product obtained by multiplying—</text><subparagraph id="HE84BB8DE6C5E4F78B8A694F75BDCA8BB" commented="no"><enum>(A)</enum><text>double the alternative compliance payment calculated under subsection (f)(1) for such calendar year; and</text></subparagraph><subparagraph id="H4354BC44863B4E24A19A3CEA4B273B64" commented="no"><enum>(B)</enum><text>the aggregate quantity of Federal renewable electricity credits or equivalent alternative compliance payments that the person failed to submit in violation of the requirements of subsections (b) and (f) for such calendar year.</text></subparagraph></paragraph><paragraph id="HAC12AE584556470392911B2A245D4EE9" commented="no"><enum>(2)</enum><header>Enforcement</header><text>The Commission shall assess a civil penalty under paragraph (1) in accordance with the procedures described in section 31(d) of the Federal Power Act.</text></paragraph><paragraph id="HD472BDBF9C854CEA868249054217D9F8" commented="no"><enum>(3)</enum><header>Violation of requirement of regulations or orders</header><subparagraph id="H3783F4350CAA45799B2999020DD9841A" commented="no"><enum>(A)</enum><header>In general</header><text>Any person who violates or fails or refuses to comply with any requirement of this section, other than a requirement of subsection (b) or (f), shall be subject to a civil penalty under section 316A(b) of the Federal Power Act.</text></subparagraph><subparagraph id="H75511C4A7D4B4F30B4023A519F83C70A" commented="no"><enum>(B)</enum><header>Assessment</header><text>The penalty under subparagraph (A) shall be assessed by the Commission in the same manner as in the case of a violation referred to in section 316A(b) of that Act.</text></subparagraph></paragraph><paragraph id="H58255A46582F4B67A96B06105B930963" commented="no"><enum>(4)</enum><header>Judicial review</header><subparagraph id="H5C9DF0A36A224807B9857133F0FCEEDD" commented="no"><enum>(A)</enum><header>In general</header><text>Any person aggrieved by a final action taken by the Commission under this section, other than the assessment of a civil penalty under paragraphs (1) through (3), may use the procedures for review described in section 313 of the Federal Power Act.</text></subparagraph><subparagraph id="H4B949B9E851C461ABA4F9C3DCF2692ED" commented="no"><enum>(B)</enum><header>Reference</header><text>For purposes of this paragraph, references to an order in section 313 of that Act shall be considered to refer also to all other final actions of the Commission under this section other than the assessment of a civil penalty under paragraphs (1) through (3).</text></subparagraph></paragraph></subsection><subsection id="H6A193513CA8C4B869168380484D88509" commented="no"><enum>(i)</enum><header>Administration</header><text>Nothing in this section—</text><paragraph id="H1A9B69ED92AC4BCF9F564203E6E8BBDB" commented="no"><enum>(1)</enum><text>diminishes or qualifies any authority of a State, a political subdivision of a State, or an Indian Tribe—</text><subparagraph id="HF30E26C0F56E48F38EE805682D019EE6" commented="no"><enum>(A)</enum><text>to adopt or enforce any law or regulation respecting renewable electricity, including any law or regulation establishing requirements that are more stringent than those established by this section, provided that no such law or regulation may relieve any person of any requirement otherwise applicable under this section; or</text></subparagraph><subparagraph id="H590591CC4B90476D874BF94CFED49FCD" commented="no"><enum>(B)</enum><text>to regulate the acquisition and disposition of Federal renewable electricity credits by retail electricity suppliers within the jurisdiction of the State, political subdivision, or Indian Tribe, including the authority to require the retail electricity supplier to acquire and submit to the Commission for retirement Federal renewable electricity credits in excess of those submitted under this section; or</text></subparagraph></paragraph><paragraph id="H1A80AE843B824E52A28F869FD6A8724B" commented="no"><enum>(2)</enum><text>affects the application of or the responsibility for compliance with any other provision of law or regulation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1A29ADF442CF418AB20C9BDB6FF4616B" commented="no"><enum>3.</enum><header>Clarifying State authority to adopt renewable energy incentives</header><text display-inline="no-display-inline">Section 210 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/824a-3">16 U.S.C. 824a–3</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H401EBBBCB61848F5BDC4B57059FA72F8" style="OLC"><subsection id="H67B036C143564F85807F5247E84B5886" commented="no"><enum>(o)</enum><header>Clarification of State authority To adopt renewable energy incentives</header><paragraph id="H4B0BF8FED49141EDABA6792E1751A35E" commented="no"><enum>(1)</enum><header>Definition of State-approved production incentive program</header><text>In this subsection, the term <term>State-approved production incentive program</term> means a requirement imposed pursuant to State law or by a State regulatory authority acting within its authority under State law that an electric utility purchase renewable energy (as defined in section 609(a)) at a specified rate.</text></paragraph><paragraph id="HC15ABC0322CD42379F98D7AA2AD26BC7" commented="no"><enum>(2)</enum><header>State authority to adopt renewable energy incentives</header><text>Notwithstanding any other provision of this Act or the Federal Power Act, a State law or State regulatory authority may set the rates for a sale of electricity by a facility generating renewable energy (as defined in section 609(a)) pursuant to a State-approved production incentive program under which the facility voluntarily participates in the State-approved production incentive program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6BF443B251FF427C9ACD027C2FA24729" commented="no"><enum>4.</enum><header>Conforming amendment</header><text display-inline="no-display-inline">The table of contents of the Public Utility Regulatory Policies Act of 1978 (16 U.S.C. prec. 2601) is amended by adding at the end of the items relating to title VI the following:</text><quoted-block id="H42537C8659AE4DF486AAC47D1A4E4810" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 609.
