R. 3947</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210616">June 16, 2021</action-date><action-desc><sponsor name-id="P000618">Ms. Porter</sponsor> (for herself, <cosponsor name-id="D000399">Mr. Doggett</cosponsor>, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, <cosponsor name-id="D000216">Ms. DeLauro</cosponsor>, and <cosponsor name-id="P000607">Mr. Pocan</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the inclusion of mandatory predispute arbitration clauses and clauses limiting class action lawsuits in health insurance contracts.</official-title></form><legis-body id="H63F0293F8CAC4F2BAF9611BCAF3CF378" style="OLC"><section id="HF34A3FE746F94E9D97BE683F2B13489B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Patients Act</short-title></quote>.</text></section><section id="HCB2EF3C833744656B1FE4212F8B49458"><enum>2.</enum><header>Prohibition on mandatory predispute arbitration and limitations on class action lawsuits</header><subsection id="H68862F5069C04B3E9E4F3144D5139BB0"><enum>(a)</enum><header>PHSA</header><text>Part D of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="HA032DFA483D44B89B22D92AA81AD96A8" display-inline="no-display-inline"><section id="HAA2DD11FCBD44FD9B495631EC22F5708"><enum>2799A–11.</enum><header>Prohibition on inclusion of certain requirements in health insurance contracts</header><subsection id="HAF92427E138840928857D7FE5DECCEC2"><enum>(a)</enum><header>Prohibition on mandatory predispute arbitration</header><text display-inline="yes-display-inline">A group health plan and group or individual health insurance coverage shall not include any predispute arbitration clause that requires the arbitration of claims under such plan or coverage.</text></subsection><subsection id="HA1F81789AA5540D09158E0DDA079EDE5"><enum>(b)</enum><header>Prohibition on limitation of class actions</header><text display-inline="yes-display-inline">A group health plan and group or individual health insurance coverage shall not include any limitation on the ability of an enrollee of such plan or coverage to engage in a class action lawsuit relating to the administration of such plan or coverage.</text></subsection><subsection id="H6197880256CC437D81D3CBEC7BC1C184"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">An issue as to whether this section applies with respect to a dispute shall be determined under Federal law. The applicability of this section to an agreement to arbitrate and the validity and enforceability of an agreement to which this section applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H02F6AC48FD254F37ACB704E3DF578AB1"><enum>(b)</enum><header>ERISA</header><paragraph id="HDDB78C0243DC4D6FBE9A86263B84E7DA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H6F45D44D8CFF455CBAA66435C6677F18" display-inline="no-display-inline"><section id="HA17023F402CF4E6FA752E83236FAB7C0"><enum>726.</enum><header>Prohibition on inclusion of certain requirements in health insurance contracts</header><subsection id="HF66419E8FD4E436CB47202E0C33EBC01"><enum>(a)</enum><header>Prohibition on mandatory predispute arbitration</header><text display-inline="yes-display-inline">A group health plan or a health insurance issuer offering group health insurance coverage shall not include any predispute arbitration clause that requires the arbitration of claims under such plan or coverage.</text></subsection><subsection id="H7BA0C716A03F4D0E8C8F79C418FD02AF"><enum>(b)</enum><header>Prohibition on limitation of class actions</header><text display-inline="yes-display-inline">A group health plan or a health insurance issuer offering group health insurance coverage shall not include any limitation on the ability of an enrollee of such coverage to engage in a class action lawsuit relating to the administration of such plan or coverage.</text></subsection><subsection id="H133388FA76F942C99553500B91C982BA"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">An issue as to whether this section applies with respect to a dispute shall be determined under Federal law. Prohibition on inclusion of certain requirements in health insurance contracts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE88AA9E795814282895B038A50F398FD"><enum>(c)</enum><header>IRC</header><paragraph id="H97718C777BD84824A06242EA2D3006D6"><enum>(1)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H740FD69364D5414FA2E5067947F338A9" display-inline="no-display-inline"><section id="HD1F56E5F19EB46E0933505337354ED20"><enum>9826.</enum><header>Prohibition on inclusion of certain requirements in health insurance contracts</header><subsection id="HFACAFF4FA51F42B99C7FF54DC4FB713C"><enum>(a)</enum><header>Prohibition on mandatory predispute arbitration</header><text display-inline="yes-display-inline">A group health plan shall not include any predispute arbitration clause that requires the arbitration of claims under such plan.</text></subsection><subsection id="H816FD0D6FE464CC78F0E840211897388"><enum>(b)</enum><header>Prohibition on limitation of class actions</header><text display-inline="yes-display-inline">A group health plan shall not include any limitation on the ability of an enrollee of such plan to engage in a class action lawsuit relating to the administration of such plan.</text></subsection><subsection id="H0258920193AB4158B9B70C1CB84DEB44"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">An issue as to whether this section applies with respect to a dispute shall be determined under Federal law.
