R. 3942</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210616">June 16, 2021</action-date><action-desc><sponsor name-id="M001196">Mr. Moulton</sponsor> (for himself, <cosponsor name-id="M001215">Mrs. Miller-Meeks</cosponsor>, <cosponsor name-id="L000589">Mrs. Lesko</cosponsor>, <cosponsor name-id="M001206">Mr. Morelle</cosponsor>, <cosponsor name-id="H001085">Ms. Houlahan</cosponsor>, <cosponsor name-id="K000396">Mr. Kahele</cosponsor>, <cosponsor name-id="M001160">Ms. Moore of Wisconsin</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="C001080">Ms. Chu</cosponsor>, and <cosponsor name-id="S001159">Ms. Strickland</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to improve the process by which a member of the Armed Forces may be referred for a mental health evaluation.</official-title></form><legis-body id="H239BF55C8CB64DE7A50A81F1FE3A785A" style="OLC"><section id="HE74F3552AA454B20A3D9E780FE195897" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brandon Act</short-title></quote>. </text></section><section id="HEB71513A00804BBDBC93A23F63029FA6"><enum>2.</enum><header>Mandatory referral for mental health evaluation</header><text display-inline="no-display-inline">Section 1090a of title 10, United States Code, is amended—</text><paragraph id="H47788EBEDC86407792ECDADBDA9A7EE6"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph><paragraph id="H5FFB8EDA1CF740E1B79851B29A52D712"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection:</text><quoted-block style="USC" id="H247E30892B984B3CB0E5093446C63F28" display-inline="no-display-inline"><subsection id="HE78C27F6D5B04F608171A372F4580C5A"><enum>(e)</enum><header>Process applicable to member disclosure</header><text display-inline="yes-display-inline">The regulations required by subsection (a) shall—</text><paragraph id="HF3572206CF05434A8AED5A9B300FE95B"><enum>(1)</enum><text>establish a phrase that enables a member of the armed forces to trigger a referral of the member by a commanding officer or supervisor for a mental health evaluation;</text></paragraph><paragraph id="H2A6B1351AFDF4DB7866750D29B59FDAB"><enum>(2)</enum><text>require a commanding officer or supervisor to make such referral as soon as practicable following disclosure by the member to the commanding officer or supervisor of the phrase established under paragraph (1); and</text></paragraph><paragraph id="H4AD9AF9698C843769C4147EC59043F5C"><enum>(3)</enum><text display-inline="yes-display-inline">ensure that the process protects the confidentiality of the member in a manner similar to the confidentiality provided for members making restricted reports under section 1565b(b) of this title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
