which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to reform the American History for Freedom program, and for other purposes.</official-title></form><legis-body id="HE69A947B00C54FDB988200CDB84BB172" style="OLC"><section id="H2DC629A17DCE49579A130BFC4F749576" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Informed Electorate Act</short-title></quote>.</text></section><section id="H1DE46DD4E8354E8DA17B8F6E17B538D4" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HD240BFC0D6CC4A1EB2F87D90ACBE253B"><enum>(1)</enum><text display-inline="yes-display-inline">A growing contingent of ideological extremists seeking to transform our Nation’s understanding of the founding principles of 1787 and what makes our country great are promoting historically inaccurate and morally bankrupt curriculum at elementary and secondary schools.</text></paragraph><paragraph id="HC0AEBAF061E24A96A5173AE64CF0295B"><enum>(2)</enum><text>Too many individuals in the United States have their rights of speech, peaceable assembly, and religious practice violated by zealous government officials.</text></paragraph><paragraph id="H0B277E95F23F4F65BF3810FAC12DC21E"><enum>(3)</enum><text>Informed and enthusiastic civic engagement signifies and sustains a healthy body politic. </text></paragraph><paragraph id="H6CDC99C41624426DB9C6B684997A37A3"><enum>(4)</enum><text>There is widespread ignorance of western civilization’s economic systems and historical events that have created unprecedented human prosperity.</text></paragraph></section><section id="H551D5814E3EC42739D1D65963284C621"><enum>3.</enum><header>Amendment to American History for Freedom program</header><text display-inline="no-display-inline">Section 805 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161e">20 U.S.C. 1161e</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HA5E907519293409283AAE1C40C844A48" display-inline="no-display-inline"><section id="H25B24A05E9D34447818BC716CAFF3DBC"><enum>805.</enum><header>American history for freedom</header><subsection id="H4A7A14D019A142FB81459DDEFEF60B9D"><enum>(a)</enum><header>Grants authorized</header><text display-inline="yes-display-inline">From the amounts appropriated under subsection (f), the Secretary is authorized to award 2-year grants, on a competitive basis, to eligible institutions to establish academic centers or academic programs that—</text><paragraph id="H6476083DE021451DAEBB85524EDFBD19"><enum>(1)</enum><text>promote and impart knowledge of—</text><subparagraph id="H6CC19E16814B4C6A81E83E8BDC6CBB31"><enum>(A)</enum><text>traditional American history;</text></subparagraph><subparagraph id="HE4651086137545FA9012DE80610D3B0E"><enum>(B)</enum><text>the history and achievements of Western civilization; and</text></subparagraph><subparagraph id="H9C07316170BA4C6DB813DF9F60A6BF5D"><enum>(C)</enum><text>the importance of civic engagement and the First Amendment to protect and safeguard free society; and</text></subparagraph></paragraph><paragraph id="H77C30FD0BE8A46C888E92F5F09713DFB" commented="no"><enum>(2)</enum><text>such institutions continue to operate and fund after the end of the grant period described in subsection (a).</text></paragraph></subsection><subsection id="H56D384488BE44C0783F5F181CD203633"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBB5391023CAB4CB78421E0FC371875AE"><enum>(1)</enum><header>Eligible institution</header><text display-inline="yes-display-inline">The term eligible institution means an institution of higher education as defined in section 101.</text></paragraph><paragraph id="H630341E9A9A0443483F3F91B4701EB28"><enum>(2)</enum><header>Free institution</header><text>The term free institution means an institution that emerged out of Western civilization, such as democracy, constitutional government, individual rights, market economics, religious freedom and religious tolerance, meritocracy, and freedom of thought and inquiry.</text></paragraph><paragraph id="H9D5653087B0E4494BA88A9991C7F870A"><enum>(3)</enum><header>Traditional American history</header><text>The term traditional American history means—</text><subparagraph id="H1716847128844CA2931F8BC977CF4D04"><enum>(A)</enum><text>the significant constitutional, political, intellectual, economic, and foreign policy trends and issues that have shaped the course of American history; and </text></subparagraph><subparagraph id="HE9AF76CB3C9847FDB29F0F1E05FBCB45"><enum>(B)</enum><text display-inline="yes-display-inline">the key episodes, turning points, and leading figures involved in the constitutional, political, intellectual, diplomatic, and economic history of the United States, including the signing of the Declaration of Independence, the Constitutional Convention of 1787, the Bill of Rights, the Emancipation Proclamation, the 13th Amendment to the Constitution, the 14th Amendment to the Constitution, and the Civil Rights Act of 1964. </text></subparagraph></paragraph></subsection><subsection id="H0DC0EAF93F1E4A3A988AC0D9AE7AAD0E"><enum>(c)</enum><header>Application</header><paragraph id="H230B29E94FDE46CEB829E20B6F1277EB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each eligible institution that desires a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require.</text></paragraph><paragraph id="HAEB4791B0F9C4B1ABB14837AAA9A777A"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each application submitted under paragraph (1) shall include a description of—</text><subparagraph id="H66DA6E49BC57497E8A4C200C0A47B054"><enum>(A)</enum><text>how funds made available under this section will be used for the activities set forth under subsection (e), including how such activities will increase knowledge with respect to traditional American history, free institutions, the First Amendment to the Constitution, or Western civilization and how the funds will increase civic engagement;</text></subparagraph><subparagraph id="H349830012D4E408F95D43E83FED6EF36"><enum>(B)</enum><text>how the eligible institution will ensure that information about the activities funded under this section is widely disseminated pursuant to subsection (e)(1)(B);</text></subparagraph><subparagraph id="HE2B7156B69E0438E89BF99588DD97A60"><enum>(C)</enum><text>any activities to be undertaken pursuant to subsection (e)(2)(A), including identification of entities intended to participate;</text></subparagraph><subparagraph id="H53A0C0BC3FD64A3FB5B78C43F9D40014"><enum>(D)</enum><text>how funds made available under this section shall be used to supplement and not supplant non-Federal funds available for the activities described in subsection (e); and</text></subparagraph><subparagraph id="H84783D31EC4E41E6A56DAEDEA79F6F8D"><enum>(E)</enum><text>such fiscal controls and accounting procedures as may be necessary to ensure proper disbursement of and accounting for funding made available to the eligible institution under this section.</text></subparagraph></paragraph></subsection><subsection id="H2121484B52E94B419622A5861184688C"><enum>(d)</enum><header>Award basis</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall take into consideration the capability of the eligible institution to—</text><paragraph id="H8D48DD9F730E4905A442DD5E3CD3749E"><enum>(1)</enum><text>increase access to quality programming that expands knowledge of traditional American history, free institutions, or Western civilization;</text></paragraph><paragraph id="H5367D752066E47EEA7BD5F39C6028041"><enum>(2)</enum><text>involve personnel with strong expertise in traditional American history, free institutions, or Western civilization; and</text></paragraph><paragraph id="H6582F072BBDC4193B74E296532898EB4"><enum>(3)</enum><text>sustain the activities funded under this section after the grant has expired.</text></paragraph></subsection><subsection id="HC3A9DD6AD9A04066991F23D7E0EBDB1E"><enum>(e)</enum><header>Use of funds</header><paragraph id="H969E283A4D0442D2975E0B09AFF7A518"><enum>(1)</enum><header>Required use of funds</header><text display-inline="yes-display-inline">Funds provided under this section shall be used to—</text><subparagraph id="HB76AB16894AC42ECAD8863EF1AAB8EF8"><enum>(A)</enum><text display-inline="yes-display-inline">establish or strengthen academic programs or centers focused on traditional American history, free institutions, or Western civilization, which may include —</text><clause id="H218D039EAA324CA6A1BC3BAF673309BA"><enum>(i)</enum><text>design and implementation of programs of study, courses, lecture series, seminars, and symposia; </text></clause><clause id="HFF1663D877764B6CB0EB6CF19EE16F2E"><enum>(ii)</enum><text>development, publication, and dissemination of instructional materials; </text></clause><clause id="H47D64D8303E24191BB68213A87E6A957"><enum>(iii)</enum><text>research; </text></clause><clause id="H13D6AEA4FA1F4FDB8702D3219D8403DE"><enum>(iv)</enum><text>support for faculty teaching in undergraduate and, if applicable, graduate programs; </text></clause><clause id="HD20D08B62C7F4CB09278348D0C8C2C56"><enum>(v)</enum><text>support for graduate and postgraduate fellowships, if applicable; or </text></clause><clause id="H2B1345315AE54180847DFBFABEB10BED"><enum>(vi)</enum><text>teacher preparation initiatives that stress content mastery regarding traditional American history, free institutions, or Western civilization; and </text></clause></subparagraph><subparagraph id="H826DF0EDF1C2448C91F13137E493BF06"><enum>(B)</enum><text>conduct outreach activities to ensure that information about the activities funded under this section is widely disseminated—</text><clause id="H37E171C774C84788802BD1F56A7B4E0F"><enum>(i)</enum><text>to undergraduate students (including students enrolled in teacher education programs, if applicable); </text></clause><clause id="HFE6D7322C1FC42EAAF8C8155E651D7A0"><enum>(ii)</enum><text>to graduate students (including students enrolled in teacher education programs, if applicable); </text></clause><clause id="H56026C8ED2E844F99DB03D8A5536E4E8"><enum>(iii)</enum><text>to faculty; </text></clause><clause id="HC81E179E825C4EE3B2CBE70CD126535A"><enum>(iv)</enum><text>to local educational agencies; and </text></clause><clause id="H26025A4AEA2F40DD841D8F3C41EE1F17"><enum>(v)</enum><text>within the local community and the general public.</text></clause></subparagraph></paragraph><paragraph id="HBC41C84FE7AF410181698FEEAEBC117E"><enum>(2)</enum><header>Allowable use of funds</header><text display-inline="yes-display-inline">Funds provided under this section may be used to support—</text><subparagraph id="H17C4DBEB611F45EAAD7FD5551C3EA35D"><enum>(A)</enum><text display-inline="yes-display-inline">collaboration with entities such as—</text><clause id="HD576A185316E4906B5450DE1390CBAB5"><enum>(i)</enum><text>local educational agencies, for the purpose of providing elementary and secondary school teachers an opportunity to enhance their knowledge of traditional American history, free institutions, or Western civilization; and </text></clause><clause id="H2BFF9C52E9534D01A36CC523F75B4BF2"><enum>(ii)</enum><text>nonprofit organizations whose mission is consistent with the purpose of this section, such as academic organizations, museums, and libraries, for assistance in carrying out activities described under subsection (a); and </text></clause></subparagraph><subparagraph id="HC68A767E707346C78C633DFCB604224B"><enum>(B)</enum><text>other activities that meet the purposes of this section.</text></subparagraph></paragraph><paragraph id="H634042ECE3014479BAABA7919829AEE3"><enum>(3)</enum><header>Prohibited use of funds</header><text display-inline="yes-display-inline">Funds provided under this section may not be used for the purpose of promoting, endorsing, teaching, or distributing material related to the 1619 Project or Critical Race Theory.</text></paragraph></subsection><subsection id="HE282C0EBA2F14B8ABD42E06330F8D8FA"><enum>(f)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated $25,000,000 for each of fiscal years 2022 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
