R. 3917</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210615">June 15, 2021</action-date><action-desc><sponsor name-id="M001159">Mrs. Rodgers of Washington</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To enure that a declaration for a major disaster or emergency is made on a timely basis, rural areas receive assistance, and for other purposes.</official-title></form><legis-body id="H63481086C78647A58F558AAFFEB3866D" style="OLC"><section id="H1D0AD27CAB7A49088ACF4F2892C5CF0B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Aid for Local Disasters Equal Now Act</short-title></quote> or the <quote><short-title>MALDEN Act</short-title></quote>. </text></section><section id="HCE29F5800B9943D6A8A4163DB10AB64A"><enum>2.</enum><header>Declaration time frame</header><subsection id="H749367DC68B24B94A13DE425D52B902E"><enum>(a)</enum><header>Major disaster declaration</header><text display-inline="yes-display-inline">Section 401(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) is amended by adding at the end the following: <quote>A major disaster declaration under this section shall be made not later than 30 days after a request by a Governor or the Chief Executive of an affected Indian Tribal Government. Failure to meet the 30-day requirement shall result in an automatic approval of such request for a declaration.</quote>.</text></subsection><subsection id="H70FBDDFAFB7F49CAA68E657D72E34136"><enum>(b)</enum><header>Emergency declaration</header><text display-inline="yes-display-inline">Section 501(a) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>) is amended by adding at the end the following: <quote>An emergency declaration under this section shall be made not later than 30 days after a request for a declaration by a Governor or the Chief Executive of an affected Indian Tribal Government. Failure to meet the 30-day requirement shall result in an automatic approval of such request for a declaration.</quote>.</text></subsection></section><section id="HA1DB33EAC4DD4D298B757803B77755BB"><enum>3.</enum><header>Rural assistance</header><text display-inline="no-display-inline">Section 326 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5165d">42 U.S.C. 5165d</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H65D4A976254346DF975094BA930BBEF6" display-inline="no-display-inline"><subsection id="HB8541D5DD31140219285EC05C0F52C3B"><enum>(d)</enum><header>Additional assistance for rural areas</header><text display-inline="yes-display-inline">If a disaster or emergency occurs in a rural area, regardless if a declaration has been made, the Small State and Rural Advocate shall work in coordination with the State, Territory or Tribal Emergency Management Agency to provide guidance to the rural areas emergency manager on developing a recovery team, including resources to help prevent flooding, mudslides, rockslides or any other natural disaster that could result after a wildfire and identifying available resources for both short-term and long-term recovery, including resources to help prevent a future natural disaster within the burned area.”.</text></subsection><subsection id="HB85B3091306D49C6AC549E2CFA565D34"><enum>(e)</enum><header>Case worker availability</header><text display-inline="yes-display-inline">In a case in which a request for individual assistance in a rural area is made under section 408 but denied, the Small State and Rural Advocate shall work in coordination with the affected State, Territory or Tribal Emergency Management Agency to make disaster case workers available to the residents impacted by the disaster or emergency.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
