R. 3912</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210615">June 15, 2021</action-date><action-desc><sponsor name-id="L000562">Mr. Lynch</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Gramm-Leach-Bliley Act to require consumers to opt in before a financial institution may share the nonpublic personal information of the consumer with a nonaffiliated third party, and for other purposes.</official-title></form><legis-body id="H14B1132DA4E74307A662986F66594BE9" style="OLC"><section id="HEE3E2FC5FDB74F459D86FE5B1FE332D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Data Sharing Choice Act</short-title></quote>.</text></section><section id="H1D71AF019A34487C8E6E8E7E990F537D"><enum>2.</enum><header>Consumer opt in for sharing of nonpublic personal information to a nonaffiliated third party</header><text display-inline="no-display-inline">Section 502(b) of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6802">15 U.S.C. 6802(b)</external-xref>) is amended—</text><paragraph id="H5DDAAD9C3E5C4B35A2DB8B394D97FC61"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Opt Out</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Opt in</header-in-text></quote>; and</text></paragraph><paragraph id="HC4C36C370A72475293DCA7963FEF8E65"><enum>(2)</enum><text>by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" id="H25AD285F5A044E7F873F38821A0A7D42" display-inline="no-display-inline"><paragraph id="HFF145892813040A996CCA21405184CEB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A financial institution may not disclose nonpublic personal information of a consumer to a nonaffiliated third party unless—</text><subparagraph id="H506E42BA90A3429D903BC0CFFE8DB65E"><enum>(A)</enum><text>such financial institution has received explicit, informed consent from the consumer to authorize such information be disclosed to such third party; and</text></subparagraph><subparagraph id="H07445A05E48D45BB80699A368BD98E41"><enum>(B)</enum><text>such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 504, what information shall be disclosed to such third party and for what purpose.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
