which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Gramm-Leach-Bliley Act to give the Bureau of Consumer Financial Protection rulemaking and enforcement authority over the safeguards rule with respect to data aggregators and other financial institutions, and for other purposes.</official-title></form><legis-body id="HDD6FC2728D044AB3A57F7DF18C88A58C" style="OLC"><section id="HB614DEE17FDA4FAA83532BDE5875B8CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Non-bank Consumer Information Act</short-title></quote>.</text></section><section id="HD9D23837298E4A38BA1D7FF622399EC9"><enum>2.</enum><header>Application of safeguards rule to data aggregators</header><subsection id="HE0590E9DE6ED44B69271C69ABE6F24A5"><enum>(a)</enum><header>Application of safeguards rule</header><text display-inline="yes-display-inline">Section 501 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6801">15 U.S.C. 6801</external-xref>) is amended—</text><paragraph id="H075D599EE362494FB2495A9B31F53028"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>and except as provided in subsection (c)</quote> after <quote>subsection (a)</quote>;</text></paragraph><paragraph id="H54F534D2A6AD4186A76ECFEB97280CE8"><enum>(2)</enum><text>in subsection (b), by striking <quote>, other than the Bureau of Consumer Financial Protection,</quote>; and</text></paragraph><paragraph id="H1A0CD5F2E6C74BFCAE2FC156017D9778"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H77914AE0CCB34646A281419E6E5814D2" display-inline="no-display-inline"><subsection id="HCDF1A051A49342B1902E56C393FC8200"><enum>(c)</enum><header>Data aggregators</header><text display-inline="yes-display-inline">The Bureau of Consumer Financial Protection shall establish, by rule, appropriate standards for data aggregators relating to administrative, technical, and physical safeguards to protect records and information as described in paragraphs (1) through (3) of subsection (b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB26A89C657434444B9315761F05420A9"><enum>(b)</enum><header>Authority of the Bureau</header><text display-inline="yes-display-inline">Title V of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6801">15 U.S.C. 6801 et seq.</external-xref>) is amended—</text><paragraph id="HDA8AD4623BFA4472BE914393960BE3FA"><enum>(1)</enum><text>in section 504(a)(1)(A), by striking <quote>, except that the Bureau of Consumer Financial Protection shall not have authority to prescribe regulations with respect to the standards under section 501</quote>;</text></paragraph><paragraph id="H6E5E22F27EFA42D39DB0A5B5B8B338E5"><enum>(2)</enum><text>in section 505—</text><subparagraph id="H81555F167466438DBB349DB9C2E6B094"><enum>(A)</enum><text>in subsection (a)(8), by striking <quote>, but not with respect to the standards under section 501</quote> and inserting <quote>, including data aggregators</quote>;</text></subparagraph><subparagraph id="H2F3EEEF592C04C7880A6E4CF13848AB3"><enum>(B)</enum><text>in subsection (b)(1), by striking <quote>, other than the Bureau of Consumer Financial Protection,</quote>; and</text></subparagraph><subparagraph id="H28E5AFABCCE7441BA241FD68924EE57D"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking <quote>and (7)</quote> and inserting <quote>(7), and (8)</quote>; and</text></subparagraph></paragraph><paragraph id="H98C78392115241FD8BB6C0B6EF966254"><enum>(3)</enum><text>in section 508(a), by striking <quote>and the Federal Trade Commission</quote> and inserting <quote>, the Federal Trade Commission, and the Bureau of Consumer Financial Protection</quote>.</text></paragraph></subsection><subsection id="HDFBF2FC2A183450CB1668857A342EA32"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 509 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6809">15 U.S.C. 6809</external-xref>) is amended—</text><paragraph id="H671AD96D16174F47834C821CFA859C7B"><enum>(1)</enum><text>in paragraph (3)(A), by inserting before the period at the end <quote>, and includes a data aggregator</quote>; and </text></paragraph><paragraph id="HAD9C4606EF0F49C88EE4AB756604F93C"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H53C9553C440940C7A2144B053D31C292" display-inline="no-display-inline"><paragraph id="H0A22547AC837479BA16A1D0EBF6EA714"><enum>(12)</enum><header>Data aggregator</header><text display-inline="yes-display-inline">The term <term>data aggregator</term> means a person that collects, maintains, utilizes, distributes, or gives access to individual or aggregate nonpublic personal information to another financial institution.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
