R. 3905</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210615">June 15, 2021</action-date><action-desc><sponsor name-id="H001082">Mr. Hern</sponsor> (for himself and <cosponsor name-id="R000585">Mr. Reed</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to waive the 2-year duration of divorce requirement, and for other purposes.</official-title></form><legis-body id="H88379FA094AA45B6B8E3EEBF8E943E02" style="OLC"><section id="H87D6A3D168524869B3A138468B477D3F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security Parity Act</short-title></quote>. </text></section><section id="HF7BB164AE4914A98950BF9C372293233"><enum>2.</enum><header>Waive 2-year duration of divorce requirement</header><subsection id="HC7327F5EEC02467AB422877B3B7090E6"><enum>(a)</enum><header>Wife’s insurance benefits</header><text display-inline="yes-display-inline">Section 202(b)(4)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(b)(4)(A)</external-xref>) is amended by adding at the end the following new sentence: <quote>The criterion for entitlement under clause (ii) shall be deemed met upon the remarriage of the insured individual to someone other than the applicant during the 2-year period referred to in such clause.</quote>.</text></subsection><subsection id="H8895B745BB9B4DB088CE9ADA9CF122AB"><enum>(b)</enum><header>Husband’s insurance benefits</header><text>Section 202(c)(4)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(c)(4)(A)</external-xref>) is amended by adding at the end the following new sentence: <quote>The criterion for entitlement under clause (ii) shall be deemed met upon the remarriage of the insured individual to someone other than the applicant during the 2-year period referred to in such clause.</quote>.</text></subsection><subsection id="HB06B1EC27BDD4610831922755DE55628"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to benefits payable for months after December 2022 and for which applications are filed after December 2022.</text></subsection></section></legis-body></bill>
