R. 3902</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210615">June 15, 2021</action-date><action-desc><sponsor name-id="G000577">Mr. Graves of Louisiana</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to establish a pilot program for intermodal transportation infrastructure grants, and for other purposes.</official-title></form><legis-body id="HDBA5B9218FFB4496A85005E6749AD8AD" style="OLC"><section id="HBD4C0E68A3CE41B4B79CEAD1B4B20AAA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Aerospace Infrastructure Act of 2021</short-title></quote>.</text></section><section id="HFEE745DB79C948329148C6C1E2A41254" section-type="subsequent-section"><enum>2.</enum><header>Intermodal transportation infrastructure improvement pilot program</header><subsection id="H564A62D4BD2942D7A92520C84F03F8BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 47115 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="HCE4CB8AC51C747F1968A5F3D57609E3A" display-inline="no-display-inline"><subsection id="H07BEAF25D6564B9B89523CDE8D826ED3"><enum>(l)</enum><header>Intermodal transportation infrastructure improvement pilot program</header><paragraph id="H1DE337ED2910407A8D1510C726BFDE19"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a pilot program to issue grants to operators of launch and reentry sites for projects to construct, repair, maintain, or improve transportation infrastructure and facilities at such sites. The Secretary may enter into agreements to provide grants under this subsection.</text></paragraph><paragraph id="H2BEF9750F6E3403EB9F990A11ED4ACB0"><enum>(2)</enum><header>Pilot program qualifications</header><text>The Secretary may only issue a grant under this subsection to an operator if the operator—</text><subparagraph id="H6A2472BDBD5B4A899D834B0099101A9F"><enum>(A)</enum><text display-inline="yes-display-inline">has submitted an application to the Secretary in such form, at such time, and containing such information as prescribed by the Secretary;</text></subparagraph><subparagraph id="HDDBEB1E96EC84C6B9022C5D942CB5932"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrates to the Secretary's satisfaction that the project for which the application has been submitted is for an eligible purpose under paragraph (3); and</text></subparagraph><subparagraph id="H55573FCE382F4F9EAAD211DADD92AF7A"><enum>(C)</enum><text>agrees to maintain such records relating to the grant as the Secretary may require and to make such records available to the Secretary or the Comptroller General of the United States upon request.</text></subparagraph></paragraph><paragraph id="H5A8F7D3AD7ED4E769B6D23B9B9F3C15C"><enum>(3)</enum><header>Permitted use of pilot program grants</header><text display-inline="yes-display-inline">An operator may use a grant provided under this subsection for a project to construct, repair, maintain, or improve infrastructure and facilities that—</text><subparagraph id="H9A5753850C4F4865A88BCACD8C42D0B3"><enum>(A)</enum><text>are located at, or adjacent to, a launch or reentry site; and</text></subparagraph><subparagraph id="H1180C9B593184DD6A5D3E6EA3B2BA476"><enum>(B)</enum><text display-inline="yes-display-inline">directly enable or support transportation safety or covered transportation activities.</text></subparagraph></paragraph><paragraph id="H27AAD88BE1DA47B9AA10BC03B7F8756F"><enum>(4)</enum><header>Pilot program grants</header><subparagraph id="HDB3143C06CE84478B634C7521216DC87"><enum>(A)</enum><header>Grant formula</header><text display-inline="yes-display-inline">At the beginning of each fiscal year after fiscal year 2021, the Secretary shall issue a grant to an operator that qualifies for the pilot program under paragraph (2) an amount equal to the sum of—</text><clause id="HD3381AD4C80C492AA290D169654A9CF6"><enum>(i)</enum><text>$250,000 for each licensed launch or reentry operation conducted from the applicable launch or reentry site or at any adjacent Federal launch range in the previous fiscal year; and</text></clause><clause id="H6F471413E8824E1D8F78B9C846928059"><enum>(ii)</enum><text display-inline="yes-display-inline">$100,000 for each permitted launch or reentry operation conducted from the applicable launch or reentry site or at any adjacent Federal launch range in the previous fiscal year.</text></clause></subparagraph><subparagraph id="H71B240056311489EB8717CA09C727259"><enum>(B)</enum><header>Maximum grant</header><text>Except as provided in paragraph (5)(E), a grant issued to an operator under this subsection shall not exceed $2,500,000 for a fiscal year.</text></subparagraph><subparagraph id="HC0E5EDC1C6C24FEFB7C9A19D341DC766" commented="no"><enum>(C)</enum><header>Adjacency</header><clause id="H93FC6926959B41BD86B2345E3C931429" commented="no"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In issuing a grant to an operator under subparagraph (A), the Secretary shall determine whether a launch or reentry site is adjacent to a Federal launch range.</text></clause><clause id="H0F62899F0E4C4AA99EDF5C93AA46239C" commented="no"><enum>(ii)</enum><header>Limitation</header><text>Only 1 operator may receive an amount under subparagraph (A) for each licensed or permitted launch or reentry operation described in such subparagraph.</text></clause><clause id="H86473633B4EA4E3E9EDD739E419B284B" commented="no"><enum>(iii)</enum><header>Multiple launch or reentry sites operated by 1 operator</header><text>If an operator holds a license to operate more than 1 launch site or more than 1 reentry site that are adjacent to a Federal launch range, the Secretary shall consider such launch or reentry sites as 1 launch or reentry site for purposes of subparagraph (A). </text></clause></subparagraph></paragraph><paragraph id="H87AB7B2F4ABA45C7BF7818D71D487358"><enum>(5)</enum><header>Supplemental grants in support of State, local, or private matching</header><subparagraph id="H977EE99F105849BBA529E3FAC9929AD0"><enum>(A)</enum><header>In general</header><text>The Secretary may issue a supplemental grant to an operator, subject to the requirements of this paragraph.</text></subparagraph><subparagraph id="H163D344E45FA40A9B3450819B4DF68FE"><enum>(B)</enum><header>Dollar-for-dollar matching</header><text>If a qualified entity provides an operator an amount equal to or greater than the amount of a grant provided in a fiscal year under paragraph (4) (for the explicit purpose of matching such grant), the Secretary may issue a supplemental grant to the operator that is equal to 25 percent of such grant in the following fiscal year.</text></subparagraph><subparagraph id="H19726FCA071B4B22B5042E5685A4ACCF"><enum>(C)</enum><header>Additional non-Federal matching</header><text>If a qualified entity provides an operator an amount equal to or greater than two times the amount of a grant provided in a fiscal year to the operator under paragraph (4) (for the explicit purpose of matching such grant), the Secretary may issue a supplemental grant to the operator that is equal to 50 percent of such grant in the following fiscal year.</text></subparagraph><subparagraph id="H60F7A31EE880453D8A263D300245A33A"><enum>(D)</enum><header>Supplemental grant limitations</header><clause id="HC02C2572E0144BBD9D5B76DAF1360668"><enum>(i)</enum><header>Match timing</header><text>The Secretary may issue a supplemental grant under subparagraph (B) or (C) only if an amount provided by a qualified entity is provided to the operator in the same fiscal year as the grant issued under paragraph (4). </text></clause><clause id="H1B47D97E99714E36AEB55EE63124BF2A"><enum>(ii)</enum><header>Non-duplication of matching grants</header><text>If the Secretary issues a supplemental grant to the operator of a launch site under subparagraph (C), the Secretary may not issue a supplemental grant under subparagraph (B) to the same operator in the same fiscal year.</text></clause></subparagraph><subparagraph id="HDEDA047725DC42EDA5D027B5525C1A41"><enum>(E)</enum><header>Non-application of grant ceiling</header><text>The limitation on a grant amount under paragraph (4)(B) shall not apply to supplemental grants issued under this paragraph.</text></subparagraph></paragraph><paragraph id="HDCEEC870DD064914A6A85E1F247891F9"><enum>(6)</enum><header>Program administration</header><subparagraph id="H826F3D0E53A449A3A63B4025F05EFBD2"><enum>(A)</enum><header>Award timing</header><text display-inline="yes-display-inline">Amounts designated to carry out this section that are not obligated for grants under paragraphs (4) or (5) by July 1 of the fiscal year in which the amounts were made available shall be made available for projects in accordance with subsection (j).</text></subparagraph><subparagraph id="H0BCC08387837441583C8D186487A42C7"><enum>(B)</enum><header>Grant assurance applicability</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), a grant issued under this subsection shall not be subject to the conditions of sections 47106 or 47107, including any regulations prescribed thereunder, or any other conditions associated with grants made under this subchapter pursuant to the Secretary’s authority under chapter 471 or 475 (excluding section 47112 and 47113).</text></subparagraph><subparagraph id="H8023765E61EC45F1B54F4259FF1726B2" commented="no"><enum>(C)</enum><header>Combination with other Federal funds</header><text>If an operator combines amounts received under this subsection with Federal funds from any other source (including funds received under chapter 471 and 475), the applicable statutory or regulatory requirements associated with such funds shall apply to the total project being funded and to the funds provided under this subsection. </text></subparagraph></paragraph><paragraph id="H482C49F293D344EB82DD59F00DB1D59B"><enum>(7)</enum><header>Funding</header><subparagraph id="H71102BB9F32D4F66A9DCD56BEAC939E0"><enum>(A)</enum><header>Pilot program grant funds</header><text>The grants issued under this subsection shall be issued from funds made available under subsection (j)(4).</text></subparagraph><subparagraph id="H0183A45331BE45F4B4D6845643D40A3C"><enum>(B)</enum><header>Maximum annual limit on pilot program</header><clause id="HE3F37D57A2FD4436A582659F44B5D6A0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The total amount of all grants issued under this subsection shall not exceed $20,000,000 in any fiscal year.</text></clause><clause id="HE5A65858AFC84A5FA9E7EB19115F5971" commented="no"><enum>(ii)</enum><header>Grant reduction</header><text>In complying with clause (i), the Secretary—</text><subclause id="HCF43D97443144035AA33607E1DE71394" commented="no"><enum>(I)</enum><text>may proportionally reduce the amount of, or decline to issue, a supplemental grant under paragraph (5); and</text></subclause><subclause id="HCBD762852CDB4CE28C513681711DDCCC" commented="no"><enum>(II)</enum><text>if the reduction under subclause (I) is insufficient, shall proportionally reduce grants issued under paragraph (4).</text></subclause></clause></subparagraph></paragraph><paragraph id="H3755A26964A446799035C71001CC4EC4"><enum>(8)</enum><header>Definitions</header><text>In this subsection, the following definitions apply: </text><subparagraph id="H36E652A50E9D4979A4EBFE8D9A9816F7" commented="no"><enum>(A)</enum><header>Covered transportation activity</header><text display-inline="yes-display-inline">The term <term>covered transportation activity</term> means the movement of people or property to, from, or within a launch site and the necessary or incidental activities associated with such movement, including through use of—</text><clause id="H01441719899D402A9D743AB7F3155FF4" commented="no"><enum>(i)</enum><text>a vehicle;</text></clause><clause id="H555940515EAA4003AF2F81C6678B3304" commented="no"><enum>(ii)</enum><text>a vessel;</text></clause><clause id="H43AD60BDA2514675AA65E520CFA49506"><enum>(iii)</enum><text>a railroad (as defined in section 20102);</text></clause><clause id="HE0EA147155B8453EB06DED84FFA9FB7E" commented="no"><enum>(iv)</enum><text>an aircraft (as defined in section 40102);</text></clause><clause id="H747602E5878B43DBA166584F2E5F6230" commented="no"><enum>(v)</enum><text>a pipeline facility (as defined in section 60101); or</text></clause><clause id="HF8BB28FEE07346BEA1EEABB9F0984BF9" commented="no"><enum>(vi)</enum><text>a launch vehicle or reentry vehicle.</text></clause></subparagraph><subparagraph id="H982E2B8995B84EFC9F4BA8250C5A7C18"><enum>(B)</enum><header>Launch; launch site; launch vehicle; reentry site; reentry vehicle</header><text display-inline="yes-display-inline">The terms <term>launch</term>, <term>launch site</term>, <term>launch vehicle</term>, <term>reentry site</term>, and <term>reentry vehicle</term> have the meanings given those terms in section 50902 of title 51.</text></subparagraph><subparagraph id="H6A6155DF59D8431C94B53E91A13369F8"><enum>(C)</enum><header>Operator</header><text display-inline="yes-display-inline">The term <term>operator</term> means a person licensed by the Secretary to operate a launch or reentry site.</text></subparagraph><subparagraph id="HFDBD3C8FB53D4CD5850658A31D560A1E"><enum>(D)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means a State, local, or tribal government or private sector entity, or any combination thereof.</text></subparagraph></paragraph><paragraph id="HF01D2F9280A14A3CA4A920C46FAA53D0"><enum>(9)</enum><header>Pilot program sunset</header><text>This subsection shall cease to be effective on October 1, 2023.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2FB6352840AC4C06B551B4C5DF718CE6"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 47115(j)(4) of title 49, United States Code, is amended by inserting <quote>and subsection (l)</quote> after <quote>this subsection</quote>. </text></subsection></section></legis-body></bill>
