which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose safety requirements on commercial air tour flights, and for other purposes.</official-title></form><legis-body id="H0FB22152FB5A49909DD609E1BB843EC0" style="OLC"><section id="HEC0B541B28F241D3BC03FAA56445C484" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe and Quiet Skies Act of 2021</short-title></quote>.</text></section><section id="H6B077633D9624BF8AB8D25CDEF95466A"><enum>2.</enum><header>Requirements for commercial air tour flights</header><subsection id="HA1B77485D1B54050AFEA7D7E8477C0E0"><enum>(a)</enum><header>Prohibition of overflights</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a commercial air tour may not operate within a half mile of the following:</text><paragraph id="HD63521933D2941A9845353F1B6B19BA0"><enum>(1)</enum><text display-inline="yes-display-inline">A military installation.</text></paragraph><paragraph id="HD5BBCAE884EC443DBD2BBBC0DB1C255F"><enum>(2)</enum><text display-inline="yes-display-inline">A national cemetery.</text></paragraph><paragraph id="H5F5050069EE341B1AE87DB8811D09733"><enum>(3)</enum><text display-inline="yes-display-inline">A unit of the National Wilderness Preservation System.</text></paragraph><paragraph id="H1449F8F4623A4635AF8BD97D2B529BE3"><enum>(4)</enum><text>A unit of the National Park System.</text></paragraph><paragraph id="H4F991A86601841AA94988EDB37D3F92A"><enum>(5)</enum><text>A unit of the National Wildlife Refuge System.</text></paragraph></subsection><subsection id="HA502066A885C4D77B6261BB8464CBDEC"><enum>(b)</enum><header>Use of Automatic Dependent Surveillance-Broadcast (ADS–B) Out equipment</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration shall revise section 91.227 of title 14, Code of Federal Regulations, to require the use of ADS–B Out (as such term is defined in such section) during the entire operation of a commercial air tour.</text></subsection><subsection id="H4D9CB886601846F9B7340A95EA468A4B"><enum>(c)</enum><header>Sterile cockpit rule</header><text display-inline="yes-display-inline">The Administrator shall issue such regulations as are necessary to—</text><paragraph id="HC3A2393F50D04ED6BA6F4730AA869D8E"><enum>(1)</enum><text display-inline="yes-display-inline">impose the requirements of section 121.542 of title 14, Code of Federal Regulations, on a commercial air tour and a pilot of a commercial air tour (including a commercial air tour that does not hold a certificate under part 121 of title 14, Code of Federal Regulations);</text></paragraph><paragraph id="HE9349309193846AF886573BE4779C959"><enum>(2)</enum><text display-inline="yes-display-inline">define tour-giving and providing an oral narration of the air tour as duties that are not required for the safe operation of the aircraft for a commercial air tour (including a commercial air tour that does not hold a certificate under part 121 of title 14, Code of Federal Regulations); and</text></paragraph><paragraph id="H596B0FD512424A1986E3DF92965ECAB5"><enum>(3)</enum><text display-inline="yes-display-inline">define a critical phase of flight for a commercial air tour (including a commercial air tour that does not hold a certificate under part 121 of title 14, Code of Federal Regulations) to include all ground operations involving taxi, takeoff, and landing, and all other flight operations regardless of altitude of operation.</text></paragraph></subsection><subsection id="H184EEEF6B9F745EEBC8A995A3220A738"><enum>(d)</enum><header>Minimum altitudes</header><paragraph id="H44579EA1AF6D42F4B92C24EEE343E05C"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, a commercial air tour may not operate at an altitude of less than 1,500 feet.</text></paragraph><paragraph id="H62C4DFC135594802B4ECFD2EB2C60469"><enum>(2)</enum><header>Exceptions</header><subparagraph id="H5F465A03859145E781B33A56EE3BF956"><enum>(A)</enum><header>Safe harbor</header><text display-inline="yes-display-inline">An operator of a commercial air tour may fly below the altitude described in paragraph (1) for reasons of safety if unpredictable circumstances occur.</text></subparagraph><subparagraph id="H1EFD82313CEB41EBBA96C3FCD3716DCE"><enum>(B)</enum><header>FAA requirements</header><text display-inline="yes-display-inline">The Administrator may permit an operator of a commercial air tour to operate below the altitude described in paragraph (1) for flight operations for takeoff and landing.</text></subparagraph></paragraph><paragraph id="H74061B3BE59B49DEA6089E0DE27D5494"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">If a reasonable individual would believe a commercial air tour could not safely fly at a minimum altitude of 1,500 feet for the duration of the flight given the conditions at takeoff, the safe harbor described in paragraph (2)(A) shall not apply.</text></paragraph></subsection><subsection id="H6DCCF462C0F14982912372F7E3983C47"><enum>(e)</enum><header>Occupied areas</header><paragraph id="HBB3F0C92069F494E8A740AF4D0DD2D70"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a commercial air tour may not operate within half a mile of an occupied area unless the aircraft has noise suppression technology that brings noise to the lesser of—</text><subparagraph id="H756478345B6C42B582C8B3BF6F195516"><enum>(A)</enum><text display-inline="yes-display-inline">a maximum level of 55 dbA as measured from such occupied area; and</text></subparagraph><subparagraph id="H7129AA8135BE4F61BC4D4757614387C3" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a maximum level required in such occupied area by a requirement imposed pursuant to section 3(a) of this Act or section 40128(e) of title 49, United States Code.</text></subparagraph></paragraph><paragraph id="H14A029C9C4294727ADBDA02E07104428"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Administrator shall revise subparts F and H of part 36 of title 14, Code of Federal Regulations, and related appendices, to reduce noise limits in accordance with paragraph (1).</text></paragraph></subsection></section><section id="H7EB698578E604D09B2CF5D27B75B7C00"><enum>3.</enum><header>Delegated authority to State and local regulators</header><subsection id="H60D9A60629424E5A8D0BF66AC53AE57F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a State or locality may impose additional requirements on commercial air tours (but may not waive any requirements described in this Act or in the amendments made by this Act), including—</text><paragraph id="HF1A9727BA17344EC940F1FC158CC7021"><enum>(1)</enum><text>banning such tours;</text></paragraph><paragraph id="HDAC6995A3D8E46C2B7937BCD7B8CB5E1"><enum>(2)</enum><text>imposing day and time flight restrictions;</text></paragraph><paragraph id="H738FC572F3764FB8A42669EE49FF88D6"><enum>(3)</enum><text>regulating the total number of flights per day;</text></paragraph><paragraph id="HD01BF692C5AB4D3C98DA9135A0477D9F"><enum>(4)</enum><text>regulating route requirements over occupied areas;</text></paragraph><paragraph id="H1AED39CFEBFF410AB3D40112949C439B"><enum>(5)</enum><text>prohibiting flights over State or local parks, ocean recreation, cemeteries, and other areas of State interest; and</text></paragraph><paragraph id="H85276C757B1943E49130FC97F100B819"><enum>(6)</enum><text>requiring commercial air tours to operate at lower decibels for purposes of noise requirements.</text></paragraph></subsection><subsection id="H2F15122B54574956B11581E4150CA3A7"><enum>(b)</enum><header>FAA exceptions</header><text>The Administrator may invalidate a requirement imposed pursuant to subsection (a) if required for flight operations for takeoff and landing.</text></subsection></section><section id="H6C91B6C401534E5C86BFC5ECFC058FEC"><enum>4.</enum><header>Public engagement throughout Federal and State regulatory process</header><text display-inline="no-display-inline">During the promulgation of any regulation required by this Act or the drafting and update of the Air Tours Common Procedural Manuals, the requirements of the Administrative Procedure Act shall apply.</text></section><section id="HA3B49458754C453B98317D82DD3B91B0"><enum>5.</enum><header>Penalties</header><text display-inline="no-display-inline">The Administrator shall impose penalties for violations of this Act or the amendments made by this Act, including revoking any certifications or permits issued to operate a commercial air tour.</text></section><section id="H82A78BFC5ACE447083A072A3DC5CD502"><enum>6.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">Section 40128 of title 49, United States Code, is amended—</text><paragraph id="H6706AB2DE83D4CD3AB7B4D4DC204BEBB"><enum>(1)</enum><text>by striking <quote>a national park or</quote> in each place in which it appears;</text></paragraph><paragraph id="H9DF9A4BCAD9448F8805CCFF0C120C16D"><enum>(2)</enum><text>by striking <quote>park or</quote> in each place in which it appears;</text></paragraph><paragraph id="H8258FB7C630E447FB02FFB5B0C65F1AB" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(C), by striking <quote>or voluntary agreement under subsection (b)(7)</quote>;</text></paragraph><paragraph id="H4315CD3E79A9413888F0F1691B75DBE7"><enum>(4)</enum><text>by striking subsection (a)(2) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H6FD67C5946924C6FB82375349BA2DB9D" style="USC"><paragraph id="HAD4A35698FC64338BFA5AEE0916967D2"><enum>(2)</enum><header>Application for operating authority</header><text display-inline="yes-display-inline">Before commencing commercial air tour operations over tribal lands, a commercial air tour operator shall apply to the Administrator for authority to conduct the operations over the tribal lands.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="HA84401CBF8674FE790D6C8144F936795"><enum>(5)</enum><text display-inline="yes-display-inline">by striking subsection (a)(3); </text></paragraph><paragraph id="H2F0D287DDA9B4275852A657BECD24758" commented="no"><enum>(6)</enum><text>by redesignating paragraph (4) of subsection (a) as paragraph (3); </text></paragraph><paragraph id="H6D0B5FAE54704C3EB935902CFFFD72CB"><enum>(7)</enum><text>by striking subsection (a)(5);</text></paragraph><paragraph id="H4448878CCDDE40E1AAB64FE050E4D2B8"><enum>(8)</enum><text>in subsection (b)(1)(A)—</text><subparagraph id="H1DA432249D77449ABDB3C0FEE470EE3B"><enum>(A)</enum><text>by striking <quote>over the park</quote> and inserting <quote>over the lands</quote>; and</text></subparagraph><subparagraph id="H458A9BE9763A4197BC85969CAEDA99D1" commented="no"><enum>(B)</enum><text>by striking <quote>paragraph (4)</quote> and inserting <quote>paragraph (3)</quote>; </text></subparagraph></paragraph><paragraph id="HEAB5AC59477D43F8A4C14E5505EB4858"><enum>(9)</enum><text>by striking subsection (b)(1)(C);</text></paragraph><paragraph id="H2A82C4EE77DD4B6597856ADE6AAE11D5"><enum>(10)</enum><text>by striking subsection (b)(3);</text></paragraph><paragraph id="H12F9FD685E3D42A8B58A85D2862A7502" commented="no"><enum>(11)</enum><text>by redesignating paragraphs (4) through (6) of subsection (b) as paragraphs (3) through (5), respectively;</text></paragraph><paragraph id="H76A28FA85DAA46EE87848C937937A5FC"><enum>(12)</enum><text>by striking subsection (b)(7);</text></paragraph><paragraph id="H8A23CF87097946BCBA99ED098B5DF29F"><enum>(13)</enum><text>by striking subsection (c)(2)(B);</text></paragraph><paragraph id="H59B99389CB494AD2A3717E7CA5777BEC" commented="no"><enum>(14)</enum><text>by redesignating subparagraphs (C) through (I) of subsection (c)(2) as subparagraphs (B) through (H), respectively;</text></paragraph><paragraph id="HDBB93535F89F4609B1592677617FB017"><enum>(15)</enum><text>in subsection (c)(3)(B), by striking <quote>at the</quote> in each place in which it appears;</text></paragraph><paragraph id="HA005D59B51F5475BB3C27B2D6A5728A2"><enum>(16)</enum><text>in subsection (d)(1)—</text><subparagraph id="HD7C102E679C445C9A561AA6069BE71B8"><enum>(A)</enum><text>by striking <quote>over a national park under interim operating authority granted under subsection (c) or</quote>; and</text></subparagraph><subparagraph id="HE0CF1A95223B46ABB351187DE96F947E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>or voluntary agreement</quote>;</text></subparagraph></paragraph><paragraph id="H342B1BA17E99490B8A47E2488655ECC6"><enum>(17)</enum><text>by striking subsection (e);</text></paragraph><paragraph id="H13085901028E4E0CA7CC33C94F63AB68"><enum>(18)</enum><text>by striking subsection (f) and inserting the following:</text><quoted-block style="USC" id="H0507D663553D4AFBAACBB3A6DA22ABDC" display-inline="no-display-inline"><subsection id="HA191DA716B12463EA43F012EBEAC5BA5"><enum>(e)</enum><header>Tribal authority</header><paragraph id="H94CE9CADA9BD4DA5A4C3FA1C417270C1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a tribal entity may impose additional requirements on commercial air tours (but may not waive any requirements described in the <short-title>Safe and Quiet Skies Act of 2021</short-title> or in the amendments made by the <short-title>Safe and Quiet Skies Act of 2021</short-title>), including—</text><subparagraph id="H4C645A4D8AC647B5AC0A8E71E325D241"><enum>(A)</enum><text>banning such tours;</text></subparagraph><subparagraph id="H310C913EAD63499BAFBD26929881B0CC"><enum>(B)</enum><text>imposing day and time flight restrictions;</text></subparagraph><subparagraph id="H5CFD7BE47FFE406AA16BC3D5A7236F9A"><enum>(C)</enum><text>regulating the total number of flights per day;</text></subparagraph><subparagraph id="HFF849A9848524DEC8077AB84E9676E65"><enum>(D)</enum><text>regulating route requirements over occupied areas;</text></subparagraph><subparagraph id="H3EE750A31F144AB1AB0B6CCBA5F237B5"><enum>(E)</enum><text>prohibiting flights over tribal parks, ocean recreation, cemeteries, and other areas of tribal interest; and</text></subparagraph><subparagraph id="H889564E3DC00428D81AAF1BDF0409189"><enum>(F)</enum><text>requiring commercial air tours to operate at lower decibels for purposes of noise requirements.</text></subparagraph></paragraph><paragraph id="HA34DF02446584B5CBD871F1237742F1A"><enum>(2)</enum><header>FAA exceptions</header><text>The Administrator of the Federal Aviation Administration may invalidate a regulation imposed pursuant to paragraph (1) if required for flight operations for takeoff and landing.</text></paragraph><paragraph id="H6D4C0407F9A1494DA582F1CA2A90970C"><enum>(3)</enum><header>Tribal entity</header><text>In this subsection, the term <term>tribal entity</term> means—</text><subparagraph id="H14C76D9EE9524F01B4B9A2792D193B99"><enum>(A)</enum><text display-inline="yes-display-inline">a tribal organization (as such term is defined in section 4 of the Indian Self-Determination and Education Assistance Act of 1975 (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></subparagraph><subparagraph id="H7816B9E50C9F44A597E48FF1250AF417"><enum>(B)</enum><text>a tribally designated housing entity (as such term is defined in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)); or</text></subparagraph><subparagraph id="H069ADEEB712B4510BEE077640D567303"><enum>(C)</enum><text>an Indian-owned business or a tribal enterprise (as such terms are defined in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>)).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HCBC4EFBCBE314C23B11990B608F12BEF"><enum>(19)</enum><text>in subsection (g)(1), by striking <quote>over a national park</quote> and inserting <quote>over tribal lands</quote>;</text></paragraph><paragraph id="HA2174C324E064AF0BFA4F62C9843EB46"><enum>(20)</enum><text display-inline="yes-display-inline">in subsection (g)(2), by striking <quote>over a national park</quote> and inserting <quote>over tribal lands</quote>; </text></paragraph><paragraph id="H2B00C3E23A294BF0976A3D8F54AADA6F"><enum>(21)</enum><text>by striking subsection (g)(4); </text></paragraph><paragraph id="H457E84B02D5A41088531BCF9A04161DE" commented="no"><enum>(22)</enum><text>by redesignating paragraphs (5) through (8) of subsection (g) as paragraphs (4) through (7), respectively; and</text></paragraph><paragraph id="HDE7614D5D4914EA39C89A323A3F9597F" commented="no"><enum>(23)</enum><text>by redesignating subsection (g) as subsection (f).</text></paragraph></section><section id="H1858CDE89E5246A19AF4FD25E110E6A6"><enum>7.</enum><header>NTSB recommendations</header><subsection id="H39CD4DF7DB174059BE6D339FE560A7D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall implement all recommendations concerning operators under part 135 of title 14, Code of Federal Regulations, that—</text><paragraph id="H5CBAA3F16D82487396B47EABE74667BC"><enum>(1)</enum><text>were issued by the National Transportation Safety Board; and</text></paragraph><paragraph id="HAEFD437D54344E7DA21334E6F21644CF"><enum>(2)</enum><text>are considered by the Board to be open unacceptable response.</text></paragraph></subsection><subsection id="H9D1491E736884C62A8DFE76DD235C767"><enum>(b)</enum><header>Part 135 regulation</header><text display-inline="yes-display-inline">The Administrator—</text><paragraph id="HA20626B6E10241B8BE32077E37CFD0AF"><enum>(1)</enum><text>shall require all commercial air tours to operate pursuant to part 135 of title 14, Code of Federal Regulations; and</text></paragraph><paragraph id="HF341A52EC79D49449C95A3225D605FF3"><enum>(2)</enum><text>may not permit a commercial air tour to operate pursuant to part 91 of title 14, Code of Federal Regulations.</text></paragraph></subsection></section><section id="HB8E6EB1F92DC47A09032980D08E98032"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text><paragraph id="H0DEEACEB7A134A828E202436D7484B73"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Federal Aviation Administration.</text></paragraph><paragraph id="H86CA4659CB3B42B5BE0722C167F0C5A7"><enum>(2)</enum><header>Altitude</header><text display-inline="yes-display-inline">The term <term>altitude</term> means the distance above ground level between an aircraft and the highest obstacle that is within 2 miles of the location over which such aircraft is flying at any time.</text></paragraph><paragraph id="H081A9A07183F4A5AB4324A60C7AE370C"><enum>(3)</enum><header>Commercial air tour</header><text display-inline="yes-display-inline">The term <term>commercial air tour</term> means any flight conducted for compensation or hire in a powered aircraft where a purpose of the flight is sightseeing or intentional parachuting. If the operator of a flight asserts that the flight is not a commercial air tour, factors that can be considered by the Administrator in making a determination of whether the flight is a commercial air tour include—</text><subparagraph id="HCC3CCAB565FE48A8AD5D3E7BF03ADC5D"><enum>(A)</enum><text display-inline="yes-display-inline">whether there was a holding out to the public of willingness to conduct a sightseeing or intentional parachuting flight for compensation or hire;</text></subparagraph><subparagraph id="HCFE08D44C7254282A3BB715F60DF655C"><enum>(B)</enum><text>whether a narrative was provided that referred to areas or points of interest on the surface;</text></subparagraph><subparagraph id="H2BAB0E7E94034BFA85BE4B38573C2CFE"><enum>(C)</enum><text>the area of operation;</text></subparagraph><subparagraph id="H6564ADFF6CB94805AF1ED65B75B5828E"><enum>(D)</enum><text>the frequency of flights;</text></subparagraph><subparagraph id="H6B86A2894C0A4B96A6553C854C433462"><enum>(E)</enum><text>the route of flight;</text></subparagraph><subparagraph id="HE63606A819E24030AC39506CBB765A57"><enum>(F)</enum><text display-inline="yes-display-inline">the inclusion of sightseeing or intentional parachuting flights as part of any travel arrangement package; or</text></subparagraph><subparagraph id="H16016D949ACC4EFC8249451AAA16C957"><enum>(G)</enum><text>whether the flight in question would or would not have been canceled based on poor visibility of the surface.</text></subparagraph></paragraph><paragraph id="HC003C17C77C94328B889D3CD3FF96474"><enum>(4)</enum><header><enum-in-header>dbA</enum-in-header></header><text display-inline="yes-display-inline">The term <term>dbA</term> means the A-weighted sound level or unit of measurement describing the total sound level of all noises as measured with a sound level meter using the A weighting network.</text></paragraph><paragraph id="HABBCD0CE842C432FAAB59B4B7FAF076C"><enum>(5)</enum><header>Occupied area</header><text display-inline="yes-display-inline">The term <term>occupied area</term> means land area that is used by people, including residential areas, commercial areas, and recreational areas.</text></paragraph></section></legis-body></bill>
