which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration, to provide for ocean-based climate solutions to reduce carbon emissions and global warming; to make coastal communities more resilient; and to provide for the conservation and restoration of ocean and coastal habitats, biodiversity, and marine mammal and fish populations; and for other purposes.</official-title></form><legis-body id="HE22498D02DE546CEAFEC4A081FB18EE3" style="OLC"><section id="H4580722112884313827491BF10F26D76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Ocean and Coastal Security Improvements Act of 2021</short-title></quote>.</text></section><section id="H7D8E9E275FAE475FB2EDD501F2BBD0AF"><enum>2.</enum><header>Improvements to the National Oceans and Coastal Security Act</header><subsection id="H7645ADBD7D5E4F22B1C82653BED53A45"><enum>(a)</enum><header>Definition of tidal shoreline refined</header><text>Section 902 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7501">16 U.S.C. 7501</external-xref>) is amended—</text><paragraph commented="no" id="HFF84871A05B94AAD8DC5A699A74F1A88"><enum>(1)</enum><text>by amending paragraph (7) to read as follows:</text><quoted-block id="H202423646002421289CA6274F9A3B28E" style="OLC"><paragraph commented="no" id="H09F8D784181C496D95A9490D0395F940"><enum>(7)</enum><header>Tidal shoreline</header><text>The term <term>tidal shoreline</term> means a <quote>tidal shoreline</quote> or a <quote>Great Lake shoreline</quote> as such terms are used in section 923.110(c)(2)(i) of title 15, Code of Federal Regulations, or a similar successor regulation.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H6877E80AFA1B4F07BEB82A9D3CB33C30"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD65B20D5F17245AEA296B8CC5DEBFB8B" style="OLC"><paragraph commented="no" id="HADED126330DC4EE793DA39FE20C14D3C"><enum>(8)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given such in section 4 of the Indian Self-Determination and Education Assistance Act.</text></paragraph><paragraph id="H595C27554D2F49CF99FFF52C0022EC3C"><enum>(9)</enum><header>Blue carbon</header><text display-inline="yes-display-inline">The term <term>blue carbon</term> means the ability of an ocean or coastal ecosystem, habitat, or other natural resource to absorb, capture, and contain atmospheric carbon dioxide.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2AE04A7FE90B41999A025AF19C598911"><enum>(b)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Section 904(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7503">16 U.S.C. 7503(d)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H8E3E5A66A7864BB584E0D80A1E94F951" style="OLC"><subsection id="H985D6AF246DD4D119EF17AD899FD9D82"><enum>(d)</enum><header>Expenditure</header><paragraph id="H793B86F1AD284FBC9CBCACB57480AEBC"><enum>(1)</enum><header>Amounts to remain available</header><text display-inline="yes-display-inline">Amounts in the Fund shall remain available until extended to carry out the purposes of the Fund.</text></paragraph><paragraph id="H6307EBFE98364387BAC83FEAF5C0BF64"><enum>(2)</enum><header>Distribution</header><text display-inline="yes-display-inline">Of the amounts in the Fund, in each fiscal year—</text><subparagraph id="HFFA5C605B2034A74AF4FD9ED25800554"><enum>(A)</enum><text display-inline="yes-display-inline">not less than $150,000,000 shall be used for the award of grants under section 906(b);</text></subparagraph><subparagraph id="HED5F14C1042D4BA4A5EBB65140C90E03"><enum>(B)</enum><text display-inline="yes-display-inline">not less than $50,000,000 shall be used for the award of grants under section 906(c);</text></subparagraph><subparagraph id="HFB122192FB4B493891C044308099F0D4"><enum>(C)</enum><text display-inline="yes-display-inline">any amounts in excess of $200,000,000 shall be distributed such that—</text><clause id="HB66C61C29710408E9E36AA987340EDF6"><enum>(i)</enum><text display-inline="yes-display-inline">80 percent of such amounts shall be used for the award of grants under section 906(b); and</text></clause><clause id="H3AB71E1ACCBD413ABC552BCE8F5B9D04"><enum>(ii)</enum><text display-inline="yes-display-inline">20 percent of such amounts shall be used for the award of grants under section 906(c).</text></clause></subparagraph><subparagraph id="HF37F24BCA1D546D3B6FA1A63707E91B2"><enum>(D)</enum><text display-inline="yes-display-inline">Of amounts provided in this subsection, not more than 4 percent may be used by the Administrator and the National Fish and Wildlife Foundation for direct costs to carry out this chapter. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC2E6F9ABB123489E91601216E1C094AD"><enum>(c)</enum><header>Eligible uses of the fund</header><text>Section 905 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7504">16 U.S.C. 7504</external-xref>) is amended to read as follows:</text><quoted-block id="H485EE4C52A574537A5AC5F93380249EF" style="OLC"><section id="H0F9DE1346BDB43FCB125C33F6CC621AF"><enum>905.</enum><header>Eligible uses</header><subsection id="H5F12B2D696B84454A0B6E1B2EC1EDB0A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts in the Fund may be allocated by the Administrator and the Foundation for grants under section 906(c) to support programs and activities intended to protect, conserve, restore, better understand, and use ocean and coastal resources and coastal infrastructure, including, if appropriate, scientific research, resiliency planning, implementation, and monitoring and spatial planning, data-sharing, and other programs and activities carried out in coordination with Federal and State departments or agencies, including the following:</text><paragraph id="H19CC767D705547F29CFDF238944C546A"><enum>(1)</enum><text>Ocean, coastal, and Great Lakes restoration and protection, including efforts to address potential impacts of sea level change, sedimentation, erosion, changes in ocean chemistry, hurricanes and other extreme weather, flooding, and changes in ocean temperature to natural resources, communities, and coastal economies.</text></paragraph><paragraph id="H1DDFDD2777D44AAABCF9BCE15D38294B"><enum>(2)</enum><text display-inline="yes-display-inline">Restoration, protection, or maintenance of living ocean, coastal, and Great Lakes resources and their habitats, including habitats and ecosystems that provide blue carbon benefits.</text></paragraph><paragraph id="H27F308BB9FF4479F9F2B2847D2753807"><enum>(3)</enum><text>Planning for and managing coastal development to enhance ecosystem and community integrity, or to minimize impacts from sea level change, hurricanes and other extreme weather, flooding, and coastal erosion.</text></paragraph><paragraph id="H072E11B15ECA48B5A440DD055E125C79"><enum>(4)</enum><text>Projects to address management, planning, or resiliency and readiness issues which are regional or interstate in scope, such as regional ocean partnerships or similar bodies.</text></paragraph><paragraph id="H4BD56429E8A34EF8A9E5610E85940480"><enum>(5)</enum><text>Efforts that contribute to the understanding of ecological, economic, societal, and national security threats driven by changes to the oceans, coasts, and Great Lakes.</text></paragraph><paragraph id="HC03A963C95684F208AFFFC7C1624C1B6"><enum>(6)</enum><text>Efforts to preserve, protect, and collect data, including public ocean and coastal data portals, that would support sustainable water-dependent commercial activities including commercial fishing, recreational fishing businesses, aquaculture, boat building, or other coastal-related businesses.</text></paragraph><paragraph id="HAFECDF881C374D3AA7919B914F520F83"><enum>(7)</enum><text display-inline="yes-display-inline">Efforts to assist coastal States in repositioning, relocating or deploying natural or nature-based features to enhance the resiliency of critical coastal transportation, emergency response, water, electrical, and other infrastructure, that are already subject to or face increased future risks of hurricanes, coastal flooding, coastal erosion, or sea level change to ensure the economic security, safety, and ecological well-being of the coasts of the United States.</text></paragraph><paragraph id="H2A61D2F537E841949B31C05B12DA25B5"><enum>(8)</enum><text>Acquiring property or interests in property if—</text><subparagraph id="HBB43F5C7AE99407FA0358B0892F05CF5"><enum>(A)</enum><text>the area is located within a coastal county or adjacent county;</text></subparagraph><subparagraph id="H3F91F755C9E242E6B93153CB53DB59D5"><enum>(B)</enum><text>the funds made available under this subtitle are used to acquire land or interest in land by purchase, exchange, or donation from a willing seller;</text></subparagraph><subparagraph id="H817868BDEC7445DBAC7C6719996A7246"><enum>(C)</enum><text>the Governor of the State in which the property or interests in property are acquired approves of the acquisition; and</text></subparagraph><subparagraph id="HF83B14A13FA04DDD8C358E736C98210D"><enum>(D)</enum><text>such property or interest is acquired in a manner that will ensure such property or interest will be administered to support the purposes of this Act.</text></subparagraph></paragraph><paragraph id="H7012F8DD65714CDFA44AE0727D9DD805"><enum>(9)</enum><text>Protection and modification of critical coastal public infrastructure affected by erosion, hurricanes or other extreme weather, flooding, or sea level change.</text></paragraph><paragraph id="HE5395E8C287E44059D15518711D9DB8B"><enum>(10)</enum><text display-inline="yes-display-inline">Assistance for small businesses and communities that are dependent on coastal tourism as eligible efforts that help coastal economies minimize impacts from sea level rise and disasters.</text></paragraph><paragraph id="H650C38ECF3544F38B52E59D5488523BA"><enum>(11)</enum><text display-inline="yes-display-inline">Projects that use natural and nature-based approaches for enhancing the resiliency of wastewater and stormwater infrastructure as eligible critical infrastructure projects (as compared to just general water infrastructure, which can also include drinking water systems).</text></paragraph><paragraph id="HA043558C9BA2419CB2D437369F7CEE3F"><enum>(12)</enum><text display-inline="yes-display-inline">Technical assistance to help develop comprehensive resilience and mitigation plans as an eligible funding effort.</text></paragraph></subsection><subsection id="H0C6371EA011444B18B4E103235C6E7A3"><enum>(b)</enum><header>Prohibition on use of funds for litigation</header><text>No funds made available under this Act may be used to fund litigation against the Federal Government. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDE872F9E35194C3CACBFD199E022CAF1"><enum>(d)</enum><header>Grants</header><paragraph id="H67B7CECD0DD748DD9480F732F6C0BA23"><enum>(1)</enum><header>Administration</header><text>Section 906(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7505">16 U.S.C. 7505(a)(1)</external-xref>) is amended—</text><subparagraph commented="no" id="H71D3CC563FCA45709D8FD840ECE8471F"><enum>(A)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4F8ECA82479944EE96C10B6000C80E7A" style="OLC"><subparagraph id="H5DB974DE75274B4E8004075BCB7110C6"><enum>(B)</enum><text display-inline="yes-display-inline">Selection procedures and criteria for the awarding of grants under this section that require consultation with the Administrator and the Secretary of the Interior.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H116FFE92DE32429D8A98B301696D3139"><enum>(B)</enum><text>by amending subparagraph (C)(ii) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9BC30D6733274B33AA4505E8FF8E6F83" style="OLC"><clause id="H74C7DDDE14C04D1F97936991BB01D52A"><enum>(ii)</enum><text display-inline="yes-display-inline">under subsection (c) to entities including States, local governments, regional and interstate collaboratives, associations, nonprofit and for-profit private entities, public-private partnerships, academic institutions, and Indian Tribes.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9DF170321117409BBE0353E60E1CB4E2"><enum>(C)</enum><text>in subparagraph (F), by striking <quote>year if grants have been awarded in that year</quote> and inserting <quote>5 years</quote>; and</text></subparagraph><subparagraph id="H6DAACD0245BE40C59E724E38BA088D78"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="H0F50DDBB24C548DDB8B3A0D6BDCDAB43" display-inline="no-display-inline"><subparagraph id="HFE021789ADB4488C9587E86E4F20EFC7"><enum>(I)</enum><text display-inline="yes-display-inline">A method to give special consideration in reviewing proposals to projects with either direct or indirect coastal or marine blue carbon benefits and an accounting methodology to quantify these benefits for the purposes of the annual report required under section 907.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H665DDE90BD334BD8856BBFE30B92D413"><enum>(2)</enum><header>Grants to coastal States</header><text display-inline="yes-display-inline">Section 906(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7505">16 U.S.C. 7505(b)</external-xref>) is amended to read as follows:</text><quoted-block id="H9A7C576E8C6B4258B6BA22B73432D89A" style="OLC"><subsection id="HC4A7A246E5E2443C834A221205BCD0C2"><enum>(b)</enum><header>Grants to coastal States</header><paragraph id="H4128901F02F94243B1892549102A1E87"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (3) and (4), the Administrator shall award grants to eligible coastal States based on the following formula:</text><subparagraph id="H69BD719BFE1F4D2A850EBC610AB8EC92"><enum>(A)</enum><text>50 of the funds are allocated equally among eligible coastal States.</text></subparagraph><subparagraph id="HB14AD2E099124E379A23EBAD26D405F6"><enum>(B)</enum><text>25 percent of the funds are allocated on the basis of the ratio of tidal shoreline miles in a coastal State to the tidal shoreline miles of all coastal States.</text></subparagraph><subparagraph id="HF3EFC387C60943ADB38F87E6AE93D990"><enum>(C)</enum><text>25 percent of the funds are allocated on the basis of the ratio of population density of the coastal counties of a coastal State to the average population density of all coastal counties based on the most recent data available by the Census Bureau.</text></subparagraph></paragraph><paragraph id="HF902FB02BC474E1992BEAAA1F98B7889"><enum>(2)</enum><header>Maximum allocation to States</header><text>Notwithstanding paragraph (1), not more than 5 percent of the total funds distributed under this subsection may be allocated to any single State. Any amount exceeding this limit shall be redistributed equally among the remaining eligible coastal States.</text></paragraph><paragraph id="HAD70F3F26EBD4F3A83D19DE82BC59C8E"><enum>(3)</enum><header>Requirement to submit plans</header><subparagraph id="H069CDAAB828A470CB3B905CF43F8E173"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant under this subsection, an eligible coastal State shall submit to the Administrator for review and approval, a 5-year plan, which shall include the following:</text><clause id="H1D9AEB1272314EB0B98E39760354D280"><enum>(i)</enum><text>Criteria to determine eligibility for entities which may receive grants under this subsection.</text></clause><clause id="H316CB0C3C9DD4823BD08DE3A36C811EF"><enum>(ii)</enum><text>A description of the competitive process the coastal State will use in allocating funds received from the Fund, except in the case of allocating funds under paragraph (6), which shall include—</text><subclause id="HAC5AEA737D224515A96BB6D3ED89243F"><enum>(I)</enum><text display-inline="yes-display-inline">a description of the relative roles of and consistency with the State coastal zone management program approved under the Coastal Zone Management Act of 1972, if the coastal State has such a plan, and any State Sea Grant Program, if the State has such program; and</text></subclause><subclause id="H35E660B3D13E444099190D23645F49F0"><enum>(II)</enum><text>a demonstration that such competitive process is consistent with the application and review procedures established by the Administrator and Foundation under subsection (a)(1).</text></subclause></clause><clause id="HA7CFF94E16D74C488A1380C2CBCCFF4E"><enum>(iii)</enum><text>A process to certify that the project or program and the awarding of a contract for the expenditure of amounts received under this paragraph are consistent with the standard procurement rules and regulations governing a comparable project or program in that State, including all applicable competitive bidding and audit requirements.</text></clause><clause id="HC613F583F83F4512B3D4B0D19A56D6BA"><enum>(iv)</enum><text>Procedures to make publicly available on the internet a list of all projects supported by the Fund, that includes at a minimum the grant recipient, grant amount, project description, and project status.</text></clause></subparagraph><subparagraph id="HBC2E9A2B39CC436B8B8D23B947CE8AE1"><enum>(B)</enum><header>Updates</header><text>As a condition of receiving a grant under this subsection, a coastal State shall submit to the Administrator, not less frequently than once every 5 years, an update to the plan submitted by the coastal State under subparagraph (A) for the 5-year period immediately following the most recent submittal under this paragraph.</text></subparagraph></paragraph><paragraph id="H9E335A5AC17F4E4C86401872A9657010"><enum>(4)</enum><header>Opportunity for public comment</header><text>In determining whether to approve a plan or an update to a plan described paragraph (3), the Administrator or the Foundation shall provide the opportunity for, and take into consideration, public input and comment on the plan.</text></paragraph><paragraph id="HF733CFEA247C4676989A290A7785A816"><enum>(5)</enum><header>Indian Tribes</header><text>As a condition on receipt of a grant under this subsection, a State that receives a grant under this subsection shall ensure that Indian Tribes in the State are eligible to participate in the competitive process described in the State’s plan under paragraph (3)(A)(ii).</text></paragraph><paragraph id="HD05CB930B9404A589F68272E89F49F6B"><enum>(6)</enum><header>Nonparticipation by a State</header><text>In any fiscal year, if an eligible coastal State does not submit the plan required by paragraph (3) or declines the funds distributed under this subsection, the funds allocable to such State or area shall be allocated to the national grant program under subsection (c).</text></paragraph><paragraph id="HD58372D97D42460E8F4BFB3AD58A2226"><enum>(7)</enum><header>Eligible coastal State defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>eligible coastal State</quote> has the meaning given the term <quote>coastal state</quote> in section 304 of the Coastal Zone Management Act of 1972.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HCF6229DE745943EBBC9E280EFD1C08C4"><enum>(3)</enum><header>National grants for oceans, coasts, and Great Lakes</header><text>Section 906(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7505">16 U.S.C. 7505(c)(2)</external-xref>) is amended—</text><subparagraph id="HA3C433999BEF44FD87795CFBE9BBE12A"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="H434C2269D775498A86BE890A6CD58AF2"><enum>(i)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HEE4362B763E141388DBF1117101A9570"><enum>(ii)</enum><text>by redesignating clause (iii) as clause (iv); and</text></clause><clause id="H168663847FD4441EB9681147140EB0A9"><enum>(iii)</enum><text>by inserting after clause (ii) the following:</text><quoted-block id="HBD5CAEDC4BC641E4B846BD6E35D458B8" style="OLC"><clause id="H0C08EDDCA9204C8B9C80A36A66D3386E"><enum>(iii)</enum><text>nongovernmental organizations; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H6760270A8F2C4D45AF288B2B0B489672"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="HEFE6BD6446914E3997C16ACC05C3804B" style="OLC"><subparagraph id="HD82104CE20A944CCB4083C7C5AA97E8B"><enum>(C)</enum><header>Cap on State funding</header><text>The amount of a grant awarded under this subsection shall not count toward the cap on funding to States through grants awarded under subsection (b).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H982EF9CD2B2548C0A734F173C1981947"><enum>(e)</enum><header>Annual report</header><text>Section 907 of the National Oceans and Coastal Security Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7506">16 U.S.C. 7506</external-xref>) is amended—</text><paragraph id="H7A4CFECA714B4722A9550717E91EE52B"><enum>(1)</enum><text>by amending subsection (b)(3) to read as follows:</text><quoted-block id="H549C366EC6A848E3AFE5E862AD6DF680" style="OLC"><paragraph id="HA507CEF548CA49849A2E218E161DC99B"><enum>(3)</enum><text>a description of the expenditures made from the Fund for the fiscal year, including the purpose of the expenditures; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2E3526D21B7C4C13A33DCEC576D06E5F"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HE8C392D58C654468A82F7EDBAD0C0B45" style="OLC"><paragraph id="H8B86CA36AA6E4EF2A1036BCCBF43CEE6"><enum>(4)</enum><text>an estimate of blue carbon benefits, in tons of carbon dioxide-equivalent emissions, expected through grants awarded to projects that received special consideration under section 906 due to the blue carbon potential of such projects.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4D633761FB434FE9A69AB39ACF54E2ED"><enum>(f)</enum><header>Funding</header><text>Section 908 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/7507">16 U.S.C. 7507</external-xref>) is amended to read as follows:</text><quoted-block id="H9CBE9893EABD4B2B9CE016F7F525D956" style="OLC"><section id="HC99E29990209497A93B23AEB5CF492BA"><enum>908.</enum><header>Funding</header><text display-inline="no-display-inline">There is appropriated $200,000,000 for each of fiscal years 2021 through 2030 to the Fund, to remain available until expended.</text></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section><section id="H02D0E15D0C4442C987E0C78DA309C6F8"><enum>3.</enum><header>Increasing funding for coastal conservation and resilience</header><text display-inline="no-display-inline">Section 8(p)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H1030D66A5D454852A9DA7ADE60188F03" style="OLC"><subparagraph id="H20DE635EE8C8437687BE0D7CBDF8C9D4"><enum>(C)</enum><text>With respect to any lease under this subsection for the production of wind energy, 30 percent of the revenue from such lease shall be deposited in the National Oceans and Coastal Security Fund established by section 904 of the National Oceans and Coastal Security Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
