which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require a study and report on the housing and service needs of survivors of trafficking and individuals at risk for trafficking.</official-title></form><legis-body id="H580A5AA15F604DDFBA6B2DF3E3DF42C0" style="OLC"><section section-type="section-one" id="HFC53474EE99F406FAAB21EF4AE6D2C79"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trafficking Survivors Housing Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="H07FB13FB678D45548617FE263460E74E"><enum>2.</enum><header>Study and report on housing and service needs of survivors of trafficking and individuals at risk for trafficking</header><subsection id="HB871099B19EA4F5C9B1732749A754C84"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H45949D51389D41B5A252456D1A1A0378"><enum>(1)</enum><header>Survivor of a severe form of trafficking</header><text>The term <term>survivor of a severe form of trafficking</term> has the meaning given the term <term>victim of a severe form of trafficking</term> in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph><paragraph id="H49FEC2D6FA1649F6971FCF4C84FA496B"><enum>(2)</enum><header>Survivor of trafficking</header><text>The term <term>survivor of trafficking</term> has the meaning given the term <term>victim of trafficking</term> in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph></subsection><subsection id="H39E5ED3CD37346BFBB2F38F3EEC20B50"><enum>(b)</enum><header>Study</header><paragraph id="HCC5344E57EB94761BFCDE72FBE94DD2F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The United States Interagency Council on Homelessness shall conduct a study assessing the availability and accessibility of housing and services for individuals experiencing homelessness or housing instability who are—</text><subparagraph id="HB5ABE66379824D05BB963BC76DCB5E41"><enum>(A)</enum><text display-inline="yes-display-inline">survivors of trafficking, including survivors of severe forms of trafficking; or</text></subparagraph><subparagraph id="H14DE7C05F3D64AE6841E84D8ED0D4C4B"><enum>(B)</enum><text display-inline="yes-display-inline">at risk of being trafficked.</text></subparagraph></paragraph><paragraph id="H3E637CCB6C464E4EB088ADDC5B89BFD9"><enum>(2)</enum><header>Coordination and consultation</header><text display-inline="yes-display-inline">In conducting the study required under paragraph (1), the United States Interagency Council on Homelessness shall—</text><subparagraph id="H0F20E892405246A9BD6C876D554A137E"><enum>(A)</enum><text display-inline="yes-display-inline">coordinate with—</text><clause id="H9F812CA19BCF4D43805F1DC9C4C36C00"><enum>(i)</enum><text display-inline="yes-display-inline">the Interagency Task Force to Monitor and Combat Trafficking established under section 105 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103</external-xref>);</text></clause><clause id="H37A59E66B41549E683377A4DACF8C0DC"><enum>(ii)</enum><text display-inline="yes-display-inline">the United States Advisory Council on Human Trafficking;</text></clause><clause id="H5A42385075204347B21F09241C88CA2C"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary of Housing and Urban Development;</text></clause><clause id="HE744F4985F9C4D0A8234581C64F82DC4"><enum>(iv)</enum><text display-inline="yes-display-inline">the Secretary of Health and Human Services; and</text></clause><clause id="H7A3D4D902D4F4335A8CBBB6F0E3270B1"><enum>(v)</enum><text display-inline="yes-display-inline">the Attorney General; and </text></clause></subparagraph><subparagraph id="H84642A8AF37E40138FB272914DD66786"><enum>(B)</enum><text display-inline="yes-display-inline">consult with—</text><clause id="H221701D2F16B44CD8B46FAD658EFDAE7"><enum>(i)</enum><text display-inline="yes-display-inline">the National Advisory Committee on the Sex Trafficking of Children and Youth in the United States;</text></clause><clause id="HE7EB33623A0646BD8A59B3AD25316720"><enum>(ii)</enum><text display-inline="yes-display-inline">survivors of trafficking;</text></clause><clause id="H091DDAF0A7F7458292457F28ED8EAEDD"><enum>(iii)</enum><text display-inline="yes-display-inline">direct service providers, including—</text><subclause id="H6D933EB861864326ABECC5377E383249"><enum>(I)</enum><text>organizations serving runaway and homeless youth;</text></subclause><subclause id="HFB6E23CD534640448D233A5829045803"><enum>(II)</enum><text display-inline="yes-display-inline">organizations serving survivors of trafficking through community-based programs; and</text></subclause><subclause id="H23202E51F7A14A218361DB67EBCA7353"><enum>(III)</enum><text display-inline="yes-display-inline">organizations providing housing services to survivors of trafficking; and</text></subclause></clause><clause id="H8088E984AEEA4443925BFA3D41DF34C7"><enum>(iv)</enum><text display-inline="yes-display-inline">housing and homelessness assistance providers, including recipients of grants under—</text><subclause id="H020899D9FC524B1DBE5638D975BCB925"><enum>(I)</enum><text display-inline="yes-display-inline">the continuum of care program authorized under subtitle C of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>); and</text></subclause><subclause id="H707A977B14E74B4FA4B5C5F2404FA62F"><enum>(II)</enum><text>the Emergency Solutions Grants Program authorized under subtitle B of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11371">42 U.S.C. 11371 et seq.</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph id="H1C76189CFE6F41918972A1AAF267671B"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The study conducted under paragraph (1) shall include—</text><subparagraph id="H3ACD27E2CC2740D0A4A8873D519450C9"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to the individuals described in that paragraph—</text><clause id="H308D7C3A617840F78C8AE748A07BBCCA"><enum>(i)</enum><text>an evaluation of formal assessments and outreach methods used to identify and assess the housing and service needs of those individuals, including outreach methods to—</text><subclause id="H7C63C812A9C448738ED4BE246A05EA24"><enum>(I)</enum><text>ensure effective communication with individuals with disabilities; and</text></subclause><subclause id="H9B9157B0DBAC40ECBFF46270E06ECC87"><enum>(II)</enum><text>reach individuals with limited English proficiency;</text></subclause></clause><clause id="HBDD45CB8FC2D492EBD4C96D7AFFF1F24"><enum>(ii)</enum><text>a review of the availability and accessibility of homelessness or housing services for those individuals, including the family members of those individuals who are minors involved in foster care systems, that identifies the disability-related needs of those individuals, including the need for housing with accessibility features;</text></clause><clause id="H8E3CA1D9F0674994B9418715E282ECEC"><enum>(iii)</enum><text>the effect of any policies and procedures of mainstream homelessness or housing services that facilitate or limit the availability of those services and accessibility for those individuals, including those individuals who are involved in the legal system, as those services are in effect as of the date on which the study is conducted;</text></clause><clause id="H09D94E255E754B04B5D8B22BFB705CFD"><enum>(iv)</enum><text>an identification of best practices in meeting the housing and service needs of those individuals; and</text></clause><clause id="H3BC31C5990014648BED8179802C65609"><enum>(v)</enum><text>an assessment of housing discrimination against survivors of trafficking who are members of a protected class under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>);</text></clause></subparagraph><subparagraph id="H9ADB8EE4DFEA4965BEF8A9E6AD72D011"><enum>(B)</enum><text>an assessment of the ability of mainstream homelessness or housing services to meet the specialized needs of survivors of trafficking, including trauma responsive approaches specific to labor and sex trafficking survivors; and</text></subparagraph><subparagraph id="H27AFA906D62C4D9F825CAFD40B5FBC97"><enum>(C)</enum><text>an evaluation of the effectiveness of, and infrastructure considerations for, housing and service-delivery models that are specific to survivors of trafficking, including survivors of severe forms of trafficking, including emergency rental assistance models.</text></subparagraph></paragraph></subsection><subsection id="H554E60B3903A4632B7AD57E0C0A1E755"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the United States Interagency Council on Homelessness shall—</text><paragraph id="HB5FA9174AEC34B4FB00DE40E5DAF3B4E"><enum>(1)</enum><text>submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report containing the information described in subparagraphs (A) through (C) of subsection (b)(3); and</text></paragraph><paragraph id="HDBD9C2250033429C8F002FDB3F127509"><enum>(2)</enum><text>make the report submitted under paragraph (1) publicly available.</text></paragraph></subsection></section></legis-body></bill>
