which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Farm Security and Rural Investment Act of 2002 by requiring preclearance quarantine inspections for all movement to or from the State of Hawaii by either domestic or international travel, and for other purposes.</official-title></form><legis-body id="HA4AB928125404DAB8F09D64AD26BB6B6" style="OLC"><section id="HB3CC4906457A4CDE918E3F3D5DCFA0CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hawaii Invasive Species Protection Act</short-title></quote>.</text></section><section id="H893421CB6AB840B7B94A64F67B0BD0F3"><enum>2.</enum><header>Requiring preclearance quarantine inspections for all movement to or from the State of Hawaii<editorial></editorial></header><text display-inline="no-display-inline">Section 10811 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307</external-xref> note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H8A33D52CF25F49E28114AA9E3FA78B07" style="OLC"><section id="H1F473D2C7AF8456F804F79E1285DC40E"><enum>10811.</enum><header>Preclearance quarantine inspections</header><subsection id="H636EB762B735439A8FCDBCB4C040E393"><enum>(a)</enum><header>Preclearance Inspections Required</header><text display-inline="yes-display-inline">The Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service, in cooperation with the Secretary of the Interior, the Secretary of Homeland Security, the Secretary of Commerce, the Secretary of the Treasury, the government of Hawaii, and each of their respective quarantine, natural resource, conservation, and law enforcement agencies and officers, as appropriate, shall conduct visual, x-ray, and canine preclearance quarantine inspections of persons, baggage, cargo, and any other articles destined for direct movement to or from the State of Hawaii by either domestic or international travel for high-risk invasive species and agricultural materials.</text></subsection><subsection id="HA6EBD7DE738F40A5B2E526BEB3F7D0D9"><enum>(b)</enum><header>Inspection locations</header><text>The domestic preclearance quarantine inspections required by subsection (a) shall be conducted prior to direct travel to or from the State of Hawaii at all—</text><paragraph id="H50F129FBEDDD40BFBCF16DB980F0F0D9"><enum>(1)</enum><text>departure and interline airports;</text></paragraph><paragraph id="H8C3FD9C305A2416F97D90E0F1E0DE034"><enum>(2)</enum><text>ports of departure; and</text></paragraph><paragraph id="H87B608DFD53847648A73C7A25423DC95"><enum>(3)</enum><text>destination sectional center facilities of the United States Postal Service.</text></paragraph></subsection><subsection id="HE5DF51BD304C4D2A936755B5E45F4EE1"><enum>(c)</enum><header>Invasive species and agricultural materials</header><text display-inline="yes-display-inline">The Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service and in consultation with the government of Hawaii, shall develop a list of items subject to inspection for purposes of screening pursuant to subsection (a).</text></subsection><subsection id="H56C8CD17CF3E48F2BDEFEB8EA38384E2"><enum>(d)</enum><header>Publication in Federal Register</header><text>Not later than 180 days after the date of the enactment of the Hawaii Invasive Species Protection Act, the Secretary of Agriculture, acting through the Administrator of the Animal and Plant Health Inspection Service and in cooperation with the government of Hawaii, shall publish in the Federal Register the list developed pursuant to subsection (c).</text></subsection><subsection id="H69CD7B81C86B4AD98BB01CA328E3F4F3"><enum>(e)</enum><header>Seizure and disposal</header><text>High-risk invasive species and agricultural material discovered under subsection (a) may be seized and disposed of in accordance with section 10407.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC2925D12446341A28E024981326AA87A"><enum>3.</enum><header>Preclearance quarantine inspections for plants</header><text display-inline="no-display-inline">Section 421(b) of the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7731">7 U.S.C. 7731(b)</external-xref>) is amended—</text><paragraph id="HF4594EEF34FB4914B90B40570DE28D5D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting before the semicolon at the end the following: <quote>(including high-risk invasive species and agricultural materials into the State of Hawaii in accordance with section 10811(c) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307(c)</external-xref> note)</quote>;</text></paragraph><paragraph id="HF04BB1C1777645908362B57DD92DC011"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting before the semicolon at the end the following: <quote>(including high-risk invasive species and agricultural materials into the State of Hawaii in accordance with section 10811(c) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307(c)</external-xref> note)</quote>; and</text></paragraph><paragraph id="HEEE84F75AC2044D7AE08D8F52A76B6C3"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting before the period at the end the following: <quote>(including high-risk invasive species and agricultural materials into the State of Hawaii in accordance with section 10811(c) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307(c)</external-xref> note)</quote>.</text></paragraph></section><section id="HEA952E5CCEB54663A9090EAD770CAC5D"><enum>4.</enum><header>Collection of fees for inspection services</header><text display-inline="no-display-inline">Section 2509 of the Food, Agricultural, Conservation and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/21/136a">21 U.S.C. 136a(a)</external-xref>) is amended—</text><paragraph id="HEFA66187E0C24008B2A720578A60248B"><enum>(1)</enum><text>in subsection (a)(1)(A), by inserting <quote>including the cost of such services provided in connection with the arrival in Hawaii, with respect to screening for high-risk invasive species under section 10811 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307</external-xref> note),</quote> after <quote>port in the customs territory of the United States,</quote>; and</text></paragraph><paragraph id="H9AE9C9B9D91346D7AC0BA6EADC1BBA0B"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by inserting before the period at the end the following: <quote>, including with respect to screening conducted in connection with respect to the import, entry, and exportation to or from Hawaii of high-risk invasive species under section 10811 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307</external-xref> note)</quote>.</text></paragraph></section><section id="H4DE8768CF25642AB9562B34A1D61E6B8"><enum>5.</enum><header>Fees for inspection of plants for exporting or transiting</header><text display-inline="no-display-inline">Section 102(f) of the Department of Agriculture Organic Act of 1944 (<external-xref legal-doc="usc" parsable-cite="usc/7/7759">7 U.S.C. 7759(f)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HFA8CC390E3504B8488E88B17B9A872B2" style="OLC"><paragraph id="H043B1F6509BB4000928302B4A8660690"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture shall prescribe and collect user fees sufficient to cover the full cost of preclearance quarantine inspections conducted under section 10811 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8307">7 U.S.C. 8307</external-xref> note).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
