<section display-inline="no-display-inline" id="HCC23B7F6BE1E4D78936062FC0859328D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HAF62A2659C794CCF9C326762180197E1"><enum>(1)</enum><header>China</header><text>The term <term>China</term> means the People’s Republic of China.</text></paragraph>
<paragraph id="H18C9D0266C214D3DB726259A8E0554EA"><enum>(2)</enum><header>Compensation fund</header><text>The term <term>compensation fund</term> means the Coronavirus Compensation Fund.</text></paragraph></section> <section id="HF739F9B0C40248D9ABB9A29D8C87FA71"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="HC7E8F43D131A4ED9876888F237A56EEA"><enum>(1)</enum><text>In the early weeks of the spread of the virus responsible for COVID–19, the Government of China systematically suppressed, misrepresented, and falsified information concerning such spread.</text></paragraph> <paragraph id="HE72061783E03464581E4588961203A16"><enum>(2)</enum><text>The first reported instance of such virus may have occurred on November 17, 2019, in Wuhan, China. The Government of China did not notify the World Health Organization that it had detected an unknown respiratory illness until December 31, 2019.</text></paragraph>
<paragraph id="H914B47D25ABE42ADA144FD05EE64C4D3"><enum>(3)</enum><text>The Government of China violated international law by covering up the origins and spread of such virus.</text></paragraph> <paragraph id="H79BB2D154C5D48D5BA3D3259F4E792F5"><enum>(4)</enum><text>Articles 6 and 7 of the International Health Regulations of 2005 require notification to the World Health Organization within 24 hours of an assessment of events that may constitute a public health emergency of international concern.</text></paragraph>
<paragraph id="H9F69BD8EF7B544838CC9DE93C022285E"><enum>(5)</enum><text>The International Health Regulations require the World Health Organization to be notified of <quote>all relevant public health information</quote> regarding public health events of international concern, and for information to be shared in a <quote>timely, accurate, and sufficiently detailed manner</quote>.</text></paragraph> <paragraph id="H0F106682A21E452CAA526A8523268474"><enum>(6)</enum><text>The Government of China failed to share information with the World Health Organization, and embarked on a campaign to silence doctors, scientists, and whistleblowers in an attempt to mislead the Chinese people and the international community concerning the spread of such virus.</text></paragraph>
<paragraph id="H76552F789AF74F5EBFCCF11F5A4FCEB4"><enum>(7)</enum><text>On December 27, 2019, samples of the virus found in hospitals in Wuhan, China, were analyzed and determined to be a novel coronavirus.</text></paragraph> <paragraph id="HCD69C3FACE384C8B8BAAEF3769C34B7B"><enum>(8)</enum><text>The Government of China did not share with the World Health Organization such determination concerning the novel coronavirus.</text></paragraph>
<paragraph id="H6C6730F3FD544B479BC8954B444EB205"><enum>(9)</enum><text>On January 3, 2020, the Government of China ordered Chinese scientists working to sequence the genome of such virus to surrender or destroy their samples and the Government of China did not publicly share the genetic sequence until January 12, 2020.</text></paragraph> <paragraph id="HA988B57AF4E54F68BA4FFCF5CE8A4771"><enum>(10)</enum><text>In early January, the Government of China jailed eight medical professionals who sought to share information relating to such virus.</text></paragraph>
<paragraph id="H390944A704E34DAA833A1EEF2C23C7F7"><enum>(11)</enum><text>A Chinese ophthalmologist, Doctor Li Wenliang, tried to warn the medical community of such virus. The Government of China forced Doctor Li to sign a letter stating that he made <quote>false statements</quote> concerning such virus. Doctor Li later became infected with such virus and died on February 7, 2020.</text></paragraph> <paragraph id="H3225600F231E4E9F9F4D6ADC34B742A6"><enum>(12)</enum><text>The Government of China insisted that no evidence existed concerning the spread of such virus through person-to-person transmission, and allowed Chinese citizens to travel unimpeded, including during the Lunar New Year, when travelers numbered in the hundreds of millions.</text></paragraph>
<paragraph id="H2B74DD36E4A74BD2A7FDF60FE59F28C0"><enum>(13)</enum><text>On December 31, 2019, the Government of Taiwan noted the possibility that such virus could spread through person-to-person transmission. Officials of the World Health Organization sent to China did not announce that such virus could spread through person-to-person transmission until January 22, 2020.</text></paragraph> <paragraph id="H06A28FD61C17481187B6C3145A4D7096"><enum>(14)</enum><text>The Government of China continues to neutralize or eliminate actors who threaten to expose the Government of China’s culpability in the spread of such virus.</text></paragraph>
<paragraph id="H1036DB02B5CD4A0E9FAF7D11ED4C3F4D"><enum>(15)</enum><text>Wuhan Central Hospital reprimanded Doctor Ai Fen for sharing a picture of a patient report labeled <quote>SARS Coronavirus</quote>. In an interview published in the Chinese magazine Ren Wu on March 10, 2020, Doctor Ai said, <quote>This incident has shown that everyone needs to have their own thoughts because someone has to step up to speak the truth.</quote>. </text></paragraph> <paragraph id="H8785E214608141B393AADBE2EE6A2A7B"><enum>(16)</enum><text>The repeated violations of the International Health Regulations by the Government of China caused the spread of such virus first in Wuhan, China, and then worldwide.</text></paragraph>
<paragraph id="HA6C754E800DB4B6486C08742E51E2838"><enum>(17)</enum><text>As of June 8, 2021, such spread resulted in 173,331,478 confirmed cases and 3,735,571 deaths.</text></paragraph> <paragraph id="HBF7436CAE1C54518BA35652E304C710F"><enum>(18)</enum><text>As of June 8, 2021, 33,193,680 Americans had been infected by such virus and 594,802 of those people died.</text></paragraph>
<paragraph id="HB655B6D5A5084B49911A24FE14D5FAF1"><enum>(19)</enum><text>In an October 12, 2020, issue of the Journal of the American Medical Association, economists Lawrence Summers and David Cutler calculated that such spread would cost the United States at least $16 trillion.</text></paragraph> <paragraph id="H7BBC6241792449F9B36097761C03C39B"><enum>(20)</enum><text>On October 13, 2020, the International Monetary Fund estimated that such spread will cost the global economy approximately $28 trillion in lost economic output.</text></paragraph>
<paragraph id="H7C423B5DC4604F7193C5671E5460EA68"><enum>(21)</enum><text>The World Bank estimated on December 14, 2020, that such spread added between 88 million people and 115 million people to those living in extreme poverty and caused between 83 million people and 132 million people to become undernourished.</text></paragraph> <paragraph id="H3E142E1EEC2D4FB28B65E4B4775E3C58"><enum>(22)</enum><text>The World Bank further predicted that learning losses and higher dropout rates caused by such spread would cost students an estimated $10 trillion in future earnings, nearly 10 percent of global Gross Domestic Product.</text></paragraph>
<paragraph id="H580D78F2913A43DB96386CD4E6FDFAF6"><enum>(23)</enum><text>The International Labor Organization estimated that the spread of such virus caused an 8.8 percent drop in working hours globally, which is equivalent to 255 million full-time jobs.</text></paragraph> <paragraph id="HFB38EEDAB8FD428083BB3AB2D7A30BF9"><enum>(24)</enum><text>More than 60 million Americans filed unemployment claims between March and October 2020.</text></paragraph>
<paragraph id="HC892823EB86345F1B554BEF876E20302"><enum>(25)</enum><text>The United States unemployment rate reached 14.8 percent in April 2020, the highest rate observed since 1948.</text></paragraph> <paragraph id="HEF3E278554ED48FF9EF210C453582E4A"><enum>(26)</enum><text>The Congressional Budget Office predicted $7.6 trillion in United States economic output would be lost to the pandemic between 2021 and 2031.</text></paragraph>
<paragraph id="H956ED914535B4989BB638C80F5F5FEE4"><enum>(27)</enum><text>To mitigate the economic impact of such spread and bolster response efforts, Congress appropriated nearly $5.3 trillion in emergency spending.</text></paragraph> <paragraph id="H10DC0C2F983849B893DCB768D5C48C58"><enum>(28)</enum><text>The Congressional Budget Office more than tripled its Fiscal Year 2020 Federal budget deficit projection from $1 trillion in January 2020 to $3.3 trillion.</text></paragraph>
<paragraph id="HFF61D9C41C4949C5AFB59EC6185667FF"><enum>(29)</enum><text>If China had acted in accordance with its international obligations just three weeks earlier, the number of early coronavirus cases may have been 95 percent lower.</text></paragraph></section> <section id="H76F4DB2749954382BD7DD46D058A146D"><enum>4.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph id="HE46313084DD44F0EADA14856AF651B68"><enum>(1)</enum><text display-inline="yes-display-inline">in February 2020, the United States correctly designated Chinese state-owned media outlets as foreign missions; </text></paragraph> <paragraph id="HC09061F0B67743A187E1F43975FAFAB3"><enum>(2)</enum><text>the Secretary of State should limit to 100 or fewer people the total number of Chinese citizens who may work for a Chinese state-owned media outlet in the United States;</text></paragraph>
<paragraph id="H479AE245C8AE46FAA3740B199D3E0F2A"><enum>(3)</enum><text>such limitation may encourage China to allow American journalists and other foreign independent reporters to live and report in China without threat or harassment by China; and</text></paragraph> <paragraph id="H013C91ED1A6B4DDFA46A1CB2B545AAD1"><enum>(4)</enum><text display-inline="yes-display-inline">United States entities should avoid supporting or spreading propaganda from China by reviewing the policies of such entities relating to media advertisements created by China or advertising in media outlets owned or operated by China. </text></paragraph></section>
<section id="HF5A30A497D7E45E8AE69476805E0F64E" commented="no"><enum>5.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to seek compensation from China for intentionally concealing and distorting information concerning the spread of the virus responsible for COVID–19 resulting in—</text> <paragraph id="HB65373E384E144A29446AA90BE280F4D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the avoidable loss of life, health, or property of citizens of the United States; and</text></paragraph>
<paragraph id="HA36BF883646044588FD73128286B73B7" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the damage to the national economy of the United States.</text></paragraph></section> <section id="H224B73FF5B4442E68D8621B635FEE44B" commented="no"><enum>6.</enum><header>Coronavirus compensation fund</header> <subsection id="H5F740C5F10224EC8A6B2901B50390308" commented="no"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a compensation fund to be known as the Coronavirus Compensation Fund.</text></subsection>
<subsection id="H75AB28D23E79413F964896C33A0A589D" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Deposit of Funds</header><text>There shall be deposited into the compensation fund—</text> <paragraph id="HFD67577EE0214D458E9E7E02A628046D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the amount agreed upon, if any, between China and the United States relating to the bilateral agreement on compensation initiated under section 7(a) of this Act; and</text></paragraph>
<paragraph id="HB9CAFDADC675408C922AA9F988EF62C1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the amount, if any, collected from the freezing of assets belonging to China under section 8. </text></paragraph></subsection></section> <section id="HAAB9DBD31A3C488C8BADDF573922AD55" commented="no"><enum>7.</enum><header>Bilateral agreement on compensation between the United States and China</header> <subsection id="H9ABC2CC21A6741A7B7EA922D78B6CF8B" commented="no"><enum>(a)</enum><header>Negotiations</header> <paragraph id="H21DE53CA140E459B912F120E10A921DE" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary of State shall enter into negotiations with China concerning a bilateral agreement on compensation.</text></paragraph>
<paragraph id="HBA5321098547496F80617F697189336E" commented="no"><enum>(2)</enum><header>Matters included</header><text>The initiation of negotiations required under paragraph (1) shall relate to—</text> <subparagraph id="HC87B295CCAAB46CA995571C192E763AA" commented="no"><enum>(A)</enum><text>the efforts of China to intentionally distort and conceal information concerning the spread of the virus responsible for COVID–19; and</text></subparagraph>
<subparagraph id="H52353D2825DE4FDE9CCB86F62FFC383B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the avoidable loss of life, health, or property of citizens of the United States and the damage to the national economy of the United States caused by the actions of China described in subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="H3C7B8E7FAC8A4A94830C6400A5EB40E4" commented="no"><enum>(b)</enum><header>Deposit of funds</header><text>Any money received relating to negotiations initiated under paragraph (1) shall be deposited into the compensation fund established under section 6(a). </text></subsection></section>
<section id="HA1BF363C6AF3462FBDBF574E4CE760C2" commented="no"><enum>8.</enum><header>Authorization to freeze Chinese assets</header>
<subsection id="H4F0FFB618AAF4CD1994944CF468EAF20"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall use his authorities under the International Emergency Economic Powers Act to freeze or block any Chinese asset subject to the jurisdiction of the United States in order to reach a bilateral agreement on compensation with China. With the consent of China under the bilateral agreement on compensation, the President may deposit all or some of these frozen funds into the compensation fund established under section 6(a).</text></subsection> <subsection id="HD2AE4208A5A04056BAE4713080406A7A" commented="no"><enum>(b)</enum><header>Public repository of certain assets</header> <paragraph id="H981B494AD7D340A982A539F76EA38053" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Secretary of Treasury shall publish online a public repository described in paragraph (2). </text></paragraph>
<paragraph id="H28AECED8A14F4937A63FE36979C11DEF" commented="no"><enum>(2)</enum><header>Matters included</header><text>The public repository described in this paragraph shall include information relating to the following:</text> <subparagraph id="HE08B578FB7094F9EA00D870951A1BEA4" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Chinese state-owned entities in the United States.</text></subparagraph>
<subparagraph id="H6E47700E2E614430B0633435D1C2E0E8" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Chinese entities financed, directed, or controlled by the Government of China or the Chinese Communist Party.</text></subparagraph> <subparagraph id="H70B319BAEF6249268DDE07365EADC6C4" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">United States entities financed, directed, or controlled by the Government of China or the Chinese Communist Party.</text></subparagraph></paragraph>
<paragraph id="H49A9B4EF279946EA9C44434B45B3F9D1" commented="no"><enum>(3)</enum><header>Self-report</header>
<subparagraph id="H17DFE805334041ABB3F031D2B4703620" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), not later than 60 days after the date of the enactment of this Act, a United States entity employed by a Chinese entity, including a firm in the United States financial, consulting, or legal industries, shall self-report to the Secretary of Treasury and be added to the public repository described in paragraph (2).</text></subparagraph> <subparagraph id="HEC6CED8CA67948A9B0DCB081B4815AF0"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if a public report under subparagraph (A) would disclose confidential proprietary information, including business or trade secrets, the information shall be provided to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate in a classified repository and shall not be subject to public disclosure. </text></subparagraph>
<subparagraph id="HE57847549BC5454EB378063E5031C956" commented="no"><enum>(C)</enum><header>Removal from public repository</header><text>Not later than 30 days after a United State entity reports to the Secretary of Treasury that all contracts or agreements with a Chinese entity have terminated, the Secretary of Treasury shall remove all information relating to the United States entity from the public repository.</text></subparagraph></paragraph></subsection> <subsection id="H649036EC6692488AB60771AE7B3290CF" commented="no"><enum>(c)</enum><header>Deposit of funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and requiring the consent of China, the President may deposit all or some of the assets frozen pursuant to subsection (a) into the compensation fund established under section 6(a).</text></subsection></section>
<section id="HF6B20305F6B140BB9A96D8D7D3B5ADC0" commented="no"><enum>9.</enum><header>Encouraging developing nations to seek compensation from China</header>
<subsection id="HE8B2DD089E1448278CDD72D8EB9DE59B" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not earlier than 60 days after the date that the Secretary of State enters into negotiations with China concerning a bilateral agreement on compensation pursuant to section 7, if China did not enter into, or abide by, a contract or agreement relating to such negotiations, the Secretary of State shall submit to the appropriate congressional committees a report described in subsection (b). </text></subsection> <subsection id="H42219BD1DE6243CAA46DB309EF0FEFE5" commented="no"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The report described in this subsection shall include information concerning strategies to encourage and support developing countries that are facing a severe health and economic crisis due to China’s actions during the spread of the virus responsible for COVID–19 and indebted to China to freeze, repossess, and seize Chinese assets and holdings in each such country, renege on loans or debt, and expropriate ports in order to fund response efforts to the spread of the virus responsible for COVID–19 if China does not provide compensation to such developing countries.</text></subsection>
<subsection id="H7DC8BC70861E436EA29C699585D8C166" commented="no"><enum>(c)</enum><header>Definitions</header><text>In this section: </text> <paragraph id="HFF2143DD22F043269B2FBC72220F608D" commented="no"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text>
<subparagraph id="H211728D3B31D4EDE8E352439D4CFC922" commented="no"><enum>(A)</enum><text>the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph> <subparagraph id="H13BA201B781343C2BE726519A587983E" commented="no"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph>
<paragraph id="HBEB42FFB66AD479BB566504622A94EE4"><enum>(2)</enum><header>Chinese assets and holdings</header><text display-inline="yes-display-inline">The term <term>Chinese assets and holdings</term> means the following entities in a developing country—</text> <subparagraph id="H2C6C7F295F7D4E68899D653CB246B6B3"><enum>(A)</enum><text>Chinese state-owned entities;</text></subparagraph>
<subparagraph id="HFB66E1CE40024312BE3592618CC8C733"><enum>(B)</enum><text display-inline="yes-display-inline">Chinese entities financed, directed, or controlled by China or the Chinese Communist Party; or </text></subparagraph> <subparagraph id="HB52F09257E2943B6953B1FFF47AFF96C"><enum>(C)</enum><text display-inline="yes-display-inline">entities organized under the laws of a developing country that are financed, directed, or controlled by China or the Chinese Communist Party.</text></subparagraph></paragraph></subsection></section>
<section id="H447D92CA2CDE45EBA185C4D7CD580045" commented="no"><enum>10.</enum><header>Suspension of requests made by Chinese entities to acquire United States entities under certain circumstances</header>
<subsection id="H69CFF4A853D8445CB5CA2EF93E8DF991" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not earlier than 60 days after the date that the Secretary of State enters into negotiations with China concerning a bilateral agreement on compensation pursuant to section 7, the President shall suspend review of requests made by a Chinese entity to acquire a United States entity to the Committee on Foreign Investment in the United States.</text></subsection> <subsection id="H2E851972F60A4A72AF15DFB18A7FC2B1" commented="no"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Subsection (a) shall only apply if China did not enter into, or abide by, a contract or agreement relating to such negotiations pursuant to section 7, and such suspension shall be lifted if such contract or agreement is established.</text></subsection></section>
<section id="HA2E969BF68F44C5FACCC75B952F64D2B"><enum>11.</enum><header>Prohibition on procurement of certain products from a covered foreign entity, including products intended to be included in the Strategic National Stockpile</header>
<subsection id="H72D4DDE5E4C94A78A0062A7EA74A1D54"><enum>(a)</enum><header>Prohibition on use of Federal funds for foreign procurement</header><text display-inline="yes-display-inline">No Federal funds may be used to procure by contract, subcontract, grant, cooperative agreement, or otherwise any product sourced, manufactured, or assembled in whole or in part by a covered foreign entity that poses a supply chain risk to the national security of the United States, including products identified in the report required under subsection (b).</text></subsection> <subsection id="HC0FC459609764D48A2ADC4CABFE75C60"><enum>(b)</enum><header>Report</header> <paragraph id="HFB3344175593422CBB0CE01CDC241949"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a report concerning supply chain risks and vulnerabilities posed by a covered foreign entity to the national security, including health security, of the United States, and methods to mitigate such risks and vulnerabilities.</text></paragraph>
<paragraph id="H4D4BBAFA34804CCFA57FC72D87C9E666"><enum>(2)</enum><header>Matters Included</header><text display-inline="yes-display-inline">The report required under paragraph (1) shall include information relating to such business sectors:</text> <subparagraph id="HF189EFA291AF498D9A22CCF366C4BBBB"><enum>(A)</enum><text>Pharmaceutical.</text></subparagraph>
<subparagraph id="H4A6E7DFCAFAA4F30AEEDEA4939DF4948"><enum>(B)</enum><text>Medical.</text></subparagraph> <subparagraph id="H86FCEF851F7E44CC8D5C95FE89E1B6FF"><enum>(C)</enum><text>Rare earth material.</text></subparagraph>
<subparagraph id="H3D18CDD12DF04812A54887E19CB2F107"><enum>(D)</enum><text>Cybersecurity.</text></subparagraph> <subparagraph id="H0178C5062E284FB4926671635517DB17"><enum>(E)</enum><text>Information security.</text></subparagraph>
<subparagraph id="HAB34B93E20D14E45838E79A01E9B8294"><enum>(F)</enum><text>Communication technology, including fifth generation technology.</text></subparagraph> <subparagraph id="H04C198537B43453D8A458E83AA9FF869"><enum>(G)</enum><text>Electronics.</text></subparagraph></paragraph></subsection>
<subsection id="H438434E8CDBE40AA9E6EB56433FBD07B"><enum>(c)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the prohibitions under this section with respect to a product if the President determines and reports to the appropriate congressional committees that such waiver is in the national security interests of the United States.</text></subsection> <subsection id="H9B8A235220024E8F9C3AA4917FB36A5A"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">The President may terminate the prohibition with respect to a product if the President determines and reports to the appropriate congressional committees not less than 15 days before such termination takes effect that China—</text>
<paragraph id="H01A240519C2F4C12829B4E366324C3D0" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">acknowledges intentionally distorting and concealing information concerning the spread of the virus responsible for COVID–19; and</text></paragraph> <paragraph id="HC0C2349277A34E9C9A453E68EE167DE4" commented="no"><enum>(2)</enum><text>provides compensation to the United States for actions described in paragraph (1), which caused—</text>
<subparagraph id="H02E6443104354AD9839E15461F507765" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">avoidable loss of life, health, or property of citizens of the United States; and</text></subparagraph> <subparagraph id="H91CF1495668C4187A112742B0902C299" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">damage to the national economy of the United States.</text></subparagraph></paragraph></subsection>
<subsection id="HC81059C5E6B647208F6D70DCC54345DF"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H3617BD952AD544EC89BB2C559297608A"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text>

<subparagraph id="HE623740704AD44E7896DF0DEE2EAB1BA"><enum>(C)</enum><text>the Committee on Homeland Security of the House of Representatives;</text></subparagraph> <subparagraph id="H0DA9C8CD1E4D4E03A377DF65250EA415"><enum>(D)</enum><text>the Committee on Armed Services of the House of Representatives;</text></subparagraph>
<subparagraph id="H4619E5CF4FB24B5BA0353045E511C31A"><enum>(E)</enum><text>the Committee on Veterans’ Affairs of the House of Representatives;</text></subparagraph> <subparagraph id="H373B17EE37D441F09B2472C66DE747EE"><enum>(F)</enum><text>the Committee on Ways and Means of the House of Representatives;</text></subparagraph>
<subparagraph id="HF933B90839444D2EA9E55C11667891BF"><enum>(G)</enum><text>the Committee on Foreign Relations of the Senate;</text></subparagraph> <subparagraph id="H6E6FFBC7FB9144E18A2F52F375A69135"><enum>(H)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate; </text></subparagraph>
<subparagraph id="HF6CFF0DF47D649A3943F94A5927C7939"><enum>(I)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph> <subparagraph id="H4757FE3EC23E40B8A0DB2469B828E61D"><enum>(J)</enum><text>the Committee on Armed Services of the Senate; and</text></subparagraph>
<subparagraph id="H2C2AA7286FEB4556A3EC1D2E72C48F7E"><enum>(K)</enum><text>the Committee on Veterans’ Affairs of the Senate.</text></subparagraph></paragraph> <paragraph id="H8BE789FFD9B14D3BA14029470A0266EC"><enum>(2)</enum><header>Covered foreign entity</header><text display-inline="yes-display-inline">The term <term>covered foreign entity</term> means any entity domiciled in China or subject to influence or control by China or the Communist Party of China, as determined by the Secretary of State.</text></paragraph></subsection></section>
<section id="H14017D9878F64B0FB1E7F26045D09951" commented="no"><enum>12.</enum><header>Report on integrity of the United States supply chain</header>
<subsection id="H3996B1A1BBD1443685916328EFAAED30" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Commerce shall submit to the appropriate congressional committees a report concerning strategies to incentivize, require, or compensate United States persons for relocating or repatriating United States business activities and assets from China to the United States. </text></subsection> <subsection id="HC206390F91544CF8880687FDC1008687" commented="no"><enum>(b)</enum><header>Matters included</header><text>The report required under subsection (a) shall include information relating to the following business sectors:</text>
<paragraph id="HB97920BA38E6481AA3A68BCBB54A5D86" commented="no"><enum>(1)</enum><text>Pharmaceutical.</text></paragraph> <paragraph id="H507ABA60C09544BD84D64B520612D930" commented="no"><enum>(2)</enum><text>Medical.</text></paragraph>
<paragraph id="H4F1ABC72D4C5407EA5EB1DC18E571A51" commented="no"><enum>(3)</enum><text>Electronics.</text></paragraph> <paragraph id="H616A4D89F9414E25AB753971B67F5481" commented="no"><enum>(4)</enum><text>Information and communications technology.</text></paragraph>
<paragraph id="HAB6DAE16ABDC4941B57F387521BB4A51" commented="no"><enum>(5)</enum><text>Science. </text></paragraph> <paragraph id="H1963F8CAE8E34F419D08B412B307DFA5" commented="no"><enum>(6)</enum><text>Defense industries.</text></paragraph></subsection>

<paragraph id="HF88F06D7B074463490637C5B7498E921" commented="no"><enum>(2)</enum><header>Person</header><text>The term <term>person</term> means—</text> <subparagraph id="H469EADC8D8AC48FDB878739A963A91B4" commented="no"><enum>(A)</enum><text>a natural person;</text></subparagraph>
<subparagraph id="H4A44CE6696AE44B6A17900D3A3D0C547" commented="no"><enum>(B)</enum><text>a corporation, business association, partnership, society, trust, financial institution, insurer, underwriter, guarantor, and any other business organization, any other nongovernmental entity, organization, or group, or any government or agency thereof; and</text></subparagraph> <subparagraph id="H2726BF92434341ACBCCF8B4D710423B0" commented="no"><enum>(C)</enum><text>any successor to any entity described in subparagraph (B).</text></subparagraph></paragraph>
<paragraph id="H5B29EB30676744A295724F04BB832825" commented="no"><enum>(3)</enum><header>United States person</header><text>The term <term>United States person</term> means—</text> <subparagraph id="H8C472A9C5EA94B2F9704AD523426C2EB" commented="no"><enum>(A)</enum><text>any individual who is a citizen or national of the United States or who is an individual described in subparagraph (B) of section 274B(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324b">8 U.S.C. 1324b(a)(3)</external-xref>); or</text></subparagraph>
<subparagraph id="HC3C8DDDADA864FD091F7C7B66C04DC3C" commented="no"><enum>(B)</enum><text>a corporation or other legal entity which is organized under the laws of the United States, any State or territory thereof, or the District of Columbia.</text></subparagraph></paragraph></subsection></section> <section id="H1C440A95939140B1B0DDDB2DEFD91F35" commented="no"><enum>13.</enum><header>Restriction on Federal funds to propose, finalize, implement, or enforce any rule that reconsiders or amends certain Bureau of Industry and Security rules</header><text display-inline="no-display-inline">No Federal funds may be used to propose, finalize, implement, or enforce any rule that reconsiders or amends Bureau of Industry and Security’s—</text>
<paragraph id="HECFE435FB1724D5C81CFDA8E58105D60" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">rule dated April 28, 2020, and titled, <quote>Elimination of License Exception Civil End Users (CIV)</quote> (85 Fed. Reg. 23470); or </text></paragraph> <paragraph id="HCD82635165394BA8A10426481D2AC200" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">rule dated April 28, 2020, and titled, <quote>Expansion of Export, Reexport, and Transfer (in-Country) Controls for Military End Use or Military End Users in the People’s Republic of China, Russia, or Venezuela</quote> (85 Fed. Reg. 23459).</text></paragraph></section>
<section id="HB15EC84FD31D4F5B863AE45A46F1DBB8" commented="no"><enum>14.</enum><header>Authorization of sanctions</header>
<subsection id="HC00130DAC5F5466EBF143B1EE2F7B5F6" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall impose the sanctions described in subsection (b) with respect to a foreign person the President determines, based on credible evidence, is one of the following:</text> <paragraph id="H7D1EBF87C86C4213A6808CEA9263A7B9" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">A government official, or a senior associate of such an official, of China.</text></paragraph>
<paragraph id="HF869C4D54F9C4E09A1C8E3AEB7794E35" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A Chinese manufacturer or supplier, or a corporate officer of, or a principal shareholder with controlling interests in, such a manufacturer or supplier, in the following industries:</text> <subparagraph id="H001E11A5FD414237B2EE01AA1C1D7651" commented="no"><enum>(A)</enum><text>Artificial intelligence.</text></subparagraph>
<subparagraph id="H2B678CE8797541AA9FFD83C75C2F3359" commented="no"><enum>(B)</enum><text>Genetic engineering technologies.</text></subparagraph> <subparagraph id="HF9461DB68929447C94B472B2161E1736" commented="no"><enum>(C)</enum><text>Semiconductors.</text></subparagraph>
<subparagraph id="H5CC5A2A82EBC4EB39407F7F7C3B32EEA" commented="no"><enum>(D)</enum><text>Lithium battery manufacturing.</text></subparagraph> <subparagraph id="HD1708B45B8ED459EAA154ADEBB1A84D9" commented="no"><enum>(E)</enum><text>High-capacity computing.</text></subparagraph>
<subparagraph id="HC874F69064324372A285DA882B96CC04" commented="no"><enum>(F)</enum><text>Quantum computing.</text></subparagraph> <subparagraph id="HD230B5A5B95C4866AB6C0BFED4DFEB5F" commented="no"><enum>(G)</enum><text>Medical equipment.</text></subparagraph>
<subparagraph id="H31234CEA69184E7B82AB6B6ED9D58027" commented="no"><enum>(H)</enum><text>Pharmaceuticals.</text></subparagraph> <subparagraph id="H6A8F3A337035469FAC8F99BB5E702916" commented="no"><enum>(I)</enum><text>Robotics.</text></subparagraph>
<subparagraph id="HB8690E906DD840D58F48B32D9D025A6F" commented="no"><enum>(J)</enum><text>Biotechnology.</text></subparagraph></paragraph> <paragraph id="HD80A0BAE8CCC4AC098BA36E7637744AC" commented="no"><enum>(3)</enum><text>An individual, corporate officer, or principal shareholder with controlling interests in a medical equipment supplier or pharmaceutical manufacturer entity that profited from the global response to the spread of the virus responsible for COVID–19.</text></paragraph>
<paragraph id="H4C6386AE97CA4725B582C6028CEA934F" commented="no"><enum>(4)</enum><text>A citizen of China who the President determines to—</text> <subparagraph id="H9840411D398943418DA968738FAC9CC5" commented="no"><enum>(A)</enum><text>be responsible for or complicit in, or to have engaged in, the misappropriation, receipt, or use of intellectual property stolen from United States persons if that misappropriation, receipt, or use is reasonably likely to result in, or has materially contributed to, a significant threat to the national security, foreign policy, or economy of the United States;</text></subparagraph>
<subparagraph id="HD330A0B60D034DA385CDE420E73295E4" commented="no"><enum>(B)</enum><text>have materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of—</text> <clause id="H196F4870BE6848ABA8DE7F1AB23BD3CE" commented="no"><enum>(i)</enum><text>any activity described in subparagraph (A); or</text></clause>
<clause id="H1B6FCB94E4B5473CA65FF11A21D91926" commented="no"><enum>(ii)</enum><text>any person the property and interests in property of which are blocked pursuant to subsection (b)(1);</text></clause></subparagraph> <subparagraph id="HE8D6ED4DBA324FCE8BB6BAB965168047" commented="no"><enum>(C)</enum><text>be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, any person the property and interests in property of which are blocked pursuant to subsection (b)(1);</text></subparagraph>
<subparagraph id="H18F7FB46A023476B8D51F6DA556B3FD9" commented="no"><enum>(D)</enum><text>have attempted to engage in any of the activity described in subparagraph (A), (B), or (C); or</text></subparagraph> <subparagraph id="H59949427AFB54BAD993E3AE36D069DDD" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">be a corporate officer of, or a principal shareholder with controlling interests in, an entity described in any of subparagraph (A), (B), (C), or (D). </text></subparagraph></paragraph>
<paragraph id="HFA88667FB42C4150B911C1E5AAD0D6AD" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">A Chinese state-owned entity or a Chinese entity financed, directed, or controlled by the Government of China or the Chinese Communist Party, that the President determines to, on or after the date of the enactment of this Act—</text> <subparagraph id="HDB40A62F7CE24C9DAF2B26CD6BBDF3C5" commented="no"><enum>(A)</enum><text>be responsible for or complicit in, or to have engaged in, censorship, surveillance, or any other similar or related activity through means of telecommunications, including the internet;</text></subparagraph>
<subparagraph id="H930CCA71A5E04641B9279C61F9D72BB2" commented="no"><enum>(B)</enum><text>have materially assisted, sponsored, or provided financial, material, or technological support for, or goods or services to or in support of—</text> <clause id="H5278D5FFE9364E00A4FA0CB7B5C5EB71" commented="no"><enum>(i)</enum><text>any activity described in subparagraph (A); or</text></clause>
<clause id="HB042904E7BDF4C91AE5B5E3F778730B2" commented="no"><enum>(ii)</enum><text>any person the property and interests in property of which are blocked pursuant to subsection (b)(1);</text></clause></subparagraph> <subparagraph id="H33BF093962BE4C13B675983A31BBAD92" commented="no"><enum>(C)</enum><text>be owned or controlled by, or to have acted or purported to act for or on behalf of, directly or indirectly, any person the property and interests in property of which are blocked pursuant to subsection (b)(1);</text></subparagraph>
<subparagraph id="HC6EA9BC5272B4B468A4B92EBF4C24449" commented="no"><enum>(D)</enum><text> have attempted to engage in any of the activity described in subparagraph (A), (B), or (C); or</text></subparagraph> <subparagraph id="H0550D5421CC14048B7F6E30C6D17533F" commented="no"><enum>(E)</enum><text>be a corporate officer of, or a principal shareholder with controlling interests in, an entity described in any of subparagraph (A), (B), (C), or (D).</text></subparagraph></paragraph></subsection>
<subsection id="HF298A1EB816C46C788A5CD8750E6780B" commented="no"><enum>(b)</enum><header>Sanctions described</header><text>The sanctions described in this subsection are the following:</text> <paragraph id="H7E71120F558A46D6B41D7DC2A185AA57" commented="no"><enum>(1)</enum><header>Asset blocking</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of a foreign person identified in the report required under subsection (a) if such property and interests in property are in the United States, come within the United States, or come within the possession or control of a United States person.</text></paragraph>
<paragraph id="H2B1FDBC009CC48128F066AC7DD8793F9" commented="no"><enum>(2)</enum><header>Ineligibility for visas, admission, or parole</header>
<subparagraph id="HD529EEF0D2FD4DE6B1532BBED22A9647" commented="no"><enum>(A)</enum><header>Visas, admission, or parole</header><text display-inline="yes-display-inline">A foreign person described in subsection (a) and his or her immediate family members is—</text> <clause id="H21FE5667F03A4A9EA4C5CD28B2C5E566" commented="no"><enum>(i)</enum><text>inadmissible to the United States;</text></clause>
<clause id="H93A185846EF44B539E6B3DADB3228634" commented="no"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause> <clause id="HDD7AE7F7995D4607B4F98AC037BC4623" commented="no"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph>
<subparagraph id="HBA701B1AD2A24D4090AE820590198395" commented="no"><enum>(B)</enum><header>Current visa revoked</header>
<clause id="H36D8A3A4AE1D4C7886657561EC3F30FD" commented="no"><enum>(i)</enum><header>In general</header><text>A foreign person described in subsection (a) is subject to revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued.</text></clause> <clause id="H76F52D6BA7354F1AA0C5E41D1E6774A5" commented="no"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall—</text>
<subclause id="HDF46DC9D66D04C309EFA8F1EEB83988F" commented="no"><enum>(I)</enum><text>take effect immediately; and</text></subclause> <subclause id="H6771BEAF7FB149258AFE8A3A37A99E7B" commented="no"><enum>(II)</enum><text>automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text></subclause></clause></subparagraph>
<subparagraph id="H433D699EA62A402D879B489AB00B30B7" commented="no"><enum>(C)</enum><header>Exception to comply with international obligations</header><text>Sanctions under this paragraph shall not apply with respect to a foreign person if admitting or paroling such person into the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations.</text></subparagraph></paragraph></subsection> <subsection id="HC83D10B7400D4FE5A633C86E280E6A2C" commented="no"><enum>(c)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section.</text></subsection>
<subsection id="H67BC8493CDB5497690B3BF73546915DE" commented="no"><enum>(d)</enum><header>Waiver</header><text>The President may waive the application of sanctions under this section with respect to a foreign person identified in the report required under subsection (a) if the President determines and certifies to the appropriate congressional committees that such a waiver is in the national interest of the United States.</text></subsection> <subsection id="HF9E5621925C7475E87AC29B7253D2EF5" commented="no"><enum>(e)</enum><header>Termination of sanctions</header><text display-inline="yes-display-inline">The President may terminate the application of sanctions under this section with respect to a foreign person if the President determines and reports to the appropriate congressional committees not less than 15 days before such termination takes effect that China—</text>
<paragraph id="HF9FE5DAA023045BCB41D8DAEB1E597EF" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">acknowledges intentionally distorting and concealing information concerning the spread of the virus responsible for COVID–19; and</text></paragraph> <paragraph id="H22848D796C4242199987DB8DA6EC1E62" commented="no"><enum>(2)</enum><text>provides compensation to the United States for such actions described in paragraph (1), which caused an avoidable injury to—</text>
<subparagraph id="H97863800C99045798DAB3B218D696430" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the life, health, and property of the citizens of the United States; and</text></subparagraph> <subparagraph id="HF382344E6C5E42F6950FC0992E4CFCF1" commented="no"><enum>(B)</enum><text>the national economy of the United States.</text></subparagraph></paragraph></subsection>
<subsection id="H5195BD1BB597428ABCDBC8FC8FA3439F" commented="no"><enum>(f)</enum><header>Exception relating to the importation of goods</header>
<paragraph id="H730A4111CF8C4306A63701F261854716" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The authorities and requirements to impose sanctions under this section shall not include the authority or requirement to impose sanctions on the importation of goods.</text></paragraph> <paragraph id="H41897C2B628946EFB2ADAD5E4A850036" commented="no"><enum>(2)</enum><header>Good defined</header><text display-inline="yes-display-inline">In this subsection, the term “good” means any article, natural or man-made substance, material, supply or manufactured product, including inspection and test equipment, and excluding technical data.</text></paragraph></subsection>
<subsection id="HF039E149DAE746CA830B461EEC5B2543" commented="no"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HA205398451E94C5C80F849477FA3DA3C" commented="no"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text>
<subparagraph id="H45B7B9EC28D6420384A324F95F6499FB" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph> <subparagraph id="HDC1CCBBCEB524459A1EE2A84391B6280" commented="no"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph>
<paragraph id="HCEAB51C7ADB647DD880F3ACBA8984991" commented="no"><enum>(2)</enum><header>Foreign person</header><text display-inline="yes-display-inline">The term <term>foreign person</term> means—</text> <subparagraph id="HFA7B929EFD6940848131FCFF3CB849C5" commented="no"><enum>(A)</enum><text>an individual who is not a citizen of the United States or an alien admitted for permanent residence to the United States; or</text></subparagraph>
<subparagraph id="HE58850DFFE184A1482EF640C3A0E89CF" commented="no"><enum>(B)</enum><text>a corporation, partnership, or other entity which is created or organized under the laws of a foreign country or which has its principal place of business outside the United States.</text></subparagraph></paragraph></subsection></section> <section id="HB3446F6E6716463390D4A0B41C04AD59" commented="no"><enum>15.</enum><header>Export controls on certain telecommunication equipment</header> <subsection id="HD72BA473144A45A4887D563E95D32F91" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1754 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813</external-xref>) is amended by adding at the end the following: </text>
<quoted-block style="OLC" id="H28F6962EE0C54EB1A2B7419CFF66AE1E" display-inline="no-display-inline">
<subsection id="H4EF2A55EB5D84A109FCB06E9BABE6819" commented="no"><enum>(g)</enum><header>Certain telecommunications equipment</header>
<paragraph id="H052A46C24FB24125BF2FCD574A6A9D2C" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of State, the Secretary of Defense, and the heads of other appropriate Federal departments and agencies, shall establish and maintain a list of goods and technology that would serve the primary purpose of assisting, or be specifically configured to assist, the People’s Republic of China in acquiring the capability to carry out censorship, surveillance, or any other similar or related activity through means of telecommunications, including the internet, the prohibition or licensing of which would be effective in barring acquisition or enhancement of such capability.</text></paragraph> <paragraph id="H9A853F2301D14675B8EC3FC68CD3F77C" commented="no"><enum>(2)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall prohibit the export of goods or technology on the list established under paragraph (1) to Chinese state-owned entities or Chinese entities financed, directed, or controlled by the People’s Republic of China or the Chinese Communist Party.</text></paragraph>
<paragraph id="H4A62C56AD90F44C2AB684935A5A79E48" commented="no"><enum>(3)</enum><header>Waiver</header><text display-inline="yes-display-inline">The President may waive the application of paragraph (2) with respect to export of goods or technology on the list established under paragraph (1) on a case-by-case basis if the President determines and certifies to Congress that it is in the national interests of the United States to do so.</text></paragraph> <paragraph id="HAD393C797CD34F048D4D393E77B83A86" commented="no"><enum>(4)</enum><header>Definitions</header><text>In this subsection, the term <term>Internet</term> has the meaning given the term in section 231(e)(3) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(3)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H468635F16CBC4804B7EDA463FCD1EF02" commented="no"><enum>(b)</enum><header>Regulations</header>
<paragraph id="HF6DB39961BFF4879A86C909BE649CF44" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the President shall revise the Export Administration Regulations and any other regulations necessary to carry out the amendment made by subsection (a).</text></paragraph> <paragraph id="HACD88802158D439A8778D7E8A15573CE" commented="no"><enum>(2)</enum><header>Export administration regulations defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>Export Administration Regulations</term> means the Export Administration Regulations as maintained and amended under the authority of the International Emergency Economic Powers Act and codified, as of the date of the enactment of this Act, in subchapter C of chapter VII of title 15, Code of Federal Regulations.</text></paragraph></subsection>
<subsection id="H2F522BCCDB1E4978934AA50EEF813F37" commented="no"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">Section 1754(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(g)</external-xref>), as added by subsection (a), shall take effect on the date of the enactment of this Act.</text></subsection></section> <section id="H0C8247FE018D45C7B0C71C360D754801" commented="no"><enum>16.</enum><header>Visa ban on researchers affiliated with the PLA</header> <subsection id="H11364142CF1E4C19955C4A267926D1C8" commented="no"><enum>(a)</enum><header>Identification of PLA-Supported Institutions</header> <paragraph id="H396221D45BAE488DB354F8A62400A009" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall publish a list identifying the research, engineering, and scientific institutions that the Secretary of Homeland Security determines are affiliated with, or funded by, the Chinese People’s Liberation Army.</text></paragraph>
<paragraph id="H5E67DE52E56F40DCB63D0F2A2857ABCC" commented="no"><enum>(2)</enum><header>Form</header><text>The list published under paragraph (1) shall be unclassified and publicly accessible, but may include a classified annex.</text></paragraph></subsection> <subsection id="H81BAA91A6C22411FA8482DA9287F6C91" commented="no"><enum>(b)</enum><header>Exclusion from United States</header><text>Except as provided in subsections (d) and (e), the Secretary of State may not issue a visa under subparagraph (F) or (J) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>), and the Secretary of Homeland Security may not admit, parole into the United States, or otherwise provide nonimmigrant status under such subparagraphs, to any alien who is, or has previously been, employed, sponsored, or funded by any entity identified on the most recently published list under subsection (a).</text></subsection>
<subsection id="H92048B2BA20F48BB9F5FB28462225B08" commented="no"><enum>(c)</enum><header>Inquiry</header><text>Before issuing a visa described in subsection (b) to a national of China, the Secretary of State, the Secretary of Homeland Security, a consular officer, or a U.S. Customs and Border Protection officer shall ask the alien seeking such visa if the alien is, or has previously been, employed, funded, or otherwise sponsored by the Chinese People’s Liberation Army or any of the affiliated institutions identified on the most recently published list under subsection (a).</text></subsection> <subsection id="HE635E003DC6B401982809B12264C6432" commented="no"><enum>(d)</enum><header>Exception To Comply With United Nations Headquarters Agreement</header><text>Subsection (b) shall not apply to an individual if admitting the individual to the United States is necessary to permit the United States to comply with the Agreement between the United Nations and the United States of America regarding the Headquarters of the United Nations, signed June 26, 1947, and entered into force November 21, 1947, and other applicable international obligations.</text></subsection>
<subsection id="H9A9FE1F9AF7A4C898B3336D0AF6A7A9B" commented="no"><enum>(e)</enum><header>National Security Waiver</header><text>The President, or a designee of the President, may waive subsection (b) if the President or such designee certifies in writing to the appropriate congressional committees that such waiver is in the national security interest of the United States.</text></subsection></section> <section id="H3965B9B55512456199C3457838B4452D" commented="no"><enum>17.</enum><header>Prohibition on investment of TSP I fund in China</header> <subsection id="HE8BBAB69823F4809B5AEF5F7DB5244C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8438(b)(4) of title 5, United States Code, is amended by adding at the end the following:</text>
<quoted-block style="OLC" id="H5A9F258587384147B8A5897BFF13DFB9" display-inline="no-display-inline">
<subparagraph id="HD8D2524954AB44358267726C790E2718"><enum>(C)</enum><text display-inline="yes-display-inline">The index selected by the Board under subparagraph (A) may not include investments in any stock of an entity based in the People’s Republic of China.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HAE2F56A241E44D62AD24AA7971493ECF"><enum>(b)</enum><header>Divestiture of assets</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Federal Retirement Thrift Investment Board (as established under section 8472(a) of title 5, United States Code), in consultation with the manager of the Thrift Savings Fund, shall—</text>
<paragraph id="H747FB22AD7B44846AA6B80E1B2ED6608"><enum>(1)</enum><text>review whether any sums in the Thrift Savings Fund are invested in contravention of subparagraph (C) of section 8438(b)(4) of such title, as added by subsection (a);</text></paragraph> <paragraph id="H3F116EF565E6401E997968C39666C72E"><enum>(2)</enum><text>if any sums are so invested, and consistent with the legal and fiduciary duties provided under chapter 84 of such title or any other provision of law, divest such sums; and</text></paragraph>
<paragraph id="HB7D12781EB0347B2A376BAAD7CB3947F"><enum>(3)</enum><text>re-invest the divested sums in investments that do not contradict such subparagraph.</text></paragraph></subsection></section> <section id="H4681A4D611E94C759D5C812433FB6F06" commented="no"><enum>18.</enum><header>Protecting pharmaceutical access for Americans</header> <subsection id="H389723A170234F459BA9042A8F760DB0" commented="no"><enum>(a)</enum><header>List of critical drugs produced exclusively in China</header> <paragraph id="HE85FD4A04DFA46D9B9D9918A0E65753C" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Commissioner of Food and Drugs shall submit to the Congress a list of all critical drugs and critical active pharmaceutical ingredients—</text>
<subparagraph id="H196FBEF0A46444618EB48972DE44BF86"><enum>(A)</enum><text>that are produced in China; and</text></subparagraph> <subparagraph id="H59C225B8D20D40A192D9BADE2C0A939A"><enum>(B)</enum><text display-inline="yes-display-inline">the supply of which would be disrupted for United States consumers if such production were discontinued or interrupted.</text></subparagraph></paragraph>
<paragraph id="H270C92E5D23D4A7C96C43806F5CD6E5C" commented="no"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HD8DEE58BACA34EBE8EC620ED42A31529" commented="no"><enum>(A)</enum><text>The term <term>critical active pharmaceutical ingredient</term> means an active pharmaceutical ingredient in a critical drug.</text></subparagraph>
<subparagraph id="H4A0AD446C00E4CEE9DDD2B8DCFE97D03" commented="no"><enum>(B)</enum><text>The term <term>critical drug</term> means a product that—</text> <clause id="H57E0E9CBFD564C08B5B0A107D75F24CE" commented="no"><enum>(i)</enum><text>is a drug (as defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>)) for which the approval of an application submitted under subsection (b) or (j) of section 505 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) or subsection (a) or (k) of section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/352">42 U.S.C. 352</external-xref>) remains in effect; and</text></clause>
<clause id="H4C1A0901DCBC4BC79BC18AF6F323424D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">is deemed by the Commissioner of Food and Drugs to be critical to the health and safety of United States consumers.</text></clause></subparagraph> <subparagraph id="H19AD09209E5B44B685AA3E8BA04E60E2" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>produce</term> means manufactured, prepared, propagated, compounded, or processed, in whole or in part.</text></subparagraph></paragraph></subsection>
<subsection id="HAD2552C5A7274679ABF26AF9E800C77A" commented="no"><enum>(b)</enum><header>Certification concerning Chinese pharmaceutical regulation</header>
<paragraph id="HE12F1603E63E44C684232EA9D3A27976" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Commissioner of Food and Drugs (in this subsection referred to as the <quote>Commissioner</quote>) shall certify to the Congress whether the Chinese pharmaceutical industry is being regulated for safety (including regulation of such industry by Chinese authorities and the Food and Drug Administration) to substantially the same degree as the United States pharmaceutical industry.</text></paragraph> <paragraph id="H02465BEC442F4B54A9CD5695F0ECCB71" commented="no"><enum>(2)</enum><header>Investigations</header><text display-inline="yes-display-inline">The Commissioner—</text>
<subparagraph id="HBB55B081350E40A0981403B4A36B9992" commented="no"><enum>(A)</enum><text>shall conduct such investigations as may be necessary to make the certification required by paragraph (1); and</text></subparagraph> <subparagraph id="H11A69CBF8E4C44C19AE012788DABDAFA" commented="no"><enum>(B)</enum><text>in conducting such investigations, may use unannounced inspections and demand all necessary onsite access.</text></subparagraph></paragraph>
<paragraph id="H0EE85703B8B4411489DF5EB31DFA2C06" commented="no"><enum>(3)</enum><header>Plan</header><text display-inline="yes-display-inline">If the Commissioner certifies pursuant to paragraph (1) that the Chinese pharmaceutical industry is not being regulated for safety to substantially the same degree as the United States pharmaceutical industry, the Commissioner shall, not later than 60 days after the Commissioner submits the certification required by paragraph (1), submit a plan to the Congress to protect United States consumers from unsafe Chinese drugs.</text></paragraph></subsection> <subsection id="H3CB353EA43A1402D836556C543E47888"><enum>(c)</enum><header>Purchasing plan</header> <paragraph id="H0CB3994920E644C9AB516C0F0F76B512"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense, in coordination with the Secretary of Health and Human Services and the Commissioner of Food and Drugs, shall submit to the Congress—</text>
<subparagraph id="HB4BB0A7EEAAF460EA2B8564C716E147E"><enum>(A)</enum><text>a plan to ensure that by 2024 no pharmaceutical products purchased for beneficiaries of health care from the Department of Defense or any associated program are made in part or in whole in China; and</text></subparagraph> <subparagraph id="HCC46FB3846EF40528CB131CB145D0C1C"><enum>(B)</enum><text>an assessment of the resilience and capacity of the current supply chain and industrial base to support national defense if no pharmaceutical products purchased for beneficiaries of health care from the Department of Defense or any associated program are made in part or in whole in China, including with respect to—</text>
<clause id="HAE8AA47802544C6D83EC6902BF148FF6"><enum>(i)</enum><text>the manufacturing capacity of the United States;</text></clause> <clause id="H09126FDF65084D9FA25053BF8685EC15"><enum>(ii)</enum><text>gaps in domestic manufacturing capabilities, including non-existent, extinct, threatened, and single-point-of-failure capabilities; and</text></clause>
<clause id="HCEA0D459DB1A4D26A35CAD0CD3E9F74B"><enum>(iii)</enum><text>supply chains with single points of failure and limited resiliency.</text></clause></subparagraph></paragraph> <paragraph id="H43D749B626D74081AFBC2CF1A3B24F06"><enum>(2)</enum><header>Required recommendations</header><text>The assessment under paragraph (1)(B) shall include recommendations—</text>
<subparagraph id="H29705A8C4A56459E9A9B3F8FFF19612F"><enum>(A)</enum><text>to address critical bottlenecks in the supply of pharmaceutical products in the United States; and</text></subparagraph> <subparagraph id="H26986DB4DD7D48439983B9103906A7FA"><enum>(B)</enum><text>to mitigate single points of failure and limited resilience of supply chains for pharmaceutical products in the United States.</text></subparagraph></paragraph></subsection></section>
<section id="H2C7E0E410CCD4701BFA38118FD0EBBA8" commented="no"><enum>19.</enum><header>Removal of China’s designation as a developing country in international bodies</header>
<subsection id="HF9BE2D34BE404AEE828DD9E0C332DCF2" commented="no"><enum>(a)</enum><header>Statement of policy</header><text display-inline="yes-display-inline">It is the policy of the United States to oppose efforts by China to use its self-declared status as a developing country to lessen its obligations under international agreements, dispute settlement proceedings, negotiations, rules, and regulations.</text></subsection> <subsection id="HE56E81A399AB4D629914394772A75B37" commented="no"><enum>(b)</enum><header>World Bank</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall instruct the United States Executive Director at the International Bank for Reconstruction and Development to pursue the removal of China from eligibility for assistance from the Bank.</text></subsection>
<subsection id="H087F537664B04D6E8639E974BBF74987" commented="no"><enum>(c)</enum><header>Designation of China as a developed country</header>
<paragraph id="H46333100DEB34DF69FFE837F4A61603C" display-inline="no-display-inline" commented="no"><enum>(1)</enum><header>United States trade law</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, China shall be treated as a developed country for the purposes of United States trade law.</text></paragraph> <paragraph id="H123BAF3CA3624696A08F0658EF95F145" commented="no"><enum>(2)</enum><header>WTO designation</header><text display-inline="yes-display-inline">The President shall direct the United States Trade Representative to use the voice, vote, and influence of the United States to secure changes at the World Trade Organization to—</text>
<subparagraph id="H837EF06ACA2B4E8EB24D248F28A6FE01" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">prevent China from receiving benefits under the rules and regulations of the World Trade Organization that are not justified by appropriate economic and other indicators; and </text></subparagraph> <subparagraph id="HC8D52F0528F64F0A936166AB7953C413" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">treat China as a developed country. </text></subparagraph></paragraph></subsection>
<subsection id="H13997306FA534C5FB7001FF8B126B6D2" commented="no"><enum>(d)</enum><header>United Nations classification system</header><text display-inline="yes-display-inline">The President shall direct the United States Permanent Representative to the United Nations to use the voice, vote, and influence of the United States—</text> <paragraph id="HA8493DD668AA46A39A3598758DB2A1BC" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">to revise the classification system of the United Nations Statistics Division necessary to ensure the classification of China reflects justifiable economic and other indicators; and </text></paragraph>
<paragraph id="HB4BEB7654ABD4BD08093C5656846395D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">to treat China as a developed country for purposes of the Standard Country or Area Codes for Statistical Use (Series M, No. 49).</text></paragraph></subsection></section> <section id="H4AF96471757149569AE6EC1DE67CD614" commented="no"><enum>20.</enum><header>Protecting America from cyberattacks</header> <subsection id="H437C27558E4248398255668D809FB9AD" commented="no"><enum>(a)</enum><header>Exemptions to the Computer Fraud and Abuse Act</header><text display-inline="yes-display-inline">Section 1030 of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="H95E0254FCB394D89A02C377ADC34ACA6" commented="no"><enum>(k)</enum><header>Exception for the use of attributional technology</header>
<paragraph id="HAA24285787EF470C9D68F612EA5FE291" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">This section shall not apply with respect to the use of attributional technology in regard to a defender who uses a program, code, or command for attributional purposes that beacons or returns locational or attributional data in response to a cyber intrusion in order to identify the source of an intrusion; if—</text> <subparagraph id="HABB9E9E48D554B04AE88E4C2BC167F35" commented="no"><enum>(A)</enum><text>the program, code, or command originated on the computer of the defender but is copied or removed by an unauthorized user; </text></subparagraph>
<subparagraph id="HB8A8089B249641E8A10A630A0E855F55" commented="no"><enum>(B)</enum><text>the program, code, or command does not result in the destruction of data or result in an impairment of the essential operating functionality of the attacker’s computer system, or intentionally create a backdoor enabling intrusive access into the attacker’s computer system; and</text></subparagraph> <subparagraph id="H60AD6FDE00B343359771F21F5C8B91E3" commented="no"><enum>(C)</enum><text>the defender believes the attacker is an agent or an affiliate of Chinese state commercial actors in the United States, other Chinese entities or individuals financed, directed, or controlled by the Chinese State, Government of China, or the Chinese Communist Party.</text></subparagraph></paragraph>
<paragraph id="H549E462A80CB41E39AC4878D83070384" commented="no"><enum>(2)</enum><header>Definition</header><text>The term <term>attributional data</term> means any digital information such as log files, text strings, time stamps, malware samples, identifiers such as user names and Internet Protocol addresses and metadata or other digital artifacts gathered through forensic analysis.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF644CF2F50B74AF5916AC6F257F6FCA5" commented="no"><enum>(b)</enum><header>Exclusion from prosecution for certain computer crimes for those taking active cyber defense measures</header><text>Section 1030 of title 18, United States Code, is amended by adding at the end the following: </text>

<subsection id="HEE8085A9ED1747D689BA06F87F4673A6" commented="no"><enum>(l)</enum><header>Active cyber defense measures not a violation</header>
<paragraph id="HDEB2AAF33D484E9EB95AA0F6673470CE" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It is a defense to a criminal prosecution under this section that the conduct constituting the offense was an active cyber defense measure if the defender believes the attacker was an agent or an affiliate of Chinese state commercial actors in the United States, other Chinese entities or individuals financed, directed, or controlled by the Chinese State, the Government of China, or the Chinese Communist Party.</text></paragraph> <paragraph id="HE22706EFF3614BE9B1320D59A13BC5ED" commented="no"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection—</text>
<subparagraph id="H01EF5172613C4ED382F816C979EAB5A8" commented="no"><enum>(A)</enum><text>the term <term>defender</term> means a person or an entity that is a victim of a persistent unauthorized intrusion of the individual entity’s computer;</text></subparagraph> <subparagraph id="HFD48045682AB49AF9EC9DDCF6F208381" commented="no"><enum>(B)</enum><text>the term <term>active cyber defense measure</term>—</text>
<clause id="H13396A9F043F406191AA3199CBE9B797" commented="no"><enum>(i)</enum><text>means any measure—</text> <subclause id="H4B52F370C1BC4852B9B032446D12896E" commented="no"><enum>(I)</enum><text>undertaken by, or at the direction of, a defender; and </text></subclause>
<subclause id="H61C55F3BFC934B348118C5002C7B32E7" commented="no"><enum>(II)</enum><text>consisting of accessing without authorization the computer of the attacker to the defender’s own network to gather information in order to—</text> <item id="HDC14BEC7156E45CEBE491DF651F0C7CB" commented="no"><enum>(aa)</enum><text>establish attribution of criminal activity to share with law enforcement and other United States Government agencies responsible for cybersecurity;</text></item>
<item id="H6EB3E0C771EF4E51A9E0E74123E377D8" commented="no"><enum>(bb)</enum><text>disrupt continued unauthorized activity against the defender’s own network; or</text></item> <item id="H2636F494ACE845FF9A46E8CFAD49E191" commented="no"><enum>(cc)</enum><text>monitor the behavior of an attacker to assist in developing future intrusion prevention or cyber defense techniques; but</text></item></subclause></clause>
<clause id="H3D08B0540D844C9294054DBBBF2CCE17" commented="no"><enum>(ii)</enum><text>does not include conduct that—</text> <subclause id="H3EA76F7DAE3B457CB3E2DC61964AF2F5" commented="no"><enum>(I)</enum><text>intentionally destroys or renders inoperable information that does not belong to the victim that is stored on another person or entity’s computer;</text></subclause>
<subclause id="H62BED74EE2EC498DA4D3412D581480EB" commented="no"><enum>(II)</enum><text>recklessly causes physical injury or financial loss as described under subsection (c)(4);</text></subclause> <subclause id="H738642A3B08D4885BD35E0F49D71487A" commented="no"><enum>(III)</enum><text>creates a threat to the public health or safety;</text></subclause>
<subclause id="H9FC0F6A179EF488EB46366D5DF23E9CD" commented="no"><enum>(IV)</enum><text>intentionally exceeds the level of activity required to perform reconnaissance on an intermediary computer to allow for attribution of the origin of the persistent cyber intrusion;</text></subclause> <subclause id="H4D002EAEBDBA4729AD7BEAE093A45D1F" commented="no"><enum>(V)</enum><text>intentionally results in intrusive or remote access into an intermediary’s computer;</text></subclause>
<subclause id="HF7E827C6C7D143489243484C83FF2323" commented="no"><enum>(VI)</enum><text>intentionally results in the persistent disruption to a person or entities internet connectivity resulting in damages defined under subsection (c)(4); or </text></subclause> <subclause id="H8A90E70C90A8419F9453694F6DEC5265" commented="no"><enum>(VII)</enum><text>impacts any computer described under subsection (a)(1) regarding access to national security information, subsection (a)(3) regarding government computers, or to subsection (c)(4)(A)(i)(V) regarding a computer system used by or for a Government entity for the furtherance of the administration of justice, national defense, or national security;</text></subclause></clause></subparagraph>
<subparagraph id="HCAF9C1A6AC5842A49D9CA728602389C4" commented="no"><enum>(C)</enum><text>the term <term>attacker</term> means a person or an entity that is the source of the persistent unauthorized intrusion into the victim’s computer; and </text></subparagraph> <subparagraph id="HCCEF8E49CFED4ACB823BEC684AAF5B57" commented="no"><enum>(D)</enum><text>the term <term>intermediary computer</term> means a person or entity’s computer that is not under the ownership or primary control of the attacker but has been used to launch or obscure the origin of the persistent cyber-attack.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HB21982C869DA46D0BD6E60A5BB4FB0B4" commented="no"><enum>(c)</enum><header>Notification requirement for the use of active cyber defense measures</header><text>Section 1030 of title 18, United States Code, is amended by adding the following: </text> <quoted-block style="OLC" id="HC6D94876B5864E9AA8A26591A217C72F" display-inline="no-display-inline"> <subsection id="H5E083CB9B2F34AC1A37156219F785569" commented="no"><enum>(m)</enum><header>Notification requirement for the use of active cyber defense measures</header> <paragraph id="HD969AE433695467EB3368C1B3D696707" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A defender who uses an active cyber defense measure under the preceding section must notify the FBI National Cyber Investigative Joint Task Force and either receive a response from the FBI acknowledging receipt of the notification or wait 48 hours prior to using the measure.</text></paragraph>
<paragraph id="H6B21393B64BA4E6E961E4671033FEAA7" commented="no"><enum>(2)</enum><header>Required notification</header><text display-inline="yes-display-inline">Notification must include the type of cyber breach that the person or entity was a victim of, the intended target of the active cyber defense measure, the steps the defender plans to take to preserve evidence of the attacker’s criminal cyber intrusion, as well as the steps they plan to prevent damage to intermediary computers not under the ownership of the attacker and other information requested by the FBI to assist with oversight.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body> </bill>
