R. 387</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="B001305">Mr. Budd</sponsor> (for himself and <cosponsor name-id="G000061">Mr. Garcia of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent doses of vaccines for COVID–19 from being wasted, and for other purposes.</official-title></form><legis-body id="H6A67164B3FDB4040B05DBEE045421AFE" style="OLC"><section id="H22ABC126EC7A413C9696583B6E598B18" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vaccinate More Americans Act of 2021</short-title></quote>.</text></section><section id="HE36291F80F6741E58D5BCC3773F9F656"><enum>2.</enum><header>Phased allocation inapplicable where it is reasonably necessary to prevent the expiration of any dose of vaccine for COVID–19</header><subsection id="HFC542C5544704F8FACABDB5F80BAF85B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Where it is reasonably necessary to prevent the expiration of any dose of vaccine for COVID–19 purchased from the Federal Government, a vaccine provider may—</text><paragraph id="H7A94B1155143434EA29F4E09AA2751C3"><enum>(1)</enum><text display-inline="yes-display-inline">disregard any phased allocation of such dose under applicable Federal, State, and local law; and</text></paragraph><paragraph id="H4F9AB66D63A042BA8DF0F271400F8A59"><enum>(2)</enum><text display-inline="yes-display-inline">administer such dose to an individual who is in the next phased allocation group under applicable Federal, State, and local law for which the vaccine provider can locate individuals available and willing to receive the dose.</text></paragraph></subsection><subsection id="HE08B280F03844CB2A014B1C28CECDC30"><enum>(b)</enum><header>Preemption</header><text>Subsection (a) preempts any State or local law to the contrary. </text></subsection><subsection id="H52022A7513BB4B0D853A61EBF30E91B3"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in subsection (a) shall be construed to override Federal, State, or local law other than with respect to the phased allocation of dosing.</text></subsection><subsection id="HF39855F61EB6406C82E0171372291505"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>phased allocation</term> means the prioritization of groups for the receipt of the vaccine for COVID–19 as determined by appropriate public health authorities.</text></subsection><subsection id="H03097E4A227F4F69B374AC8F6EC8FD41"><enum>(e)</enum><header>Sunset</header><text>Subsection (a) shall cease to apply at the end of the public health emergency declared for COVID–19 under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), including renewals thereof.</text></subsection></section></legis-body></bill>
