R. 3876</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210614">June 14, 2021</action-date><action-desc><sponsor name-id="N000191">Mr. Neguse</sponsor> (for himself, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, <cosponsor name-id="J000032">Ms. Jackson Lee</cosponsor>, <cosponsor name-id="C001121">Mr. Crow</cosponsor>, <cosponsor name-id="J000306">Mr. Jones</cosponsor>, and <cosponsor name-id="J000298">Ms. Jayapal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ban the use of ketamine during arrest and detention other than in a hospital, and for other purposes.</official-title></form><legis-body id="H2A95721B5B2C425EA688F1E6EEEB367B" style="OLC"><section id="H0CDEB43257AB4D6B9476987ED773345B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ketamine Restriction Act</short-title></quote>. </text></section><section id="H300C7AB812E24030B87ABCDD49FBB037"><enum>2.</enum><header>Ban on use of ketamine during arrest and detention for Federal offenses other than in a hospital</header><text display-inline="no-display-inline">Beginning not later than 120 days after the date of enactment of this Act, ketamine may not be administered to an individual during an arrest or detention for a Federal offense other than in a hospital for medical purposes. </text></section><section id="H1D02E37AAE0C4223B6169D26C6A1969A"><enum>3.</enum><header>Incentives for States and units of local government to ban use of ketamine other than in a hospital</header><text display-inline="no-display-inline">Beginning in the first fiscal year that begins after the date that is one year after the date of enactment of this Act, a State or unit of local government may not receive funds under the Byrne grant program or the COPS grant program for a fiscal year if, on or before the day before the first day of the fiscal year, the State or local unit of government does not certify that the jurisdiction has in place a law or policy that prohibits the administration of ketamine to an individual during an arrest or detention other than in a hospital for medical purposes.</text></section><section id="H4EB6431F15124336AB2BD96D6C8087BD"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2B43F4731C5F45E8B46E39A247017C2E"><enum>(1)</enum><header>Byrne grant program</header><text>The term <quote>Byrne grant program</quote> means any grant program under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>), without regard to whether the funds are characterized as being made available under the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Local Government Law Enforcement Block Grants Program, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise.</text></paragraph><paragraph id="HD2C68B0FA2044F22B1119F7AD2AEBE99"><enum>(2)</enum><header>Cops grant program</header><text>The term <quote>COPS grant program</quote> means the grant program authorized under section 1701 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>).</text></paragraph></section></legis-body></bill>
