case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide that governmental pension plans may include certain firefighters, emergency medical technicians, and paramedics, and for other purposes.</official-title></form><legis-body id="H551CABE2AD7A4E8B896D08E58C4C2710" style="OLC"><section id="H1A4B96F85A344B8EB92C0B154A706DA3" section-type="section-one"><enum>1.</enum><header>Governmental pension plans may include certain firefighters, emergency medical technicians, and paramedics</header><subsection id="HFD945FD460FA410DA09B0F801132B59B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/414">Section 414(d)</external-xref> of the Internal Revenue Code of 1986 (relating to governmental plans) is amended by adding at the end the following: <quote>The term <quote>governmental plan</quote> also includes a plan which is established by a State or political subdivision thereof and maintained by a public safety agency (described in section 501(c) and exempt from taxation under section 501(a)), and all of the participants of which are employees of such agency who are emergency response providers (defined in section 2 of the Homeland Security Act of 2022 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)), substantially all of whose services as emergency response providers are in the performance of firefighting services or out-of-hospital emergency medical services for a political subdivision of a State under a contract between such public safety agency and the political subdivision of a State.</quote></text></subsection><subsection id="HB83EEF1C3CEA47D99066A31F7D2EE2DE"><enum>(b)</enum><header>Employee retirement income security Act of 1974</header><paragraph id="HA39E92ABE4F04FD1876F98C6FC06D001"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3(32) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(32)</external-xref>) is amended by adding at the end the following: <quote>The term <quote>governmental plan</quote> also includes a plan which is established by a State or political subdivision thereof and maintained by a public safety agency (described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code), and all of the participants of which are employees of such agency who are emergency response providers (defined in section 2 of the Homeland Security Act of 19 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>)), substantially all of whose services as emergency response providers are in the performance of firefighting services or out-of-hospital emergency medical services for a political subdivision of a State under a contract between such public safety agency and the political subdivision of a State.</quote></text></paragraph><paragraph id="HC67CBB0279E64FD687BBFF8B5D1A4724"><enum>(2)</enum><header>PBGC Exception</header><text>Section 4021(b)(2) of such Act is amended by striking <quote>described in the last sentence of section 3(32)</quote> and inserting <quote>described in either of the last two sentences of section 3(32)</quote>.</text></paragraph></subsection><subsection id="H7F2D900715274507A7DCE2F973318B0F"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="H741732F134C64A8FA1F265D1FE6849A0"><enum>(1)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/414">Section 414(h)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>described in the last sentence of section 414(d) (relating to plans of Indian tribal governments)</quote> and inserting <quote>described in either of the last two sentences of subsection (d)</quote>.</text></paragraph><paragraph id="H1EE963EBA9B141EF893C90B23F58AB17"><enum>(2)</enum><text>Section 415(b)(2)(H)(i) of such Code is amended by adding at the end the following: <quote>or a public safety agency described in the last sentence of section 414(d)</quote>.</text></paragraph><paragraph id="HF92B95B16D0A43F694026048152AE70A"><enum>(3)</enum><text>Section 415(b)(2)(H)(ii)(I) of such Code is amended by striking <quote>or any political subdivision</quote> and inserting <quote>any political subdivision, or a public safety agency described in the last sentence of section 414(d)</quote>.</text></paragraph><paragraph id="H34541E98528745E3BC7ED24F12CC0C3F"><enum>(4)</enum><text>Section 415(b)(10)(A) of such Code is amended by striking <quote>described in the last sentence of section 414(d) (relating to plans of Indian tribal governments)</quote> and inserting <quote>described in either of the last two sentences of section 414(d)</quote>.</text></paragraph></subsection><subsection id="H83D70EBCA9E5419189A829EDC58C9570"><enum>(d)</enum><header>Effective date</header><text>The amendment made by this section shall apply to plan years beginning after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
