which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, with respect to funding for certain safety projects, and for other purposes.</official-title></form><legis-body id="H663D1E227011472E9B3F6D007FE53019" style="OLC"><section id="HA707D6A1E50C46C2908645149B7D32D4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Routes to School Expansion Act</short-title></quote>.</text></section><section id="H348EB4C36AF84EA097CD09BEA06A1294" section-type="subsequent-section"><enum>2.</enum><header>Highway safety improvement program</header><text display-inline="no-display-inline">Section 148 of title 23, United States Code, is amended—</text><paragraph id="H73F5EE94E4734A14BE01B6EF746F1B69"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H4A037F7BA8FC434DBAEA2AB593A37881"><enum>(A)</enum><text>in paragraph (4)(B)—</text><clause id="HE0FA33A526BB40C1BE9C794D5C032E04"><enum>(i)</enum><text>by striking clause (xviii) and inserting the following:</text><quoted-block style="USC" id="HF5805C2B4A824A73935E5800DBA4604A" display-inline="no-display-inline"><clause id="HE1D512E87BEE417EB30042E01B6A9583"><enum>(xviii)</enum><text display-inline="yes-display-inline">Safe Routes to School infrastructure related projects described in section 211(e). </text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HC773789784A14B8E8B3B330DB695D841"><enum>(ii)</enum><text>in clause (xxvi) by inserting <quote>or leading pedestrian intervals</quote> after <quote>beacons</quote>;</text></clause><clause id="H7A7927741703412982F45E82897E04CA"><enum>(iii)</enum><text display-inline="yes-display-inline">by redesignating clause (xxviii) as clause (xxix);</text></clause><clause id="H305BB3CD134E4FCA96599B6AE8809121"><enum>(iv)</enum><text>by inserting after clause (xxvii) the following:</text><quoted-block style="USC" id="H0AE61341B2CE4AD095D2F7D30F8DFA57" display-inline="no-display-inline"><clause id="H4856684B2D6246FD88758E9D2DE8DF9A"><enum>(xxviii)</enum><text display-inline="yes-display-inline">Installation of infrastructure improvements, including sidewalks, crosswalks, signage, and bus stop shelters or protected waiting areas. </text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></clause><clause id="HD87D0694BD56411C9140A0C6C0A0E2D4"><enum>(v)</enum><text>in clause (xxix), as redesignated, by striking <quote>(xxvii)</quote> and inserting <quote>(xxviii)</quote>;</text></clause></subparagraph><subparagraph id="H34687052FF504253B12AE0C8C888F80A"><enum>(B)</enum><text>by redesignating paragraphs (10) through (12) as paragraphs (11) through (13), respectively;</text></subparagraph><subparagraph id="H086339AAB7B140E8BCFBC8761D86EE7C"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text><quoted-block style="USC" id="HC7A38DD6C43D4A569228656B9A8E3348" display-inline="no-display-inline"><paragraph id="H3F40675753B341B5AE9307852B6FE971"><enum>(10)</enum><header>Safety project under any other section</header><subparagraph id="HBADF96D0C8624950A468040D901CD510"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>safety project under any other section</term> means a project carried out for the purposes of safety under any section of this title other than this section.</text></subparagraph><subparagraph id="H3DF7A44D6A014ED0A1042CD481D37ABB"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>safety project under any other section</term> includes a project, consistent with the State strategic highway safety plan, that—</text><clause id="H5B7822B4944F49768D7E357E2A12A448"><enum>(i)</enum><text>promotes public awareness and informs the public regarding highway safety matters (including motorcycle safety and school bus stop safety);</text></clause><clause id="H5FCF6C2C1BC8472B9390E3C9182B1337"><enum>(ii)</enum><text>facilitates enforcement of traffic safety laws; and</text></clause><clause id="H95DDA5AF81CB47D0BD970D90A55E4710"><enum>(iii)</enum><text display-inline="yes-display-inline">supports Safe Routes to School non-infrastructure projects, as described in section 211(e).</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H69816BD638074FD1B654E11D6EF88DC6"><enum>(D)</enum><text>in paragraph (12)(A), as so redesignated—</text><clause id="H528F0B4BB3394DAA927A447F2A97CDBA"><enum>(i)</enum><text>in clause (ix) by striking <quote>and</quote>;</text></clause><clause id="HF2D2E1DC516F4E24B51AE07518E2AD9A"><enum>(ii)</enum><text>by redesignating clause (x) as clause (xi); and</text></clause><clause id="H454DAD4D275A431CB15B697A46C46055"><enum>(iii)</enum><text>by inserting after clause (ix) the following:</text><quoted-block style="USC" id="HD35DB0BDDB2747F8ABF9267A2051CC94" display-inline="no-display-inline"><clause id="H15F644D86A18422D945176284171293B"><enum>(x)</enum><text display-inline="yes-display-inline">State or local representatives of educational agencies to address Safe Routes to School and school bus safety; and</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HDF0B7042D731419DBFE8684E77A20073"><enum>(2)</enum><text>in subsection (c)(1)(A) by striking <quote>(11)</quote> and inserting <quote>(12)</quote>;</text></paragraph><paragraph id="H53C07F28AF0F4C97B66EBDCFE025ACCB"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d)(2)(B)(i) by striking <quote>(11)</quote> and inserting <quote>(12)</quote>; and</text></paragraph><paragraph id="H3B721112954F40158B43C2D94ADA9167"><enum>(4)</enum><text>in subsection (e) by adding at the end the following:</text><quoted-block style="USC" id="H80BD7B41396342318B08E37D31EF6BB9" display-inline="no-display-inline"><paragraph id="H0372BF6563484C61AE11D7A6E25FD7E7"><enum>(3)</enum><header>Flexible funding for safety projects under any other section</header><subparagraph id="H9E6FBB4217524D849BEA6CB2F74BEF23"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To advance the implementation of a State strategic highway plan, a State may use not more than 25 percent of the amounts apportioned to the State under section 104(b)(3) for a fiscal year to carry out safety projects under any other section.</text></subparagraph><subparagraph id="H6865455C547443E98E8C44433894F53D"><enum>(B)</enum><header>Other transportation and safety plans</header><text>Nothing in this paragraph requires a State to revise any State process, plan, or program in effect on the date of enactment of this paragraph.</text></subparagraph><subparagraph id="HF8FA294018934687A525E0220D90BD21"><enum>(C)</enum><header>Effect of paragraph</header><clause id="HEE3F69164EB7446AB9C6FB3993D73887"><enum>(i)</enum><header>Requirements</header><text display-inline="yes-display-inline">A project funded under this paragraph shall be subject to all requirements under this section that apply to a highway safety improvement project.</text></clause><clause id="H35DADA6EC574443FABBF126DF8D161BF"><enum>(ii)</enum><header>Other apportioned programs</header><text>Subparagraph (A) shall not apply to amounts that may be obligated for non-infrastructure projects apportioned under any other paragraph of section 104(b). </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H1FB9643209724F2691BC555DD5BDD908"><enum>3.</enum><header>Federal share payable</header><text display-inline="no-display-inline">Section 120(c)(1) of title 23, United States Code, is amended by inserting <quote>an improvement for pedestrian or bicyclist safety or safety of people with disabilities, Safe Routes to School improvements,</quote> after <quote>utility poles,</quote>.</text></section><section id="H91F1C7EBD1BA499C9E89BF295081373E"><enum>4.</enum><header>Safe routes to school program</header><subsection id="HD2511599AF48427AAED9D4FAFE11BE76"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/2">Chapter 2</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/210">section 210</external-xref> the following:</text><quoted-block id="H9C4F9B0B0F6F449D996CEB6C78BE4CAC" style="USC"><section id="H6C59E4D34A2E4D838E78A15EC7672308"><enum>211.</enum><header>Safe routes to school program</header><subsection id="H849BD7B4B3144EAC83CD3BB4F4CE4528"><enum>(a)</enum><header>Program</header><text>The Secretary shall carry out a safe routes to school program for the benefit of children in primary, middle, and high schools. </text></subsection><subsection id="H02CE229CC581408AAB7C546A67476A31"><enum>(b)</enum><header>Purposes</header><text>The purposes of the program shall be—</text><paragraph id="H92AB4E017C6541C9999DC4BC4679D2A7"><enum>(1)</enum><text>to enable and encourage children, including those with disabilities, to walk and bicycle to school;</text></paragraph><paragraph id="H420622D1316043E5895AEDB60F774F05"><enum>(2)</enum><text>to make bicycling and walking to school a safer and more appealing transportation alternative, thereby encouraging a healthy and active lifestyle from an early age; and</text></paragraph><paragraph id="H8FC31F40C7DA43A888D332771EF09C71"><enum>(3)</enum><text>to facilitate the planning, development, and implementation of projects and activities that will improve safety and reduce traffic, fuel consumption, and air pollution in the vicinity of schools.</text></paragraph></subsection><subsection id="HD837972B9FFE44169A70D0C675348D7A"><enum>(c)</enum><header>Use of funds</header><text>Amounts apportioned to a State under paragraphs (2) and (3) of section 104(b) may be used to carry out projects, programs, and other activities under this section.</text></subsection><subsection id="H292E1E467A0D4E9984AAA4FD645EF3D1"><enum>(d)</enum><header>Eligible entities</header><text>Projects, programs, and activities funded under this section may be carried out by eligible entities described under section 133(h)(4)(B) that demonstrate an ability to meet the requirements of this section.</text></subsection><subsection id="HED4A9D6020D54DFD83D8F9ED7FE2C49F"><enum>(e)</enum><header>Eligible projects and activities</header><paragraph id="HFFEA66CEDFD44E768DB9D060755D919A"><enum>(1)</enum><header>Infrastructure-related projects</header><subparagraph id="H5185FABC11F044E7AAF61AD19051DE2E"><enum>(A)</enum><header>In general</header><text>A State may obligate funds under this section for the planning, design, and construction of infrastructure-related projects that will substantially improve the ability of students to walk and bicycle to school, including sidewalk improvements, traffic calming and speed reduction improvements, pedestrian and bicycle crossing improvements, on-street bicycle facilities, off-street bicycle and pedestrian facilities, secure bicycle parking facilities, and traffic diversion improvements in the vicinity of schools.</text></subparagraph><subparagraph id="H3AE20814FAD74A689866867C61CF5177"><enum>(B)</enum><header>Location of projects</header><text>Infrastructure-related projects under subparagraph (A) may be carried out on any public road or any bicycle or pedestrian pathway or trail in the vicinity of schools.</text></subparagraph></paragraph><paragraph id="H151D1B66219A4999AA791732A0A08671"><enum>(2)</enum><header>Noninfrastructure-related activities</header><text>In addition to projects described in paragraph (1), a State may obligate funds under this section for noninfrastructure-related activities to encourage walking and bicycling to school, including—</text><subparagraph id="H36872EA7E9144DDE9255F11EAFF75D78"><enum>(A)</enum><text>public awareness campaigns and outreach to press and community leaders;</text></subparagraph><subparagraph id="H834B92F58D5C4D5EA00C0093B9087CA7"><enum>(B)</enum><text>traffic education and enforcement in the vicinity of schools;</text></subparagraph><subparagraph id="H7A572F42CD244970AC3D387C1E5929B1"><enum>(C)</enum><text>student sessions on bicycle and pedestrian safety, health, and environment;</text></subparagraph><subparagraph id="H71A00CA65D1B4BF2B264CFA1E0A3E2E6"><enum>(D)</enum><text>programs that address personal safety; and</text></subparagraph><subparagraph id="H475259485489485B9AC6E80364336AB1"><enum>(E)</enum><text>funding for training, volunteers, and managers of safe routes to school programs.</text></subparagraph></paragraph><paragraph id="HA6A3F7A5D10940888ACC9289B070CCD9"><enum>(3)</enum><header>Safe routes to school coordinator</header><text>Each State receiving an apportionment under paragraphs (2) and (3) of section 104(b) shall use a sufficient amount of the apportionment to fund a full-time position of coordinator of the State’s safe routes to school program. </text></paragraph><paragraph id="HE122C7CE8EA947128D3A3395672F1FEC"><enum>(4)</enum><header>Rural school district outreach</header><text display-inline="yes-display-inline">A coordinator described in paragraph (3) shall conduct outreach to ensure that rural school districts in the State are aware of such State’s safe routes to school program and any funds authorized by this section. </text></paragraph></subsection><subsection id="HC0CDAC3D8140421D9FDA32C5A23F74D3"><enum>(f)</enum><header>Federal share</header><text>The Federal share of the cost of a project, program, or activity under this section shall be 100 percent. </text></subsection><subsection id="H311254F6414D456EB44221A3B181765B"><enum>(g)</enum><header>Clearinghouse</header><paragraph id="HBD819314135F477E9E6D9FD28899BC45"><enum>(1)</enum><header>In general</header><text>The Secretary shall maintain a national safe routes to school clearinghouse to—</text><subparagraph id="HDFD885F19243410BB0F0CF0BA9681184"><enum>(A)</enum><text>develop information and educational programs on safe routes to school; and</text></subparagraph><subparagraph id="HC10CF9A84604435897A60B18F9DC064D"><enum>(B)</enum><text>provide technical assistance and disseminate techniques and strategies used for successful safe routes to school programs.</text></subparagraph></paragraph><paragraph id="H4F1605401A334D07B80BF045F700C789"><enum>(2)</enum><header>Funding</header><text>The Secretary shall carry out this subsection using amounts authorized to be appropriated for administrative expenses under section 104(a).</text></paragraph></subsection><subsection id="H0B25869E40364D8F825E8632E47842CE"><enum>(h)</enum><header>Treatment of projects</header><text>Notwithstanding any other provision of law, projects carried out under this section shall be treated as projects on a Federal-aid highway under chapter 1 of this title.</text></subsection><subsection id="H01CC694AE0CC47ACAD0EC20F5726CFD8"><enum>(i)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="HF92A7A696E4640219E194ABAA834ED86"><enum>(1)</enum><header>In the vicinity of schools</header><text>The term <term>in the vicinity of schools</term> means, with respect to a school, the area within bicycling and walking distance of the school (approximately 2 miles). </text></paragraph><paragraph id="H43D94FBE4D474F8B8022D0AB6F55B97E"><enum>(2)</enum><header>Primary, middle, and high schools</header><text>The term <term>primary, middle, and high schools</term> means schools providing education from kindergarten through twelfth grade.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEF838DDE016B4A8F927365E3C3DFE66D"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H6C9E9DEBDA674A2CAFD516C490D4F444"><enum>(1)</enum><header>Repeal</header><text>Section 1404 of SAFETEA–LU (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1228–1230), and the item relating to such section in the table of contents in section 1(b) of such Act, are repealed.</text></paragraph><paragraph id="H72666D4144C74D4D81BBB52A0F688965"><enum>(2)</enum><header>Analysis</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/2">chapter 2</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/210">section 210</external-xref> the following:</text><quoted-block id="H0A323BDF233D474E99239AD03E25E2F8" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">211.
