R. 3864</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210614">June 14, 2021</action-date><action-desc><sponsor name-id="B001304">Mr. Brown</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of the Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration, to provide grants supporting research on the conservation, restoration, or management of oysters in estuarine ecosystems, and for other purposes.</official-title></form><legis-body id="H4F3F991C66464C54BD91B5E19326218F" style="OLC"><section id="H67A6F3AAFC9842A8B4CF2DC42FA60165" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act maybe cited as the <quote><short-title>Oyster Conservation Act</short-title></quote>. </text></section><section id="H6FC8747880994A3E942DA627AFF72B7B"><enum>2.</enum><header>Grants for recovering oysters</header><subsection id="H6C4403F77E284768828D27D6B1D08C52"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish a grant program (in this section referred to as the <quote>Program</quote>) under which the Administrator shall award grants to eligible entities for the purpose of conducting research on the conservation, restoration, or management of oysters in estuarine ecosystems.</text></subsection><subsection id="H9F8D623C5D8E4157B97E2FDCAFB1F1C0"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under this section, an eligible entity shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subsection><subsection id="HBEB03C02277C4DD1A3857DB702BFBE3E"><enum>(c)</enum><header>Allocation of grant funds</header><paragraph id="H9ACF240399DC4A12B0D2DF681F4B0A2B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall award a grant under the Program to eligible entities that submit an application under subsection (b).</text></paragraph><paragraph id="H4E4CF5A75FA64DEA9AA7529EB64080D5"><enum>(2)</enum><header>Matching requirement</header><subparagraph id="HCF87484144D048F792F586B599A2CB44"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the total amount of Federal funding received under the Program by an eligible entity may not exceed 85 percent of the total cost of the research project for which the funding was awarded. For the purposes of this subparagraph, the non-Federal share of project costs may be provided by in-kind contributions and other noncash support.</text></subparagraph><subparagraph id="HF85A743C563A4D69B936F9705AECE528"><enum>(B)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Administrator may waive all or part of the requirement in subparagraph (A) if the Administrator determines that no reasonable means are available through which an eligible entity applying for a grant under this section can meet such requirement and the probable benefit of such research project outweighs the public interest in such requirement.</text></subparagraph></paragraph><paragraph id="H3BA7A6E6B48549148395E5B2E3015612"><enum>(3)</enum><header>Equitable distribution</header><text display-inline="yes-display-inline">The Administrator shall ensure, to the maximum extent practicable, that grant funding under this section is apportioned according to the historic baseline oyster population of each estuary of the United States.</text></paragraph></subsection><subsection id="HF888547A0C444184A6BB7CCEA1295FD1"><enum>(d)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="HA64FA347E1504F489BDEF40960DF9A66"><enum>(1)</enum><header>Academic community</header><text display-inline="yes-display-inline">The term <term>academic community</term> means faculty, researchers, professors, and representatives of State-accredited colleges and universities.</text></paragraph><paragraph id="H8B9C235825F640C5B2636E0F30CF060B"><enum>(2)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Secretary of Commerce acting through the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="HD9432D2FC87B40ACB89652A9AB56C2CE"><enum>(3)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a member of the academic community, the seafood industry, a relevant nonprofit organization, or a relevant State agency, that is proposing or conducting a research project on the conservation, restoration, or management of oysters in an estuarine ecosystem developed through consultation with a member of the academic community, a member of the seafood industry, a relevant nonprofit organization, or a relevant State agency.</text></paragraph><paragraph id="H46C5280D28E7461BAADE04E7EFC1EAEB"><enum>(4)</enum><header>Historic baseline</header><text display-inline="yes-display-inline">The term <term>historic baseline</term> means the estimated population of oysters in an estuary in 1850.</text></paragraph><paragraph id="H59E2937179B746278001838CE06C5969"><enum>(5)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code.</text></paragraph><paragraph id="HE90267386A9C44BC97B793FE2966C00C"><enum>(6)</enum><header>Seafood industry</header><text display-inline="yes-display-inline">The term <term>seafood industry</term> means shellfish growers, shellfish harvesters, commercial fishermen, and recreational fishermen.</text></paragraph></subsection><subsection id="HF2A37BAC87894385AF712098336278C2"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator $5,000,000 for each of the fiscal years 2022 through 2026 to carry out this section.</text></subsection></section></legis-body></bill>
