R. 3852</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210611">June 11, 2021</action-date><action-desc><sponsor name-id="S001209">Ms. Spanberger</sponsor> (for herself and <cosponsor name-id="B001298">Mr. Bacon</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to provide for a presumption of toxic exposure for certain veterans who, while serving in the Armed Forces, were consistently exposed to jet fuel, and for other purposes.</official-title></form><legis-body id="H0D2F1A861FBB4DC0B232FAAF36889E0B" style="OLC"><section id="H8BC7538B6B9F4E76B458CC74D536BAEF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>William Collins Jet Fuel Exposure Recognition Act</short-title></quote>. </text></section><section id="H88F8579975D84EDE92538235EFC43B29"><enum>2.</enum><header>Presumptions of toxic exposure</header><subsection id="H148A3D0F486C4E0EAB8796250F8DD386"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H5ED2D88DB1854FCAAAB3E81D2E0F6D18"><section id="H98E738E87C15499FA72B6B8DF700337A"><enum>1119.</enum><header>Presumptions of toxic exposure</header><subsection id="HB2ECCBA7C1854F90ACB164BECC3373D5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, for purposes of section 1110 and chapter 17 of this title, presume that any covered veteran was exposed to toxic substances, chemicals, and airborne hazards during the service of the covered veteran, unless there is affirmative evidence to establish that the covered veteran was not exposed to any such substances, chemicals, or hazards in connection with such service. </text></subsection><subsection id="H59EFF7ACF1374704944FE6C80846AFED"><enum>(b)</enum><header>Adjudication of claims</header><text>If a covered veteran submits to the Secretary a claim for compensation for a service-connected disability related to jet fuel exposure under section 1110 of this title with evidence of a disability and a presumption of toxic exposure under subsection (a) that occurred during active military, naval, or air service, the Secretary shall, in adjudicating such claim—</text><paragraph id="H14A46B4E422640AB852CAC402CB976BE"><enum>(1)</enum><text display-inline="yes-display-inline">provide a medical examination and request a medical opinion for service connection; and</text></paragraph><paragraph id="H21CD1093BC8E454FB382A2E2C6B8346F"><enum>(2)</enum><text>direct a medical provider providing such a medical examination to consider—</text><subparagraph id="H3F6FCE25E19B4ED09EBBFF7EF92858B2"><enum>(A)</enum><text>the exposure of the veteran to toxic substances during all military deployments; and</text></subparagraph><subparagraph id="HD732084BB45F4D1EB05CE8342D908AAB"><enum>(B)</enum><text>the synergistic effect of all combined toxic substances through inhalation, dermal exposure, and ingestion.</text></subparagraph></paragraph></subsection><subsection id="H535C7948D1A34A7EBC55982CF7608852"><enum>(c)</enum><header>Covered veteran</header><text>The term <quote>covered veteran</quote> means any veteran who, while serving in the active military, naval, or air service, worked for a cumulative period of at least two years in a military occupational specialty that involved consistent exposure to jet fuel.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H267F4206049D4CFB8332AFE998420AC8"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 11 is amended by inserting after the item relating to section 1118 the following new item: </text><quoted-block style="USC" id="H4D32C3078A58410FA949015C7246FE20"><toc><toc-entry level="section" idref="H98E738E87C15499FA72B6B8DF700337A">1119. Presumptions of toxic exposure.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8FAF444ECA6E49B8A2C0D6FED562D75F"><enum>(c)</enum><header>Biennial report</header><paragraph id="HC59E93A3A399411695CD10864E8ABD98"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of the enactment of this Act, and biennially thereafter during the subsequent eight-year period, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives, and make publicly available, a report that includes—</text><subparagraph id="HC04DDCFE10464B54985FEC5606F4895F"><enum>(A)</enum><text>a discussion of the effect of various different types of jet fuels used by the Armed Forces on the health of individuals by length of exposure;</text></subparagraph><subparagraph id="H6CDD73B648644BE1A2E7A4E618ACA947"><enum>(B)</enum><text>an identification of the immediate symptoms of jet fuel exposure that may indicate future health risks;</text></subparagraph><subparagraph id="H8E065FDDE1564FD08EF58973C916D722"><enum>(C)</enum><text>a chronology of health safeguards implemented by the Armed Forces intended to reduce the exposure of members of the Armed Foces to jet fuel; and</text></subparagraph><subparagraph id="H22A7C7DFE0184FD58072E271154DC432"><enum>(D)</enum><text>an identification of any areas relating to jet fuel exposure about which new research needs to be done.</text></subparagraph></paragraph><paragraph id="H31F4C53E921D430BB731B153E2AF913C"><enum>(2)</enum><header>Use of findings</header><text>In evaluating claims for compensation for service-connected disabilities submitted by veterans who were exposed to jet fuel, the Secretary shall take into consideration the findings of the reports under this subsection.</text></paragraph></subsection></section></legis-body></bill>
