which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Director of the National Science Foundation to establish a capacity-building program for developing universities, and for other purposes.</official-title></form><legis-body id="H32B02DBDBDFC4BD1A03FB220E5B89262" style="OLC"><section id="H190343FE78E54D56B87CFAF41341DD03" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening MSI Competitiveness in Research and Innovation Act</short-title></quote>.</text></section><section id="HE97DD0A50E62404AA81E8A7458BC2FE6"><enum>2.</enum><header>Capacity-building program for developing universities</header><subsection id="H3BCEEBD427FD4A3FAA8E2BACDB333479"><enum>(a)</enum><header>In general</header><text>The Director of the National Science Foundation shall establish a program to make awards, on a competitive basis, to eligible institutions described in subsection (b) to support the mission of the Foundation and to build institutional research capacity at eligible institutions.</text></subsection><subsection id="H18D2B69FBF014594B0EBAC41CB73E998"><enum>(b)</enum><header>Eligible institution</header><paragraph id="H99082598E4C649029F10BD76A515EE77"><enum>(1)</enum><header>In general</header><text>To be eligible to receive an award under this section, an institution—</text><subparagraph id="H8F0673A368294C68926EB2FFCD40E16E"><enum>(A)</enum><text>shall be—</text><clause id="HBB2C1E34077B4FFEABCB56A4F47BAEA6"><enum>(i)</enum><text>a historically Black college or university;</text></clause><clause id="HB6B35470F52741F29FEDC3A99E53D078"><enum>(ii)</enum><text>a Tribal College or University;</text></clause><clause id="H74ADF5ABA61C46A89EA6067C940EDC68"><enum>(iii)</enum><text>a minority-serving institution; or</text></clause><clause id="H41C11234316D4C5EB5E6BBCCEACBCD66"><enum>(iv)</enum><text>an institution of higher education with an established STEM capacity building program focused on traditionally underrepresented populations in STEM, including Native Hawaiians, Alaska Natives, and Indians; and</text></clause></subparagraph><subparagraph id="H5D3777AA9FCC424E9999DDC0FB01730F"><enum>(B)</enum><text>shall have not more than $50,000,000 in annual federally-financed research and development expenditures for science and engineering as reported through the National Science Foundation Higher Education Research and Development Survey.</text></subparagraph></paragraph><paragraph id="H1AF9D06B347F432B83A0ED0F88218CC6"><enum>(2)</enum><header>Partnerships</header><text>An eligible institution receiving a grant under this section may carry out the activities of the grant through a partnership with other entities, including community colleges and other eligible institutions.</text></paragraph></subsection><subsection id="HE1EB2671B7F542F3B32FE75AFF33ACE4"><enum>(c)</enum><header>Proposals</header><text>To receive an award under this section, an eligible institution shall submit an application to the Director at such time, in such manner, and containing such information as the Director may require, including a plan that describes how the eligible institution will establish or expand research office capacity and how such award would be used to—</text><paragraph id="HF9428C227D6C47FF9AEA7BD30C389243"><enum>(1)</enum><text>conduct an assessment of capacity-building and research infrastructure needs of an eligible institution;</text></paragraph><paragraph id="HD7F410534C6041CABA010D3F088C3256"><enum>(2)</enum><text>enhance institutional resources to provide administrative research development support to faculty at an eligible institution;</text></paragraph><paragraph id="H3F546FCEF2C64418B390844590B49C31"><enum>(3)</enum><text>bolster the institutional research competitiveness of an eligible institution to support grants awarded by the Foundation;</text></paragraph><paragraph id="HB4B390622F9546F0AA62619A32BAE50C"><enum>(4)</enum><text>support the acquisition of instrumentation necessary to build research capacity at an eligible institution in research areas directly associated with the Foundation;</text></paragraph><paragraph id="H570ECADCF87441218AD9156B7D29328B"><enum>(5)</enum><text>increase capability of an eligible institution to move technology into the marketplace;</text></paragraph><paragraph id="HA4C00B62850842C8B15AA34F18CFCAB2"><enum>(6)</enum><text>increase engagement with industry to execute research through the SBIR and STTR programs (as defined in section 9(e) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(e)</external-xref>) and direct contracts at an eligible institution;</text></paragraph><paragraph id="HEA7A4291BCBC438E92017EDB0AC8D0A4"><enum>(7)</enum><text>provide student engagement and research training opportunities at the undergraduate, graduate, and postdoctoral levels at an eligible institution;</text></paragraph><paragraph id="H6848E49DEA2C4022B4CE8C00425686CF"><enum>(8)</enum><text>further faculty development initiatives and strengthen institutional research training infrastructure, capacity, and competitiveness of an eligible institution; or</text></paragraph><paragraph id="H3BC2D363A9D043A89123333CF8926B08"><enum>(9)</enum><text>address plans and prospects for long-term sustainability of institutional enhancements at an eligible institution resulting from the award including, if applicable, how the award may be leveraged by an eligible institution to build a broader base of support.</text></paragraph></subsection><subsection id="H3FE581A2A3824D45850E59DC769F9B84"><enum>(d)</enum><header>Awards</header><text>Awards made under this section shall be for periods of 3 years, and may be extended for periods of not more than 5 years.</text></subsection><subsection id="HD7B2ADDD93E74C58A3546EEE06A94518"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3EE484BADE544C5CAB04B6FDAAA40D53"><enum>(1)</enum><header>Historically Black college or university</header><text display-inline="yes-display-inline">The term <quote>historically Black college or university</quote> has the meaning given the term <quote>part B institution</quote> in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph><paragraph id="HBD344CEDBFAA4906A34E41BEAE4456AA"><enum>(2)</enum><header>Minority-serving institution</header><text display-inline="yes-display-inline">The term <quote>minority-serving institution</quote> or <quote>MSI</quote> means—</text><subparagraph id="H86E690B3A7D94F58B14BD791296940C1"><enum>(A)</enum><text>a Hispanic-serving institution as defined in section 502 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a</external-xref>);</text></subparagraph><subparagraph id="H2C2F010190664F9D8A7B23059321F434"><enum>(B)</enum><text>an Alaska Native-serving Institution or a Native Hawaiian-serving institution as such terms are defined in section 317 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d</external-xref>); and</text></subparagraph><subparagraph id="HC46539AA658B4396B654130CA0A04183"><enum>(C)</enum><text>a Predominantly Black institution, an Asian American and Native American Pacific Islander-serving institution, or a Native American-serving nontribal institution as such terms are defined in section 371 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>).</text></subparagraph></paragraph><paragraph id="H67D553EA0243445F8FCE3D890699CF03"><enum>(3)</enum><header>Tribal College or University</header><text>The term <quote>Tribal College or University</quote> has the meaning given such term in section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>).</text></paragraph></subsection><subsection id="HD60782C497D3488F934DBF1BE27C830B"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Director of the National Science Foundation $100,000,000 for each of fiscal years 2022 through 2026 to carry out the activities in this Act.</text></subsection></section></legis-body></bill>
