which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to provide additional amounts of loan forgiveness to teachers of English learners and teachers of bilingual and dual language immersion students, and for other purposes.</official-title></form><legis-body id="H4BB52B7FE6BF4D889DD14E93522A39ED" style="OLC"><section id="HF1A10A7BB14B44659473F31ADD58E361" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Providers of English Language Learning Act</short-title></quote> or the <quote><short-title>SPELL Act</short-title></quote>.</text></section><section id="HF3912929EC1743689BA8237E02423197"><enum>2.</enum><header>Teachers of English learners, bilingual, and dual langage students</header><subsection id="H8A4C35005DD94359A75C3CECBD90F25B"><enum>(a)</enum><header>Loan forgiveness for teachers</header><text>Section 428J(c)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10(c)(3)</external-xref>) is amended—</text><paragraph id="H4824C7A32A6640DCBEADB6C7E9E9519E"><enum>(1)</enum><text display-inline="yes-display-inline">in the paragraph heading by striking <quote><header-in-text level="paragraph" style="OLC">Mathematics, science, or special education</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Mathematics, science, special education, or English language education</header-in-text></quote>;</text></paragraph><paragraph id="H774B7A92FE584B00B76F4E306174FBC7"><enum>(2)</enum><text>in subparagraph (A)(ii) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H2E374DD7682944ECB64162F811B37025"><enum>(3)</enum><text>in subparagraph (B)(iii) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H9BE32D3AB7014FF5A5E631A51F383A21"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block id="H2B69EBD97DD6419EB8618B3C8BCEA3DD" style="OLC"><subparagraph id="H237BE3348477403BAA15C599FCB9A3BB"><enum>(C)</enum><text>an elementary school or secondary school teacher—</text><clause id="H2745C6DA3AE2491A9265F4401C87EB18"><enum>(i)</enum><text>who meets the requirements of subsection (b);</text></clause><clause id="H7D1AEB59838A4914B4B9861FB3E50C13"><enum>(ii)</enum><text>whose qualifying employment for purposes of such subsection is—</text><subclause id="H6130BF6045C04E7E94E44E1EF4B7ED95"><enum>(I)</enum><text>as a teacher of English learners (as that term is defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) whose primary responsibility is to teach such learners; or</text></subclause><subclause id="H814CA65A44904E81BBFDE663866BC03F"><enum>(II)</enum><text>as a bilingual or dual language immersion teacher; and</text></subclause></clause><clause id="H0C00D66A8A1C4C269AF1FD80E2C990D2"><enum>(iii)</enum><text>who, as certified by the chief administrative officer of the public or nonprofit private elementary school or secondary school in which the borrower is employed, or, in the case of a teacher who is employed by an educational service agency, as certified by the chief administrative officer of such agency—</text><subclause id="HDECDFF6A58954809BDDEDD26164931E6"><enum>(I)</enum><text>is teaching English learners or bilingual or dual language immersion students who correspond with the borrower’s training; and</text></subclause><subclause id="HC650618D8118445E873D7848E797FD86"><enum>(II)</enum><text>has demonstrated knowledge and teaching skills in the content areas of the elementary school or secondary school curriculum that the borrower is teaching.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H160C15A5CA474D14BCBB6854037F70C9"><enum>(b)</enum><header>Loan cancellation for teachers</header><text>Section 460(c)(3) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j(c)(3)</external-xref>) is amended—</text><paragraph id="H3C8156D3CD004EC1A4E3D52A3971AB32"><enum>(1)</enum><text>in the paragraph heading by striking <quote><header-in-text level="paragraph" style="OLC">Mathematics, science, or special education</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Mathematics, science, special education, or English language education</header-in-text></quote>;</text></paragraph><paragraph id="H9F496211763448928CC0E359D07EB199"><enum>(2)</enum><text>in subparagraph (A)(ii) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H589BD217D1EA42DD8D357766D0E6D684"><enum>(3)</enum><text>in subparagraph (B)(iii) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H7EE91DFD45E9475086F56B7710F8CA7C"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block id="H3EE9738374B44C8A93926915A4136D3D" style="OLC"><subparagraph id="H715C017CC78B42A69D120AAACD378A94"><enum>(C)</enum><text>an elementary school or secondary school teacher—</text><clause id="HBAAE7C69261A48BEB3E3D56A4B57CBDD"><enum>(i)</enum><text>who meets the requirements of subsection (b); and</text></clause><clause id="HFA354D735B124E56BA34718C10362CC7"><enum>(ii)</enum><text>whose qualifying employment for purposes of such subsection is—</text><subclause id="H5C90D6C936C34DE18C2D3D5F377F797E"><enum>(I)</enum><text>as a teacher of English learners (as that term is defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) whose primary responsibility is to teach such learners; or</text></subclause><subclause id="HFACA82C5FCC74A82B8FF8066D3ABF05D"><enum>(II)</enum><text>as a bilingual or dual language immersion teacher; and</text></subclause></clause><clause id="H8DDE0F8611AB4CFDBB56FBF0A7489224"><enum>(iii)</enum><text>who, as certified by the chief administrative officer of the public or nonprofit private elementary school or secondary school in which the borrower is employed, or, in the case of a teacher who is employed by an educational service agency, as certified by the chief administrative officer of such agency—</text><subclause id="HAD52ADFFFE4041ABA0CFDA62B19A2CA6"><enum>(I)</enum><text>is teaching English learners or bilingual or dual language immersion students who correspond with the borrower’s training; and</text></subclause><subclause id="H44D36BBB841F48E0AFBCDA0E1571BE3A"><enum>(II)</enum><text>has demonstrated knowledge and teaching skills in the content areas of the elementary school or secondary school curriculum that the borrower is teaching.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HC4A5E3B0D2174E048F32FAB795B69652"><enum>3.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by section 2 shall take effect on the date of the enactment of this Act and shall apply with respect to individuals who are eligible to receive teacher loan forgiveness under section 428J of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10</external-xref>) or teacher loan cancellation under section 460 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j</external-xref>) after such date.</text></section></legis-body></bill>
