which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to prohibit certain abortion procedures, and for other purposes.</official-title></form><legis-body id="HA911581A71E249F09A3D1351484E36BE" style="OLC"><section id="H830D0D6013D64D3D966717B339BEE515" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pregnant Women Health and Safety Act of 2021</short-title></quote>.</text></section><section id="HF2507B302E5B44E0940D831BE0D40692"><enum>2.</enum><header>Requirement for physicians relating to the performance of abortions</header><subsection id="HB4ED5163C6C74B33896E9CC6106D3B1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/74">Chapter 74</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H99575D7DBD444721B839154ED83CD8C8"><enum>(1)</enum><text>in the chapter heading by striking <quote><header-in-text level="chapter" style="USC">Partial-Birth</header-in-text></quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H282276B36CF347FCA5B2027FC8C17B09"><enum>(2)</enum><text>by inserting after section 1531 the following:</text><quoted-block display-inline="no-display-inline" id="HB7804EFF1D15416892BD898AAB4518EB" style="USC"><section id="H3E669E04955A478C804FA79B0D9EB8C2"><enum>1532.</enum><header>Prohibition on certain procedures</header><subsection id="HCF036A8D7FF849B48AE73739638E1517"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>physician</term> means a doctor of medicine or osteopathy legally authorized to practice medicine and surgery by the State in which the doctor performs such activity, or any other individual legally authorized by the State to perform abortions.</text></subsection><subsection id="H6EB885F8342E4C3E996C6B9013748C01"><enum>(b)</enum><header>Requirements</header><text>A physician who performs an abortion shall—</text><paragraph id="H8E5373CD31724A57B403E03A88B78C24"><enum>(1)</enum><text>have admitting privileges at a hospital located within 15 miles from the principal medical office of the physician and the location in which the abortion is being performed; and</text></paragraph><paragraph id="H8941897FD0CD44869A625CB5D1382B94"><enum>(2)</enum><text>at the time of the abortion, notify the patient involved of the hospital location where the patient can receive follow-up care by the physician if complications resulting from the abortion arise.</text></paragraph></subsection><subsection id="H5F9B6DCDB70F4937AF2DB2892AAFA093"><enum>(c)</enum><header>Offense</header><text>It shall be unlawful for a physician, in or affecting interstate or foreign commerce, to knowingly perform an abortion and, in doing so, fail to comply with subsection (b).</text></subsection><subsection id="H478A4CEB399546C39CCB6257D98ECF82"><enum>(d)</enum><header>Penalty</header><text>Any physician who violates subsection (c) shall be fined under this title, imprisoned not more than 2 years, or both.</text></subsection><subsection id="HDB9E000B84A34A3F9391D5E009F26F6A"><enum>(e)</enum><header>Limitation</header><text>A woman upon whom a procedure described in subsection (c) is performed may not be prosecuted under this section, for a conspiracy to violate this section, or for an offense under section 2, 3, or 4 of this title based on a violation of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBC8D1536B2EB4A70B358D62A84EBBE6E"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H2B96ADE49C074567B7409F920F6167C0"><enum>(1)</enum><header>Chapter 74</header><text>The table of sections for such chapter is amended by inserting after the item relating to section 1531 the following:</text><quoted-block display-inline="no-display-inline" id="H6452ECFB0EF4469DA86C39C036100888" style="OLC"><toc><toc-entry idref="H3E669E04955A478C804FA79B0D9EB8C2" level="section">1532. Prohibition on certain procedures.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HA8980B963D37423C85293175E8592ABE"><enum>(2)</enum><header>Part I</header><text>The table of chapters for part I of title 18, United States Code, is amended by striking item relating to chapter 74 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H6A95F03F203A46A9ADDFF276F02CCE2B" style="OLC"><toc><multi-column-toc-entry level="section"><toc-enum>74.</toc-enum><level-header level="section">Abortions</level-header><target>1531</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HEF388C0A7ECD49DABBE040DCBC9CF2F0"><enum>3.</enum><header>Requirement of abortion clinics</header><subsection id="HF20A89EAFB424F79BA366D81880D1578"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), as a condition for receiving any Federal funds or assistance, an abortion clinic shall—</text><paragraph id="H010320E49D3A4010922A8C02062F1835"><enum>(1)</enum><text>be licensed by the State in which it is located; and</text></paragraph><paragraph id="HA1E595B3124B46988A4F8D5D162B01F1"><enum>(2)</enum><text>be in compliance with the requirements for ambulatory surgery centers under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.), except for any requirement relating to a certificate of public need for State licensing purposes.</text></paragraph></subsection><subsection id="H05AE7D8FA5A5459197DEBBA49D97681D"><enum>(b)</enum><header>Waiver</header><text>For purposes of complying with subsection (a)(2) with respect to an abortion clinic, a State board of health may waive the application of certain structural requirements (as the Secretary of Health and Human Services determines appropriate).</text></subsection><subsection id="H7255259DFC244755BB84646757228CB7"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>abortion clinic</term> means a facility, other than a hospital or ambulatory surgery center, in which first, second, or third trimester abortions are performed during any 12-month period.</text></subsection></section></legis-body></bill>
