<official-title display="yes">To amend section 2202 of the American Rescue Plan Act of 2021 to authorize States to expand the uses of the child care stabilization funds to include support to improve and increase the availability of safe child care facilities, and for other purposes.</official-title>

<section id="HBCEBD6497A5B4E52B0D4C169DC4FD808" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Increasing Access to Safe Child Care Facilities Act of 2021</short-title></quote>.</text></section> <section id="H002E4ADE15A14DC1B85D90013AB6B109"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Section 2202 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; March 11, 2021) is amended—</text>
<paragraph id="HD9A50780CFF44DD796BAB639106F8FE9"><enum>(1)</enum><text>in subsection (e)(1), by striking <quote>such a subgrant</quote> and inserting <quote>a subgrant under subsection (d)</quote>;</text></paragraph> <paragraph id="H9ED04DF0E0384793A12FCCDCFD530231"><enum>(2)</enum><text>by redesignating subsection (f) as subsection (h); and</text></paragraph>
<paragraph id="HE3F8F4908B5542A8B6E28ACA3B090211"><enum>(3)</enum><text>by inserting after subsection (e) the following:</text> <quoted-block id="H8444C04E0CC3462AB36F50E14FD961C1" style="OLC"> <subsection id="H95A539CEE9784EBE87CDE1EABEF7DB50"><enum>(f)</enum><header>Subgrants for safe child care facilities</header> <paragraph id="HE1123A4FB79A40CDB5851EFDFD3691A5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2)(A) of subsection (d), and with the authorization of the State under <internal-xref idref="HB00A8181C9554F8AB65D115C7C176701" legis-path="(f)(6)">subparagraph (6)</internal-xref>, the lead agency may use any unobligated grant funds awarded pursuant to subsection (c) (including unobligated funds otherwise reserved under subsection (d)(1)) to make subgrants to eligible entities to improve and increase the availability of safe child care facilities. Any fund used for subgrants under this subsection shall be obligated before October 1, 2024, and expended before October 1, 2025.</text></paragraph>
<paragraph id="H5DD60401730445A5B181820A0E25B7B5"><enum>(2)</enum><header>Selection of subgrantees</header><text>In making subgrants under this subsection, the lead agency shall select subgrantees based on demonstrated need. In making such selection, the lead agency shall—</text> <subparagraph id="H0A9B261873C046718DD0A22593348D6D"><enum>(A)</enum><text>give priority to eligible entities that—</text>
<clause id="H2957E745EC3443DBB458492595B259CB"><enum>(i)</enum><text display-inline="yes-display-inline">are new child care providers described in <internal-xref idref="HBBFA80479A0945E5B0C91645F5C01151" legis-path="(f)(3)(C)">paragraph (3)(C)</internal-xref> who agree to serve children receiving assistance under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857</external-xref>); or</text></clause> <clause id="HB2B48E57963E4F678E6D6900AF93FA8B"><enum>(ii)</enum><text>serve rural areas; and</text></clause></subparagraph>
<subparagraph id="H42FD22BD432B44C4AA8400B466FDF816"><enum>(B)</enum><text display-inline="yes-display-inline">give highest priority to eligible entities that are new child care providers described in <internal-xref idref="HBBFA80479A0945E5B0C91645F5C01151" legis-path="(f)(3)(C)">paragraph (3)(C)</internal-xref> who—</text> <clause id="HECCBAB1D2E57474CB331D86EA04CE786"><enum>(i)</enum><text display-inline="yes-display-inline">agree to serve children receiving assistance under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857</external-xref>); and</text></clause>
<clause id="H2AE6BBEF2AD84A9D9BB08EB8A6C09F8E"><enum>(ii)</enum><text>serve rural areas.</text></clause></subparagraph></paragraph> <paragraph id="H8DD15B201DF44E3094214AFAC09DEC89"><enum>(3)</enum><header>Eligible entity</header><text>In this section, the term <quote>eligible entity</quote> means—</text>
<subparagraph id="H4D90EC6CFCE64FEF84D5624719075B5E"><enum>(A)</enum><text>an eligible child care provider, as defined in section 658P(6)(A) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n(6)(A)</external-xref>); </text></subparagraph> <subparagraph id="H72B84F62F22945C08F30AEFF80036707"><enum>(B)</enum><text>a child care provider that—</text>
<clause id="HD9355258876041F6AF7863523AB06D0F"><enum>(i)</enum><text>is license-exempt and operating legally in the State;</text></clause> <clause id="HDD903A02DC9549BFB32DA703A0A1FBF5"><enum>(ii)</enum><text>is not providing child care services to relatives; and</text></clause>
<clause id="H5C1755922C0C4F3AAB5CE8845B1FA62C"><enum>(iii)</enum><text>satisfies State and local requirements, including those referenced in section 658E(c)(2)(I) of the Child Care and Development Block Grant Act of 1990 ((<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c</external-xref>)(c)(2)(I)); or</text></clause></subparagraph> <subparagraph id="HBBFA80479A0945E5B0C91645F5C01151"><enum>(C)</enum><text>a new child care provider that, on or before the date such provider begins to provide child care services, will—</text>
<clause id="H80C035C081534A618110807633900875"><enum>(i)</enum><text>be licensed, regulated, or registered in the State, territory, or Indian Tribe; and</text></clause> <clause id="HE6F606266DBA4041ABA9EE17655DF1C7"><enum>(ii)</enum><text>meet applicable State and local health and safety requirements.</text></clause></subparagraph></paragraph>
<paragraph id="HC7660036618B4D929DE9C5E1173E0626"><enum>(4)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity that receives funds through a subgrant authorized under this subsection shall use such funds to modify, renovate, upgrade, maintain, or repair a child care facility to—</text> <subparagraph id="H33CAE29910A7448CB6F866B23955B9DF"><enum>(A)</enum><text>meet applicable State and local health and safety requirements; or</text></subparagraph>
<subparagraph id="H5B22553ED8CD449CB055D99E2D6C2240"><enum>(B)</enum><text>increase the capacity of the provider to offer child care services, including modifications, renovations, upgrades, maintenance, or repairs necessary to—</text> <clause id="H87F83916B23C46FBB1098E305373C89F"><enum>(i)</enum><text>offer child care during nontraditional hours; and</text></clause>
<clause id="HF60934F80AC54EE187C00F287AB74CD4"><enum>(ii)</enum><text>provide services to more children or specific populations of children, including infants and toddlers, and children with disabilities.</text></clause></subparagraph></paragraph> <paragraph id="HFF21C4B272414EFC9BC2156A6169C53B"><enum>(5)</enum><header>Prohibited use</header><text display-inline="yes-display-inline">Funds received through a subgrant authorized under this subsection may not be used for the erection of a facility that does not currently exist. </text></paragraph>
<paragraph id="HB00A8181C9554F8AB65D115C7C176701" commented="no"><enum>(6)</enum><header>Amended plan and report</header><text>If a State elects to authorize the lead agency to provide subgrants to eligible entities under this subsection, the State shall amend the State plan submitted under section 658E of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9859c">42 U.S.C. 9859c</external-xref>) to specify—</text> <subparagraph id="H37038B7CF27947BF81BDAFF259905EE0" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the goals and outcomes the State intends to achieve to improve and increase the availability of safe child care facilities;</text></subparagraph>
<subparagraph id="HF5F3C8D80D574B5DA1799BFB3E18C821" commented="no"><enum>(B)</enum><text>how the State will measure and evaluate eligible entities in relation to these goals; and</text></subparagraph> <subparagraph id="H610AF4EC71394C06A354EC3E34C785C5" commented="no"><enum>(C)</enum><text>after the expenditure of such subgrants by such eligible entities, the State shall submit to the Secretary of Health and Human Services a report that measures, with respect to each such eligible entity—</text>
<clause id="H99424E6473A842C6AF760FF727F58C8F" commented="no"><enum>(i)</enum><text> the amount of the subgrant received by such entity;</text></clause> <clause id="HFA7BF359833E4CD18578235517362B06" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a list and description of the modifications, renovations, upgrades, maintenance, and repairs carried out by such entity during such period; and</text></clause>
<clause id="HC8778E24863140D2A4F237BB4EF79E01" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">using the metrics described in subparagraphs (A) and (B), the extent to which the State improved or increased the availability of safe child care facilities, including—</text> <subclause id="HD1E96388D8904DF590E6AE9F658EAC67" commented="no"><enum>(I)</enum><text>in rural areas;</text></subclause>
<subclause id="H68AD93AE77BA482A93A23A8D214C506E" commented="no"><enum>(II)</enum><text>for children receiving subsidies under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857</external-xref>);</text></subclause> <subclause id="HC992D4AB214A46378F31142A43B40F31" commented="no"><enum>(III)</enum><text>offering care during nontraditional hours; and</text></subclause>
<subclause id="HCED2B9877FDA4A66BC63D2698524676A" commented="no"><enum>(IV)</enum><text>providing services to more children or specific populations of children.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body> </bill>
