R. 377</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="A000375">Mr. Arrington</sponsor> (for himself, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="E000298">Mr. Estes</cosponsor>, and <cosponsor name-id="B001299">Mr. Banks</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to increase certain penalties for assaulting, resisting, or impeding certain officers or employees, and for other purposes.</official-title></form><legis-body id="HFBF46506C92345089697C01A056B9615" style="OLC"><section id="HC9835F6316D2405B8D04FB6F876DC11D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patrick Underwood Federal Law Enforcement Protection Act of 2021</short-title></quote>.</text></section><section id="HD817124452614F53A89BD3054CC63C94" section-type="subsequent-section"><enum>2.</enum><header>Assaulting, resisting, or impeding certain officers or employees</header><text display-inline="no-display-inline">Section 111 of title 18, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="H8B23EED2214349A48BBC5F5C13A661A0" display-inline="no-display-inline"><section id="HE27AE61AD0CB4D5A8AB96EE48A0120B6"><enum>111.</enum><header>Assaulting, resisting, or impeding certain officers or employees</header><subsection id="HBA8D467D2D5B49BBBF97C60BB1EA1453"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Whoever knowingly—</text><paragraph id="H26730C95921D4B20A70624F0E573AC16"><enum>(1)</enum><text display-inline="yes-display-inline">forcibly assaults, resists, opposes, impedes, intimidates, or interferes while performing official duties,</text></paragraph><paragraph id="H6CB4F84BB6E6463187740E2830C31B58"><enum>(2)</enum><text display-inline="yes-display-inline">makes physical contact with or has the intent to commit another felony while acting under paragraph (1), or</text></paragraph><paragraph id="HAC7E0E1AAA104B13AEF6A58A9C0ED3E4"><enum>(3)</enum><text display-inline="yes-display-inline">uses a deadly or dangerous weapon against (including a weapon intended to cause death or danger but that fails to do so by reason of a defective component) or inflicts bodily injury while acting under paragraph (1),</text></paragraph><continuation-text continuation-text-level="subsection">any officer or employee of the United States or of any agency in any branch of the United States Government (including any member of the uniformed services) while engaged in or on account of the performance of official duties, or any person who formerly served as a person defined above on account of the performance of official duties during such person’s term of service shall be punished as provided in subsection (b). </continuation-text></subsection><subsection id="H7AA3401466FC4802AA235C3AADBEA792"><enum>(b)</enum><header>Punishment</header><text display-inline="yes-display-inline">A violation of subsection (a) shall be punished as follows:</text><paragraph id="H526020551ABA4A7ABCD1445CDB24CADB"><enum>(1)</enum><text display-inline="yes-display-inline">For a violation of paragraph (1) of such subsection, by a fine under this title of not less than $1,000 or by imprisonment for not more than 1 year, or both.</text></paragraph><paragraph id="HB75B66371C364B2F85B6BF68CCB957C0"><enum>(2)</enum><text display-inline="yes-display-inline">For a violation of paragraph (2) of such subsection, by a fine under this title of not less than $2,500 or by imprisonment for not more than 10 years, or both.</text></paragraph><paragraph id="H53B6A9EA5F47422B9A0B439DEF26DB62"><enum>(3)</enum><text display-inline="yes-display-inline">For a violation of paragraph (3) of such subsection, by a fine under this title of not less than $10,000 or by mandatory imprisonment, or both.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
