R. 3776</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210608">June 8, 2021</action-date><action-desc><sponsor name-id="K000394">Mr. Kim of New Jersey</sponsor> (for himself, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, and <cosponsor name-id="L000588">Mr. Lamb</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that not less than 3 percent of the amounts made available for certain Federal-aid highway programs shall be expended through veteran owned small business concerns, and for other purposes.</official-title></form><legis-body id="H5B89A191C8D94065BD5FE71E08EE8973" style="OLC"><section id="H5352BDFA24C54A4EBB70986BAE0B9DA3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Better Utilizing Infrastructure for Lasting Development of Veterans Businesses Act of 2021</short-title></quote> or the <quote><short-title>BUILD Veterans Businesses Act of 2021</short-title></quote>.</text></section><section id="H73AA502E056F4D1A85700DFB5605761A"><enum>2.</enum><header>Better utilizing infrastructure for lasting development of veterans businesses</header><subsection id="H2E97953D2E4D4343961A29500B82CD17"><enum>(a)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="HC3ABFB515FC44023B0C5F56EA3B3BF15"><enum>(1)</enum><header>Small business concern</header><text>The term <quote>small business concern</quote> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph><paragraph id="HB2569E607DA14F239BA3AE63ABC037F9"><enum>(2)</enum><header>Veteran</header><text>The term <quote>veteran</quote> has the meaning given the term in section 101(2) of title 38, United States Code.</text></paragraph><paragraph id="H46A54C6E4A65432C877D087208ACAC69"><enum>(3)</enum><header>Veteran owned small business concern</header><text>The term <quote>veteran owned small business concern</quote> has the meaning given the term <quote>small business concern owned and controlled by veterans</quote> in section 3(q) of the Small Business Act (15 U.S.C. 632 (q)).</text></paragraph></subsection><subsection id="H8D2F992D4EE847CE8D2EB44EF707F073"><enum>(b)</enum><header>Amounts for veteran owned small business concerns</header><text display-inline="yes-display-inline">Except to the extent that the Secretary of Transportation determines otherwise, not less than 3 percent of the amounts made available for Federal-aid highway and public transportation funds made available under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, shall be expended through veteran owned small business concerns.</text></subsection><subsection id="H861986D1172B4884A61B307C54AA4D03"><enum>(c)</enum><header>Uniform criteria</header><text>The Secretary shall establish minimum uniform criteria for use by State governments in certifying whether a concern qualifies as a veteran owned small business concern for the purpose of this section. Such criteria shall include a limit on the personal net worth of the veterans who own and control the small business concern.</text></subsection><subsection id="HA2CC874B06814BF7B4C32409A20C4694"><enum>(d)</enum><header>Reporting</header><text>The Secretary shall establish minimum requirements for use by State government in reporting to the Secretary—</text><paragraph id="H9C35F180631E4550B6868D909861D1F1"><enum>(1)</enum><text>information concerning veteran owned small business concern awards, commitments, and achievement; and</text></paragraph><paragraph id="HAA71F475FB19411DA5623F2AB6D8F446"><enum>(2)</enum><text>such other information as the Secretary determined to be appropriate for the proper monitoring of the veterans business enterprise program.</text></paragraph></subsection></section></legis-body></bill>
